भारताचे संिवधान.

Hमांक संHीआ-१३२४/L.H.९३/Hीयुसे-२.— भारतीय संिवधानाRया अनुRछTद ३०९ खालील परंतुकाWवये Lदान करXयात आलेYया श[त\चा वापर क]न महारा^_ाचे रा`यपाल याaारे महारा^_ शासनाRया शालेय िशbण व Hीडा िवभागाRया अिधप/याखालील Hीडा व युवक सेवा संचालनालयातील, "सहसंचालक, Hीडा Lिशbण (गट-अ), उप-संचालक, Hीडा Lिशbण/िवशेष काय7 Lिशbण अिधकारी (गट-अ), मुgय Hीडा काय7कारी अिधकारी (Lिशbण), (गट-अ), Hीडा काय7कारी अिधकारी (Lिशbण), (गट-ब राजपि9त), Hीडा िवकास अिधकारी (Lिशbण), (गट-ब अराजपि9त), सहायक Hीडा िवकास अिधकारी (Lिशbण), (गट-क)" पदांRया सेवाLवेशाचे िविनयमन करXयासाठी याaारे पुढील िनयम करीत आहेत :-

(१) संिbDत नाव, Lारंभ :- या िनयमांना (गट-अ), (गट-ब) आिण (गट-क) "Hीडा व युवक सेवा संचालनालयातील सेवाLवेश िनयम, २०२४" असे संबोधXयात यावे.

(२) lयाgया :- सदर िनयम िदनांक ०९ जुलै, २०२४ पासून अंमलात येतील.

२. या िनयमांमoये संदभा7नुसार दुसरा अथ7 अिभLेत नसेल तर.—

(क)"िनयु[ती Lािधकारी" याचा अथ7,

(i) शासकीय सेवेतील सहसंचालक, Hीडा Lिशbण, गट-अ आिण उपसंचालक, Hीडा Lिशbण/िवशेष काय7 Lिशbण अिधकारी (गट-अ), या पदांवर खेळाडrची िनयु[ती करXयासाठी सbम असणारा मा.मुgयमं9ी हा Lािधकारी असा आहे;

(१)

भाग चार-अ-४१८–१महारा(cid:144)(cid:157) शासन राजप& असाधारण भाग चार-अ, स/ट1बर २३, २०२५/आ9:वन १, शक> १९४७ (ii) शासकीय सेवेतील मु/य 0ीडा काय2कारी अिधकारी (7िश8ण), (गट- अ) आिण 0ीडा काय2कारी अिधकारी (7िश8ण), (गट- ब राजपिBत) या पदांवर खेळाडGची िनयुJती करKयासाठी स8म असणारा िवभागाचे मंBी हा 7ािधकारी असा आहे;

(iii) शासकीय सेवेतील 0ीडा िवकास अिधकारी (7िश8ण), (गट- ब अराजपिBत) आिण सहायक 0ीडा िवकास अिधकारी (7िश8ण), (गट- क) या पदांवर खेळाडGची िनयुJती करKयासाठी स8म असणारा आयुJत, 0ीडा व युवक सेवा, महाराPQ राRय, पुणे हा 7ािधकारी असा आहे.

उमेदवाराला संचालनालयात शासकीय सेवेत संबिधत पदावर िनयुJत करणारा स8म 7ािधकारी.

(ख) "संचालनालय" याचा अथ2, 0ीडा व युवक सेवा संचालनालय असा आहे;

(ग) "पदोWनतीसाठीची पाBता" याचा अथ2 पदोWनतीसाठीची पाBतेXया अटी शतY सामाWय 7शासन िवभागाने वेळोवळी िविहत कZलेले िनयम, शासन िनण2य, आदेश यातील तरतुदीनुसार असा आहे;

(घ) "शासन" याचा अथ2 महाराPQ शासन असा आहे;

(ड) "उXच मा\यिमक शालांत 7माणपB परी8ा" याचा अथ2 महाराPQ मा\यिमक व उXच मा\यिमक िश8ण मंडळ] अिधिनयम, १९६५ (१९६५ चा महाराPQ अिधिनयम 0.४१) अWवये गठीत कZलेcया िवभागीय मंडळाकडGन घेKयात येणारी उXच मा\यिमक शालांत 7माणपB परी8ा असा आहे आिण याम\ये शासनाने dयास समतुcय eहणून घोिषत कZलेली इतर कोणतीही परी8ा याचा समावेश होतो;

(च) "माWयता7ाiत संjथा" याचा अथ2, शासनाXया शालेय िश8ण व 0ीडा िवभागाने वेळोवेळी 7िस\द कZलेcया यादीतील सदर 7योजनाथ2 माWयता7ाiत असलेcया संjथा असा आहे;

(छ) "शालेय िश8ण व 0ीडा िवभाग" याचा अथ2, शालेय िश8ण व 0ीडा, महाराPQ शासन असा आहे;

(ज) "छाननी सिमती" याचा अथ2 या िनयमांम\ये नमूद कZलेcया पदांवर थेट िनयुJतीसाठी खेळाडG lची िशफारस करKयाXया 7योजनाथ2 शालेय िश8ण आिण 0ीडा िवभागाने वेळोवेळी jथापन कZलेली िनवड सिमती असा आहे;

lXया थेट िनयुJती संदभा2तील संबंिधत पदासाठी (झ) "0ीडा अह2ता" याचा अथ2 शालेय िश8ण व 0ीडा िवभागाने खेळाडG िविहत कZलेली आिण तoनंतर वेळोवेळी िविहत करKयात येणारी 0ीडा अह2ता असा आहे.

३. सहसंचालक, 0ीडा 7िश8ण (गट-अ) पदावरील िनयुJती, उपसंचालक, 0ीडा 7िश8ण/िवशेष काय2 7िश8ण अिधकारी (गट- अ) हे पद धारण करणाqया तसेच सदर पदावर तीन वषाrहून कमी नसेल इतकी सलग िनयिमत सेवा झालेcया sयJतtमधून पदोWनतीसाठीची पाBता धारण करणाqया योuय sयJतीXया पदोWनतीने करKयात येईल.

४. उप-संचालक, 0ीडा 7िश8ण/िवशेष काय2 7िश8ण अिधकारी (गट-अ) पदावरील िनयुJती, मु/य 0ीडा काय2कारी अिधकारी (7िश8ण), (गट-अ) हे पद धारण करणाqया तसेच सदर पदावर तीन वषाrहून कमी नसेल इतकी सलग िनयिमत सेवा झालेcया आिण िनयम १३ येथे नमूद कZलेली अह2ता धारण करणाqया sयJतtमधून पदोWनतीसाठीची पाBता धारण करणाqया योuय sयJतीXया पदोWनतीने करKयात येईल.

५. संचालनालयातील मु/य 0ीडा काय2कारी अिधकारी (7िश8ण), (गट- अ) पदावरील िनयुJती, पुढील मागा2ने करKयात येईल.—

(क) पदोGनतीने िनयुNती -

0ीडा काय2कारी अिधकारी (7िश8ण), (गट-ब राजपिBत) हे पद धारण करणाqया तसेच सदर पदावर पाच वषाrहून कमी नसेल इतकी सलग िनयिमत सेवा झालेcया आिण िनयम १३ येथे नमूद कZलेली अह2ता धारण करणाqया sयJतtमधून पदोWनतीसाठीची पाBता धारण करणाqया योuय sयJतीXया पदोWनतीने,

(ख) थेट िनयुNती -

अdयुXच गुणवzाधारक खेळाडG lना थेट िनयुJतीने, देKयासंदभा2तील शासनाXया धोरणानुसार खालील अटी पूण2 करणाqया खेळाडG lमधून थेट िनयुJतीने,महारा(cid:144)(cid:157) शासन राजप& असाधारण भाग चार-अ, स/ट1बर २३, २०२५/आ9:वन १, शक> १९४७ (एक) वयोमया"दा –

अ) िकमान वयोमया"दा:- थेट िनयु.तीसाठी अज" क4ले6या िदनांकास िकमान वय १८ वष<पे>ा कमी नसावे;

आ) कमाल वयोमया"दा:- थेट िनयु.तीसाठी अज" क4ले6या िदनांकास कमाल वय ४३ वष<पे>ा जाCत नसावे;

(दोन) शै>िणक अह"ता;

थेट िनयु.तीसाठी अज" क4ले6या िदनांकास उIच माKयिमक शालांत LमाणपM परी>ा उOीण" क4ली आहे िकPवा Qयापे>ा उIच शै>िणक अह"ता धारण क4ली आहे;

(तीन) Sीडा अह"ता -

थेट िनयु.तीसाठी अज" सादर करUयाIया िदनांकास शासनाने वेळोवेळी िविहत क4लेली Sीडा अह"ता धारण करणे आवWयक राहील.

६. Sीडा काय"कारी अिधकारी (Lिश>ण), (गट- ब राजपिMत) पदावरील िनयु.ती, पुढील मागा"ने करUयात येईल - (क) पदोHनतीने िनयुOती -

Sीडा िवकास अिधकारी (Lिश>ण), (गट-ब अराजपिMत) हे पद धारण करणा^या तसेच सदर पदावर पाच वषा_हून कमी नसेल इतकी सलग िनयिमत सेवा झाले6या आिण िनयम १३ येथे नमूद क4लेली अह"ता धारण करणा^या cय.तdमधून पदोeनतीसाठीची पाMता धारण करणा^या योfय cय.तीIया पदोeनतीने;

िकPवा

(ख) थेट िनयुOती -

jIया थेट िनयु.ती बाबत िविहत क4ले6या खालील अटी िनकष पूण" करणा^या आिण शालेय िश>ण व Sीडा िवभागाने खेळाडi धोरणानुसार सिमतीने िशफारस क4ले6या अितउIच गुणवOाधारक खेळाडi jIया थेट िनयु.तीने;

(एक) वयोमया"दा –

(दोन) शै>िणक अह"ता -

(तीन) Sीडा अह"ता -

७. Sीडा िवकास अिधकारी (Lिश>ण), (गट- ब अराजपिMत) पदावरील िनयु.ती, पुढील मागा"ने करUयात येईल – (क) पदोHनतीने िनयुOती -

सहायक Sीडा िवकास अिधकारी (Lिश>ण), (गट-क) हे पद धारण करणा^या तसेच सदर पदावर पाच वषा_हून कमी नसेल इतकी सलग िनयिमत सेवा झाले6या आिण िनयम १३ येथे नमूद क4लेली अह"ता धारण करणा^या cय.तdमधून पदोeनतीसाठीची पाMता धारण करणा^या योfय cय.तीIया पदोeनतीने;

(ख) थेट िनयुOती -

शालेय िश>ण आिण Sीडा िवभागाने थेट िनयु.तीसाठी िनlWचत क4ले6या धोरणानुसार िनवड सिमतीने िशफारस क4ले6या अQयुIच गुणवOाधारक खेळाडi jची थेट िनयु.तीसाठी खालील िनकष पूण" करणे आवWयक आहे –महारा(cid:144)(cid:157) शासन राजप& असाधारण भाग चार-अ, स/ट1बर २३, २०२५/आ9:वन १, शक> १९४७ (एक) वयोमया"दा -

(दोन) शै>िणक अह"ता -

(तीन) Sीडा अह"ता –

८. सहायक Sीडा िवकास अिधकारी (Lिश>ण), (गट- क) पदावर शासनाने यासंदभा"त िविहत क4ले6या धोरणानुसार, खालील अटी पूण" करणा^या अQयुIच गुणवOाधारक खेळाड_ `Iया थेट िनयु.तीने करUयात येईल,

(एक) वयोमया"दा -

(दोन) शै>िणक अह"ता -

(तीन) Sीडा अह"ता -

९. िनयु.तीचे Lमाण -

िनयम ५, ६ व ७ येथे नमूद क4ले6या पदांवर िनयु.Qया पदोeनतीने आिण खेळाड_ `Iया थेट िनयु.ती मंजूर पदसंfयेIया ५०:५० या Lमाणात करUयात येतील.

Lिश>ण यासाठीची सवलत घेUयाचा िवक6प िदले6या खेळाड_

१०. िनयम ५ व ६ मKये नमूद क4ले6या पदांवर थेट िनयु.ती िदलेले खेळाड_ दोन वषा"साठी पhरिव>ाधीन राहतील. खेळाचा सराव/ `बाबत, सवलतीचा कालावधी संप6यानंतर पhरिव>ा कालावधी सुl होईल;

पhरवी>ा कालावधी हा िनयु.ती Lािधका^याIया अिधकाराने कमाल एक वषाmपयmत वाढिवता येईल. सदर पhरवी>ा कालावधी समाधानकारकhरQया पूण" करणे आवWयक राहील. तथािप, पhरवी>ा कालावधी अथवा वाढीव पhरिव>ा कालावधी समाधानकारकhरQया पूण" न क46यास Qयांची सेवा समाoत करUयात येईल.

११. िनयम ३, ४, ५, ६, ७ व ८ मKये नमूद पदांवर कोणQयाही मागा"ने िनयु.त क4ले6या खेळाड_ `ना, pयावसाियक CवqपाIया/ pयावसाियक Cतरावर आयोिजत होणा^या CपधाmमKये कोणQयाही Cवqपाचा सहभाग घेता येणार नाही. खेळाड_ने अशा CपधाmमKये कोणQयाही Cवqपाचा सहभाग घेत6याचे िनदश"नास आ6यास Qयाची िनयु.ती ताQकाळ रr करUयात येईल.

१२. िनयम ३, ४, ५, ६, ७ व ८ मKये नमूद पदांवर कोणQयाही मागा"ने िनयु.त खेळाड_, कोणQयाही Sीडा Cपध<त, उOेजक spय चाचणी (Doping) मKये दोषी ठर6यास आिण सदर उOेजक चाचणीबाबत अंितम आदेश देणा^या संCथेने सदर आदेश कायम क46यास, सदर खेळाड_स िदलेली थेट िनयु.ती ताQकाळ संपुzटात आणUयात येईल.

परंतु असे की सदर खेळाड_ने समुिचत Lािधकरणाकड{ अिपल दाखल क4ले अस6यास QयाIया/ितIयािवqKद उOेजक spय चाचणी (Doping) Lकरणाबाबत चौकशी चालू असेल तोपयmत Qयाला/ितला, खेळाचा सराव/Lिश>णाकhरता खेळाड_ }हणून देUयात येणारी सवलत अनु~ेय राहणार नाही.

Bप(cid:144)टीकरण - या िनयमा(cid:157)या !योजनाथ% "यं'णा" ही सं,ा -हणजे उ0ेजक चाचणीबाबत अंितम आदेश देणारी सं:था, जसे की, जागितक डोिपंग रोधी यं'णा (WADA), राCEीय डोिपंग रोधी यं'णा (NADA) व तGसम यं'णा.

Xना, १३. (क) िनयम ५, ६, ७ व ८ मधील पदांवर थेट िनयुQती िदलेRया तसेच कायम:वSपी समायोजनाने िनयुQती िदलेRया खेळाडV िनयुQतीनंतर खालीलपैकी कोणतीही एक अह%ता यापुव[च धारण क\ली नसRयास, सदर अह%ता ५ वषा%त धारण करणे आव^यक राहील- (एक) नेताजी सुभाषचंa राCEीय bीडा सं:था, पितयाळा सं:थेचा िकcवा सदर सं:थे(cid:157)या कोलकाता, बंगळVd िकcवा गांधीनगर येथील िवभागीय कeaाचा िकcवा यासंदभा%तील माfयता!ाgत सं:थेचा bीडा !िशhण पदिवका अiयासbम पूण% करणे;

िकcवा

(दोन) आंतरराCEीय ऑिलm-पक सिमतीशी संलnन असलेRया िकcवा आंतरराCEीय ऑिलm-पक सिमतीने माfयता िदलेRया, संबंिधत खेळा(cid:157)या आंतरराCEीय महासंघाpारे आयोिजत क\ले जाणारे आंतरराCEीय :तरावरील bीडा !िशhण कोस% यश:वीqरGया पूण% क\Rयाचे !माणप' धारण करणे;

टीप- खेळाडV rया खेळाशी संबंिधत आहे, Gया खेळा(cid:157)या आंतरराCEीय महासंघाpारे आयोिजत क\ले जाणारे यथाm:थती "लेsहल १", "लेsहल २", "लेsहल ३" िकcवा "लेsहल ४" कोस% अथवा "अ", "ब", "क" िकcवा "ड" कोस% यांपैकी कोणताही एक कोस% यश:वीqरGया पूण% करणे आव^यक आहे.

(ख) वर नमूद क\लेली अह%ता धारण करxयासाठी खेळाडVस, संबंिधत कोस% कालावधी इतकी िवशेष रजा मंजूर करxयात येईल. ही िवशेष रजा संपूण% सेवा कालावधीत क\वळ एकदाच अनु,ेय राहील. खेळाडVने सदर अह%ता धारण करेपय|त पुढील पदोfनतीकरीता पा' ठरणार नाही.

१४. मराठी व िहंदी भाषा परीJेबाबतची तरतूद –

(क) िनयम ३, ४, ५, ६ व ७ म~ये नमूद क\लेRया पदावर पदोfनतीने िनयुQत होणा€या खेळाडVने, पदोfनतीपूव[ िहंदी भाषा परीhा व मराठी भाषा परीhा या दोfही परीhांसंदभा%त मराठी भाषा िवभागाने वेळोवेळी क\लेRया िनयमांनुसार, िहंदी भाषा व मराठी भाषा परीhा अगोदरच उ0ीण% क\लेली असणे अथवा उ0ीण% होxयापासून सूट िमळिवलेली असणे आव^यक राहील. अfयथा वqरCठ पदावर पदोfनती अनु,ेय होणार नाही;

(ख) िनयम ५, ६, ७ व ८ म~ये नमूद क\लेRया पदावर थेट िनयुQती देxयात येणा€या खेळाडVने, िहंदी भाषा परीhा व मराठी भाषा परीhा या दोfही परीhांसंदभा%त मराठी भाषा िवभागाने वेळोवेळी क\लेRया िनयमांनुसार, िहंदी भाषा व मराठी भाषा परीhा उ0ीण% क\लेली नसेल अथवा उ0ीण% होxयापासून सूट िमळिवलेली नसेल तर, िनयुQतीनंतर, िविहत मुदतीत िहंदी भाषा परीhा व मराठी भाषा परीhा उ0ीण% होणे आव^यक राहील. तसेच िविहत मुदतीत िहंदी भाषा परीhा व मराठी भाषा परीhा उ0ीण% न झाRयास परीhा उ0ीण% होईपय|त अथवा परीhा उ0ीण% होxयातून सूट िमळƒपय|त वािष%क वेतनवाढ अनु,ेय राहणार नाही.

१५. संगणक अहNता Oमाणप&ाबाबतची तरतूद –

(क) िनयम ३, ४, ५, ६ व ७ म~ये नमूद पदावर पदोfनतीने िनयुQत होणा€या खेळाडVने, पदोfनतीपूव[, संगणक अह%ता !माणप'ासंदभा%त शासनाने वेळोवेळी क\लेRया िनयमांनुसार, संगणक अह%ता !माणप' धारण करणे अथवा सामाfय !शासन िवभाग (मािहती व तं',ान) यांनी वेळोवेळी शासन आदेशाpारे नमूद क\लेRया संगणक / मािहती तं',ान िवषयक परीhा उ0ीण% होणे अथवा सामाfय !शासन िवभागाने वेळोवेळी शासन आदेशानुसार िनm^चत क\लेRया वयोमया%देनुसार संगणक अह%ता !माणप' सादर करxयापासून सूट िमळिवलेली असणे आव^यक राहील. अfयथा वqरCठ पदावर पदोfनती अनु,ेय होणार नाही;

(ख) िनयम ५, ६, ७ व ८ म~ये पदावर थेट िनयुQती देxयात येणा€या खेळाडVने, संगणक अह%ता !माणप'ासंदभा%त शासनाने वेळोवेळी क\लेRया िनयमांनुसार, िनयुQतीपूव[ संगणक अह%ता !माणप' धारण क\लेले नसRयास, यासंबंधी(cid:157)या िनयमात िवहीत क\लेRया मुदतीत सदर !माणप' धारण करणे आव^यक राहील. Gयाच!माणे िविहत मुदतीत !माणप' धारण न क\Rयास, सदर संगणक !माणप' धारण करेपय|त अथवा सदर !माणप' सादर करxयापासून सूट िमळƒपय|त वािष%क वेतनवाढ अनु,ेय राहणार नाही.

१६ . लहान कEटF

GबाHया JितMापनाची तरतूद –

Hबांचे १) िनयम ५, ६, ७ व ८ म%ये नमूद क+ले.या पदांवर थेट िनयु6ती दे9यात येणा;या खेळाड?ने, महाराAB नागरी सेवा (लहान कFटG KितLापन) िनयम, २००५ मधील तरतुदीनुसार व Pयाबाबत वेळोवेळी कर9यात येणा;या िनयमांनुसार, थेट िनयु6तीRया वेळी, लहान कFटG Hबाचे KितLापन सादर करणे आवTयक राहील;

२) लहान कFटG Hबाचे KितLापन सादर कर9याRया िदनांकास दोनपेVा अिधक अपPय असलेला खेळाड? शासन सेवेत थेट िनयु6तीसाठी अपाZ राहील;

३) शासन सेवेत थेट िनयु6तीनंतर खेळाड?स, िनयु6तीRया वेळ\स अथवा Pयानंतर सदर िनयमातील तरतुदीनुसार दोनपेVा अिधक अपPये अस.याचे िस%द झा.यास शासन सेवेत.

१७. बदलीबाबतची तरतूद –

िनयम ३, ४, ५, ६, ७ व ८ मधील पदांवर िनयु6त खेळाड? रा`यात कोठ\ही बदलीसपाZ राहील. या पदांवर िनयु6त रा`यaतरीय HRया पदaथापना, बद.यांबाबत, शालेय िशVण व bीडा िवभागाकड?न वेळोवेळी िविहत कर9यात राहतील. तसेच या पदांवर िनयु6त खेळाड? येणा;या धोरणानुसार कायdवाही कर9यात येईल.

१८. शासकीय सेवेत Jवेश क>Sयानंतर सेवािवषयक व अVय आदेश/िनयम लागू होणे.—

क) शासनाकड?न वेळोवेळी िनगdिमत क+ले.या कोणPयाही िनयम, आदेश िकfवा िनणdयाgवये शासकीय कमdचा;यास िनयु6तीनंतर िविनदhAट क+ले.या अटी व शतh या िनयमानुसार िनयु6त क+ले.या खेळाड? Hना देखील लागू राहतील;

ख) िनयम ३, ४, ५, ६, ७ व ८ म%ये नमूद क+ले.या पदांवर िनयु6त खेळाड? HRया सेवा`येAठतेबाबत व `येAठतायादीबाबत, शासनाRया शालेय िशVण व bीडा िवभागाकड?न वेळोवेळी िविहत कर9यात येणा;या धोरणानुसार कायdवाही कर9यात येईल.

NOTIFICATION

CONSTITUTION OF INDIA.

No. Sakria-1324/C.R.93/Sport-2.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of Joint Director, Sports Coaching, (Group A), Deputy Director, Sports Coaching/Special Duty Executive Officer, Coaching, (Group A), Chief Sports Executive Officer (Coaching), (Group A), Sports Executive Officer (Coaching), (Group B Gazetted), Sports Development Officer, (Group B Non-Gazetted), and Assistant Sports Development Officer (Coaching), (Group C) in the office of the Directorate Sports and Youth Services under administrative control of the School Education and Sports Department of Government of Maharashtra, namely :—

1. (1) Short title, commencement and application.— These rules may be called the Officers Group A, Group B, and Group C in the office of the Directororate Sports and Youth Services, Recruitment Rules, 2024".

(2) Definition.— These rules shall come into force with effect from 09th July, 2024.

In these rules unless the context requires otherwise,—

(a) "Appointing Authority" means,—

(i) The Chief minister in respect of Joint Director, Sports Coaching, (Group A) and Deputy Director, Sports Coaching/Special Duty Executive Officer, Coaching, (Group A) posts;

(ii) The Minister in charge of the Sports Department, in respect of Chief Sports Executive Officer (Coaching), (Group A) and Sports Executive Officer (Coaching), (Group B Gazetted); and (iii) The Commissioner, Sports and Youth Services, Maharashtra State, Pune in respect of Sports Development Officer (Coaching), Group B Non-Gazetted) and Assistant Sports Development Officer (Coaching), (Group C) posts;

in the Directorate, who shall be competment to appoint the candidate to the concern post in the Government Service;

(b) "Directorate" means the Directorate of Sports and Youth Services under the administrative control of School Education and Sport Department;

(c ) " Eligibility for promotion" means the eligibility for promotion in accordance with the terms and conditions specified for promotion in rules, resolutions or orders issued by General Administrative Department of the Government from time to time;

(d) "Government" means the Government of Maharashtra;

(e) "Higher Secondary School Certificate Examination" means the Higher Secondary School Certificate Examination conducted by Maharashtra State Board of Secondary and Higher Secondary Education, constituted under the Maharastra Secondary and Higher Secondary Education Boards Act, 1965 ( Mah. XLI of 1965) and it includes any other equivalent examination declared by the Government to be equivalent thereto;

(f) "Recognised Institute" means the institute included in the list published by the School Education and Sports Department from time to time for the purpose of these rules;

(g) "School Education and Sports Department" means the School Education and Sports Department, of the Maharashtra Government;

भाग चार-अ-४१८–२ अमहारा(cid:144)(cid:157) शासन राजप& असाधारण भाग चार-अ, स/ट1बर २३, २०२५/आ9:वन १, शक> १९४७ (h) "Scrutiny Committee" means a Scrutiny Committee constituted from time to time, by the School Education and Sports Department for the purpose of selection of candidates by direct recruitment to the posts mentioned in these rules ;

(i) "Sports Qualification" means the sports qualification specified from time to time by School Education and Sports Department, in accordance with the policy laid down regarding direct appointment of sports persons on the post mentioned in these rules;

3. Appointment to the post of the Joint Director, Sports Coaching, (Group A) in the office of directorate shall be made by promotion of a suitable person having eligibility for promotion, on the basis of seniority, from amongst the persons holding the post of Deputy Director, Sports Coaching/ Special Duty Executive Officer, Coaching, (Group A) and having not less than 3 years regular and continuous service on the said post.

4. Appointment to the post of the Deputy Director, Sports Coaching/Special Duty Executive Officer, Coaching, (Group A) in the directorate shall be made by promotion of a suitable person having eligibility for promotion, on the basis of seniority, from amongst the persons holding the post of Chief Sports Executive Officer (Coaching), (Group A) having not less than 3 years regular and continuous service on the said post and possess the qualification prescribed in Rule 13.

5. Appointment to the post of the Chief Sports Executive Officer (Coaching), (Group A) in the directorate shall be made either,—

(a) by promotion of a suitable person having eligibility for promotion, on the basis of seniority, from amongst the persons holding the post of Sports Executive Officer (Coaching), (Group B Gazetted) and having not less than 5 years regular and continuous service on the said post and possess the qualification prescribed in Rule 13; or

(b) by direct appointment of meritorious sports persons recommended by the Scrutiny Committee in accordance with the policy laid down for the direct appointment of sports person by the School Education and Sports Department, who fulfills following criteria, namely :—

(i) Age Limit :—

(a) Lower age limit :— Not less than eighteen years of age completed as on the date of submission of an application for direct appointment.

(b) Uper age limit :— Not more than forty- three years of age as on the date of submission of an application for direct appointment.

(ii) Educational Qualification :—

Passed the higher secondary certificate examination or has acquired the higher educational qualification on the date of submission of application for direct appointment.

(iii) Sports Qualification :—

Possess the sports qualification priscribed by Government from time to time on the date of submission of application for direct appointment.

6. Appointment to the post of the Sports Executive Officer (Coaching), (Group B Gazetted) in the directorate shall be made either,—

(a) by promotion of a suitable person having eligibility for promotion, on the basis of seniority, from amongst the persons holding the post of Sports Development Officer (Coaching), (Group B Non-Gazetted) and having not less than 5 years regular and continuous service on the said post and possess the qualification prescribed in Rule 13; or

(i) Age Limit :—

(a) Lower age limit :- Not less than eighteen years of age completed as on the date of submission of an application for direct appointment.

(b) Uper age limit :- Not more than forty- three years of age as on the date of submission of an application for direct appointment.

(ii) Educational Qualification :—

Passed the higher secondary certificate examination or has acquired the higher educational qualification on the date of submission of application for direct appointment.

(iii) Sports Qualification :-

Possess the sports qualification priscribed by Government from time to time on the date of submission of application for direct appointment.

6. Appointment to the post of the Sports Development Officer (Coaching), (Group B Non-Gazetted) in the directorate shall be made either,—

(a) by promotion of a suitable person having eligibility for promotion, on the basis of seniority, from amongst the persons holding the post of Assistant Sports Development Officer (Coaching), (Group C) and having not less than 5 years regular and continuous service on the said post and possess the qualification prescribed in Rule 13; or

(a) Lower age limit :- Not less than eighteen years of age completed as on the date of submission of an application for direct appointment.

(b) Uper age limit :- Not more than forty- three years of age as on the date of submission of an application for direct appointment.

(ii) Educational Qualification :—

Passed the higher secondary certificate examination or has acquired the higher educational qualification on the date of submission of application for direct appointment.

(iii) Sports Qualification:-

Possess the sports qualification priscribed by Government from time to time on the date of submission of application for direct appointment.

7. Appointment to the post of the Sports Development Officer (Coaching), (Group B Non-Gazetted) in the directorate shall be made either,—

(i) Age Limit :-

(a) Lower age limit :- Not less than eighteen years of age completed as on the date of submission of an application for direct appointment.

(b) Upper age limit :- Not more than forty- three years of age as on the date of submission of an application for direct appointment.

(ii) Educational Qualification :—

Passed the higher secondary certificate examination or has acquired the higher educational qualification on the date of submission of application for direct appointment.

(iii) Sports Qualification :—

Possess the sports qualification priscribed by Government from time to time on the date of submission of application for direct appointment.

8. Appointment to the post of the Assistant Sports Development Officer (Coaching), (Group C) in the directorate shall be made by direct appointment of meritorious sports persons recommended by the Scrutiny Committee in accordance with the policy laid down for the direct appointment of sports persons School Education and Sports Department, who fulfills following criteria, namely :—

(i) Age Limit :-

(a) Lower age limit :- Not less than eighteen years of age completed as on the date of submission of an application for direct appointment.

(b) Uper age limit :— Not more than forty- three years of age as on the date of submission of an application for direct appointment.

(ii) Educational Qualification : -

Passed the higher secondary certificate examination or has acquired the higher educational qualification on the date of submission of application for direct appointment.

(iii) Sports Qualification :—

Possess the sports qualification priscribed by Government from time to time on the date of submission of application for direct appointment.

9. Appointment to the post mentioned in Rules 5, 6 and 7 shall be made by Promotion and by Direct Appointment of sports persons, in the ratio of 50:50, respectively, for the total no of sanctioned post to be filled under rules 5, 6, and 7.

10. Sport persons directly appointed to the posts mentioned in Rules 5 and 6 shall be on probation for a period of two years. Sport persons who have opted for concession regarding practice/tranning for sports, the probation commence after the concession period is over.

Probation period may be extended by a maximum of one year at the discretion of the appointing authority. Completion of probation period (including extended period) as per probation policy of the Government is mandatory. In the event of failing to complete of probation period (including extended period) as per probation policy of the Government his/her services will be liable to immediately terminated.

11. Sport persons appointed by promotion or direct appointment to the posts mentioned in rules 3, 4, 5, 6, 7 and 8 shall not be allowed to participate in any form of competitions organized in the professional form/professional level. If it is found that sport person appointed under these rules have/has participated in any form in such competetion shall be liable for immediately terminated.

12. Sport person appointed by any mode to the posts mentioned in Rules 3, 4, 5, 6, 7 and 8, are found guilty of doping in any sporting event and if the order is upheld by the body which gives the final order in respect of the said doping test, the appointment of the said sports person will be terminated with immediate effect.

Provided that, if the said sportsperson files an appeal with the appropriate authority, he/she shall not be admissible for concession regarding sports practice/training, pending the investigation of the doping case.

Explanation :— For the purpose of this rule the term "Body" means the bodies that make the final ruling on doping test like the World Anti-Doping Agency (WADA), National Anti-Doping Agency (NADA) and similar bodies.

13. (i) Sport persons appointed to the posts mentioned in Rules 5, 6, 7 and 8 shall be required to possess any one of the following qualifications within 5 years from the date of appointment, if he/she has not already hold.

(a) Certificate of Completion of Diploma Course in Sports Training of Netaji Subhash Chandra National Sports Institute, Patiala or Divisional Center of the said Institute at Kolkata, Bengaluru or Gandhinagar or of a recognized institute in this regard, or

(b) Possess a certificate of successful completion of an International Level Sports Training Course organized by an International Federation affiliated to the International Olympic Committee or recognized by the International Olympic Committee of the relevant sport;

Note— Should successfully complete any one of course, viz-"Level 1", "Level 2", "Level 3" or "Level 4" course or "A", "B", "C" or "D" courses as the case may be, conducted by the International Federation of the sport related to the sports person.

(ii) Special leave equivalent to the relevant course duration will be sanctioned to the sportsperson to acquire the qualification mentioned above. This special leave will be admissible only once in the entire period of service. He shall not be eligible for further promotion to the next promotional post until he/she posses the said qualification.

Sport persons who have opted for concession regarding practice/trainging for sports, five years period shall commence after the concession period is over.

14. (1) A Sport person to be appointed to the posts mentioned in rules 3, 4, 5, 6 and 7 by promotion shall pass the and Marathi and Hindi Languages Examinations as per the rules made or orders issued in that behalf by the government, from time to time, unless he/she has already passed or he/ she has been exempted from passing those examinations before getting promoted to the said post.

(2) A Sport person appointed to the post mentioned in rules 5, 6, 7 and 8 by direct appointment shall pass the Marathi and Hindi Languages Examinations as per the rules made or orders issued in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he/she has already passed or has been exempted from passing those examinations. He/She shall not be eligible for annual increment and pormotion to the next promotional post until he/she passes these examinations or exempted from passing these examinations.

15. (1) A sport person to be appointed to the posts mentioned in rules 3, 4, 5, 6 and 7 by promotion shall possess a certificate of computer Operations perscribed by rules or orders issued in that behalf by the Government, from time to time, unless he has been exempted therefrom before getting promoted to the said post.

(2) A sport person to be appointed the post mentioned in rules 5, 6, 7 and 8 by direct appointment shall possess a certificate of computer operations prescribed by the Government, from time to time. within the perscribed by rules or orders issued time limit after appointment, unless he/she has has been exempted from possessing such Certificate of Computer Operations, otherwise he/she shall not be eligible for annual increment or promotion to the next promotional post until he possess the same.

16. (1) A person recommended for appointment by directly to the posts mentioned in rules 5, 6, 7 and 8 by direct appointment shall submit a decleration of Small Family as per the provisions of the Maharashtra Civil Services (Small Family Decleration) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, time to time.

(2) A person having more than two childern on the date of submission of Decleration o Small Family shall be disqualified for the appointment in the Government Service.

(3) After appointment of a personin the Government Service, if it is proved that he/she has more than two childern at the time of appointment or thereafter, then he/she shall be disqualified for continuing on the said post in the Government Service.

17. The person appointed on the posts mention in rules 3, 4, 5, 6, 7 and 8 shall be liable for transfer everywhere in the sate of Maharashtra. The posting, transfer of the sport persons appointed to these posts, shall be made in accordance with the policy of specified by the School Education and Sport Department form time to time in this regad.

18. (a) The term and conditions specified by the Government, subsequent to the apppoint to the any Government Servant in any rules, orders or resolutions issued by the Government from time to time, shal also be applicable to the sport persons appointed under these rules.

(b) The seniority and seniority list of the sport persons appointed under these rules to the post mentioned in rules 3, 4, 5, 6, 7 and 8 shall be governed in accordance with the policy framed by the Government in School Education and Sports Department from time to time.
