आवि ज्योाअर्थी, उक्त आराक्षेाचीे एकू क्षेत्र २.२३८ हीे. नमुदे असले तराी, सदेरा विकास योजना मजूरा हीोताना त्योामध्योे क्षेत्राढी झाली असून, सहीायोक सचीालक, नगरा राचीना, अमराती शाखा कायोालयोाने सादेरा केलेल्योा विकास योजना भाग नकाशारा देशाविलेनूसारा उक्त आराक्षेाचीे एकू क्षेत्र २. २८ हीे. आहीे;
आवि ज्योाअर्थी, उक्त मजूरा विकास योजनेतील उक्त जविमनीराील उक्त आराक्षेाबोाबोतची उपुराोक्त नमूदे स्तुस्थिस्र्थीती विचीारात घेता, उक्त जविमनीचीे २.२८ हीे. क्षेत्राराील उक्त आराक्षे उक्त अविधाविनयोमाचीे कलम १२७ (२) चीे तरातुदेीन्योे व्योपुगत झाल्योाबोाबोतचीे आदेशा विनगविमत कराे क्रमप्राप्‍त झाले आहीे, असे सचीालक, नगरा राचीना, महीाराष्ट्र राज्यो, पुे योाचीे मत झाले आहीे;
आवि ज्योाअर्थी, शासनाच्योा नगरा विकास विभागाचीा विनयो क्र. विटीपुीएस १८१३/३२११-प्रा.क्र.५०८-नवि-१३, विदे. ०१ विसंबोरा, २०१६ अन्योे विनयोजन प्राविधाकरा असलेल्योा स नगरापुरिराषदेा / नगरा पुचीायोती-विजल्हीा पुरिराषदेा योाच्योा विकास योजना सबोधाने, उक्त अविधाविनयोमाचीे कलम १२७(२) चीे तरातूदेीन्योे कायोाही कराण्योाचीे शासनाचीे अविधाकारा कलम १५१ चीे तरातूदेीन्योे सचीालक, नगराराचीना, महीाराष्ट्र राज्यो, पुे योाना प्रादेान केलेले आहीेत;
आता त्योाअर्थी, उक्त अविधाविनयोमाचीे कलम १२७ (२) चीे तरातूदेीन्योे सचीालक, नगरा राचीना, महीाराष्ट्र राज्यो, पुे हीे, योा आदेशाद्वाराे पुढील पुरिराविशाष्टीात नमूदे केल्योाप्रामाे उक्त मजूरा विकास योजनेतील उक्त जविमनीराील उक्त आराक्षे भागशाः व्योपुगत झाले आहीे, असे अविधासूविचीत कराीत आहीेत आवि त्योासाठी उक्त मजूरा विकास योजनेच्योा उक्त अविधासूचीनेमध्योे पुढीलप्रामाे सुधारा कराीत आहीे- उक्त मजूरा विकास योजनेच्योा उक्त अविधासूचीनेच्योा बोदेलाच्योा पुरिराविशाष्टीामधाील शाेटीच्योा नंदेीनतरा पुढील नविन नंदेीचीा समाेशा कराण्योात योेत आहीे

२. उक्त आराक्षेामधाून मुक्त झालेल्योा उक्त जविमनीचीे क्षेत्र देशाविारा उक्त मजूरा विकास योजनेचीा भाग नकाशा हीा मुख्योा- विधाकाराी, नगरा पुरिराषदे, रू, विज. अमराती योाच्योा कायोालयोात, कामकाजाच्योा विदेशाी कायोालयोीन ेळेत, नागरिराकाच्योा अलोकनार्थी एक मविहीन्योापुयोंत खाुला ठेण्योात योेत आहीे.
३. सदेरा आदेशा सचीालनालयोाचीे www.dtp.maharashtra.gov.in योा सकेतस्र्थीळारा प्राविसद्ध कराण्योात योेत आहीे.

ORDER
No. D.T.P-D.P. Warud[O(R)+A]-Sec-127(2)-Order-TPV-VI-6054.—
Whereas, the Development Plan of Warud Municipal Council [Original (Revised) + Additional] has been partly sanctioned under the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide Notification No. TPS-2803-1896-CR-8 (A)- 2004-UD-30, dated 15th July, 2005 (hereinafter referred to as "the said Notification") & has come into force with effect from 01st September, 2005 (hereinafter referred to as "the said Sanctioned Development Plan");
And whereas, in the said Sanctioned Development Plan and as specified in the Development Plan Report, the land bearing S. No. 258 of Mouza Warud is affected by the Reservation Site No. 7, "Weekly Market" admeasuring approximately 2.238 Ha. (hereinafter referred to as "the said Reservation") and the Appropriate Authority for the acquisition and development of the said Reservstion is Municipal Council, Warud (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land affected by the said Reservation has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan has come into force;
And whereas, on behalf of the concerned land owner (hereinafter referred to as "the said Land Owner") of the Land bearing S. No. 258 admeasuring approximately 3.34 Ha. from which area affected by the said Reservation (hereinafter referred to as "the said Land"), Adv. Shri. G. K. Mundhada had served a notice as per the provisions of section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 20th July,2023 and same has been received by the Warud Munical Council on 24th July, 2023;
४ महाराष्ट्र शासन राजपत्र भाग एक-अ अमरावती विवभागीय पुरावणी, ऑक्‍टोबरा २३-२९, २०२५/कावितीिक १-७, शाके १९४७And whereas, however the said Appropriate Authority has submitted the land acquisition proposal to the Collector, Amravati on 06th May, 2024, the said Land under the said Reservation is not acquired or the notification as mentioned in the -provisions of section 126(4) is not issued by the said Appropriate Authority within the stipulated period from the date of service of the said notice served by the said land owner;
And whereas, the Chief Officer, Municipal Council, Warud vide Letter No. 1583/2025 dated 11th August, 2025 has submitted a proposal stating that, a proposal for allocation of funds for acquisition of land affected by the said Reservation has been submitted to the Government through the District Collector, Amravati and upon receipt of such funds, the land acquisition process will be undertaken, hence no action under the provisions of section 127(2) of the said Act would be initiated;
And whereas, the Joint Director, Town Planning, Amravati Division, Amravati, vide Letter No. 826 dated 16th September, 2025, has submitted a report stating that although the Municipal Council, Warud, has submitted a land acquisition proposal, no notification under the provisions of section 126(2) or 126(4) of the said Act has been published in the Official Gazette within a period of 24 months from the date of service of the said notice under the provisions of section 127(1) of the said Act for the acquisition of the said land. Therefore, it is necessary to issue an order under the provisions of Section 127(2) of the said Act;
And whereas, although the total area of the said Reservation is stated as 2.238 Ha. the said area has been increased at the time of sanctioning of the said Development Plan; and as per the part plan of the said Reservation submitted by the Assistant Director, Town Planning, Amravati Branch Office, the total area of the said Reservation is 2.28 Ha;
And whereas, after considering the above facts in respect of the said land affected by the said Reservation, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is appropriate to issue an order declaring that the reservation on area admeasuring 2.28 Ha. of the said land has lapsed under the provisions of Section 127(2) of the said Act;
And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No.TPS-1813/3211/CR- 508/UD-13, Dated 01st December, 2016, has delegated the powers exercisable by it as per the provisions of section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;
Now therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said land as per the provisions of section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows -
After the last entry in the Schedule of Modifications accompanying the said Notification of the said Sanctioned Development Plan, the following new entry shall be added :-

NOTE :- 1. The said Land so released from the said Reservation shall become available to the said Land Owners for the purpose of development as otherwise permissible in the case of adjacent land under the said Sanctioned Development Plan.
2. A copy of the part plan of the said Sanctioned Development Plan showing the area of the said land which is lapsed from the said Reservation, is available in the office of the Chief Officer, Municipal Council, Warud, District Amravati during office hours on all working days for inspection to public upto one month.
3. This Order shall also be published on the Directorate's official website
