आदिणे ज्याअर्थी, उपीाध्यक्षे तर्थीा मंख्य कायशकारी अदिकारी, 'मंहाराष्ट्र गृहादिनांमंाशणे आदिणे क्षेत्रा दिकासा प्रादिकरणे (म्हाडा) (यापींढे याचा उल्लेख "म्हाडा" असा करण्यात आला आहाे) यांनांी ासानां नांगरदिकासा दिभूागासा सार केलेल्या दिनांांक१२/१२/२०२३ रोजीचे पीत्राद्वारे म्हाडा साहातंचे पींनांदिशकासा योजनांा व्यहायश हाोण्याच्या ृष्टिष्टोनांे उक्त दिनांयमंालीचे दिदिनांयमं ३१(३) दिदिनांयमं ३३(५) च्या उपीखंडा २.१(साी) मंध्ये सांारणेा करणेबाबत दिनांती केली आहाे. सार पीत्रामंध्ये, उक्त दिनांयमंालीचे दिदिनांयमं ३३(५) अंतगशत पींनांदिशकासासाठी दिदिनांयमं ३१(३) अन्ये अनांज्ञेय हाोणेारे फ़ंदिजबल क्षेत्रा 'दिद्यमंानां बांदि क्षेत्राऐजी' दिदिनांयमं ३३(५)(२.१)(ए) नांसारचे पींनांशसानां क्षेत्रार (Rehab entitlement) अनांज्ञेय करणेसांबंी सांारणेा करणेबाबत दिनांती करण्यात आली आहाे. तसाेच, उक्त दिनांयमंालीचे दिदिनांयमं ३३(५) अंतगशत पींनांदिशकासाकरिरता अदितरिरक्त बांकामं क्षेत्राफेळूाची पीरिरगणेनांा करतानांा एकूणे अनांज्ञेय बांकामं क्षेत्राफेळूामंूनां अष्टिस्त्ातील बांकामं क्षेत्राफेळू गळूण्याऐजी पींनांशसानां घटोकाचे बांकामं क्षेत्राफेळू गळूनां उशरिरत अदितरिरक्त बांकामं क्षेत्राफेळूाकरिरता अदिमंल्याची आकारणेी केल्यासा, पींनांदिशकासा प्रकल्पीांची शनांक्षेमंता सांारूनां पींनांदिशकासा सांकर हाोण्यासा मंत हाोईल, असाे म्हाडाचे पीत्रात नांमंू केले आहाे ;

आदिणे ज्याअर्थी, म्हाडाची उक्त दिनांती दिचारात घेता, उक्त दिनांयमंालीचे दिदिनांयमं ३१(३) दिदिनांयमं ३३(५) च्या उपीखंडा २.१(साी) मंध्ये साोबत जोडालेल्या पीरिरदिष्टोामंध्ये शदिल्यानांसार फ़ंेरबल करणे साशजदिनांक दिहाताचे ृष्टोीनांे आश्यक आहाे, असाे ासानां नांगरदिकासा दिभूागाचे मंत झाले आहाे. (यापींढे याचा उल्लेख "प्रस्तादित फेरबल" असा करणेत आलेला आहाे) ;

आदिणे त्याअर्थी, उपीरोक्त पीरिरष्टिस्र्थीती आदिणे स्तंष्टिस्र्थीती दिचारात घेता आदिणे उक्त अदिदिनांयमंाच्या कलमं ३७ च्या पीोटो-कलमं (१कक) अन्ये प्राप्त अदिकार आदिणे त्या सांभूाशतील साश क्तंचा ापीर करुनां, ासानां याद्वारे प्रस्तादित फेरबलादिषयी उक्त अदिदिनांयमंाच्या कलमं ३७, पीोटो-कलमं (१कक) चे खंडा(क) नांसार कोणेत्याहाी व्यक्तीकडाूनां हारकती / साूचनांा मंागदिण्यासाठी तसाेच सांभूाव्य बादित हाोणेाऱ्या व्यक्तंच्या मंादिहातीसाठी सार साूचनांा प्रदिसाद्धी करीत आहाे. ासानांाकडाूनां अ़साेहाी कळूदिणेत येत आहाे की, खालील पीरिरदिष्टोात नांमंू प्रस्तादित फेरबलादिषयी कोणेत्याहाी हारकती/ साूचनांा महाराष्ट्र ासन राजपत्रात सार साूचनांा प्रदिसाद्धी झाल्याच्या दिनांांकापीासाूनां एक मंदिहान्याच्या आत उपीसांचालक, नांगररचनांा, बृहान्मं ंबई यांचेकडाे इन्सा हाटोमंटोसा, ई-ब्लॉक, आझा मंैानां, मंहापीादिलका मंागश, मं ंबई ४००००१ या कायाशलयाचे पीत्त्यार पीाठदिण्यात याव्यात. सार प्राप्त हारकती / साूचनांांर सांनांाणेी ेऊनां तसाेच लागू असाेल त्याप्रमंाणे उक्त मंहानांगरपीादिलकेचे म्हाणेणे घेऊनां त्यारील अहाल ासानांासा सार करण्यासाठी उपीसांचालक, नांगररचनांा, बृहान्मं ंबई यांनांा ासानांाचे तीनांे "अदिकारी" म्हाणेूनां प्रादिकृत करण्यात येत असाूनां त्यांच्याकडाे सारच्या कालाीत प्राप्त हाोणेाऱ्या हारकती/साूचनांा यार उक्त अदिदिनांयमंाच्या कलमं ३७ च्या पीोटो-कलमं (१कक) अन्ये कायशाहाी करण्यात येईल ;

Notice

Maharashtra regional and town Planning act, 1966.

No. TPB-4325/1585/CR-142/2025/UD-11.—Whereas, the Municipal Corporation of Greater Mumbai is the Planning Authority for the area within its jurisdiction (hereinafter referred to as "the said Corporation") as per the provision of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act");

And Whereas, in exercise of the powers conferred by sub-section (1) of Section 31 of the said Act, the State Government vide Notification No.TPB-4317/629/CR-118/2017/DP/UD-11, dated 8th May 2018 (hereinafter referred to as "the said Notification") has accorded sanction to the Draft Development Plan-2034 of Greater Mumbai along with the Development Control and Promotion Regulations -2034 for Greater Mumbai (hereinafter referred to as "the said Regulations") with modifications shown in SCHEDULE-A appended to the said Notification excluding the substantial modifications as shown in SCHEDULE-B appended to the said Notification. And whereas, Government has issued corrigendum of even number dated 22nd June 2018; And whereas, thereafter Government has issued a Corrigendum and Addendum of even number dated 29th June 2018 to the said Notification, which is published in Government Gazette dated 30th June, 2018; And whereas, the said Regulations have come into force from 1st September 2018; And whereas, the Government of Maharashtra vide Notification dated 21st September 2018 has sanctioned EP-1 to EP-168 (Excluding certain EP and provisions which were kept in abeyance) in the said Regulation; And whereas, the Government of Maharashtra vide Notification dated 12th November 2018 has issued corrigendum in respect of some typographical errors and mistakes and also to clarify and co-relate certain provisions of said Regulations for its proper interpretation ;

And Whereas, Regulation 31(3) of the said Regulations stipulates about 'Fungible Compensatory Area' and whereas as per this provision, in case of redevelopment under regulation 33(5), the fungible compensatory area admissible on existing BUA shall be granted without charging premium. Provided further that in case of redevelopment schemes of EWS/ LIG category under Regulation 33(5) where rehab entitlement not exceeding 35 sq.mt, then fungible compensatory area on such rehab entitlement shall be granted without charging premium ;

And Whereas, Regulation 33(5) of the said Regulations stipulates about 'Development/ Redevelopment of Housing Schemes of Maharashtra Housing and Area Development Authority (MHADA)' and Sub Clause 2.1(C) of Regulation 33(5) stipulate about 'sharing of the balance FSI'. As per this provision, the FSI remaining in balance after providing for the rehabilitation and the incentive components, shall be shared between the Co-operative Housing Society and MHADA in the form of BUA. Provided that, MHADA without insisting MHADA's Share in the form of BUA, may allow additional BUA over and above existing BUA upto 3.00 FSI by charging premium as given in this regulation ;

And Whereas, the Vice Chairman and Chief Executive Officer, Maharashtra Housing and Area Development Authority (hereinafter referred to as "MHADA") vide his letter dated 12th December 2023 addressed to the Government in Urban Development Department has requested to make modification in Regulation 31(3) and in Sub Clause 2.1(C) of Regulation 33(5) of the said Regulations so as to make MHADA redevelopment schemes more feasible. It is requested to modify the Regulation 31(3) to allow 'Fungible Compensatory Area' on rehab entitlement as per Regulation 33(5) (2.1) (A) instead of existing BUA and it is further stated that while calculating the additional built up area for redevelopment under Regulation 33(5), instead of deducting the existing built up area from the total permissible built up area, if premium is levied for the remaining additional built up area excluding the built up area of rehab component, it will help in facilitating redevelopment by improving the viability of redevelopment projects ;

And whereas, in view of the above said request of MHADA, the Government in Urban Development Department is of the opinion that in the public interest, it is expedient to modify the Regulation 31(3) and Sub Clause 2.1(C) of Regulation 33(5) of the said Regulations as specifically described in the Schedule attached herewith (hereinafter referred to as "the Proposed Modification").

Now, therefore, after considering the above facts and circumstances and in exercise of the powers conferred by sub-section (1AA) of Section 37 of the said Act; and of all other powers enabling it in this behalf, Government hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to the Proposed Modification, as required by clause (a) of sub-section (1AA) of Section 37 of the said Act, for information of all persons likely to be affected thereby. The Government is further pleased to inform that any objections/ suggestions in respect of the Proposed Modification mentioned in the Schedule attached herewith may be forwarded, before the expiry of one month from the date of publication of this Notice in the Maharashtra Government Gazette, (hereinafter referred to as "the said period") to the Deputy Director of Town Planning, Greater Mumbai, having his office at ENSA Hutments, E-Block, Azad Maidan, Mahapalika Marg, Mumbai 400 001. Any objections / suggestions, which may be received within the said period will be dealt with in accordance with the provisions of sub-section (1AA) of Section 37 of the said Act by the Deputy Director of Town Planning, Greater Mumbai, who is hereby authorised as an "officer" on the behalf of Government to hear objections / suggestions which are received and say of the said Corporation, as the case may be and submit his report to the Government ;
