No. SPP. 2025/U.O.R.58-XIV.—The Government of Maharashtra has appointed of Adv. Shri. Ujjwal Nikam as " Special Public Prosecutor " for conducting the case/s pending before Hon'ble Sessions Court, Mumbai which is/are arising out of D.C.B., C.I.D.,C.R. No. 44/2012 (C.R.No.105/2012 registered at Oshiwara Police Station, Mumbai) under Notification No. SPP 2024/U.O.R.68/D-XIV dated 10th June, 2024.

Now, the Government of Maharashtra hereby appoints Adv. Smt. Ashwini Avinash Rayakar as " Assistant to Special Public Prosecutor " for conducting the case/s pending before Hon'ble Sessions Court, Mumbai which is/are arising out of D.C.B., C.I.D.,C.R. No.44/2012 (C.R.No.105/2012 registered at Oshiwara Police Station, Mumbai)

2. The fees and other remuneration payable to Adv. Smt. Ashwini Avinash Rayakar as " Assistant to Special Public Prosecutor " shall be born by the Home Department, and shall be regulated in accordance with the scale of fees applicable Additional Public Prosecutors as prescribed by the Government from time to time.

3. The appointment of Adv. Smt. Ashwini Avinash Rayakar shall be governed by the provisions of the Maharashtra Law Officers (Appointment, Condition of Service and Remuneration) Rules, 1984 as amended from time to time.

4. The Government of Maharashtra reserves the right to modify,revoke or annul this appointment at any time without assigning any reason therefor.

टीप.—

(१) सुली अविकाराी यानाी महाराष्ट्र सहाकाराी सस्था अविविनायम, १९६० चे कलम १५६ विनायम, १९६१ चे विनायम १०७ मील तरातुदाीनाुसारा कजम सुलीचेी कायमाहाी कराी. कजम सुली कराताना सहाकारा कायदा, विनायम यातील तरातुदाी परिरापत्राकीय सूचेनाचे पालना ना केल्याचे विनादाशमनास आल्यास आश्यक ती चेौकशी करूना आश्यकता भासल्यास सदाराचे अविकारा तात्काळ काढेूना घेण्यात येतील.

(२) सदाराचे अविकारा सहाकारा कायदा कलम १०१ ९१ अन्ये प्राप्त सुली दाखाल्याचेी अमलबंजाणी कराण्याकरिराता असतील.

(३) सुली अविकाराी यानाी मा. सहाकारा आयुक्त विनाबंक, सहाकाराी सस्था, महाराष्ट्र राज्य, पुणीे याचेकडील परिरापत्राक जा. क्र. पतसस्था /सआ-५ खाचेम/ सुली आदाेश / २०१८, विदानाक ३१ ऑक्टीोबंरा २०१८ राोजी विनागमविमत केलेल्या परिरापत्राकानाुसारा दारामहा सोबंत जोडीलेल्या विविहात नामुन्यात प्रपत्रा १,२,३ ५ प्रमाणीे कजम सुलीचेी माविहाती या कायामलयास सादारा कराी.

(४) या कायामलयानाे अविकारा प्रदाना केलेल्या सुली अविकाराी असलेल्या व्यक्तीचेी बंदाली झाल्यास विकंा सेाविनाृत्ताी झाल्यास विकंा सेतूना काढेूना टीाकल्यास विकंा त्याचेा मृत्यू झाल्यास, अशा अविकाऱ्यास प्रदाना केलेले अविकारा आपोआप राद्दा हाोतील.

(५) सुली अविकाराी यानाी नामूदा केलेल्या कालाीत सुलीचे कामकाज समानाकाराक केले नासल्याचे विनादाशमनास आल्यास विकंा प्रदाना केलेल्या अविकाराचेा गैरापरा कराीत असल्याचे विनादाशमनास आल्यास, प्रदाना केलेले अविकारा काढेूना घेतले जातील भाविष्यात असे कोणीतेहाी अविकारा अशा व्यक्तीस प्रदाना कराण्यात येणीारा नाहाी.

(६) शासना विनाणीमय क्रमाक सविकणीम-१५०४/प्र.क्र. २३१/१५-स, विदानाक २३ नाोव्हांबंरा २००६ अन्ये विशेष सुली अविकाऱ्याना तीना विसहाच्या राजमुद्रीेचेा ापरा कराता येणीारा नाहाी.

(७) सुली अविकाऱ्यास त्याच्या नापुढे कोठीेहाी " महाराष्ट्र शासना विनायुक्त " आविणी विकंा " विसव्हाील कोटीट " " एक्झाीक्युटीव्हा कोटीट " या शब्दाचेा अथा तत्सम शब्दाचेा ापरा कराता येणीारा नाहाी. त्याऐजी सुली अविकाऱ्यानाी त्याच्या नापुढे " सुली अविकाराी (महाराष्ट्र सहा. सस्था अविविनायम, १९६० विनायम, १९६१ चे विनायम १०७ अन्ये) " असे विलहाे.

(८) सुली अविकाऱ्यास सुलीसाठी ापरा कराण्यात येणीाऱ्या ाहानारा " सुली अविकाराी, सह्याद्री नागराी सहाकाराी पतसस्था मयाम., नाविशक" असा फलक लाता येईल.

(९) सुली अविकाऱ्यानाे पगारा जप्तीचेी कायमाहाी कराताना कजमदाराच्या/ जामीनादाराच्या पगारा कपातीबंाबंत राष्ट्रीयीकृत बंँका ा अन्य बंँका याचेकडीे परास्परा ेतना कपातीचेा आदाेश दाेऊना परास्परा पगारा कपात कराता येणीारा नाहाी. सबंवित कजमदारा/जामीनादारा ज्या आस्थापनाेरा काम कराीत आहाे त्या आस्थापनाेराील आहाराणी सवितराणी अविकाराी / पगारा कराणीारा अविकाराी याचेमाफफत पगारातूना कजम सूल कराण्याचेी कायमाहाी कराी.

(१०) सुली अविकाऱ्यास, थाकबंाकीदाराकडीूना सुली दाखाल्यानाुसारा सूलपात्रा राक्कम मा. सहाकारा आयुक्त विनाबंक, सहाकाराी सस्था, महाराष्ट्र राज्य, पुणीे याचे विदानाक ६ एविप्रल २०१८ राोजीचे आदाेशामध्ये विनाश्चिश्चेत केलेल्या दारानाे सूल करायाचेी राक्कम याविशाय इतरा कोणीतीहाी राक्कम कराता येणीारा नाहाी. सदारा खाचेामचेी आकाराणी विविनायोग याबंाबंत प्रकराणीविनाहाय विहाशोबं ठीेायाचेा असूना त्याचेी तपासणी सस्थाेच्या ैाविनाक लेखापरिराक्षेकाकडीूना करूना घ्यायाचेी आहाे.

(११) सुली अविकाऱ्यानाे मा. सहाकारा आयुक्त विनाबंक, सहाकाराी सस्था, महाराष्ट्र राज्य, पुणीे याचे कायामलयाच्या विदानाक ३१ ऑक्टीोबंरा २०१८ विदानाक ११ जुलै २०१९ च्या परिरापत्राकातील सूचेनाचेी काटीेकोरापणीे अमलबंजाणी कराी. सदारा परिरापत्राकातील सुचेनाचे उल्लघेना झाल्यास सुलीचे अविकारा काढेूना घेण्यात येऊना भाविष्यकाळात असे अविकारा प्रदाना केले जाणीारा नाहाीत याचेी नांदा घ्याी. पतसस्थाेच्या चेअरामना/व्यस्थापक/ असायक यानाी दारामहा सुली अविकाऱ्याच्या कामकाजाचेा कजमदाराविनाहाय आढेा परिरापत्राकातील प्रपत्रा पाचे मध्ये नामूदा केल्याप्रमाणीे घ्या.

(१२) सुली अविकाराी यानाी विनागमविमत करायाच्या नाोटीस/ आदाेश/ घेोषणीापत्रा यामध्ये त्याना अविकारा प्रदाना केलेल्या या आदाेशाचेा सदाभाम नामूदा करा.
