Maharashtra Regional and Town Planning Act, 1966.

ORDER

No. D.T.P-D.P.Ballarpur-Sec-127(2)-Order-TPV-II-6412-2025.–

Whereas, the Development Plan of Ballarpur Municipal Council has been Partly sanctioned as per the provisions of section 31(1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide Notification No. TPS-2202-1260-CR-2(B)-2004-UD-09,dated 16th Au- gust, 2005 (hereinafter referred to as "the said Notification") & has come into force with effect from dt.01st October, 2005, (hereinafter referred to as "the said Sanctioned Development Plan") and the Excluded Plan has been sanctioned in Urban Development Department vide Notification No. TPS- 2202-1260-CR-2(C)-2004-UD-09, dated 18th June, 2008 & has come into force with effect from dated 28th July, 2008;

And whereas, as per the said Sanctioned Development Plan, the land bearing S.No. 32/96 of Mouza Ballarpur is affected by the Reservation Site No. 34, "Shopping Centre" (total area under reservation 0.26 Ha.) (hereinafter referred to as "the said Reservation") and the Planning and Appro- priate Authority for the acquisition and development of the said Reservation is Municipal Council, Ballarpur (hereinafter referred to as "the said Appropriate Authority");

And whereas, the Lands affected by the said Reservation have not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan come into force;

And whereas, the concerned land owner (hereinafter referred to as "the said Land Owner") of the land bearing S. No. 32/96 of Mouza Ballarpur admeasuring area approximately 1300 sq.mt. which is affected by the said Reservation (hereinafter referred to as "the said Land") had served a notice dt. 29th November, 2022 as per the provisions of section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority;

And whereas, the said Land under the said Reservation is not acquired or no steps as required as per the provisions of section 127 (1) of the said Act have been taken by the said Appropriate Authority within the stipulated period from the date of service of the said notice by the said land owner as per the provisions of Section 127 of the said Act ;

And whereas, the Hon'ble High Court, Mumbai, Nagpur Bench in the judgement dated 08th Au- gust, 2024 in Writ Petition No.7376/2024 has passed an order that, the reservation on the said land has lapsed under section 127 of the Said Act and directed to notify the lapsing of the reservation in accordance with law;

And whereas, the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur and Joint Director of Town Planning, Nagpur Division, Nagpur vide letter No.2082, dt.19th September, 2025 and letter No.1585, dt.08th October, 2005 respectively have submitted report to issue an order under the provisions of section-127 (2) of the said Act, in the said matter in the prescribed manner;

And whereas, after considering the above facts in respect of the said Reservation on the said Land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the order as per the provisions of section 127(2) of the said Act, regarding the lapsing of the said Reservation on the said land admeasuring area 1300 sq.mt.;

And whereas, the Government in Urban Development Department as per the provisions of sec- tion 151 of the said Act, vide Resolution No.TPS-1813-3211-CR- 508-UD-13, dt. 01st December, 2016, has delegated the powers exercisable by it as per the provisions of section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the Develop- ment Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;

Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said land as per the provisions of section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows-

After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added:–

ORDER

Whereas, the Development Plan of Gondia Municipal Council has been sanctioned as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide Notification No. TPS- 2311-2186-CR-249B-2011-UD-9, dt. 04th April, 2012 (hereinafter referred to as "the said Notification") & has come into force with effect from dt. 15th May, 2012, (hereinafter referred to as "the said Sanctioned Development Plan");

And whereas, as per the said approved Development Plan, the area of land in Gat No. 529/2, 529/3, area 1.52 Ha. at Mouja Kudwa is affected by Reservation No. N/23 (Primary School), 12 m. and 18 m. wide Development Plan Road (hereinafter referred to as "the said Reservations") and the Planning and Appropriate Authority for the acquisition and development of the said reservations is the Municipal Council, Gondia (hereinafter referred to as "the said Appropriate Authority");

And whereas, the land affected by the said Reservation have not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan come into force;

And whereas, the concerned land owner (hereinafter referred to as "the said Land Owner") of the Land bearing Gat No. 529/2, 529/3 at Mouja Kudawa, admeasuring area 1.52 Ha., had served a notice in respect of the land affected by the said Reservations (hereinafter referred to as "the said Lands") as per the provisions of Section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority on 31st December, 2022 and same has been recieved by the Appropriate Authority on 02nd January, 2023;

And whereas, the said Lands under the said Reservation is not acquired or no steps as required as per the provisions of section 127 (1) of the said Act have been taken by the Planning Authority within the stipulated period from the date of service of the said notice. by the said lands owner as per the provisions of section 127 of the said Act;

And whereas. Assistant Director of Town Planning. Gondia Branch, Gondia vide letter No. 741, dt. 14th October, 2025 has submitted report and finally stating that, 'The land under the said reser- vation was required to be acquired by the Planning Authority, N. P. Gondia, within a period of 10 years from the date of implementation of the Development Plan, i.e. from 15th May, 2012. However, since the said land was not acquired under Section 127(1) of the Maharashtra Regional and Town८ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, नोव्हेंबर २०-२६, २०२५/कर्ातिक २९-अग्रहायण ५, शके १९४७ Planning Act, 1966, it is seen that the applicant issued a purchase notice under Section 127 on 31st December, 2022. The said land was required to be acquired by the Municipal Council within a period of 24 months after the issuance of the purchase notice. However, since the Municipal Council has not acquired the said land. the reservation under it has lapsed. This office has no objection to issuing a notification the government regarding the lapsing of the land under reservation as per Section 127(2).';

And whereas, the Joint Director of Town Planning, Nagpur Division, Nagpur, vide letter No. 1639, dated 16th October, 2025, has submitted a report and finally stated that, 'Land ownership' in Kudwa, S.No. 529/2 and 529/3 out of the total area of Reservation No. N/23 (PS) "Primary School" is lapsing as the land acquisition process has not been completed within the prescribed period of 24 months from the date of issuance of the notification for the reservation. However, as the partial area of the said land is being released from the 12.0 m. and 18.00 m. wide Development Plan road, the connectivity of the said road is being disrupted. Therefore, since the coordination of roads is neces- sary while granting development permission in the said Sanctioned Revised Development Plan from the perspective of communication and connectivity, it would be appropriate to take a decision at the level of the Directorate regarding the issuance of notification under section 127(2) of the Maharashtra Regional and Town Planning Act, 1966 for the area affected by the said reservation.;

And whereas, on perusal of the copy of 'K prat' the land measurement document No. 2440/2021, dated 02nd February, 2021, received from the Chief Officer, Municipal Council, Gondia, it is seen that the area on the land of Gat No. 529/2, 529/3 at Mauja Kudwa is being affected by the Reservation No. N-23 (Primary School), 12 m. and 18 m. wide Development Plan road;

And whereas, in view of the above stated facts regarding the said Reservation on the said lands in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that it is necessary to issue an order regarding the lapsing of the said Reservation on the said lands as per the provisions of Section 127(2) of the said Act;

And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No.TPS-1813-3211-CR- 508/UD-13, dt.01st December, 2016, has delegated the powers exercisable by it as per the provisions of section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the Develop- ment Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;

Now therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said lands as per the provisions of section 127(2) of the said Act & for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows-

After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added:–

Note:- 1. The said Lands so released from the said Reservation shall become available to the said Land Owner for the purpose of development as otherwise permissible in the case of adja- cent Land under the said sanctioned Development Plan.

2. Contiguity of the road is broken due to partial area of the Land getting released from the said Road. Therefore, the land proposed in the Sanctioned Revised Development Plan for road to be retained from the perspective of transporation and connectivity to the adjacent reservation. In this regard, the Chief Officer. Municipal Council, Gondia as a Planning Authority should take appropriate action in the framework of law by offering any other alternative to the said Land owner with his consent.

3. A copy of the part plan of the said sanctioned Development Plan showing the areas of the said Lands which are lapsed from the said Reservation is available in the office of the Chief Officer, Municipal Council, Gondia, District Gondia during office hours on all working days for inspection to public upto one month.

NOTICE

Whereas, the Regional Plan of Chandrapur-Ballarpur Region (hereinafter referred to as "the said Regional Plan") has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2284-484-CR-135-UD-9, dated the 18th November, 1991 under section 15 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and has came into force with effect from the 01st february, 1992;

And whereas, the Government vide Resolution No. TPS 1815-CR-49-15-UD-13, dated 6th May, 2015 issued directives under section 154 of the said Act, regarding the procedure to be followed under section 20 of the said Act, for making changes in the use of land in the areas of sanctioned Regional Plans under the said Act, and issued Order to follow revised procedure related to above directives vide Government Resolution No. TPS-1815-C.NO.49-15-UD-13, Dated 04th January, 2016; and in exercise of the powers conferred by sub-section (1) of Section 151 of the said Act, the Government, vide its notification No.TPS-1815-CR-49-15-UD-13, Dated 06th May, 2015, delegated the powers exercisable by it under the provisions of Section 20 (3) & 20 (4) of the said Act,१२ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, नोव्हेंबर २०-२६, २०२५/कर्ातिक २९-अग्रहायण ५, शके १९४७ subject to conditions mentioned therein, to the Divisionl Joint Director of Town Planning Nagpur for Nagpur Administrative Division;

And whereas, land bearing survey no. 8/1, 8/2, 8/3 & 8/4 of Mouza Khutala, Tah. Chandrapur, District Chandrapur, total land admeasuring approx. 7.00 hectare (hereinafter referred to as "the said Area") is included in 'Agriculture Zone' of proposed Land Use Plan in the sanctioned Regional Plan of Chandrapur-Ballarpur;

And whereas, the "Proposal Scrutiny Committee" established under the above mentioned Government Resolution, after consulting to the Director of Town Planning, Maharashtra State, Pune and taking prior approval from Government, is of the opinion that the said area proposed to be deleted from "Agriculture Zone" and proposed to be included in "Residential Zone" in accordance with the provisions of sub-section (2) of Section 20 of the said Act, subject to following conditions.---- Terms & Conditions :-

(i) It will be binding for the Applicant to Pay Requisite Premium and other fees and to follow conditions laid down in the above said Government Resolution dated 04th January, 2016.

(ii) It is mandatory to provide 10% Open Space and 10% Amenity Space in the lay-out as required by the provision for Regional Plan in Unified Development Control & Promotion Regulations (UDCPR).

(iii) It will be the responsibility of the land Owners/Developers to provide sufficient water as required by the potential population on the said land. For that, As per the Senior Geologist Groundwater Survey and Development Agency, Chandrapur's, letter No. 916, dated 22nd August, 2024 and letter No. 989, dated 18th September, 2025, it is stated that from 4 proposed borewells and 2 proposed new wells (dug cum bore) inwell bore shall be kept at 3.00 M. height from the base of in- well bore casing and if dug out in this manner, from above 6 sources there is possibility of availability of ground water approx. 1,60,000 lit/day. Hence, the final lay-out shall be sanctioned only after when the applicant fulfils this condition and due verification by District Collector, Chandrapur.

(iv) It will be binding upon land Owners/Developers to Develop and provide basic Amenities at their own cost as per the specifications decided by the Collector, Chandrapur.

(v) After the approval of the Committee, Following Conditions prescribed for the sale of plot/ flat with the development of basic amenities in lay-out mentioned in the affidavit, in the proforma 'Schedule- C' (Annexure of Govt. resolution dated 06th May, 2015) submitted with the application shall be applicable.---- A After final sanction of Lay-out Sale of 25% plot/flat will be permissible B After completion of approx. 40% Basic Amenities Sale of 50% plot/flat will be permissible C After completion of approx. 60% Basic Amenities Sale of 75% plot/flat will be permissible D After completion of approx. 80% Basic Amenities Sale of 90% plot/flat will be permissible E After completion of approx. 100% Basic Amenities Sale of 100% plot/flat will be permissible (vi) If a group housing scheme is to be developed on the land under modification proposal, occupancy certificate shall not be issued to the Land owner /Developers unless all basic Amenities are developed as prescribed by the Collector, Chandrapur.

(vii) As per the provisions of the Unified Development Control & Promotion Regulations (UDCPR), it will be necessary to maintain an adequate distance from the drain.;

Now, therefore, in exercise of the power delegated by the Govt. in this regard, suggestions and/or objections with reasons are invited from General Public in accordance with Notice u/s 20(3) of said Act, in respect of proposed modification within 30 days from the date of publication of this notice in the Maharashtra Government Gazette;

The suggestions and/or objections shall be addressed to the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur, Chavhan royals, 2nd floor, Sarkar nagar, infront of Agrawal coaching classes, Chandrapur, 442 401.
