ORDER
No. D.T.P.-D.P.-Katol(R+AA)-Sec-127(2)-Order-TPV-11-5944.–
Whereas, the Development Plan of Katol Municipal Council (Revised +AA) has been partly sanctioned as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government. in Urban Development Department vide Notification No. TPS-2406-3123-CR-133(A)-07-~UD-9, dated 04th October, 2008 (hereinafter referred to as "the said Notification") & has come into force with effect from dated 15th December, 2008, (hereinafter referred to as "the said Sanctioned Development Plan");
And whereas, in the said Sanctioned Development Plan, part area of the land bearing S.No 294 of Mouza Katol is affected by the Reservation Site No. 99 "Shopping Complex" and 12 m.wide Devel- opment Plan Road (hereinafter referred to as "the said Reservation and Road ") and the Appropriate Authority for the acquisition and development of the said Reservation and Road is Municipal Council, Katol (hereinafter referred to as "the said Appropriate Authority");
And whereas, the aforesaid land affected by the said Reservation and Road have not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan come into force;
And whereas, the concerned land owner (hereinafter referred to as "the said Land Owner") of the lands bearing S.No. 294 which are affected by the said Reservation and Road (hereinafter referred to as "the said Land") had served a notice dated 08th July, 2020 as per the provisions of section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority;
And whereas, the said Land under the said Reservation and Road is not acquired or no steps as required as per the provisions of section 127 (1) of the said Act has been taken by the Appropriate Authority within the stipulated period from the date of service of the said notice by the said Land Owner as per the provisions of section 127 of the said Act;
And whereas, the Hon'ble High Court, Mumbai, Nagpur Bench in the order dated 26th September 2022 in Writ Petition No. 4004/2022 (hereinafter referred to as "the said Writ Petition") has passed an order that, the said Reservation and Road on the said Land have been lapsed as per the provisions of section 127 of the said Act;
And whereas, Chief Officer, Municipal Council, Katol vide Marathi letter No. ॅ-न्ह्यम्-१५५४-२०२५, ह्यहॅ २१ +रू]क्ष्,२०२५ has submitted a proposal to the Directorate of Town Planning regarding the laps- ing of the said Reservation and Road, stating that, "Since the financial condition of the Municipal Council is not sound and the land cannot be aquire by, the Municipal Council, as a local authority, has no objection if the remaining reservation land, excluding the 12- meter-wide D.P. Road in the reservation number 99 "Shopping Complex and 12 m. D.P. Road" in Survey No. 294, is vacated. Such a resolution has been passed and such a proposal has been submitted to the government''; And whereas, Assistant Director,Town planning, Nagpur Branch Office, Nagpur vide Marathi letter No ॅद्ध-१२७ - ह्यम्. . ॅ]क्ष्-द्ध-ॅ]क्ष्-न्. ॅ २९४ -२२५७, ह्यहॅ २२ +रू]क्ष्, २०२५ has submitted a proposal to the Directorate of Town Planning regarding the lapsing of the said Reservation and Road, stating that, "In this case, as per the records available in this office. Writ Petition No. 4004/2022 Hon'ble High Court, Nagpur Bench, the period of time has been more than 24 months since the order passed in the relevant Writ Petition No. 4004/2022 dated 26th September, 2022 and no review petition has been filed by the Government against the said order. Therefore as per the said order, although the reservation of the proposed 12.0 m. wide development plan road in Survey No. 294 is not joint in५ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, नोव्हेंबर २७-डिसेंबर ३, २०२५/अग्रहायण ६-१२, शके १९४७ terms of planning, as specifically mentioned in the order given by the Hon'ble High Court, it would be appropriate to issue a notification under Section 127 (2) of the Maharashtra Regional Planning and Town Planning Act, 1966 regarding the lapse of reservation number 99 "Shopping Center" and 12.0 m. wide development plan road in Survey No. 294";
And whereas, in view of the above facts regarding the said Reservation and Road on the area of said land the Director Town Planning Maharashtra State, Pune is of the opinion that, it is necessary to issue an order regarding the lapsing ther said Rervation and Road on the area of the said land;
And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No.TPS-1813-3211-CR- 508-UD-13, dated 01st December, 2016, has delegated the powers exercisable by it as per the provisions of section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the land bearing S.No. 294 as per the provisions of section 127(2) of the said Act & for that purpose amend the said Notification of the said Sanctioned Development Plan, as follows-
After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added:–

Note:- 1. The said Land so released from the said Reservation and Road shall become available to the said Land Owner for the purpose of development as otherwise permissible in the case of adjacent lands under the said sanctioned Development Plan.
2. The said order is being issued subject to the photocopy of demarcation maps dated 02nd December,2016 submitted by the noticee. As the noticee have not submitted the updated and certified demarcation map of their land under notice, the noticee himselves will be responsible for any future dispute or complaint regarding the area and boundary of the said Land mentioned in this order.
3. Contiguity of the road is broken due to partial area of the said Land getting released from the said Road. Therefore, from transportation & connectivity point of view the said Road is required to be retained on the same area as proposed in the said Sanctioned Development Plan. In this regard, the Chief Officer. Municipal Council. Gondia as a Planning Authority should take appropriate action in the framework of law by offering any other alternative to the said Land owner with his consent.

A copy of the part plan of the said sanctioned Development Plan showing the areas of the said Land which are lapsed from the said Reservation and Road is available in the office of the Chief Officer, Municipal Council, Katol, District Nagpur during office hours on all working days for inspection to public upto one month.

ORDER
No. D.T.P.D.P.-Ballarpur/Sec-127(2)/Order/TPV-II/6661
Whereas, the Development Plan of Ballarpur Municipal Council has been partly sanctioned as per the provisions of section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide Notification No. TPS- 2202/1260/CR-2(B)/2004/UD-9, dated 16th Augest, 2005 (hereinafter referred to as "the said Notification") & has come into force with effect from dated 01th Octomber, 2005, (hereinafter referred to as "the said Sanctioned Development Plan") and Excluded Plan has been sanctioned by the Government in Urban Development Department vide Notification No. TPS-2202/1260/CR-2/2004/UD-9, dated18th June, 2008 & has come into force with effect from dated 28th July, 2008;
And whereas, as per the said Sanctioned Development Plan, the part area of land bearing S. No. 31/40/A at Mouja Ballarpur is affected by 'Reservation No. 45, Stadium' (hereinafter referred to as "the said Reservation") and the Planning and Appropriate Authority for the acquisition and development of the said Reservation is the Municipal Council, Ballarpur (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land, affected by the said Reservation, has not been acquired by the said Appropriate Authority within 10 (ten) years from the date on which the said Sanctioned Development Plan has come into force;
And whereas, the concerned land owners (hereinafter referred to as "the said Land Owners") of the Land bearing S. No. 31/40/A at Mouja Ballarpur had served a notice dated 28th October, 2021 in respect of the land affected by the said Reservation (hereinafter referred to as "the said Land") as per the provisions of section 127(1) of the said Act, (hereinafter referred to as "the said Notice") on the said Appropriate Authority and same has been recieved by the Appropriate Authority on 09th November, 2021;
And whereas, the said Land under the said Reservation is not acquired or no steps as required९ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, नोव्हेंबर २७-डिसेंबर ३, २०२५/अग्रहायण ६-१२, शके १९४७ as per the provisions of section 127 (1) of the said Act have been taken by the Planning Authority within the stipulated period from the date of service of the said notice by the said land owner as per the provisions of section 127 of the said Act;
And whereas, the Assistant Director of Town Planning, Chandrapur Branch, Chandrapur vide letter No. 1928, dated 26th August, 2025 has submitted report stating that, 'This office is of the opinion that since the land acquisition process has not been completed within the prescribed period, the said reservation lapses. There is no objection to the publication of the notification under Section 127 (2) of the said Act for the said reservation, as per the directions given by the Hon'ble High Court,';
And whereas, the Joint Director of Town Planning, Nagpur Division, Nagpur, vide letter No. 1466, dated 18th September, 2025, has submitted a report and finally stated that, 'Why did the Chief Officer, Municipal Council, Ballarpur not submit the proposal for the demand of funds for the acquisition of the land of the said reservation to the Government? It would be appropriate to first seek clarification from the Chief Officer, Municipal Council, Ballarpur in this regard and then take further action.
Therefore, after obtaining the clarification of the Chief Officer, Municipal Council, Ballarpur, it is necessary to issue a Notification under Section 127(2) of the Maharashtra Regional Planning and Town Planning Act, 1966 for the area affected by the said reservation on the said land, as per the order of the Hon'ble Court,;
And whereas, in Writ Petition No. 1649/2024, the Hon'ble Mumbai High Court, Nagpur Bench, Nagpur has passed an Order on 18th June, 2025 that, the said Reservation has lapsed. By virtue of the said Order, the Hon'ble High Court has directed the Respondents to issue a Notification of lapsing of the 'Reservation No. 45, Stadium' on the land at S. No. 31/40/A of Mauja Ballarpur within four months from the date of the order of the court;
And whereas, in view of the above stated facts regarding the said Reservation on the said land in the said Sanctioned Development Plan, the Director of Town Planning, Maharashtra State, Pune is of the opinion that it is necessary to issue an order regarding the lapsing of the said Reservation on the said land as per the provisions of section 127(2) of the said Act;
And whereas, the Government in Urban Development Department as per the provisions of section 151 of the said Act, vide Resolution No.TPS-1813/3211/CR- 508/UD-13, dated 01th December, 2016, has delegated the powers exercisable by it as per the provisions of section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune, by this order and as specified in the Schedule hereinafter hereby notify the lapsing of the said Reservation in respect of the said land as per the provisions of section 127(2) of the said Act and for that purpose amends the said Notification of the said Sanctioned Development Plan, as follows-
After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added :-

As the said land owners have not submitted the original demarcation map of the said lands under the notice, the said land owners will be responsible for any future dispute or complaint regarding the area under Reservation.
2. Before certifying the part plan in accordance with the said order, the said and/or land owners will be required to submit updated and certified demarcation map of the Land Records Department for the said land under the notice.
3. The said Land so released from the said Reservation shall become available to the said Land Owners for the purpose of development as otherwise permissible in the case of adjacent Land under the said sanctioned Development Plan.
4. A copy of the part plan of the said sanctioned Development Plan showing the area of the said Lands which is lapsed from the said Reservation is available in the office of the Chief Officer, Municipal Council, Ballarpur, District Chandrapur during office hours on all working days for inspection to public upto one month.
5. The said landowner will be responsible for any dispute or complaint arising in the future regarding ownership or government lease of the said land.
