क्रमांक अ.बां.नि.वि./३८५३/२०२५.-----ज्याअर्थी, महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ मधील कलम ५३ (८) अन्वये नियोजन प्राधिकरण, राजपत्रातील अधिसूचनेद्वारे, या कलमान्वये आणि कलमे ५४, ५५ व ५६ अन्वये, नियोजन प्राधिकरणाच्या अधिकारांचा वापर करण्याच्या प्रयोजनांसाठी पदनिदशित अधिकारी म्हणून, नियोजन प्राधिकरणाच्या एखाा अधिकायास पदनिदशित करील. पदनिदशित अधिकायास, अधिसूचनेमध्ये विनिर्दिष्ट केलेल्या अशा स्थानिक क्षेत्रावर अधिकारिता असेल आणि वेगवगया स्थानिक क्षेत्रांसाठी वेगवेगळे पदनिदशित अधिकारी पदनिदशित करता येतील, अशी तरतूद आहे.
त्याअर्थी, अनधिकृत बांधकाम निर्मूलन विभागाकडील तहसीलदार (पश्चिम) व तहसीलदार (पूर्व) यांना महाराष्ट्र प्रादेशिक व नगर रचना अधिनियम, १९६६ मधील कलम ५२, पोट-कलम १ मधील खंड (अ) व (क) करिता त्यांचे कार्यक्षेत्राकरिता पदनिदशित अधिकारी व संबंधित तालुक्यातील कार्यरत शाखा अभियंता यांना सहायक पदनिदशित अधिकारी घोषित करण्यात आलेले आहे, तसेच त्याअर्थी, नियमानुसार दिलेल्या परवानगीव्यतिरिक्त विकसक यांनी केलेले अनधिकृत / वाढीव बांधकाम महाराष्ट्र प्रादेशिक व नगर रचना अधिनियम, १९६६ मधील कलम ५२, पोट-कलम १ मधील खंड (ब) व (ड) करिता विकास परवानगी विभागाकडील खालील अधिकायांना पदनिदशित अधिकारी म्हणून घोषित करणेत येत आहे.

त्याअर्थी, उक्त महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ मधील कलम ५३ (८) अन्वये प्राप्त अधिकारानुसार सदर अधिसूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध करणेसाठी प्रस्तावित करणेत येत आहे. सदर अधिसूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून अमलात येईल.

Regarding the Publication of the Gazette Notification of appointment of Designated Officers under
Section 53 (8) of the Maharashtra Regional Planning and Town Planning Act, 1966
NOTIFICATION
क्रमांक अ.बां.नि.वि./३८५३/२०२५.––Whereas, provided that provision under Section 53 (8) of the Maharashtra Regional Planning and Town Planning Act, 1966 is "The Planning Authority shall, by Notification in the Gazette, Designate an Officer of the Planning Authority as the Designated Officer for the purpose of exercising the powers of the Planning Authority under this Section and under Sections 54, 55 and 56 the Designated Officer shall have Jurisdiction over such local area as may be specified in the Notification and different Designated Officers may be appointed for different local areas."
Accordingly, the Tahsildar (West) and Tahsildar (East) of the Unauthorized Construction Removal Department have been declared as Designated Officers for their respective jurisdictions for Section 52, sub-section (1) Clauses (a) and (c) of the Maharashtra Regional and Town Planning Act, 1966 and the Junior Engineer working in the concerned taluka has been declared as an Assistant Designated Officer.
Similarly, in accordance with the rules, for any unauthorized or additional constructions carried out by developers beyond the permissions granted, the following officers from the building permission department are being declared as Designated Officers for Section 52, sub-section (1) Clauses (b) and (d) of the Maharashtra Regional and Town Planning Act, 1966.

Therefore, under the powers vested by Section 53 (8) of the Maharashtra Regional and Town Planning Act, 1966, this Notification is being proposed for publication in the Maharashtra Government Gazette. The Notification will come into effect from the date it is published in the Maharashtra Government Gazette.
