ज्याअर्थी, उक्त अविविनांयमंाचे कलमं ३१ पुो-कलमं (१) अन्ये प्राप्त अविकारीांचा ापुरी करूनां रीाज्य ासानांानांे अविसाूचनांा क्र. विपुीबी-४३१७/६२९/प्र.क्र.१९८/२०१७/वियो/नांवि-११, वि.८/०५/२०१८ (यापुढे याचा उल्लेख "उक्त अविसाूचनांा" असा करीणेत आलेला आहाे) द्वारीे बृहान्मंु ंबई प्रारूपु विकासा योजानांा २०३४ (यापुढे याचा उल्लेख "उक्त विकासा योजानांा" असा करीणेत आलेला आहाे) साहा विकासा विनांयंत्राणे प्रोत्साहानां विनांयमंाली २०३४ ला (यापुढे याचा उल्लेख "उक्त विनांयमंाली" असा करीणेत आलेला आहाे) उक्त अविसाूचनांेसाोबतचे पुरिरीविष्-ब मंध्ये शविलेले सारीभाूत स्रुपुाचे फेरीबल (ई.पुी.) गळूनां उक्त अविसाूचनांेत पुरिरीविष्-अ मंध्ये शविलेल्या साुारीणेसाहा मंजाुरी विली आहाे; आविणे ज्याअर्थी ासानांानांे उक्त अविसाूचनांेसा सामं क्रमंांकाचे ुध्ीपुत्राक वि.२२ जाूनां २०१८ रीोजाी विनांगशविमंत केले आहाे ;आविणे ज्याअर्थी, त्यानांतरी उक्त अविसाूचनांेसा ासानांानांे सामंक्रमंांकाचे ुध्ीपुत्राक पुरीकपुत्रा वि. २९ जाूनां, २०१८ रीोजाी पुारिरीत केले असाूनां सारी ुध्ीपुत्राक पुरीकपुत्रा महाराष्ट्र शासनाच्या राजपत्रात वि. ३० जाूनां, २०१८ रीोजाी प्रविसाद्ध करीण्यात आले आहाे; आविणे ज्याअर्थी, उक्त विनांयमंाली वि.१/०९/२०१८ पुासाूनां अंमंलात आली आहाे;

आविणे ज्याअर्थी, उक्त मंहानांगरीपुाविलकेनांे वि.२९/०१/२०२५ रीोजाीचे पुत्रान्ये ासानां नांगरीविकासा विभागासा प्रस्ता सारी केला असाूनां सारी पुत्रात असाे नांमंू आहाे विक, ासानांानांे वि.२१/११/२०२३ रीोजाी अविसाूचनांा क्र.विपुीबी-४३१९/३८६/प्र.क्र.१५४/२०१९/नांवि-११ ंबई हाद्दीतील विहासारी (पुश्चिचमं) येर्थील विलंक रीोड ते विमंरीा भाईंरी हाद्दीतील भाईंरीपुयंत प्रस्तावित ४५ मंी रुंीचा रीस्ता मंजाूरी केला द्वारीे बृहान्मंु ंबई मंहानांगरीपुाविलकेच्या Bridge Department च्या विनांयोजानांानांुसारी, प्रस्तावित ४५ मंी रुंीच्या विकासा योजानांा रीस्ता आहाे. तसाेच बृहान्मंु नांीनां विलंक रीोडसाठी जांक्नां आयक आहाे; तसाेच विभागीय नां अविकारी, मंु ंबई कांळूनां सांशनां युविनां यांनांी विकासा योजानांा २०३४ मंध्ये प्रस्तावित 'विहासारी कांळूनां उद्यानांासा' पुोहाच रीस्ता सामंाविष् करीण्याची विनांती केली आहाे.

भाग एक (को.वि.पु.)-६–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक–कोकण विभागीय पुरिणी, जानेिारी २०, २०२६/पौर्ष ३०, शके १९४७ आविणे ज्याअर्थी, उक्त विनांती विचारीात घेऊनां उक्त मंहानांगरीपुाविलकेनांे उक्त अविविनांयमंाचे कलमं ३७ चे पुो कलमं (१) नांुसारी प्राप्त अविकारीांतगशत मंजाूरी विकासा योजानांा-२०३४ मंील आरी/उत्तरी विभागातील मंौजाे-एकसारी, नां.भाू.क्र.५३२अ(भाग), ५३४(भाग), ६६०अ/३(भाग) ६६१(भाग) या जागेरील ४५ मंी. रुं उन्नांत मंागश (विकनांारी मंागश ेचा प्पुा) अश्चिस्त्ातील विलंक रीोड यांचे शत करीण्याबाबत आविणे प्रस्तावित प्रस्तावित जांक्नां (अंाजाे २२,००० चौ.मंी. क्षेत्रा) हाे रीस्त्याचा भाग म्हाणेूनां मंजाूरी विकासा योजानांेमंध्ये अंतभाू 'विहासारी कांळूनां उद्यानांासा' पुोहाच रीस्ता म्हाणेूनां मंौजाे विहासारी, नां.भाू.क्र.१ (भाग), २०७ (भाग), २०८ (भाग) या जागेरी असालेल्या अश्चिस्त्ातील रीस्त्याच्या सांरीेखनांानांुसारी अंाजाे १००० मंी. लांबीचा ९.१५ मंी. रुंीचा विकासा योजानांा रीस्ता प्रस्तावित करीणेकरिरीता फेरीबल प्रस्ता कायाशश्चिन्त केला आहाे (यापुढे याचा उल्लेख "प्रस्तावित फ़ेरीबल" असा करीणेत आलेला आहाे.);

आविणे ज्याअर्थी, उक्त मंहानांगरीपुाविलकेनांे सारी प्रस्तावित फेरीबलाची साूचनांा सामंान्य जानांतेच्या साूचनांा/हारीकतीकरिरीता महाराष्ट्र शासन राजपत्रात वि.०५ ते ११ विडसांबरी, २०२४ रीोजाी प्रविसाध् केली आहाे; आविणे ज्याअर्थी, उक्त मंहानांगरीपुाविलकेनांे उक्त अविविनांयमंाचे कलमं ३७(१) अन्ये प्रस्तावित फेरीबलाची ैाविनांक कायशाहाी पुूणेश करूनां वि. २९/१/२०२५ चे पुत्रान्ये फेरीबल प्रस्ता ासानांाचे मंान्यतेसाठी सारी केला आहाे;

आविणे ज्याअर्थी सांचालक, नांगरीरीचनांा, मंहारीाष्ट्र रीाज्य, पुणे यांनांी त्यांचेकडील वि.१८/०६/२०२५ रीोजाीचे पुत्राद्वारीे सारी प्रस्तावित फेरीबलारी अहाल सारी केला आहाे;

आविणे ज्याअर्थी उक्त मंहानांगरीपुाविलकेची विनांती विचारीात घेऊनां सांचालक, नांगरीरीचनांा, मंहारीाष्ट्र रीाज्य, पुणे यांचेी साल्लामंसालत केल्यानांतरी प्रस्तावित फेरीबल मंजाूरी करीणे आयक असाल्याचे ासानांाचे मंत झालेले आहाे.

आता त्याअर्थी, उक्त अविविनांयमंाच्या कलमं ३७(२) अन्ये प्राप्त अविकारीात आविणे त्या सांभाशतील साश क्तंचा ापुरी करूनां ासानां याद्वारीे: -

अ) उक्त प्रस्तावित फेरीबलाचे प्रस्तासा साोबतचे पुरिरीविष्ामंध्ये नांमंू केलेप्रमंाणे मंजाुरी ेत आहाे.

ब) सारीची अविसाूचनांा शासकीय राजपत्रामध्ये प्रविसाद्ध झाल्याचा विनांांक हा उक्त फेरीबल अंमंलात आलेचा विनांांक असाेल.

क) बृहान्मंु ंबई मंहानांगरीपुाविलकेच्या उक्त विकासा योजानांेच्या मंजाुरी साोबतच्या फेरीबलाचे पुरिरीविष्ामंध्ये ेच्या नांीनांतरी साोबतचे पुरिरीविष् सामंाविष् करीणेचे विनांे ेत आहाे.

ii. Proposed 9.15m wide DP road affecting land bearing C.T.S. No. 1(Pt), 207(pt) & 208(pt) of Village Dahisar having approx. length of 1000mt as per alignment of existing road on site as an approach road to proposed Mangroves Park is sanctioned as shown on plan.

NOTIFICATION

Maharashtra regional and town Planning act, 1966.

No.TPB-4323/388/C.R.120/2025/UD-11.— Whereas, the Municipal Corporation of Greater Mumbai is the Planning Authority for the area within its jurisdiction (hereinafter referred to as "the said Corporation") as per the provision of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act").

Whereas, in exercise of the powers conferred by sub-section (1) of Section 31 of the said Act, the State Government vide Notification No. TPB-4317/629/CR-118/2017/DP/UD-11, Dt. 08/05/2018 (hereinafter referred to as "the said Notification") has accorded sanction to the Draft Development Plan 2034 of Greater Mumbai (hereinafter referred to as "the said Development Plan") along with the Development Control and Promotion Regulations 2034 (hereinafter referred to as "the said Regulations") for Greater Mumbai with modifications shown in SCHEDULE-A appended to the said Notification excluding the substantial modifications as shown in SCHEDULE-B appended to the said Notification; And whereas, Government has issued corrigendum of even number dt. 22nd June, 2018; and whereas, thereafter Government has issued a Corrigendum and Addendum of even number dt. 29th June, 2018 to the said Notification, which is published in Government Gazette dt. 30th June, 2018; and whereas, the said Regulations have come into force from 1/09/2018;

And whereas, Government in Urban Development Department has received a proposal vide letter dtd.29/01/2025 from the said Corporation wherein it is stated that, Government of Maharashtra, vide notification No. TPB-4319/386/Cr -154/2019/UD 11, dated 21st Novemebr, 2023 has sanctioned the proposed 45m wide road from Link Road at Dahisar(W) in BMC limits to Bhayandar in MBMC limits. Further as per planning of BMC Bridge Department, the junction for proposed 45m wide DP road and new link road is necessary and also Divisional Forest Officer, Mumbai Mangroves Conservation unit has also requested to include approach road for proposed Mangroves Park in DP 2034.

And whereas, considering the above request, in exercise of the powers conferred under sub-section (1) of Section 37 of the said Act, the said Corporation has initiated modification proposal to modify junction of proposed 45m wide DP road & New Link road (Existing road) affecting land bearing CTS No. 532A, 534, 661 & 660A/3 of village Eksar having area admeasuring 22,000 sq.mt as road area/interchange and also to include 9.15m wide DP road affecting land bearing C.T.S. No.1(Pt), 207(pt) & 208(pt) of Village Dahisar having approx. length of 1000mt as per alignment of existing road on site as an approach road to proposed Mangroves Park(hereinafter referred to as 'the proposed modification');

And whereas accordingly, the said Corporation had issued Notice for inviting suggestions/ objections from the general public with regard to the proposed modification which is published in Maharashtra Government Gazette on 05-11 December 2024; And whereas, the said Corporation after completing the legal procedure regarding the proposed modification as stipulated under Section 37(1) of the said Act, has submitted the modification proposal vide letter dated 29/01/2025 to the Government for sanction;

And whereas, Director of Town Planning, Maharashtra State, Pune vide his letter dated 18/06/2025 has submitted his report to the Government on the proposed modification;

And whereas, after considering the request of the said Corporation and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the proposed modification is required to be sanctioned;

Now, therefore, in exercise of the powers conferred upon it under Section 37(2) of the said Act, the Government hereby:-

A) Sanctions the proposed modification as described more specifically in the Schedule attached herewith.

B) Fixes the date of publication of this Notification in the Official Gazette as the date of coming into force of this modification.

C) Directs the Municipal Corporation of Greater Mumbai that in the Schedule of Modifications sanctioning the said Development Plan, after the last entry, the Schedule referred to at (A) above shall be added.
