ORDER
No. D.T.P.-D.P.-Kalmeshwar-Site No.50-Sec 50(2)-3125-Order-TPV-2-7774–
Whereas, the Second Revised and Additional Area Development Plan of 'C' Class Municipal Council Kalmeshwar- Brahmani has been partly sanctioned under the provisions of section 31(1) of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") by the Directorate of Town Planning vide Notification No. TPV-2/4287, dated 21nd July, 1992 (hereinafter referred to as "the said Notification") and come into force with effect from 01st October, 1992 (hereinafter referred to as "the said sanctioned Development Plan");

No. 830 (Area: 0.46 ha) of Mouja Kalmeshwar (hereinafter referred to as "the said Land" is reserved for "Extension of Police Station" as Site No.50 (hereinafter referred to as "the said Reservation") and "Police Department is the Appropriate Authority for acquisition and development of the said Reservation (hereinafter referred to as "the said Appropriate Authority") ;
And whereas, the Superintendent of Police, Nagpur District (Rural), Nagpur on behalf of the said Competent Authority has inforned Chief Officer, Municipal Council, Kalmeshwar-Brahmani, Mouja- Kalmeshwar. Taluka- Nagpur vide letter No. 9023/ 2024, dated 23rd September, 2024 and so accordingly, Planning Authority, Municipal Council, Kalmeshwar-Brahmani has informed along with its report for the said deletion, in accordance with the prescribed procedure, Government of Maharashtra vide letter No.03311/25, dated 20th March, 2025, that the said Land under the said Reservation is not necessary for Police Department ;
And whereas, to the effect that, regarding deletion of the entire area under the said Land from the said Reservation, as notified by the Competent Authority to the Planning authority; Chief Officer, Municipal Council, Kalmeshwar-Brahmani, Mouja- Kalmeshwar, Taluka- Nagpur vide letter No. 03311/25, dated 20th March, 2025 has submitted the said deletion report, in accordance with the prescribed procedure, to the Government for further necessary action ;
And whereas, the Chief Officer, Kalmeshwar-Brahmani, Mouja- Kalmeshwar, vide its letter No.03311/25, dated 20th March, 2025 has submitted a report to the Assistant Director of Town Plan- ning, Nagpur Branch, Nagpur that, Municipal Council has no objection for the deletion of the said Reservation on the said Land under the provisions of section 50 of the said Act:
And whereas, the Assistant Director of Town Planning, Nagpur Branch. Nagpur has submitted a report vide its letter No.1105, dated 09th April, 2025 to the Joint Director of Town Planning, Nagpur Division, Nagpur stating it's no objection to delete the said Reservation on the said Land;
And whereas, the Joint Director of Town Planning. Nagpur Division. Nagpur has submitted a report vide its letter No.928, date: 23rd June, 2025 to the Director of Town Planning, Maharashtra State, Pune stating it's no objection to delete the said Reservation on the said Land;
And whereas, the Superintendent of Police, Nagpur District (Rural), Nagpur, on behalf of the said Appropriate Authority, has informed the Directorate of Town Planning vide letter No.7472/2025. dated 03rd Septmber, 2025, that the said Land under the said Reservation is not necessary for their department;
And whereas, as per the provisions of section 151 of the said Act, the Government in Urban Development Department vide Government Resolution No.TPS-1813/3211/CR-508/UD- 13, dated 01st December, 2016 has delegated the powers exercisable by it under the provisions of section 50(2) of the said Act to the Director of Town Planning, Maharashtra State, Pune in respect of Development Plans of all Municipal Councils / Nagar Panchayat and for the Development Plans under taken by Zilha Parishad as a Planning Authority;
And whereas, to the effect that, in accordance with the above Government Resolution. regard- ing deletion of the entire area under the said Land from the said Reservation, as notified by the Appropriate Authority to Planning authority and after making necessary enquiry, it is satisfied that, the said Reservation on the said Land is no longer required to the said Appropriate Authority and the Director of Town Planning, Maharashtra State, Pune is of the opinion that, the proposal of the deletion of the said Reservation on the said Land under the provisions of section 50(2) of the said Act should be sanctioned ;
And whereas, Assistant Director, Town Planning, Nagpur Branch vide its letter No.2898, dated 03rd November, 2025 has communicated to the Directorate that, as per the Government direc- tives dated 20th April, 2016, out of the premium amount calculated at the rate of 5% of the land value as per the land rates in Annual Statement of Rates (ASR), 50% premium amount of Rs.4,53,100/- payable to the Government through Government treasury on 29th October, 2025 and the remaining 50% premium amount of Rs.4,53,100/- payable to the Planning Authority with the account of Chief Officer, Municipal Council, Kalmeshwar-Brahmani dated 30th October, 2025.

After the last entry in the Schedule of Modifications accompanying the said Notification of the said sanctioned Development Plan, the following new entry shall be added: –

Note:- 1. The said Land, in the said sanctioned Development Plan, affected by proposed road widening of 18m. wide road, shall stand retained.
2. The said Land so released from the said Reservation shall become available to the said Land owner for the purpose of development as otherwise permissible in the case of adjacent land under the said sanctioned Development Plan.
3. A copy of the part plan of the said sanctioned Development Plan showing the area of the said Land which is deleted from the said Reservation, is available in the office of the Chief Officer. Municipal Council, Kalmeshwar-Brahmani, Tal. and Dist. Nagpur during office hours on all working days for inspection to public up to One month.
4. This Order shall also be published on the Directorate's official website. www.dtp.
