क्रमांका जमाीन-२०२५/प्र.क्र.२९/जमाीन-१.— माहुाराष्ट्र जमाीन माहुसूल सूंदिहुता, १९६६ (१९६६ चा माहुा. अदि. ४१) च्या कालमा ३२८ आदि कालमा २९अ अन्वाये प्रदान कारण्याता आलेल्या अदिकारांचा वा त्याबाबता सूमार्थग काराऱ्या इतार सूवाग अदिकारांचा वापर कारून "माहुाराष्ट्र जमाीन माहुसूल (भाोगवाटादार वागग-२ आदि भाडेपट्ट्याने ार काेलेल्या जदिमानी भाोगवाटादार वागग-१ माध्ये रुपांतारीता कारे ) दिनयमा, २०२५" यामाध्ये सूुारा कारण्यासूाठी योदिजले आहुे. त्या दिनयमांचा पुढील मासूुदा उक्ता सूंदिहुताेच्या कालमा ३२९ च्या, पोटा-कालमा (१) द्वारे आवाश्यका असूल्याप्रमाे, त्याद्वारे बा पोहुचाण्याचा सूंभावा असूलेल्या सूवाग व्यक्तांच्या मादिहुताीसूाठी प्रदिसूद्ध कारण्याता येता आहुे आदि अशी नोटाीसू दाेण्याता येता आहुे काी, उक्ता मासूुदा १२ माचाग, २०२६ रोजी दिकांवा त्यानंतार माहुाराष्ट्र शीासून दिवाचाराता घेईल.

२. उक्ता मासूुद्याच्या सूंबंाता काोत्याहुी व्यक्तांकाडेून माहुाराष्ट्र शीासूनाचाे अपर माुख्य सूदिचावा (माहुसूल), माहुसूल वा वान दिवाभाग, ंबई ४०० ०३२ यांचाेकाडे वारील दिदानांकापूवाी येाऱ्या सूचाना दिकांवा प्राप्ता हुोाऱ्या मादामा कामा मागग, हुतात्मा राजगुरू चाौका, मांत्रालय, माु हुरकाताी शीासून दिवाचाराता घेईल.

प्रारुप किंनयेम

१. या दिनयमांना, "माहुाराष्ट्र जमाीन माहुसूल (भाोगवाटादार वागग-२ आदि भाडेपट्ट्याने ार काेलेल्या जदिमानी भाोगवाटादार वागग-१ माध्ये रुपांतारीता कारे) (सूुारा) दिनयमा, २०२६" असूे म्हुावाे.

२. माहुाराष्ट्र जमाीन माहुसूल (भाोगवाटादार वागग-२ आदि भाडेपट्ट्याने ार काेलेल्या जदिमानी भाोगवाटादार वागग-१ माध्ये रुपांतारीता कारे) दिनयमा, २०२५ (यापुढीे ज्याचा उल्लेख "माुख्य दिनयमा" असूा कारण्याता आला आहुे) याताील दिनयमा ३ च्या पोटा-दिनयमा (४) माील ताक्त्यामाध्ये,—

(i) ताक्ता (अ) माध्ये,-

(अ) स्तांभा (३) माील शीर्षगकाता, "३१ दिडेसूंबर, २०२५" या अंकांऐवाजी आदि शीब्दाऐवाजी "३१ दिडेसूंबर, २०२६" हुे

(१)

भाग चार-ब-८९–१२ महाराष्ट्रट शासन राजपत्र असाधाराण भाग चारा-ब, फेब्रुवाराी २६, २०२६/फेाल्गुन ७, शाके १९४७ अंका आदि शीब्दा दाखल कारण्याता येताील;

(ब) स्तांभा (४) माील शीर्षगकाता, "३१ दिडेसूंबर, २०२५" या अंकांऐवाजी आदि शीब्दाऐवाजी "३१ दिडेसूंबर, २०२६" हुे अंका आदि शीब्दा दाखल कारण्याता येताील;

(ii) ताक्ता (ब) माध्ये,-

(अ) स्तांभा (३) माील शीर्षगकाता, "३१ दिडेसूंबर, २०२५" या अंकांऐवाजी आदि शीब्दाऐवाजी "३१ दिडेसूंबर, २०२६" हुे अंका आदि शीब्दा दाखल कारण्याता येताील;

(ब) स्तांभा (४) माील शीर्षगकाता, "३१ दिडेसूंबर, २०२५" या अंकांऐवाजी आदि शीब्दाऐवाजी "३१ दिडेसूंबर, २०२६" हुे अंका आदि शीब्दा दाखल कारण्याता येताील;

(का) अनुक्रमांका ४ सूमाोरील स्तांभा (२) माध्ये, "काब्जेहुक्काने भाोगवाटादार वागग-२ " पासून सूुरू हुोाऱ्या आदि " प्रानमांत्राी आवासू योजनेसूाठी उपलब् कारून दाेण्यासू तायार हुोताील " वार सूंपाऱ्या माजकाुराऐवाजी खालील माजकाूर दाखल कारण्याता येईल, ताो असूा:-

"काब्जेहुक्काने/भाडेपट्ट्याने भाोगवाटादार वागग-२ च्या जदिमानी ार काराऱ्या वा स्वायंपुनदिवागकासू काराऱ्या सूहुकारी गृहुदिनमाग सूंस्र्था "

(डे) अनुक्रमांका ४ नंतार खालील अनुक्रमांका अंताभाू गता कारण्याता येईल, ताो असूा :-

(इ) 'अटाी' या शीर्षगकाखालील अटा (१) वागळण्याता येईल.

३. माुख्य दिनयमांच्या दिनयमा ३ नंतार खालील दिनयमा सूमादिवाष्टा कारण्याता येईल, ताो असूा:-

"४. (१) जेर्थे भाोगवाटादार वागग-२ दिकांवा भाडेपट्ट्याने प्रदान काेलेली जमाीन हुी न्यायालयीन प्रकार, दिनयोजन प्रादिकाराने दिवाकासू योजनेता (Development Plan) काेलेला बदाल दिकांवा भाोगवाटादाराच्या दिनयंत्राबाहुेरील इतार काोत्याहुी कारामाुळे, ज्या प्रयोजनासूाठी ताी मांजूर कारण्याता आली हुोताी त्या प्रयोजनासूाठी वापरली गेली नसूेल, तार अशीा जदिमानीचा भाोगवाटादार, अशीा जमाीन प्रदानाच्या दिदानांकापासून १० वार्षाचा कालावाी उलटाल्यानंतार, सूंबंदिता दिजल्हुादिकाऱ्यांकाडे जमाीन काेवाळ माूळ प्रयोजनासूाठीचा वापरली जाईल असूे हुमाीपत्रा दाेऊन, अशीा भाोगवाटादार वागग-२ दिकांवा भाडेपट्ट्याने दिदालेल्या जदिमानीचाे भाोगवाटादार वागग-१ माध्ये रूपांतार कारण्यासूाठी अजग कारू शीकाेल:

परंताु असूे काी, असूा अजग कारताेवाेळी, अजगदाराकाडे सूंबंदिता दिनयोजन प्रादिकाराकाडेून दिदालेले बांकामा प्रारंभा प्रमापत्रा असूे आवाश्यका असूेल.

(२) दिजल्हुादिकारी रुपांतारासूाठीचा असूा अजग राज्य शीासूनाच्या पूवागपरवानगीसूाठी पाठीवाताील. राज्य शीासून त्याचाे सूमान झाल्यासू आदि लेखी कारे नंदावाून अशीा रूपांतारासूाठी पूवागपरवानगी दाेऊ शीकाेल दिकांवा नाकारू शीकाेल.

(३) राज्य शीासूनाचाी अशी परवानगी प्राप्ता झाल्यानंतार, दिजल्हुादिकारी पोटा-दिनयमा (१) माध्ये नमाूदा काेलेल्या भाोगवाटादार वागग-२ दिकांवा भाडेपट्ट्याने दिदालेल्या जदिमानंचाे भाोगवाटादार वागग-१ माध्ये रूपांतार कारताील आदि दिनयमा ३ माील ताक्त्यामाध्ये नमाूदा काेलेले रूपांतार अदिमाूल्य आदि अटाी अशीा रूपांतारासूाठी लागू असूताील."

NOTIFICATION

Maharashtra Land revenue Code, 1966.

No.Jamin-2025/C.R.29/J-1.— The following draft of rules to amend the Maharashtra Land Revenue (Conversion of Occupancy Class-II and Leasehold lands into Occupancy Class-I lands) Rules, 2025, which the Government of Maharashtra proposes to make in exercise of the powers conferred by sections 29A and 328 of the Maharashtra Land Revenue Code, 1966 (Mah. XLI of 1966) and of all other powers enabling it in that behalf, is hereby published as required by sub-section (1) of section 329 of the said Code, for information of all the persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra on or after the -12th of March 2026.

2. Any objection or suggestion which may be received by the Additional Chief Secretary to Government of Maharashtra, Revenue and Forests Department, Mantralaya, Madam Cama Marg, Hutatma Rajguru Chowk, Mumbai 400 032, from any person with respect to the said draft on or before the aforesaid date will be considered by the Government.

DRAFT RULES

1. These rules may be called the Maharashtra Land Revenue (Conversion of Occupancy Class- II and Leasehold lands into Occupancy Class-I lands) (Amendment) Rules, 2026.

2. In rule 3 of the Maharashtra Land Revenue (Conversion of Occupancy Class-II and Leasehold lands into Occupancy Class-I lands) Rules, 2025 (hereinafter referred to as "the principal Rules") in sub-rule (4), in the TABLE,—

(i) in clause (A),—

(a) in column (3), in the heading, for the figures, letters and words "31st December, 2025" the figures, letters and word "31st December 2026" shall be substituted;

(b) in column (4), in the heading, for the figures, letters and words "31st December, 2025" the figures, letters and words "31st December 2026" shall be substituted;

(ii) in clause (B),—

(a) in column (3), in the heading, for the figures, letters and words "31st December, 2025" the figures, letters and words "31st December 2026" shall be substituted;

(b) in column (4), in the heading, for the figures, letters and words "31st December, 2025" the figures, letters and words "31st December 2026" shall be substituted;

(c) in entry 4, in column (2), for the portion beginning with "Land held on" and ending with "Awas Yojana (PMAY)", the following portion shall be substituted, namely :—

"Land held on Occupant Class II or leasehold basis by Co-operative Housing Society provided that the Co-operative Housing Society is opting for self- redevelopment.";

(d) after entry 4, the following entry shall be inserted, namely :—

(e) Under the heading Conditions, Condition (1) shall be deleted.

3. After rule 3 of the principal Rules, the following rule shall be added, namely :—

"4. (1) Where land granted on Occupancy Class-II or leasehold basis is not used for the purpose for which it was granted due to a court case, or a change made in the Development Plan by the Planning Authority or any other reason beyond the control of the occupant, then the occupant of such land may, after lapse of period of ten years from the date of such grant, make an application, alongwith the undertaking that the land shall be used only for the purpose for it was granted originally, to the concerned District Collector to convert such Occupancy Class-II or leasehold lands into Occupancy Class-I lands:

Provided that, at the time of making such application, the applicant shall have a Commencement Certificate (CC) for building construction from the concerned Planning Authority.

(2) The District Collector shall forward such application to the State Government for prior permission to such conversion. The State Government may if it is satisfied and after recording reasons in writing either grant or deny such prior permission for such conversion.

(3) The District Collector shall, after obtaining such permission of the State Government, convert such Occupancy Class-II or leasehold lands mentioned in sub-rule (1) into Occupancy Class-I land and the conversion premium and the conditions mentioned in Table in rule 3, shall apply to such conversion.".
