अधिसूचना

क्रमांक म.रा.र.वि.म./आदेश/७४७/२०२६.----ज्याअर्थी, महाराष्ट्र शासन, नगर विकास विभागाकडील वेळोवेळी निर्गमित शासन निर्णयान्वये महाराष्ट्र राज्य रस्ते विकास महामंडळ (यात यापुढे उक्त महामंडळ म्हणून उल्लेख करण्यात येईल) यांना सातारा जिल्ह्यातील सातारा, जावळी, महाबळेश्वर व पाटण तालुक्यातील एकूण ५२९ गावांमध्ये नवीन महाबळेश्वर गिरीस्थान क्षेत्र (यात यापुढे उक्त अधिसूचित क्षेत्र म्हणून उल्लेख करण्यात येईल) विकसित करण्यासाठी महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ चे (यात यापुढे उक्त अधिनियम म्हणून उल्लेख करण्यात येईल) कलम ४०, उपकलम (१ब) अन्वये अधिसूचित क्षेत्रासाठी विशेष नियोजन प्राधिकरण (यात यापुढे उक्त प्राधिकरण म्हणून उल्लेख करण्यात येईल) म्हणून नियुक्त करण्यात आले आहे ;

आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ५३ (८) नुसार नियोजन प्राधिकरण हे, राजपत्रातील अधिसूचनेद्वारे कलम ५३, ५४, ५५, ५६ अन्वये नियोजन प्राधिकरणाच्या अधिकारांचा वापर करण्याच्या प्रयोजनासाठी पदनिदशित अधिकारी म्हणून नियोजन प्राधिकरणाच्या एखाा अधिकायास पदनिदशित करेल व असा अधिकारी अधिसूचनेमध्ये विनिर्दिष्ट केलेल्या अशा स्थानिक क्षेत्रावर अधिकाराकरिता असेल अशी तरतूद आहे ;

आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम १५२ अन्वये नियोजन प्राधिकरणाच्या कलम ५३ अन्वयेचे अधिकार विशेष नियोजन प्राधिकरणाच्या बाबतीत उक्त महामंडळाचे उपाध्यक्ष तथा व्यवस्थापकीय संचालक यांनी वापरणेस मुभा आहे.

आता त्याअर्थी, उक्त अधिनियमाच्या कलम १५२ (४) व ५३ (८) अन्वये प्राप्त अधिकारात उक्त अधिसूचित क्षेत्रासाठी तहसीलदार तथा सहायक नियंत्रक, अनधिकृत बांधकाम निष्कासन विभाग, शिबीर कार्यालय, सातारा यांची पदनिदशित अधिकारी म्हणून पदनिदशन करण्यात येत आहे.

आता उक्त अधिसूचित क्षेत्रामधील अनधिकृत बांधकामांवर नियंत्रण मिळवण्यासाठी आणि उक्त अधिनियमाच्या कलम ५२ (१), ५२ (२) व ५३ ते ५६ अन्वये कायदेशीर कारवाई करण्यासाठी, तसेच वेगवेगळी न्यायालयीन प्रकरणे (राष्ट्रीय हरित लवादाकडील प्रकरणांसह), सातारा शिबीर कार्यालयाकडे प्राप्त होत असलेल्या सर्व तक्रारींच्या अनुषंगाने युक्तिवाद करणे, शपथपत्रे सादर करणे, अर्ज/पुरावे सादर करणे, बैठकांना उपस्थित राहण्याचे कामकाज सदर अधिकारी पार पाडतील. पदनिदशित अधिकारी हे उक्त अधिसूचित क्षेत्रामधील सर्व अनधिकृत विकासाचे शोधकाम, त्यांचे पाडकाम आणि त्यासंबंधी सर्व कायदेशीर / न्यायालयीन कार्यवाहीसाठी जबाबदार राहतील.

या विषयाबाबत यापूर्वी निर्गमित केलेले सर्व संबंधित कार्यालयीन आदेश याद्वारे रद्द करण्यात येत आहेत.

Maharashtra Regional and Town Planning Act, 1966

NOTIFICATION

No. MSRDC/Order/747/2026.– Whereas, pursuant to the Government Resolutions issued from time to time by the Urban Development Department, Government of Maharashtra, the Maharashtra State Road Development Corporation Limited (hereinafter referred to as "the said Corporation") has been appointed as the Special Planning Authority under Section 40, sub-section (1 B) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") for Development of the New Mahabaleshwar Hill Station Area (hereinafter referred to as "the said Notified Area"), comprising a total of 529 villages in Satara, Jaoli, Mahabaleshwar and Patan Talukas of Satara District ;

and whereas, as per Section 53 (8) of the said Act, the Planning Authority shall, by Notification in the Official Gazette, designate an officer to be the Designated Officer for the purposes of exercise of the powers of the Planning Authority under Sections 53, 54, 55 and 56 of the said Act, and such officer shall have jurisdiction over the local area specified in such Notification ;

and whereas, under Section 152 of the said Act, in the case of a Special Planning Authority, the powers of the Planning Authority under Section 53 of the said Act may be exercised by the Vice-Chairman and Managing Director of the said Corporation.

Now therefore, in exercise of the powers conferred under Sections 152 (4) and 53 (8) of the said Act, the Tahasildar and Assistant Controller, Unauthorized Construction Removal Department, Camp Office, Satara, is hereby appointed as the Designated Officer for the said Notified Area.

Now, for the purpose of controlling unauthorized constructions within the said Notified Area and for initiating legal action under Sections 52 (1), 52 (2) and 53 to 56 of the said Act, as well as for dealing with various court cases (including matters before the National Green Tribunal), all complaints received at the Satara Camp Office, including appearing before courts, presenting arguments, filing affidavits, applications and evidence, and attending meetings, shall be carried out by the said Designated Officer.

The Designated Officer shall be responsible for detection of all unauthorized development within the said Notified Area, demolition thereof, and for undertaking all related legal and judicial proceedings.

All previous office orders issued in this regard are hereby cancelled.
