Whereas, in the Revised Development Plan of Nagpur City, the Government has approved the lapsing of Reservation of "Site No. MNW-39-High School" on the land bearing Khasara No.22/4 area admeasuring 0.0992 Hectare of Mouje Zingabai Takali under section 127(2) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) vide Urban Development Department's Order No.TPS-2419-2822-CR-22-2021-UD-9, dated the 06th October, 2022 (hereinafter referred to as "the said Order");

And whereas, some corrections are required to be made in the Para No. 2 and in the Annexure in the said Order;

आणि ज्याअर्थी, उक्त विकास योजनेमध्ये, मौजे चिंचभवन येथील खसरा क्र. २७ (भाग) व २८/१-३ मधील अंदाजे ५.०२ हेक्टर जमीन (यापुढे " उक्त जमीन "" असे संबोधिले आहे) " आरक्षण क्र.एमएस-११३-उद्यान " (भागश:) करीता (यापुढे " उक्त आरक्षण " असे संबोधिले आहे) आरक्षित असुन उक्त आरक्षणाचे समूचित प्राधिकरण नागपूर महानगरपालिका, नागपूर हे आहेत (यापुढे " उक्त प्राधिकरण " असे संबोधिले आहे);

आणि ज्याअर्थी, उक्त प्राधिकरणाने, उक्त जमीन, उक्त विकास योजना अंमलात आल्याच्या दिनांकापासून दहा वर्षाच्या कालावधीमध्ये संपादन केलेली नाही;

आणि ज्याअर्थी, उक्त जमिनीपैकी, खालील नमूद परिशिष्टामध्ये वर्णन केलेल्या उक्त जमिनीच्या मालकानी, उक्त अधिनियमाचे कलम १२७ चे उप कलम (१) नुसार, समूचित प्राधिकरण यांचेवर दिनांक २४ सप्टेंबर, २०१३ रोजी सूचना (यापुढे " उक्त सूचना " असे संबोधिले आहे) बजावून उक्त जागा, उक्त प्राधिकरणाने विहित कालावधीत संपादन केली नसल्याचे कळविले होते;

आणि ज्याअर्थी, वरीलप्रमाणे उक्त अधिनियमाचे कलम १२७ चे उप कलम (१) नुसार, उक्त सूचना बजावल्यानंतरही उक्त प्राधिकरणाने विहित कालावधीत उक्त जमिन संपादन केली नाही;

आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम १२७ चे उप कलम (२) नुसार, उक्त विकास योजनेमधील उक्त आरक्षणापैकी, उक्त जमिनीपुरते आरक्षण व्यपगत झाल्याबाबत आदेश निर्गमित करणे आवश्यक आहे;

आणि ज्याअर्थी, उक्त जमिनीच्या मालकांनी मा. मुंबई उच्च न्यायालय, नागपूर खंडपीठ येथे रिट याचिका क्र. २२९०/२०२७ दाखल केली असून सदर प्रकरणी मा. उच्च न्यायालयाने दि. ०३ डिसेंबर, २०२४ रोजी अंतिम निर्णय पारीत केलेला आहे.

आणि ज्याअर्थी, उक्त सूचना बजावल्यापासून, उक्त समूचित प्राधिकरणाने विहित कालावधीत उक्त जमीन संपादन केली नाही अथवा उक्त जमीन संपादन करण्यासंबंधीची, उक्त अधिनियमाचे कलम १२६ (४) सह भूसंपादन, पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा आणि पारदर्शकतेचा हक्क अधिनियम, २०१३ चे कलम १९ अन्वयेची भूसंपादनाची अधिसूचना विहित कालावधीत प्रसिध्द केलेली नाही. त्यामुळे या परिस्थितीत उक्त अधिनियमाचे कलम १२७(१) मधील तरतुदीनुसार, उक्त जमिनीवरील उक्त आरक्षण व्यपगत झाले असल्याचे शासनाचे मत झाले आहे;

आता, त्याअर्थी, उक्त अधिनियमाचे कलम १२७ (२) नुसार प्राप्त अधिकारात राज्य शासन, उक्त विकास योजनेतील, मौजे चिंचभवन, ता. जि. नागपूर मधील खसरा क्र. २७ व २८/१-३ मधील, खालील परिशिष्टात नमूद केल्यानुसार ५.०२ हेक्टर क्षेत्रावरील " आरक्षण क्र. एमएस - ११३ - उद्यान " (भागश:) हे आरक्षण व्यपगत झाल्याचे अधिसूचित करीत आहे व अशाप्रकारे उक्त आरक्षणातून मुक्त झालेली जमीन, संबंधित जमीनमालकास उक्त विकास योजनेतील लगतच्या अनुज्ञेय भूवापराप्रमाणे अन्यथा अनुज्ञेय असलेल्या विकासाकरीता उपलब्ध होईल;

ORDER

No. TPS-2425-329-C.R.93-2025-UD-9.—

Whereas, Revised Development Plan of Nagpur City has been partly sanctioned by the Government vide Urban Development Department's Notification No.TPS-2496-2643-CR-300-(A)-97-UD-9, dated the 07th January, 2000 and finally sanctioned vide Notification No.TPS-2400-1628-CR-200-2000-UD-9, dated the 10th September, 2001 & has come into force with effect from dated the 01st March, 2000 & 21st September, 2001 respectively (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");

And whereas, in the said Development Plan, the land admeasuring 5.02 hectare, bearing Khasara Nos. 27 & 28/1-3 of Mouja Chinchbhawan (hereinafter referred to as "the said Land"); is reserved as "Site No. MS-113-Park" (hereinafter referred to as "the said Reservation"); and the Appropriate Authority for the said Reservation is Nagpur Municipal Corporation (hereinafter referred to as "the said Appropriate Authority");

And whereas, the said Land has not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force;

And whereas, the owner of the said Land more particularly described in Schedule appended hereto, had served a notice dated the 24th September, 2013 under section 127 (1) of the said Act (hereinafter referred to as "the said Notice"); to the said Appropriate Authority, informing that the said Land has not been acquired by the said authority, within the stipulated period;

And whereas, even after service of the said Notice as aforesaid, the said Land has not been acquired within a stipulated period from the date of the service of the said Notice under sub-secton (1) of section 127 of the said Act, by the said Appropriate Authority;

And whereas, it is accordingly expedient to notify that the said Reservation on the said Land, has lapsed under sub-section (2) of section 127 of the said Act, from the said Development Plan;

And whereas, the owners of the said Land have filed Writ Petition No. 2290/2017 before the Hon'ble Bombay High Court, Nagpur Bench, and the final order is passed on dated the 03rd December, 2024 by the Hon'ble High Court;

And whereas, it is observed that, the said Land had neither been acquired, within prescribed time period from the date of service of Notices, nor notification of land acquisition required under section 126 (4) of the said Act, read with section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, been publised within prescribed time period by the said Appropriate Authority and in consequence thereof, the Government of Maharashtra is of opinion that, the said Reservation on the said Land stands lapsed as per the provisions of section 127 (1) of the said Act;

Now, therefore, in exercise of the powers conferred by Sub-section (2) of section 127 of the said Act, and of all other powers enabling it in that behalf, the Government of Maharashtra, as mentioned in the Schedulule below, hereby notifies that, the said Reservation i.e. "Site No. MS-113-Park" (Partly) as specified in the said Development Plan stands lapsed to the extent of area admeasuring 5.02 Hectare bearing Khasara Nos. 27 & 28/1-3 of Mouja Chinchbhawan, Tal., Dist. Nagpur and the area so released will be available to the owners for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan.

आणि ज्याअर्थी, उक्त विकास योजनेत, मौजे सिताबर्डी येथील नगर भूमापन क्र. २४२२, २४०८, २३१०, २४०९, २४०७, २४०६, २४०४, २४०३ व २४०२ मधील काही जागा (यापुढे " उक्त जमीन- १ " असे संबोधले आहे) महाराष्ट्र राज्य मार्ग परिवहन महामंडळ (MSRTC) व मध्य प्रदेश राज्य मार्ग परिवहन महामंडळ (MPSRTC) याकरिता नामनिर्देशित असून नेहरु मॉडेल हायस्कुलची जागा (यापुढे " उक्त जमीन - २ " असे संबोधले आहे) सार्वजनिक / निमसार्वजनिक विभागात समाविष्ट आहे;

आणि ज्याअर्थी, मा. मुंबई उच्च न्यायालय, नागपूर खंडपीठ, नागपूर येथे दाखल रिट याचिका क्र.२७५६/२०२२ मधील दिनांक २७ फेब्रुवारी, २०२५ रोजीच्या निर्णयानुसार, नागपूर महानगरपालिकेने (यापुढे " उक्त नियोजन प्राधिकरण " असे संबोधले आहे) उक्त जमीन - १ चा विद्यमान वापर बदलून तसेच उक्त जमीन - २ सार्वजनिक निमसार्वजनिक विभागातून वगळून वाणिज्य विभागात समाविष्ट करण्याचे ठरवून, त्याअनुषंगाने, उक्त अधिनियमाचे कलम ३७ चे उप कलम (१) मध्ये नमूद वैधानिक कार्यवाही पूर्ण करुन त्यानुसार फेरबदलाचा प्रस्ताव दिनांक ०५ मे, २०२५ रोजीच्या पत्रान्वये अंतिम मंजुरीसाठी शासनास सादर केलेला आहे (यापुढे " उक्त फेरबदल प्रस्ताव " असे संबोधले आहे);

आणि ज्याअर्थी, आवश्यक त्या चौकशीनंतर व संचालक, नगर रचना, महाराष्ट्र राज्य, पुणे यांचा सल्ला घेतल्यानंतर, उक्त फेरबदल प्रस्ताव काही बदलांसह व अटींसह मान्य करावा, असे राज्य शासनाचे मत झाले आहे;

आता, त्याअर्थी, उक्त अधिनियमाचे कलम ३७(२) अन्वये व त्या अनुषंगाने असलेल्या इतर अधिकारांचा वापर करुन शासन उक्त विकास योजनेतील उक्त फेरबदलास काही बदलांसह व अटींसह मान्यता देत आहे, आणि त्यासाठी उक्त विकास योजना मंजुरीची अधिसूचना सुधारित करण्यात येत आहे;

" उक्त विकास योजना मंजुरीच्या अधिसूचनेच्या फेरबदल सुचीतील शेवटच्या नोंदीनंतर पुढील नव्या नोंदीचा समावेश करण्यात येत आहे ."

" मौजे सिताबर्डी येथील नगर भूमापन क्र. २४२२, २४०८, २३१०, २४०९, २४०७, २४०६, २४०४, २४०३ व २४०२ मधील, महाराष्ट्र राज्य मार्ग परिवहन महामंडळ (MSRTC) व मध्य प्रदेश राज्य मार्ग परिवहन महामंडळ (MPSRTC) म्हणून नामनिर्देशित केलेल्या जागेचा विद्यमान वापर बदलण्यात येत आहे तसेच, नेहरु मॉडेल हायस्कुलची जागा सार्वजनिक / निमसार्वजनिक विभागातून वगळण्यात येत असून, मुक्त झालेल्या जागा, खालील अटींच्या अधिन राहून, नकाशात दर्शविल्यानुसार, " मल्टी मॉडेल ट्रान्सपोर्ट हब " म्हणून दर्शविण्यात येत आहेत.

अट क्र. १ - मंजूर फेरबदल प्रस्तावामधील, संरक्षण विभागाच्या समाविष्ट असलेल्या जागेकरीता संरक्षण विभागाचे ना हरकत प्रमाणपत्र प्राप्त करुन घेणे आवश्यक राहील.

अट क्र. २ - मंजूर फेरबदल प्रस्तावामधील, मध्य प्रदेश राज्य मार्ग परिवहन महामंडळ (MPSRTC) म्हणून नामनिर्देशन असलेल्या जागेकरीता . मा. उच्च न्यायालयात दाखल रिट याचिका क्र.६०९/२०१९ मधील मा. न्यायालयाच्या निर्णयाच्या अधिन राहून कार्यवाही करणे आवश्यक राहील.

अट क्र. ३ - मंजूर फेरबदल प्रस्तावामधील, महाराष्ट्र राज्य मार्ग परिवहन महामंडळाच्या व रेल्वेच्या जागांकरीता महाराष्ट्र राज्य मार्ग परिवहन महामंडळ व रेल्वे विभागाचे ना हरकत प्रमाणपत्र प्राप्त करुन घेणे आवश्यक राहील. "महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, मार्च ५-११, २०२६/फाल्गुन १४-२०, शके १९४७ ७ टीप - (क) प्रस्तुतची अधिसूचना, उपरोक्त मंजूर फेरबदल दर्शविणाया विकास योजना भाग नकाशाच्या प्रतीसह, आयुक्त, नागपूर महानगरपालिका, नागपूर यांच्या कार्यालयात कामकाजाच्या दिवशी कार्यालयीन वेळेत नागरिकांच्या अवलोकनार्थ एक महिन्याच्या कालावधीसाठी उपलब्ध राहील.

Whereas, Revised Development Plan of Nagpur has been partly sanctioned by the Government in Urban Development Department vide Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated the 07th January, 2000 and has come into force with effect from the 1st March, 2000 and the Republished Development Plan of Excluded Parts of substantial nature modifications, has been sanctioned by the Government in Urban Development Department vide Notification No. TPS-2400-1638-CR-200-2000-UD-9, dated the 10th September, 2001 and has come into force with effect from the 21st September, 2001 (hereinafter referred to as "the said Development Plan") under section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act"); And whereas, in the said Development Plan, some of the land bearing City Survey Nos.2422, 2408, 2310, 2409, 2407, 2406, 2404, 2403 & 2402 of Mauje Sitabuldi (hereinafter referred to as "the said Land-1") is designated as Maharashtra State Road Transport Corporation (MSRTC) and Madhya Pradesh State Road Transport Corporation (MPSRTC) and the land of Nehru Model High School (hereinafter referred to as "the said Land-2") is included in Public-Semi Public Zone;

And whereas, in respect of the decision of the Hon'ble Bombay High Court. Nagpur Bench, Nagpur, in Writ Petition No. 2756-2022, dated the 27th February, 2025, the Nagpur Municipal Corporation being a Planning Authority, has decided to after following the legal procedure under sub-section (1) of Section 37 of the said Act, has submitted a proposal for modification in the said Development Plan so as to change the existing user of the said Land -1 and to delete the said Land -2 from Public-Semi Public Zone and to include the lands so released in Commercial Zone, to the Government vide it's letter dated the 05th May, 2025 (hereinafter referred to as "the said Proposed Modification");

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the said Proposed Modification should be sanctioned with some changes and some conditions;

Now, therefore, in exercise of the powers conferred under sub-section (2) of section 37 of the said Act and all other powers enabling it in that behalf, the State Government hereby sanctions the said Proposed Modification to the said Land -1 & the said Land-2 with some changes and some conditions, as described below-८ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, मार्च ५-११, २०२६/फाल्गुन १४-२०, शके १९४७ "In the Schedule of Modifications appended with the said Notification after the last entry, the following new entry shall be inserted viz;"

"The existing user of some area of the land bearing City Survey Nos. 2422, 2408, 2310, 2409, 2407, 2406, 2404, 2403 & 2402 of Mauje Sitabaldi, shown as Maharashtra State Road Transport Corporation (MSRTC) and Madhya Pradesh State Road Transport Corporation (MPSRTC) is changed and the land of Nehru Model High School is deleted from Public-Semi Public Zone and the lands so released are shown as "Multi Model Transport Hub", as shown on plan, subject to following conditions-

Condition No. 1 – It is necessary to obtain a No Objection Certificate from Department of Defence for the area of Defence Department, included in the sanctioned modification proposal.

Condition No. 2 – It is necessary to take action subject to the decision of the Hon'ble High Court in Writ Petition No.609/2019 in respect of the land designated as Madhya Pradesh State Road Transport Corporation (MPSRTC).

Condition No. 3 – It is necessary to obtain a No Objection Certificate from Maharashtra State Road Transport Corporation (MSRTC) and Department of the Railways, in respect of the land of Maharashtra State Road Transport Corporation (MPSRTC) and the department of the Railways."

Note - (A) A copy of the part plan of the aforesaid sanctioned modification shall be available for public inspection in the office of the Commissioner, Nagpur Municipal Corporation, Nagpur, during office hours on all working days for a period of one month.

And whereas, in the said Development Plan, land bearing City Survey No. 178/2, Sheet No. 196, situated at Mauje Nagpur, is included in the existing lndustrial Zone (Empress Mill) (hereinafter referred to as "the said Land");

And whereas, the Nagpur Municipal Corporation, Nagpur (hereinafter referred to as "the said Planning Authority") vide its General Body Resolution No. 187, dated the 23rd February, 2004 has resolved to proposed 12 Mt, wide Development Plan Road in the said Land, as per the provisions of sub-section (1) of section 37 of the said Act, after following the legal procedure laid down under the said Act, (hereinafter referred to as "the Proposed Modification") the Planning Authority has submitted the said Proposal of Modification to the Government for sanction;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the said Proposed Modification should be sanctioned ;

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification and for that purpose amends the aforesaid Notification dated the 7th January, 2000 as follows;

"In the Schedule of Modifications appended to the above said Notification dated the 7th January, 2000 sanctioning the said Development Plan, the follwing new entry shall be added after the last entry-"

"The 12 Mt. wide Development Plan Road is proposed in the land bearing Survey No. 178/2, Sheet No. 196 at Mauje Nagpur, starting from the existing road in front of Marwadi Chawl to the road from Ganesh Chowk to Gandhi Sagar Road, as shown on the Plan."

A copy of the part plan of the aforesaid sanctioned modification shall be available for public inspection in the office of the Commissioner, Nagpur Municipal Corporation, Nagpur during office hours on all working days for a period of one month.

आणि ज्याअर्थी, उक्त आरक्षित जमिनीपैकी, सोबतच्या परिशिष्टामध्ये वर्णन केलेल्या खसरा क्र.१६/१, क्षेत्र १.२६ हेक्टर (यापुढे " उक्त जमीन " असे संबोधिले आहे) या जागेच्या मालकांनी उक्त अधिनियमाचे कलम १२७ चे उप-कलम (१) नुसार, समूचित प्राधिकरण यांचेवर दिनांक १६ सप्टेंबर, २०२२ रोजी सूचना (यापुढे " उक्त सूचना " असे संबोधिले आहे) बजावलेली आहे;

आणि ज्याअर्थी, वरीलप्रमाणे उक्त अधिनियमाचे कलम १२७ चे उप-कलम (१) नुसार, उक्त सूचना बजावल्यानंतरही उक्त प्राधिकरणाने विहित कालावधीत उक्त जमीन संपादन केली नसल्याचे दिनांक ०९ जून, २०२५ च्या पत्रान्वये कळविले आहे;

आणि ज्याअर्थी, मा. उच्च न्यायालयाने, उक्त जागेच्या दाखल केलेल्या रिट याचिका क्र. ६२३९/२०२४ मध्ये दिनांक ०७ मे, २०२५ रोजीच्या आदेशान्वये उक्त विकास योजनेतील उक्त जागेपुरते, उक्त अधिनियमाचे कलम १२७ मधील तरतुदीनुसार व्यपगत झाल्याचे आदेश पारित केले आहेत;

आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम १२७ चे उप-कलम (२) नुसार उक्त विकास योजनेतील आरक्षण उक्त जागेपुरते व्यपगत झाल्याबाबत आदेश निर्गमित करणे आवश्यक झाले आहे;

आता, त्याअर्थी, उक्त अधिनियमाचे कलम १२७ चे उप-कलम (२) नुसार प्राप्त अधिकारात राज्य शासन, नागपूर शहराच्या विकास योजनेमधील उक्त आरक्षणामधील उक्त जमिनीपुरते आरक्षण व्यपगत झाल्याचे अधिसूचित करीत आहे व अशा प्रकारे मुक्त झालेली जमीन विकास योजनेतील लगतच्या अनुज्ञेय भूवापरा प्रमाणे जमीन मालकास विकासाकरीता मा. उच्च न्यायालयाने घातलेल्या अटीस अधिन राहून उपलब्ध होईल.

(१) प्रस्तुत आदेशान्वये, आरक्षणातून व्यपगत झालेले क्षेत्र दर्शविणाया भाग नकाशाची प्रत सभापती, नागपूर सुधार प्रन्यास, नागपूर यांच्या कार्यालयात कार्यालयीन वेळेत नागरिकांच्या अवलोकनार्थ एक महिन्यापर्यंत ठेवण्यात आली आहे.

Whereas, Revised Development Plan of Nagpur City has been partly sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated 07th January, 2000 and finally sanctioned vide Notification No. TPS-2400-1628-CR-200-2000-UD-9, dated 10th September, 2001 & has come into force with effect from 1st March, 2000 & 21st September, 2001 respectively (hereinafter referred to as "the said Development Plan") under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act"); And whereas, in the said Development Plan, the land bearing Khasara No.16/1 area admeasuring 1.26 Hectare of Mouja Wathoda (hereinafter referred to as "the said Reserved Land") is reserved as "Site No.ME-59-Park" (hereinafter referred to as "the said Reservation") and the Appropriate Authority for the said reservation is Nagpur Improvement Trust, Nagpur (hereinafter referred to as "said Authority");

And whereas, the said land has not been acquired by the said authority within ten years from the date on which the said Development Plan came into force;

And whereas, the owner of the land bearing Khasara No.16/1 of Mouje Wathoda admeasuring 1.26 Hectare (hereinafter referred to as "the said Land") more particularly described in Schedule appended hereto, out of the said reserved land, had issued a notice dated the 16th September, 2022 under section 127(1) of the said Act (hereinafter referred to as "the said Notice") to the said authority;

And whereas, even after service of the said Notice as aforesaid, the said land has not been acquired within a stipulated period from the date of the service of the said Notice under sub-section (1) of section 127 of the said Act, intimated by the said authority vide its letter dated 09th June, 2025;

And whereas, Hon'ble High Court in Writ Petition No.6239/2024 file by the owner of the said land, vide its order dated the 07th May, 2025 held that the said reservation to the extend of the said land stands lapsed, U/s 127 of the said Act.;

And whereas, Now, it becomes expedient to notify by an order under section 127 (2) of the said Act that the said Reservation on the said Land in the said Development Plan has been lapsed;

Now, therefore, in exercise of the powers conferred by sub-section (2) of section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby Notifies that, the said reservation on the said land stands lapsed and the land so released shall be available to the landowner for the purpose of Development as otherwise permissible in the case of adjacent land under the Development Plan subject to the condition by Hon'ble High Court;
