क्रमंांका मंुद्रांांका २०२५/. क्र. २४६/मंुद्रांांका-२.— मंहुाराष्ट्र मंुद्रांांका अदिदिनांयमं (१९५८ चा ६०) (याता यापुढे ज्याचा दिनांदाेश, "उक्ता अदिदिनांयमं" असा काेला आहुे) याच्या कालमं ९ च्या खंड (अ) द्वारे दानां काेलेल्या अदिकारांचा वापुर कारूनां, मंहुाराष्ट्र शासानां, ंबई मंील मंहुानांगरपुादिलकाेच्या शाळांांमंील, बालवाड्यांांमंील जनांदिहुतार्थग तासाे कारणे आवाश्यका असाल्याचाी खंात्राी पुटल्यानांे, याद्वारे, मंु मंुले वा सावागजदिनांका रुग्णेालयांताील दिताकाूल पुरिरस्थिर्थताीशी सामंनांा कारणेारी काुटं बे यांच्याकारिरता आपुत्ती दिनांवारणे काये कारण्याच्या योजनांार्थग, घोडपुदाेवा येर्थील फ्रेरे लँड इटेट येर्थे स्थिर्थता असालेल्या मंाझगावा दिवाभागाच्या नांगर भाूमंापुनां क्र. ४/७४८ या २८५२ इताक्या चाौरसा मंीटर ंबई बंदार ादिकारणे आदिणे एचाकाेएमं चाॅरीटेबल फाउडेशनां यांच्यामंध्ये कारण्याता क्षेत्राफळांाच्या आरआर क्र. २०६० या जदिमंनांीच्या बाबताीता मंु आलेल्या भाडेपुट्ट्याच्या सांलेखंावार, उक्ता अदिदिनांयमंासा जोडलेल्या अनांुसाूचाी-एकाच्या अनांुच्छेदा ३६ अन्वाये अन्यर्था आकारण्यायोग्य असालेले सांपुूणेग मंुद्रांांका शुल्का, पुढेील शतांसा अीनां राहुूनां, मंाफ कारीता आहुे :—
शाती.-
(१) हुा आदाेश, महाराष्ट्र शासन राजपत्रा त दिसाद्ध काेल्याच्या तारखंेपुूवाी पुट्टाकारानांे/पुट्टाेदारानांे आीचा मंुद्रांांका शुल्का दानां काेलेले असाेल त्या बाबताीता, काोणेताहुी पुरतावा दाेण्याता येणेार नांाहुी.
(२) जर या आदाेशान्वाये, मंुद्रांांका शुल्काताील साूट दिमंळांवाणेारा काोणेताहुी पुट्टाकार/पुट्टाेदार, उक्ता योजनां दिकांवा उक्ता योजनांाचाी उदिष्टे पुूणेग कारण्यासा दिनांष्फळां ठरला तार, ताो, जणेू काहुी, मंुद्रांांका शुल्काता साुरुवाताीपुासाूनांचा काोणेताीहुी साूट दिदालेली नांव्हुताी असाे सामंजूनां, उक्ता अदिदिनांयमंानांुसार, सांपुूणेग मंुद्रांांका शुल्का वा शाताी दानां कारण्यासा पुात्रा असाेल.

No. Mudrank-2025/C.R.No.246/Mudrank-2.—In exercise of the powers conferred by clause (a) of section 9 of the Maharashtra Stamp Act (LX of 1958) (hereinafter referred to as "the said Act"), the Government of Maharashtra, being satisfied that it is necessary to do so in the public interest, hereby remits the stamp duty in whole, as otherwise chargeable under Article 36 of Schedule-I appended to the said Act, on the instrument of lease, executed between the Mumbai Port Authority and HKM Charitable Foundation in respect of the land bearing RR No.2060 admeasuring 2852 Sq. Mtrs. bearing C.S.No.4/748 of Mazgaon division situated at Frere Land Estate at Ghodapdeo for the purpose to cater to disaster relief efforts, children in Municipal Schools, Balwadis and underprivileged families in the public hospitals in Mumbai, subject to the following conditions, namely :—
Conditions .—
(1) No refund shall be granted where the stamp duty has already been paid by the Lessor/ Lessee prior to the date of publication of this Order in the Maharashtra Government Gazette.
(2) If any Lessor/Lessee availing remission of the stamp duty under this order fails to fulfil the purpose or objectives of the said purpose, the shall be liable to pay the whole stamp duty and penalty as per said Act, as if there was no remission of stamp duty from the beginning.
