आविण ज्याअर्थी, उक्त विनांयमालीच्या विविनांयम क्र. ४(ii) अन्ये ांद्रे-कुलाव संकुलातील र्चई क्षेत्रा विनांेशांक (Aggregate FSI) हा संबंवित जमीनां ापीराच्या एकूण विकासयोग्य क्षेत्रासाठी लागू असूनां विनांव्ळू भाूखंडीाराील कमाल र्चई क्षेत्रा विनांेशांक हा ाविकराणाच्या ास्तंशास्त्राीय विनांयंत्राणानांसारा लागू राहाील असे नांमू केले आहाे ;
आविण ज्याअर्थी, शासनां नांगराविकास विभागाच्या विनांांक २९ ऑगस् २०२२ राोजीच्या शासनां विनांणवय क्र.एमआराडी-३३२२/ .क्र.८३/नांवि-७ अन्ये ांद्रे-कुलाव संकुलातील ाविकराणाच्या भाूखंडीारा अवितरिराक्त र्चई क्षेत्रा विनांेशांक अविमूल्यार्चे उविर्चत सूसंत्राीकराण कराण्याकरिराता अभ्यास कराण्यासाठी अवितरिराक्त मंख्य सविर्च, नांगराविकास विभाग यांच्या अध्यक्षेतेखाली एक उच्र्चस्तराीय सविमती गठीत केली आहाे;

आविण ज्याअर्थी, सरा उच्र्चस्तराीय सविमतीच्या विशाफाराशाी विर्चारात घेऊनां, ांद्रे-कुलाव संकुलातील उक्त ब्लॉकमील स्तावित आंतराराष्ट्रीय वित्त व्यापीारा कंद्रेार्चा जलगतीनांे विकास हाोऊनां जास्तीत जास्त कायावलये, विनांासी सविनांका इतरा सोयी संविा यांच्या माफाफत राोजगाराच्या संी उपीलब् हाोण्यासाठी तसेर्च ांद्रे-कुलाव संकुल बृहान्मं ंबई महापीाविलकेतील इतरा क्षेत्रांमील विकासांमध्ये समानांता राहाण्याच्या ृष्ीकोनांातूनां उक्त विनांयमालीमध्ये फ़ेराबल कराण्यात आला असूनां, सरा फाेराबलास शासनां नांगराविकास विभागाकडील वि.१९/०७/२०२४ राोजीर्चे अविसूर्चनांेद्वाराे मंजंराी ेण्यात आली आहाे (ज्यार्चा उल्लेख यापींढे "उक्त अविसूर्चनांा" असा केला आहाे);
आविण ज्याअर्थी, मंख, ाऊनां ॲण्डी कंन्ट्री प्लाविनांग विडीस्तिव्हाजनां, मं ंबई महानांगरा ेशा विकास ाविकराण (MMRDA) यांर्चेकडील विनांांक २३/०५/२०२५ राोजीर्चे पीत्रा शासनां नांगराविकास विभागास ाप्त झाले असूनां, सरा पीत्रामध्ये असे नांमू केले आहाे की, "CREDAI- MCHI यांनांी विनांांक ३०/०१/२०२५ राोजीर्चे तसेर्च BKC Property Owners Association यांनांी विनांांक २३/०४/२०२५ राोजीर्चे एमएमआराडीए ला सारा केलेल्या पीत्रांद्वाराे राज्य शासनांाच्या विनांांक १९/०७/२०२४ च्या अविसूर्चनांेनांसारा बीकेसी येर्थीे अनांज्ञेय असलेल्या अवितरिराक्त बांकाम क्षेत्राच्या ापीरासाठी आश्यक असलेल्या पीाविकंगर्चे माणात ५०% सलत ेण्याबाबत विनांती केली आहाे. यासंभावत, एमएमआराडीएर्चे मत असे आहाे की, बीकेसीमील भाडीेकरू/मालमत्ता ाराकांनांा भाेडीसाणाऱ्या अडी-अडीर्चणी तसेर्च CREDAI-MCHI यांर्चे विनांांक ३०/०१/२०२५ राोजीच्या पीत्रामध्ये BKC Property Owners Association यांर्चेकडील विनांांक २३/०४/२०२५ राोजीच्या रा नांमू पीत्रांमध्ये नांमू केलेले विवि मंद्दे विर्चारात घेणे आश्यक असूनां, बीकेसीमील अवितरिराक्त बांकाम क्षेत्राच्या ापीरास ोत्साहानां ेण्यासाठी यार्चा विर्चारा कराणे आश्यक आहाे." असे नांमू केले असूनां, पीाविकंग सलती संभावतील राील विनांतीबाबत शासनांानांे योग्य ते विनांेशा ेणेबाबत, एमएमआराडीएनांे विनांती केली आहाे;
आविण ज्याअर्थी, रा नांमू स्तंस्तिस्र्थीती एमएमआराडीएर्ची विनांती विर्चारात घेता, उक्त अविसूर्चनांा वि.१९/०७/२०२४ नांसारा अनांज्ञेय असलेल्या अवितरिराक्त बांकाम क्षेत्रार्चा ापीरा शाक्य हाोण्याच्या ृष्ीनांे, त्यानांषंगानांे सावजविनांक विहातार्चे ृस्तिष्नांे उक्त विनांयमालीर्चे वत कराण्यासाठी सोबत जोडीलेल्या पीरिराविशाष्ामध्ये शावविल्यानांसारा उक्त विविनांयम ४(ii) मील खंडी (A) मध्ये नांीनां तरातू अंतभाू विनांयमालीमध्ये संाराणा कराणे आश्यक आहाे, असे शासनां नांगराविकास विभागार्चे मत झाले आहाे (ज्यार्चा उल्लेख यापींढे "स्तावित फ़ेराबल" असा केला आहाे).
महाराष्ट्र शासन राजपत्र असाधारण भाग एक–मध्य उप-विभाग, एवपल २७, २०२६/िैशाख ७, शके १९४८ ३ंबई यांर्चेकडीे इन्सा हामंस, ई-ब्लॉक, आझा मैानां, महापीाविलका मागव, मं आविण त्याअर्थी, उपीराोक्त पीरिरास्तिस्र्थीती आविण स्तंस्तिस्र्थीती विर्चारात घेता आविण उक्त अविविनांयमाच्या कलम ३७ च्या पीो-कलम (१कक) अन्ये ाप्त अविकारा आविण त्या संभावतील सव शाक्तंर्चा ापीरा करूनां, शासनां याद्वाराे स्तावित फाेराबलाविषयी उक्त अविविनांयमाच्या कलम ३७, पीो-कलम (१कक) र्चे खंडी(क) नांसारा कोणत्याहाी व्यक्तीकडीूनां हाराकती / सूर्चनांा मागविण्यासाठी तसेर्च संभाव्य बावित हाोणाऱ्या व्यक्तंच्या माविहातीसाठी सरा सूर्चनांा विसद्ध कराीत आहाे. शासनांाकडीूनां अ़सेहाी कळूविणेत येत आहाे की, खालील पीरिराविशाष्ात नांमू स्तावित फाेराबलाविषयी कोणत्याहाी हाराकती/ सूर्चनांा महाराष्ट्र शासन राजपत्रात सरा सूर्चनांा विसद्ध झाल्याच्या विनांांकापीासूनां एक मविहान्याच्या आत उपी संर्चालक, नांगरारार्चनांा, बृहान्मं ंबई ४०० ००१ या कायावलयार्चे पीत्त्यारा पीाठीविण्यात याव्यात. सरा ाप्त हाराकती / सूर्चनांांरा संनांाणी ेऊनां तसेर्च लागू असेल त्यामाणे उक्त महानांगरापीाविलकेर्चे म्हाणणे घेऊनां त्याराील अहाल शासनांास सारा कराण्यासाठी उपी संर्चालक, नांगरारार्चनांा, बृहान्मं ंबई यांनांा शासनांार्चे तीनांे "अविकाराी" म्हाणूनां ाविकृत कराण्यात येत असूनां त्यांच्याकडीे सराच्या कालाीत ाप्त हाोणाऱ्या हाराकती/सूर्चनांा यारा उक्त अविविनांयमाच्या कलम ३७ च्या पीो-कलम (१कक) अन्ये कायवाहाी कराण्यात येईल;
शासनां याद्वाराे उक्त अविविनांयमार्चे कलम १५४(१) अन्ये एमएमआराडीएला विनांेशा ेत आहाे की, उक्त अविविनांयमार्चे कलम ३७(१कक) र्चे उपी-कलम (ग) अन्ये स्तावित फाेराबलास शासनां मान्यता लंविबत असेपीयंत स्तावित फाेराबल लगोलग अंमलात येईल.

New Note (iv) is proposed to be inserted under Clause (A) of Regulation 4(ii) of BKC Notified Area Development Control Regulations as follows :—
In case additional construction is proposed in the previously developed / under construction buildings in 'E' and 'G' blocks as per additional Built-Up area permissible under this regulation wherein clearly demonstrable hardship is caused in proposing parking area as per the provisions of the Development Control and Promotion Regulations for such additional built-up area, then in such cases, with prior approval of Government, the Metropolitan Commissioner, MMRDA is empowered to grant upto 50% relaxation in the required parking to be provided for such additional built-up area only. Provided that, in any circumstances, the parking area shown while approving the plans before coming into force of notification dated 24/07/2024 shall not be reduced.
उक्त अविविनांयमार्चे कलम ३७(१कक) अन्ये सरा फाेराबलार्ची सूर्चनांा महाराष्ट्र शासनांाच्या www.maharashtra.gov.in (काया/विनांयम) या ेबसाईरा ेखील विसद्ध कराण्यात याी.

Notice
Maharashtra regional and town Planning act, 1966.
No. TPB-4323/C.R.139/2023/UD-11.—Whereas, the Government in the Urban Development, Public Health and Housing Department vide Notification No. BKR 1177/262/UD-5, dated 7th March, 1977 has appointed the Mumbai Metropolitan Region Development Authority established under the Mumbai Metropolitan Region Development Authority Act, 1974(Mah.IV of 1975) to be the Special Planning Authority (hereafter referred to as "the Authority") for the Bandra-Kurla Complex Notified Area (hereafter referred to by its acronym as "BKC") under clause (C) of sub-section (1) of section 40 of Maharashtra Regional and Town Planning Act, 1966 (hereafter referred to as "the said Act"); And whereas, in exercise of its powers under sub-section(1) of section 115 as substituted by subsection (3) of section 40 of the said Act, the Government in the Urban Development, Public Health and Housing Department vide Notification No. BKR 1177/262/UD-5, dated 9th April, 1979 approved the Planning Proposals submitted by the Authority for the development of lands in the Bandra-Kurla Complex Notified Area together with the Bandra-Kurla Complex Notified Area Development Control Regulations, 1979 (hereafter referred to as " the said Regulation") ;
And whereas, in exercise of its powers under sub-section (2) of section 37 of the said Act, the Government of Maharashtra vide Notification No.TPB-4307/2594/2617/CR-65/2008/UD-11, dated 2nd May,2008 sanctioned the modification in Regulation 4(ii) of the said Regulation regarding increase in Floor Space Index(FSI) from 2.00 to 4.00 for Commercial purposes and from 1.50 to 3.00 for Residential purposes in 'G' Block of BKC;
And whereas, in exercise of its powers under sub-section (2) of section 37 of the said Act, the Government of Maharashtra vide Notification No.TPB-4308/3531/2617/CR-29/2009/UD-11, dated 31st August, 2009 sanctioned the modification in Regulation 4(ii) of the said Regulation regarding increase in FSI from 2.00 to 4.00 for Commercial purposes and from 1.50 to 3.00 for Residential purposes in 'E' Block of BKC except areas under CRZ for which the sanctioned DCR as on 19/02/1991 are applicable;
And whereas, in exercise of its powers under sub-section (2) of section 37 of the said Act, the Government of Maharashtra vide Notification No.TPB-4313/244/CR-158/13/UD-11, dated 23rd August,2015 further sanctioned the modification in Regulation 4(ii) of the said Regulation regarding increase in FSI from 3.0 to 4.00 for Residential purposes in 'G' Block of BKC;
And whereas, as per the said Regulation the values of Floor Space Index (FSI) in Bandra-Kurla Complex Notified Area are the values of the aggregate FSI in respect of the total buildable area in a block of plots in the respective zone and the maximum permissible floor space in any plot shall be in accordance with the Architectural Control Drawings for that plot prepared by the Authority;
And whereas, the Government in Urban Development Department vide G.R. No.MRD-3322/ CR-83/UD-7 dated 29th August,2022 constituted a High-Level Committee under the Chairmanship of Additional Chief Secretary, Urban Development Department (hereafter referred to as " the said H. L. Committee") to study and submit report on rationalization of premium rates for allotment of Additional FSI on Authority's Lands in BKC;
And whereas, the said High-Level Committee held its meetings on 23rd November 2022, 12th January 2023 and 12th May, 2023 to deliberate various issues pertaining to the Additional FSI in BKC and submitted the final report to the Government of Maharashtra on 10th July, 2023 wherein the High Level Committee recommended amalgamation of Block 'E' & 'G' and Global FSI 4.0 for the saidमहाराष्ट्र शासन राजपत्र असाधारण भाग एक–मध्य उप-विभाग, एवपल २७, २०२६/िैशाख ७, शके १९४८ ५ block to further promote development of International Finance and Business Centre(IFBC) as most of the plots in the said block are allotted and Additional FSI is required for facilitating competitive bidding for development of balance plots and encouraging redevelopment/reconstruction of existing plots through promotional rates of premium;
And whereas, after considering the recommendations of the High Level Committee, in order to promote the development of International Finance and Business Centre in BKC and to bring parity between the developments in BKC and Brihanmumbai Municipal Corporation Area, Government in Urban Development Department vide notification of even number dated 19/07/2024 has sanctioned a modification proposal in the said Regulations (hereafter referred to as "the said Notification");
And whereas, Government in Urban Development Department has received a letter dated 23/05/2025 from Chief, Town and Country Planning Division, Mumbai Metropolitan Region Development Authority (MMRDA) wherein it is stated that, CREDAI- MCHI vide its letter dt.30/01/2025 and M/s. BKC Property Owners Association vide their letter dt.23/04/2025 have requested MMRDA for relaxation of 50% parking requirement for consumption of additional built up area in BKC admissible as per the State Government's Notification dated 19/07/2024. In this regard, MMRDA is of the view that the hardships faced by the lessee's/ property owners in BKC and various aspects as mentioned in CREDAI-MCHI letter dt.30/01/2025 and M/s. BKC Property Owners Association's letter dt.23/04/2025 require due consideration to promote consumption of Additional BUA in BKC." and has requested the Government to give necessary directions in respect of the above said request regarding concession in parking;
And whereas, in view of the above said facts and request of MMRDA, the Government in Urban Development Department is of the opinion that in order to make possible the utilization of the additional built up area permissible as per the said notification dated 19/07/2024, it is expedient to modify the said Regulations in the public interest, to add new proviso by new note under Clause (A) of Regulation 4 (ii) of the said Regulations as specifically described in the Schedule attached herewith (hereinafter referred to as "the Proposed Modification").
Now, therefore, after considering the above facts and circumstances and in exercise of the powers conferred by sub-section (1AA) of Section 37 of the said Act; and of all other powers enabling it in this behalf, Government hereby publishes a Notice for inviting objections/ suggestions from any persons with respect to the Proposed Modification, as required by clause (a) of sub-section (1AA) of Section 37 of the said Act, for information of all persons likely to be affected thereby. The Government is further pleased to inform that any objections/ suggestions in respect of the Proposed Modification mentioned in the Schedule attached herewith may be forwarded, before the expiry of one month from the date of publication of this Notice in the Maharashtra Government Gazette, (hereinafter referred to as "the said period") to the Deputy Director of Town Planning., Greater Mumbai, having his office at ENSA Hutments, E-Block, Azad Maidan, Mahapalika Marg, Mumbai 400 001. Any objections / suggestions, which may be received within the said period will be dealt with in accordance with the provisions of sub-section (1AA) of Section 37 of the said Act by the Deputy Director of Town Planning, Greater Mumbai, who is hereby authorised as an "officer" on the behalf of Government to hear objections / suggestions which are received and say of the said Corporation, as the case may be and submit his report to the Government;
Further, the Government hereby issues directives under Section 154(1) of the said Act to MMRDA that, pending sanction to the Proposed Modification under clause (c) of Section 37(1AA) of the said Act by the Government, the Proposed Modification shall come into force forthwith.

Accompaniment to the Government in Urban Development Department Notice No. TPB-4323/ C.R.139/2023/UD-11, dated – 20/04/2026.
New Note (iv) is proposed to be inserted under Clause (A) of Regulation 4(ii) of BKC Notified Area Development Control Regulations as follows :—
In case additional construction is proposed in the previously developed / under construction buildings in 'E' and 'G' blocks as per additional Built-Up area permissible under this regulation wherein clearly demonstrable hardship is caused in proposing parking area as per the provisions of the Development Control and Promotion Regulations for such additional built-up area, then in such cases, with prior approval of Government, the Metropolitan Commissioner, MMRDA is empowered to grant upto 50% relaxation in the required parking to be provided for such additional built-up area only. Provided that, in any circumstances, the parking area shown while approving the plans before coming into force of notification dated 24/07/2024 shall not be reduced.
This Notice under sub-section (1AA) of Section 37 of the said Act shall also be available on the Govt. of Maharashtra website : www.maharashtra.gov.in (Acts/Rules).
