आवि ज्याअर्थी, शासनां नांगरविकास आवि सावजविनांक आरोग्य विभागाकडील अविसूचनांा क्र.बीकेआर ११७७/२६२-युडी-५, विनांांक ९ एविल, १९७९ अन्ये उक्त अविविनांयमंाच्या मंील तरतुीनांुसार एमंएमंआरडीए नांे बी.के.सी. अविसूविचत क्षेत्रामंील जविमंनांीच्या विकासाबाबत सार केलेल्या विनांयोजनां स्तांनांा (यापुढे ज्याचा उल्लेख "उक्त विनांयोजनां स्ता" यामंाे करण्यात आला आहाे.) विकास विनांयंत्रा विनांयमंालीसहा(यापुढे ज्याचा उल्लेख "उक्त विनांयमंाली" यामंाे करण्यात आला आहाे.) मंजूरी विलेली आहाे;

आवि ज्याअर्थी, पुयवटीनां सांस्कृवितक कायव विभाग, मंहाराष्ट्र शासनां यांच्याकडीूनां ेखील स्तावित विकासाबाबत विनांती ाप्त झाला असूनां, त्यामंध्ये मंहाराष्ट्र राज्य पुराविभालेख भानांचा स्तावित विकासासाठी, 'सामंाविजक सुविा' (Social Facility) या नांामंविनांेशांतगवत 'मंहाराष्ट्र राज्य पुराविभालेख भानां, ाविज्य आवि इतर अनांुषंविगक ापुरकते' या विविशाष्टी सुारिरत ापुरासहा उक्त जविमंनांीरील विद्यमंानां अनांुज्ञाेय चटीई क्षेत्रा विनांेशांक(FSI) ५.०० पुयंत सुारिरत करण्यास नांगरविकास विभागाची मंान्यता विमंळण्याची विनांती करण्यात आली आहाे;

आवि ज्याअर्थी, नांगरविकास विभागानांे विनांांक ०७/०७/२०२५ रोजीच्या पुत्राद्वारे उक्त ाविकरास असे विनांेविशात केले आहाे की, सर जविमंनांीसाठी 'विशाेष विनांयोजनां ाविकर' (SPA) या नांात्यानांे, उक्त ाविकरानांे अस्तिस्त्ातील मंजूर 'सामंाविजक सुविा' भाूापुरात 'मंहाराष्ट्र राज्य पुराविभालेख भानां, व्यासावियक इतर संबंवित ापुर' असा विविशाष्टी ापुर बल करण्यास, रस्त्याची रुंी आवि कमंाल अनांुज्ञाेय क्षेमंता(सर भाूभागाचे विकासासाठी लागूनां असलेल्या रस्ता रुंीच्या अनांुषंगानांे अनांुज्ञाेय असलेल्या Max Permissible Potential) या बाबीची पुडीताळी करूनां त्यानांुसार उक्त अविविनांयमंाच्या कलमं ३७(१) अन्ये फेरबलाची कायवाहाी अनांुसरुंनां ैाविनांक कायवाहाी करूनां पुरिरपुूव फेरबलाचा स्ता शासनांास सार करा, जेकरूनां शासनांस्तरार त्याबाबत योग्य विनांवय घेता येईल;

आवि ज्याअर्थी, सर ाविकरानांे पुडीताळी केल्यानांुसार, उक्त जमंीनां ांद्रे-कुलाव संकुल (BKC) च्या विनांयोजनां स्तानांुसार स्तावित ३० मंी. रुं रस्त्याला लागूनां आहाे. आवि ज्याअर्थी, उक्त विनांयमंाली सोबत बृहान्मंु ंबईसाठी मंजूर 'विकास विनांयंत्रा ोत्साहानां विनांयमंाली (DCPR) - २०३४' मंील विविनांयमं क्र.३३(३) चे तरतुं ाचाे, त्यानांुसार शासनांाची विविशाष्टी विनांकडी लक्षेात घेता, २७ मंी. विकंा त्यापुेक्षेा जास्त रुंीच्या रस्त्यारील शासकीय/बृहान्मंु ंबई मंहानांगरपुाविलका/सांविविक संस्र्थीा, विनांमंशासकीय आवि सावजविनांक उपुक्रमं (PSU) यांच्या कायावलयांच्या इमंारतंसाठी ५.०० पुयंत कमंाल चटीईक्षेत्रा विनांेशांक (FSI) अनांुज्ञाेय आहाे, तसेच पुराविभालेख संचालनांालय, पुयवटीनां सांस्कृवितक कायव विभाग यांनांी केलेली विनांती आवि स्तावित विकासाबाबत शासनांानांे विनांगवविमंत उक्त ाविकरास विलेले विनांेशा विचारात घेता, उक्त ाविकरानांे 'सामंाविजक सुविा' म्हाूनां नांामंविनांेविशात असलेल्या उक्त जविमंनांीर 'मंहाराष्ट्र राज्य पुराविभालेख भानां, ाविज्य आवि इतर अनांुषंविगक ापुरकते' या विविशाष्टी ापुरासहा, विद्यमंानां अनांुज्ञाेय चटीई क्षेत्रा विनांेशांक ५.०० पुयंत बलण्याचा फेरबल स्ता (यापुढे ज्याचा उल्लेख "उक्त फेरबल" यामंाे करण्यात आला आहाे) उक्त अविविनांयमंाच्या कलमं ३७ च्या पुोटी-कलमं (१) अन्ये ानां करण्यात आलेल्या अविकारांचा ापुर करूनां स्तावित केला आहाे; आवि ज्याअर्थी, उक्त ाविकरानांे उक्त फेरबलाबाबत सवसामंान्य जनांतेकडीूनां सूचनांा/हारकती मंागविण्यासाठी सूचनांा विसद्ध केली असूनां ती महाराष्ट्र ासन असारण राजपत्रात विनांांक १२ ऑगस्टी २०२५ रोजी विसद्ध झाली आहाे; आवि ज्याअर्थी, उक्त ाविकरानांे उक्त अविविनांयमंाच्या कलमं ३७(१) अन्ये स्तावित फेरबलाची ैाविनांक कायवाहाी पुूव करुंनां, उक्त फेरबल स्ता मंजुरीसाठी शासनांाकडीे विनांांक १९/०९/२०२५ रोजीच्या पुत्राद्वारे सार केला आहाे;

आवि ज्याअर्थी संचालक, नांगर रचनांा, मंहाराष्ट्र राज्य, पुे यांनांी त्यांचेकडील वि.०३/०२/२०२६ रोजीचे पुत्राद्वारे सर स्तावित फेरबलार अहाल सार केला आहाे; आवि ज्याअर्थी, उक्त ाविकराची विनांती विचारात घेऊनां संचालक, नांगर रचनांा, मंहाराष्ट्र राज्य, पुे यांचेशाी सल्लामंसलत केल्यानांतर स्तावित फेरबल मंजूर करे आश्यक असल्याचे शासनांाचे मंत झालेले आहाे.

आता त्याअर्थी, उक्त अविविनांयमंाच्या कलमं ३७(२) अन्ये ाप्त अविकारात आवि त्या संभावतील सव शाक्तंचा ापुर करूनां शासनां याद्वारे :-

(अ) उक्त स्तावित फेरबलाचे स्तास सोबतच्या पुरिरविशाष्टीामंध्ये नांमंू केलेमंाे मंजूरी ेत आहाे.

(ब) सरची अविसूचनांा शासकीय राजपत्रामध्ये विसद्ध झालेचा विनांांक हा उक्त फेरबल अंमंलात आलेचा विनांांक असेल.

(क) एमं.एमं.आर.डी.ए ला उक्त विनांयोजनां स्ता मंजूरी सोबतच्या फेरबलाचे पुरिरविशाष्टीामंध्ये शाेटीच्या नांीनांतर सोबतचे पुरिरविशाष्टी समंाविष्टी करेचे विनांेशा ेत आहाे.

The user and permissible FSI of the land bearing S. No. 341, CTS No. 629 (pt) of Village Bandra, Taluka Andheri; Ward "H/E" in Mumbai Suburban District having approximate area of 8,291.40 sq.m. (6,691.00 sq.m. + 1,600.40 sq.m.), more specifically marked as 'A-B-C-D-E-F" on accompanying plan is sanctioned as tabulated below:-

Note.–

(1) The land use composition within the users shall be as decided by Metropolitan Commissioner, MMRDA from time to time.

(2) The land in 'F' block of BKC is owned by Collector, Mumbai Suburban District and the modification shown as 'A-B-C-D-E-F' on part plan is subject to actual measurement by the office of Collector, Mumbai Suburban District.

(3) *This sanctioned modification in Floor Space Index for the purpose of development of the plot under reference shall be duly incorporated in the Reg.4(ii) of the Sanctioned Development Control Regulations of BKC Notified Area.

NOTIFICATION

Maharashtra regional and town Planning act,1966.

No.TPB-4325/1316/C.R.93/2025/UD-11.– Whereas, State Government in Urban Development and Public Health Department vide Notification No. BKR 1177/262-UD-5 dated 07/03/1977 has appointed Mumbai Metropolitan Region Development Authority (hereinafter referred to as "MMRDA") formed under the provisions of Mumbai Metropolitan Region Development Authority Act, 1974 as Special Planning Authority for Bandra-Kurla Complex Notified Area (hereinafter referred to as B.K.C. Notified Area ") under section 40(1)(c) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act");

And whereas, the Planning Proposals for the area included in B.K.C. Notified Area (hereinafter referred to as "the said Planning Proposal") alongwith Development Control Regulations (hereinafter referred to as "the said Regulations") have been sanctioned by State Government in Urban Development and Public Health Department's Notification no. BKR 1177/262-UD-5 dated 09/04/1979 under the provisions of said Act;

And whereas, the lands bearing S. No. 341, CTS No. 629 (pt) of Village Bandra, Taluka-Andheri, in Ward "H/E" (hereinafter referred to as "the said land") having approximate area of 8,291.40 sq.m. (6,691.00 sq.m. + 1,600.40 sq.m.) is located in 'F' block of BKC and is shown as 'Social Facility' in the Sanctioned Planning Proposal Plan of BKC;

And whereas,Government in Urban Development Department have received a letter from Hon. Ashish Shelar, Hon.Minister, Information Technology & Cultural Affairs (hereinafter referred to "the said letter"); And whereas, it is stated in the said letter that, The Directorate of Archives of Tourism & Cultural Affairs, GoM has proposed the development of 'Maharashtra Archives Bhavan' on the land bearing Survey No.341(Pt), CTS No.629(Pt) in village Bandra(E) situated in 'F' Block of Bandra-Kurla Conplex(BKC) and based on the request and requirement of the Directorate of Archives, Department of Tourism and Cultural Affairs GoM, the said authority vide its letter dated 28/05/2025 have suggested certain way forward for the proposed development;

And whereas, request is also received regarding proposed development from Department of Tourism and Cultural Affairs, Government of Maharashtra wherein it is requested that for proposed development of Maharashtra Archives Bhavan, it required to modify permissible FSI to 5.00 on the said land which is proposed to be reserved for 'Social Facility' with specific modified users of 'State Archives Bhavan, Commercial and other allied users' with approval from Government in Urban Development Department;

And whereas Government in Urban Development Department vide letter dated 07/07/2025 has directed the said Authority that being the Special Planning Authority for the said land, MMRDA has to verify the proposed modification of allowing the specific user of 'Maharashtra State Archives Bhavan, Commercial and other Allied Users' in the existing sanctioned land use of 'Social Facility' with respect to the road width and maximum permissible potential and submit the modification proposal to State Government by following due process u/s 37(1) of the said Act so that the appropriate decision regarding the same can be taken at State Government level;

And whereas, the said Authority has verified that the said land is abutting the proposed 30mt.

wide road as per the said Planning Proposal of BKC. And whereas as per the said regulation read with Reg. No.33(3) of sanctioned Development Control & Promotion Regulation (DCPR) - 2034 for Greater Mumbai, considering the specific requirement of Government, the maximum permissible FSI of upto 5.00 for minimum road width of 27 mt. is permissible for buildings of Government/ BMC/Statutory Bodies, Semi Government and PSU offices and considering request of Directorate of Archives, Department of Tourism & Cultural Affairs and directions issued by Government regarding the proposed development, the said Authority in exercise of the powers conferred under Sub-Section (1) of Section 37 of the said Act has initiated modification proposal in respect of the said land which is proposed to be reserved for 'Social Facility' with specific modified users of 'State Archives Bhavan, Commercial and other allied users and to change existing permissible FSI to 5.00 on the said land (hereinafter referred to as "the proposed modification"); And whereas accordingly, the said Authority has issued Notice for inviting suggestions/objections from the general public with regard to the proposed modification which is published in Maharashtra Government Extra Ordinary Gazette dated 12th August, 2025; And whereas, the said Authority after completing all the legal procedure regarding the proposed modification as stipulated under Section 37(1) of the said Act, has submitted the modification proposal to the Government for sanction vide their letter dated 19/09/2025;

And whereas, Director of Town Planning, Maharashtra State, Pune vide his letter dated 03/02/2026 has submitted his report to the Government on the proposed modification;

And whereas, after considering the request of the said Authority and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the proposed modification is required to be sanctioned;

Now, therefore, in exercise of the powers conferred upon it under Section 37(2) of the said Act, the Government hereby:-

(A) Sanctions the proposed modification as described more specifically in the Schedule attached herewith.

(B) Fixes the date of publication of this Notification in the Official Gazette as the date of coming into force of this modification.

(C) Directs the said Authority that in the Schedule of Modifications sanctioning the said Planning Proposal, after the last entry, the Schedule referred to at (A) above shall be added.
