ज्याअर्थी, नागपूर शहराची सुधारित विकास योजना, महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ (१९६६ चा महा. ३७ वा) (यापुढे " उक्त अधिनियम " असे संबोधले आहे) चे कलम ३१ (१) अन्वये शासन अधिसूचना, नगर विकास विभाग क्र. टिपीएस-२४९६-२६४३- प्र.क्र. ३०० (अ)-९७-नवि-९, दिनांक ०७ जानेवारी, २००० अन्वये भागश: मंजूर व क्र. टिपीएस-२४००-१६२८-प्र.क्र. २००-२०००-नवि-९, दिनांक १० सप्टेंबर, २००१ नुसार अंतिमत: मंजूर करण्यात आलेली असून ती अनुक्रमे दिनांक ०१ मार्च, २००० व दिनांक २१ सप्टेंबर, २००१ पासून अंमलात आली आहे (यापुढे " उक्त विकास योजना " असे संबोधले आहे);
आणि ज्याअर्थी, उक्त विकास योजनेत, मौजा चिंचभूवन येथील खसरा क्र. ११ ते १४,१५/१-२-३, २३ (भाग), २४ (भाग) आणि १६/१-२-३, १६/४ (भाग) मधील अंदाजे २१.०० हेक्टर क्षेत्र (यापुढे " उक्त जागा " असे संबोधले आहे.) "आरक्षण क्र. एस -२४३- रेल्वे प्रपोजल" या आरक्षणात समाविष्ट आहे (यापुढे " उक्त आरक्षण " असे संबोधले आहे.) ;
आणि ज्याअर्थी, उक्त जागेच्या चौदा जमिनधारकांनी, नियोजन प्राधिकरण म्हणून नागपूर महानगरपालिकेवर (यापुढे " उक्त नियोजन प्राधिकरण " असे संबोधले आहे) महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ चे कलम १२७ अन्वये सूचना बजावली असता,उक्त जागेच्या विकासाकरीता व भूसंपादनाकरीता समूचित प्राधिकरण रेल्वे विभाग असल्याने (यापुढे " उक्त समूचित प्राधिकरण " असे संबोधले आहे) सदरची सूचना पुढील कार्यवाहीसाठी उक्त समूचित प्राधिकरणाकडे पाठविण्यात आलेले होत्या. तसेच उक्त समूचित प्राधिकरणाने दिनांक ०७ जुलै, २०१५ रोजीच्या पत्रान्वये उक्त जागेचे संपादन करण्याचे त्यांचे कुठलेही प्रयोजन नसल्याचे व त्याअनुषंगाने उक्त आरक्षणाखालील उक्त जागेचा वापर प्रचलित निकषानुसार करावा असे शासनास कळविले आहे ;
आणि ज्याअर्थी, उक्त नियोजन प्राधिकरणाने उक्त अधिनियमाचे कलम ५० अन्वये उक्त आरक्षण वगळण्याकरीता व लगतचा वापर अनुज्ञेय करण्यासाठी प्रस्ताव शासनास सादर केलेला आहे (यापुढे " उक्त प्रस्ताव " असे संबोधले आहे);

(१)२ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, मे १४-२०, २०२६/वैशाख २४-३०, शके १९४८ आणि ज्याअर्थी, आवश्यक त्या चौकशीनंतर व संचालक, नगर रचना महाराष्ट्र राज्य, पुणे यांचा सल्ला घेतल्यानंतर, उक्त अधिनियमाचे कलम ५० च्या तरतुदीअंतर्गत, मौजे चिंचभूवन येथील खसरा क्र. ११ ते १४, १५/१-२-३, २३ (भाग), २४ (भाग) आणि १६/१-२-३, १६/४ (भाग) मधील अंदाजे क्षेत्र २१.०० हेक्टर ही जागा "आरक्षण क्र. एस -२४३- रेल्वे प्रपोजल" मधून वगळून लगतच्या वापर विभागात समाविष्ट करणे आवश्यक आहे, असे शासनाचे मत झाले आहे;
आणि ज्याअर्थी, उक्त प्रस्तावाखालील उक्त जागापैकी मौजा चिंचभूवन येथील खसरा क्र. १६/३ (संेट्रल अॅगमार्क लॅबोरेटरी को. ऑ.हौ. सोसायटी), १६/२ (कोलाबा स्वामी गृ. नि. स. संस्था), १४/१,२,३,४ (मालीक मकबुजा) व १४/२ (शिवशक्ती गृ. नि. स. संस्था) च्या जमिन मालकांनी शासनाच्या धोरणानुसार सन २०२५-२६ या वर्षातील बाजार मूल्यदर तक्त्यानुसार उक्त जागेच्या जमिन दराच्या ५% दराने येणाया अधिमूल्य रक्कमेपैकी ५०% शासनास देय असलेली अधिमूल्याची रक्कम रुपये ५८,८२,८८३/- सहायक संचालक, नगर रचना, नागपूर शाखा, नागपूर यांचेकडील लेखाशिर्षामध्ये दिनांक ०१ जानेवारी, २०२६ रोजी जमा केलेली आहे आणि उक्त नियोजन प्राधिकरणास देय असलेली ५०% अधिमूल्याची रक्कम रुपये ५८,८२,८८३/- सभापती, नागपूर सुधार प्रन्यास, नागपूर यांचेकडे दिनांक ०२ जानेवारी, २०२६ रोजी जमा केलेली आहे;
आता त्याअर्थी, उक्त अधिनियमाचे कलम ५० चे उप कलम (२) नुसार प्राप्त असलेल्या अधिकारांचा वापर करुन, शासन उक्त प्रस्तावास काही अटींसह पुढील प्रमाणे मान्यता देत आहे आणि त्यासाठी उपरोल्लिखीत दिनांक ०७ जानेवारी, २००० ची विकास योजना मंजुरीची अधिसूचना सुधारित करण्यात येत आहे;
" उक्त विकास योजना मंजुरीच्या अधिसूचनेच्या फेरबदल सूचितील शेवटच्या नोंदीनंतर पुढील नव्या नोंदीचा समावेश करण्यात येत आहे.
नोंद
मौजा चिंचभूवन येथील खसरा क्र. १६/३ (सेंट्रल अॅगमार्क लॅबोरेटरी को. ऑ.हौ. सोसायटी), १६/२ (कोलाबा स्वामी गृ. नि. स. संस्था), १४/१,२,३,४ (मालीक मकबुजा) व १४/२ (शिवशक्ती गृ. नि. स. संस्था) मधील " आरक्षण क्र. एस-२४३-रेल्वे प्रपोजल "मधून वगळण्यात येत आहे. व अशा प्रकारे मुक्त झालेली जागा उक्त विकास योजनेतील लगतच्या जमिन वापरानुसार अन्यथा अनुज्ञेय असल्याप्रमाणे विकासासाठी खालील अटींवर, उपलब्ध झाली आहे".
अट क्र.-१. विषयांकित जागेच्या अभिन्यासात १०% अनिवार्य खुल्या जागेव्यतिरिक्त १०% क्षेत्र सुविधा क्षेत्र म्हणून ठेवण्यात यावे.
अट क्र.-२. विषयांकित जागेत अभिन्यास मंजूर करण्यापूर्वी नागपूर महानगरपालिका, नागपूर यांनी प्रचलित विकास नियंत्रण नियमावलीतील नियमास अधिन राहून अभिन्यासाची छाननी व पडताळणी आपल्या स्तरावर करणे बंधनकारक राहील.
०२. उपरोक्त मंजूर बदल, प्रस्तुत आदेश शासन राजपत्रात प्रसिध्द झाल्याच्या दिनांकापासून अंमलात येईल.
०३.उपरोक्त मंजूर बदल दर्शविणाया विकास योजना भाग नकाशाची प्रत, आयुक्त, नागपूर महानगरपालिका, नागपूर यांच्या कार्यालयांत कामकाजाच्या दिवशी कार्यालयीन वेळेत नागरिकांच्या अवलोकनार्थ एक महिन्याच्या कालावधीसाठी उपलब्ध राहील.
सदर अधिसूचना विभागाच्या www.maharashtra.gov.in या संकेतस्थळावर देखील उपलब्ध राहील.

THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
ORDER
No.TPS-2416-05-C.R.-16- 2016-UD-9.--
Whereas, Revised Development Plan of Nagpur City (hereinafter referred to as "the said Development Plan") has been sanctioned by the Government vide Urban Development Department's Notification No. TPS- 2496-2643-C.R. 300(A)-97-UD-9, dated the 07th January, 2000 and has come into force with effect from 01st March, 2000 and the Republished Development Plan of Excluded Parts of substantial nature modification, has been sanctioned by the Government vide Notification No.TPS-2400-1628-C.R. 200-2000-UD-9, dated the 10th September, 2001 has come into force with effect from the 21st September, 2001 under section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah.XXXVII of 1966) (here- inafter referred to as "the said Act");
महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, मे १४-२०, २०२६/वैशाख २४-३०, शके १९४८ ३And whereas, in the said Development Plan, the lands bearing Khasara Nos.11 to 14, 15/1-2-3, 23(pt.) & 24(pt.) & 16/1-2-3, 16/4 (pt.) admeasuring about 21.00 Hectare of Mouja Chinchbhuvan (here- inafter referred to as "the said Land") reserved "Site No. S-243 -Railway Proposal" (hereinafter referred to as "the said Reservation");
And whereas, all the fourteen lands owners of the said Lands had served the Notice (hereinafter referred to as "the said Notice"),under Sections 127 of the said Act, to the Nagpur Municipal Corporation, Nagpur being the Planning Authority (hereinafter referred to as "the said Planning Authority "), the said Notice was forwarded for acquisition of the said Lands to the Railway Department, being the Acquiring Body and Appropriate Authority (hereinafter referred to as "the said Appropriate Authority");
And whereas, Appropriate Authority has communicated to the State Government vide its letter dated 07th July, 2015 that, the Railway Department has no plan for acquiring the said lands for it's purpose, and therefore the said Lands can be used as per prevailing norms;
And whereas, the Planning Authority has sent the proposal (hereinafter referred to as "the said Proposal") to the State Government under Section 50 of the said Act, to deleted the said Land from the said Reservation and make them available for use as otherwise permissible to develop as per adjacent land use;
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of the opinion that, the said Lands bearing Khasara Nos.11to 14, 15/1-2-3, 23(pt.) & 24(pt.) & 16/1-2-3, 16/4 (pt.) of Mouja Chinchbhuvan admeasuring about 21.00 Hectare are reserved as "Site No. S-243 -Railway Proposal"should be deleted from the said Reservation and the lands so released should be included in the adjacent Zone as per the provisions of section 50 of the said Act;
And whereas, as per the Government Policy the Land Owners have deposited out of the lands under the said Proposal, of Khasara No.16/3 (Central Agmark Laboratory C. H. S.), 16/2, (Kolba Swami C.H.S.),14/ 1,2,3,4 (Malik Makbuja) & 14/2 (Shivshati C.H.S.) of Mouja Chinchbhuvan i. e. have deposited Rs. 58,82,883 towards the 50% Government share of premium amount worked out as per the 5% rate of the land rates prescribed in the Annual Statement of Rates (ASR) for the year 2025-26 in the Government Treasury on 1st January, 2026 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the premium amount Rs. 58.82.883/- payble to the said Planning Authority has been deposited with the Chairman, Nagpur Im provement Trust, Nagpur on 02nd January, 2026;
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of section 50 of the said Act, the Government hereby, sanctions the said Proposal subject to some condition and for that purpose amends the above referred Notification dated the 07th January, 2000 as follows ;
"In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry-
ENTRY
"The land bearing Khasara No.16/3 (Central Agmark Laboratory C. H. S.), 16/2, (Kolba Swami C.H.S.), 14/1,2,3,4 (Malik Makbuja) & 14/2 (Shivshakti C.H.S.) of Mouje Chinchbhuvan, are deleted from reserved "Site No. S-243-Railway Proposal" and the lands so released shall become available for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan, subject to the follwing conditions-"
Conditions:– 1. In the layout of the said Land, in addition to 10% compulsory open space, 10% addi- tional amenity space should be proposed.
Conditions:– 2. At the time of permission of layout, the concerned Planning Authority should scruti- nize the proposal as per the prevailing Development Control Regulation of Nagpur.
2. The abovesaid sanctioned modification shall come into force from the date of publication of this Order in the Official Gazette.
3. A copy of the part plan of the aforesaid sanctioned modification shall be available for public inspection in the offices of the Commissioner, Municipal Corporation, Nagpur & the Chairman, Nagpur Improvement Trust, Nagpur on during office hours on all working days for a period of one month.
This Notification shall also be available on the Urban Development Department's web site www.maharashtra.gov.in

आणि ज्याअर्थी, नियोजन प्राधिकरणाने म्हणजे नगरपरिषद, काटोल ने मंजूर विकास योजनेतील पुढे दर्शविलेल्या तक्त्यामधील जागेचे वापरात फेरबदल करण्याचे नगरपालिकेचे सभेने ठरविलेले आहे. बदलामुळे मंजूर झालेल्या विकास योजनेच्या स्वरुपात विशेष बदल होणार नाही.

त्याअर्थी, महाराष्ट्र प्रादेशिक व नगर रचना अधिनियम, १९६६ चे कलम ३७ नुसार अशी जाहीर सूचना देण्यात येत आहे की, वरील बदलाबाबत जर कोणत्याही व्यक्तीला काही हरकत असेल अथवा सूचना करावयाची असेल तर त्यांनी लेखी स्वरुपात अध्यक्षा, नगरपरिषद, काटोल यांचेकडे ही जाहीर सूचना महाराष्ट्र शासन राजपत्रात प्रसिध्द झाल्यापासून एक महिन्याच्या आत सादर करावी.
अशा सर्व सूचनांचा योग्य तो विचार करुन वरील बदलाचा प्रस्ताव शासनाकडे सादर करण्यापूर्वी करण्यात येईल.

Whereas, Development Plan of Katol has been sanctioned by the Government of Maharashtra in Urban Development Department vide it's letter No. TPS-2406-3123-case No. 133-07-UD-9, dated 04th November, 2008 and it has came into force with effect from 15th December, 2008.
And whereas, the Planning Authority i.e. Municipal Council, Katol has now decided to make modifica- tion in the aforesaid sanctioned Development Plan of Katol in respect of change the purpose as per Municipal Resolution in following chart. Therefore, under Section 37 of the Maharashtra Regional and Town Planning Act, 1966, it's hereby notified that any person having any objection or suggestion regarding the proposed modifiction may communicate the same in writing to the President, Municipal Council, Katol within a period of not more than one month from the date of publication of this Notice in the Maharashtra Government Gazette. The objections shall be considered by the Planning Authority before submitteng the Proposal to the Government for sanction.
