त्याअर्थी, आता;

(१) उक्त शासन निर्णय आणि शासन परिपत्रकातील तरतुदीनुसार उपजिल्हाधिकारी (भूसंपादन), लघु सिंचन कामे, अमरावती तथा सदस्य सचिव, जिल्हास्तरीय समिती, अमरावती याव्दारे.----

खाजगी क्षेत्रातील जमिनी खाजगी वाटाघाटीने थेट खरेदी पध्दतीने कार्यकारी अभियंता, अमरावती प्रकल्प बांधकाम विभाग क्र. १, अमरावती यांचे नावे घेण्याबाबत जाहीर नोटीस प्रसिध्द करीत आहे.

अमरावती पश्चिम वळण रस्ता रामा - २९९ रस्त्यावर नरखेड रेल्वे लाईन सा. क्र. २९/००० मध्ये उड्डाणपुलाचे बांधकाम प्रयोजनाकरीता जमिनी खाजगी वाटाघाटीने थेट खरेदी पध्दतीने संपादित करतांना जिल्हास्तरीय समिती मार्फत भूमि संपादन, पुनर्वसन आणि पुनस्र्थापना करताना वाजवी नुकसान भरपाई मिळण्याचा व पारदर्शकतेचा हक्क अधिनियम, २०१३ मधील कलमे २६ ते ३० च्या शेडयुल १ च्या तरतुदीनुसार संबंधित जमिनीसाठी परिगणीत होणाया एकूण मोबदल्याच्या रक्कमेवर २५ टक्के रक्कम वाढीव देऊन मोबदला निश्चित करण्यात येईल.

संबंधित भूधारकांकडून शासनाच्या प्रचलित धोरणाप्रमाणे खाजगी जमीन खाजगी वाटाघाटीने थेट खरेदीपध्दतीने कार्यकारी अभियंता, सार्वजनिक बांधकाम विभाग, अमरावती यांचे नावे खरेदी करुन देण्यास स्वेच्छेने तयार असल्याबाबत व जिल्हास्तरीय समितीने निश्चित केलेला मोबदला संपूर्णत: अंतिमरित्या स्विकारण्यास तयार असल्याबाबतचे संमतीपत्र (विकल्प) मागवित आहे.

(२) संबंधित भूधारकांनी ही जाहीर नोटीस प्रसिध्द झाल्यानंतर विहीत नमुन्यातील संमतीपत्र (विकल्प) कार्यकारी अभियंता, सार्वजनिक बांधकाम विभाग, अमरावती यांचेकडे दाखल करावीत.

(३) संमतीपत्राचा (विकल्प) विहीत नमुना कार्यकारी अभियंता, सार्वजनिक बांधकाम विभाग, अमरावती यांचे कार्यालयात उपलब्ध आहे.

ज्याअर्थी, भूमि संपादन, पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा आणि पारदर्शकतेचा हक्क अधिनियम, २०१३ (२०१३ चा ३०) (ज्याचा उल्लेख पुढे " उक्त अधिनियम " असा करण्यात आला आहे.) च्या कलम ३ च्या खंड (इ) च्या परंतुकाव्दारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करुन काढण्यात आलेली शासकीय अधिसूचना महसूल व वन विभाग क्र. संकीर्ण ११-२०१४-प्र.क्र. ७७-२, दिनांक १९ जानेवारी, २०१५ (यात यापुढे जिचा निर्देश "उक्त अधिसूचना" असा करण्यात आला आहे.) याव्दारे असे अधिसूचित केले आहे की, उक्त अधिनियमाच्या कलम ३ च्या खंड (झेड-ए) मध्ये व्याख्या केलेल्या एखाद्या सार्वजनिक प्रयोजनासाठी, एखाद्या जिल्ह्यतील ५०० हेक्टरपेक्षा अधिक नसेल इतक्या क्षेत्राकरीता जमीन संपादन करण्याच्या संबंधात, अशा जिल्याचा जिल्हाधिकारी हा उक्त अधिनियमाच्या प्रयोजनासाठी " समूचित शासन " असल्याचे मानण्यात येईल;

आणि ज्याअर्थी, उक्त अधिसूचनेनुसार समूचित शासन असलेल्या, अकोला जिल्ह्यच्या जिल्हाधिकायास यासोबत जोडलेल्या " अनुसूची-एकमध्ये " अधिक तपशीलवार वर्णन केलेली जमीन (यात यापुढे जिचा निर्देश " उक्त जमीन " असा करण्यात आला आहे.) आवश्यक आहे अथवा तिची आवश्यकता भासण्याची शक्यता आहे, असे वाटते, ज्याच्या स्वरुपाचे विवरण यासोबत जोडलेल्या "अनुसूची-दोनमध्ये" दिलेले आहे;

आणि म्हणून, उक्त अधिनियमाच्या कलम ११ च्या पोट-कलम (१) च्या तरतुदीन्वये याव्दारे असे अधिसूचित करण्यात येत की, उक्त जमिनीची उक्त सार्वजनिक प्रयोजनासाठी आवश्यकता भासण्याची शक्यता आहे;

आणि ज्याअर्थी, महाराष्ट्र शासन राजपत्र असाधारण क्र. ३८, दिनांक १३ मार्च, २०१५ अन्वये सिंचन प्रकल्पांना उक्त अधिनियमाच्या प्रकरण दोन व तीन यांच्या तरतुदी लागू करण्यापासून सूट देण्यात आली असल्यामुळे या प्रकल्पासाठी सामजिक प्रभाव निर्धारण करण्याची आवश्यकता उरलेली नाही ;

आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ४३ च्या पोट-कलम (१) अन्वये पुनर्वसन व पुनर्वसाहत या प्रयोजनासाठी नियुक्त केलेल्या प्रशासकाचा तपशील, यासोबत जोडलेल्या " अनुसूची-पाचमध्ये " दिलेला आहे;

मौ तजामहाराष्ट्र शासन राजपत्र भाग एक अमरावती विभागीय पुरवणी, मे २१-२७, २०२६/वैशाख ३१-ज्येष्ठ ६, शके १९४८ ५ त्याअर्थी, आता, असे घोषित करण्यात येत आहे की, उक्त अधिनियमाच्या कलम ११ च्या पोट-कलम (४) अनुसार कोणतीही व्यक्ती, ही अधिसूचना प्रसिध्द झाल्याच्या दिनांकपासून ते उक्त अधिनियमाच्या प्रकरण चार खालील कार्यवाही पूर्ण हाईल त्या कालावधीपयर्ंत उक्त जमिनीचा अथवा तिच्या भागाचा कोणताही व्यवहार करणार नाही, किंवा उक्त जमिनीवर कोणताही भार निर्माण करणार नाही;

परंतु, उक्त जमिनीच्या अथवा तिच्या भागाच्या मालकाने अर्ज केल्यावर, जिल्हाधिकायास विशेष परिस्थितीत, कारणे लेखी नमूद करुन अशा मालकास उपरोक्त तरतुदीच्या प्रर्वतनातून सूट देता येईल;

परंतु, आणखी असे की, जर कोणत्याही व्यक्तीने या तरतुदीचे बुध्दीपुरस्सर उल्लंघन केल्यामुळे तिला झालेल्या कोणत्याही हानीची किंवा क्षतीची जिल्हाधिकायांकडून भरपाई दिली जाणार नाही.

तसेच, उक्त अधिनियमाच्या कलम ११ च्या पोट-कलम (५) अनुसार, जिल्हाधिकारी, भूमि संपादन, पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा व पारदर्शकतेचा हक्क (महाराष्ट्र) नियम २०१४ (यात यापुढे ज्याचा निर्देश " उक्त नियम " असा करण्यात आला आहे.) त्याच्या नियम १० च्या उप-नियम (३) व्दारे विहीत केल्याप्रमाणे भूमि अभिलेखाच्या अद्ययावतीकरणाचे काम हाती घेणार असल्याचे व पूर्ण करणार असल्याचे देखील घोषित करीत आहे.

आणि म्हणून, त्याअर्थी, उक्त अधिनियमाच्या कलम ३ च्या खंड (छ) अन्वये समूचित शासन असलेले जिल्हाधिकारी, अकोला उक्त नियमाखालील जिल्हाधिकायांचे कार्ये पार पाडण्यासाठी डॉ. शरद ज्ञानेश्वर जावळे, उपविभागीय अधिकारी तथा भूसंपादन अधिकारी, अकोला यांस पदनिर्देशित केले आहे;
