त्याअर्थी, आता, उक्ता जागदिताका क्षमंता कांद्रां धोरर्ण-२०२५ अन्वये, मंहुाराष्ट्र मंुद्रांांका अदिधोदिनांयमं, (१९५८ चा ६०) (याता यापीुढे ज्याचा दिनांदाेशा, "उक्ता अदिधोदिनांयमं" असा काेला आहुे) याच्या कालमं ९ च्या खंड (अ) द्वारे प्रदानां काेलेल्या अदिधोकारांचा वापीर कारूनां, मंहुाराष्ट्र शासनां, जनांदिहुतार्थीग तासे कारर्णे आवश्यका आहुे अशाी खात्राी पीटील्यानांे, याद्वारे, यासोबता जोडलेल्या अनांुसूचाीच्या स्तांभा (२) मंध्ये दिवदिनांदिदागष्टी काेलेल्या उक्ता जागदिताका क्षमंता कांद्रां धोरर्ण-२०२५ नांुसार युदिनांटीांच्या दिकांवा प्रकाल्पीांच्या पीात्रा प्रवगागच्या बाबताीता, (१)

भाग चार-ब-२६४–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, मे २२, २०२६/ज्येष्टठ १, शके १९४८ अनांुसूचाीच्या स्तांभा (४) मंध्ये दिवदिनांदिदागष्टी काेलेल्या संलेखावर, उक्ता अदिधोदिनांयमंास जोडलेल्या अनांुसूचाी-एकाच्या दिवदिवधो अनांुछेदांन्वये आकारण्यायोग्य असलेल्या मंुद्रांांका शाुल्काता, अनांुसूचाीच्या स्तांभा (३) मंध्ये दिवदिनांदिदागष्टी काेलेल्या मंयागदाेपीयंता, ०३ नांोव्हुंबर, २०२५ पीासूनां सुरू हुोर्णाऱ्या ताे ०३ नांोव्हुंबर, २०३० रोजी संपीर्णाऱ्या(दाोन्हुी दिदावस धोरूनां) कालावधोीसाठी दिकांवा उक्ता जागदिताका क्षमंता कांद्रां धोरर्ण-२०२५ अंमंलाता असेपीयंता, पीुढेील शातांस अधोीनां राहुूनां, कापीाता कारीता आहुे दिकांवा मंाफ कारीता आहुे:-

शती-

(१) ज्यासाठी मंुद्रांांका शाुल्काता कापीाता कारण्याता आलेली आहुे दिकांवा मंाफी दाेण्याता आलेली आहुे असे उपीक्रमं सुरू कारण्याता दिनांष्फळ ठीरर्णारे अर्थीवा मंहुाराष्ट्र राज्य जागदिताका क्षमंता कांद्रां धोरर्ण, २०२५ याच्या. काोर्णत्याहुी शाताीचा भांग कारर्णारे काोर्णताेहुी जागदिताका क्षमंता कांद्रां युदिनांटी, जर्णू काहुी सुरुवाताीपीासूनांचा काोर्णताीहुी कापीाता काेलेली नांव्हुताी दिकांवा मंाफी दिदालेली नांव्हुताी असे समंजूनां, मंुद्रांांका शाुल्का व शास्ताी काोर्णताीहुी असल्यास, प्रदानां कारण्यास पीात्रा असेल.

(२) जागदिताका क्षमंता कांद्रां धोरर्णान्वये मंुद्रांांका शाुल्काता मंाफी मंागर्णाऱ्या जागदिताका क्षमंता कांद्रां युदिनांटीांसाठी, याबाबताीता मंहुाराष्ट्र शासनांानांे, दिनांगगदिमंता काेलेल्या इतार काोर्णत्याहुी धोरर्णांन्वये, दिवचाराधोीनां युदिनांटीानांे मंुद्रांांका शाुल्काताील मंाफीचा काोर्णताहुी लाभा घोेतालेला आहुे दिकांवा नांाहुी दिकांवा कासे याचाी पीडताळर्णी कारर्णे आवश्यका असेल. या संबंधोाता उद्योग दिवभागाच्या सक्षमं प्रादिधोकाऱ्याकाडूनां 'नांा हुरकाता प्रमंार्णपीत्रा' सादार कारर्णे अदिनांवायग असेल.

(३) जेव्हुा काोर्णत्याहुी जागदिताका क्षमंता कांद्रां युदिनांटीानांे, हुा आदाेशा, महाराष्ट्र शासन राजपत्रात प्रदिसद्ध काेल्याच्या तारखेपीूवी आधोीचा संपीूर्णग दिकांवा उदिचाता मंुद्रांांका शाुल्का प्रदानां काेलेले असेल त्या बाबताीता, काोर्णताहुी पीरतावा दाेण्याता येर्णार नांाहुी.

(४) या आदाेशाखालील मंुद्रांांका शाुल्काताील मंाफीचा दिकांवा कापीाताीचा लाभा, यासोबता जोडलेल्या अनांुसूचाीमंध्ये दिवदिनांदिदागष्टी काेलेल्या प्रक्षेत्रांनांा लागू असेल.

(५) या आदाेशान्वये ज्याला मंुद्रांांका शाुल्काताील मंाफीचा दिकांवा कापीाताीचा लाभा दिमंळालेला आहुे असे जागदिताका क्षमंता कांद्रां युदिनांटी, इतार काोर्णत्याहुी आदाेशानांुसार दिकांवा धोरर्णानांुसार त्याचा संव्यवहुारासाठी मंुद्रांांका शाुल्काताील मंाफीसाठी दिकांवा कापीाताीसाठी हुक्कादार असर्णार नांाहुी.

(६) ज्यासाठी या आदाेशान्वये मंुद्रांांका शाुल्काता मंाफी दाेण्याता आलेली आहुे दिकांवा कापीाता कारण्याता आलेली आहुे आदिर्ण जे, उक्ता जागदिताका क्षमंता कांद्रां धोरर्ण-२०२५ चाी प्रयोजनांे दिकांवा उदिष्टीे याचाी पीूतागता कारण्याता दिनांष्फळ ठीरले आहुे अर्थीवा ज्यानांे, या आदाेशामंध्ये दिवदिनांदिदागष्टी काेलेल्या शातांपीैकाी काोर्णत्याहुी शातांचा भांग काेला आहुे असे यासोबता जोडलेल्या अनांुसूचाीच्या स्तांभा (४) मंध्ये दिवदिनांदिदागष्टी काेलेल्या दास्ताऐवजांचा पीक्षकार असलेले काोर्णताेहुी जागदिताका क्षमंता कांद्रां युदिनांटी, जर्णू काहुी सुरुवाताीपीासूनांचा मंुद्रांांका शाुल्काता काोर्णताीहुी मंाफी दाेण्याता आलेली नांव्हुताी दिकांवा कापीाता कारण्याता आलेली नांव्हुताी असे समंजूनां, संपीूर्णग मंुद्रांांका शाुल्का व शास्ताी, काोर्णताीहुी असल्यास, प्रदानां कारण्यास पीात्रा असेल.

(७) उक्ता जागदिताका क्षमंता कांद्रां धोरर्ण-२०२५ मंध्ये दिवदिनांदिदागष्टी काेल्याप्रमंार्णे, सक्षमं प्रादिधोकारर्ण, ज्यांनांा या आदाेशान्वये मंुद्रांांका शाुल्काताील मंाफीचा दिकांवा कापीाताीचा लाभा दिमंळालेला आहुे, पीरंताु, जी, उक्ता जागदिताका क्षमंता कांद्रां धोरर्ण-२०२५ चाी प्रयोजनांे दिकांवा उदिष्टीे याचाी पीूतागता कारण्याता दिनांष्फळ ठीरलेली आहुेता अर्थीवा ज्यांनांी या आदाेशामंध्ये दिवदिनांदिदागष्टी काेलेल्या शातांपीैकाी काोर्णत्याहुी शातांचा भांग काेला आहुे अशा युदिनांटीांचाी नांावे व तापीशाील, नांदार्णी मंहुादिनांरीक्षका व मंुद्रांांका दिनांयंत्राका, मंहुाराष्ट्र राज्य, पीुर्णे यांनांा दिनांयदिमंतापीर्णे काळदिवला पीादिहुजे.

(८) काोर्णताेहुी जागदिताका क्षमंता कांद्रां युदिनांटी, ज्या जागेला संबंदिधोता दिनांयोजनां प्रादिधोकारर्णाकाडूनां दिकांवा सक्षमं प्रादिधोकारर्णाकाडूनां वैधो प्रारंभा प्रमंार्णपीत्रा दिकांवा रेरा मंान्यता दिमंळालेली आहुे, अशाचा जागांसाठी काेवळ या आदाेशान्वये मंुद्रांांका शाुल्का मंाफीचा लाभा दिमंळदिवण्यासाठी, पीात्रा असेल.

(९) उत्पीादानांाता दिकांवा कायगचालनांाता असलेले काोर्णताेहुी जागदिताका क्षमंता कांद्रां युदिनांटी, एका दिठीकार्णाहुूनां दाुसऱ्या दिठीकार्णी स्र्थीलांतारिरता हुोता असल्यास आदिर्ण या युदिनांटीनांे यापीूवीचा मंुद्रांांका शाुल्का मंाफीचा लाभा घोेतालेला असल्यास, असे युदिनांटी, या आदाेशान्वये मंुद्रांांका शाुल्काता मंाफीसाठी पीात्रा असर्णार नांाहुी.

(१०) जर काोर्णत्याहुी दिवद्योमंानां जागदिताका क्षमंता कांद्रां युदिनांटीानांे या धोरर्णाच्या प्रारंभाी दिकांवा त्यानांतार दिकामंानां २५% ंतावर्णूका काेलेली असेल तार, त्यास, दिवस्तार दिकांवा दिवदिवधोीकारर्ण युदिनांटी म्हुर्णूनां समंजण्याता येईल अदितारिरक्ता दिनांयता भांडवली गु आदिर्ण ताे या आदाेशान्वये मंुद्रांांका शाुल्काता मंाफीसाठी पीात्रा असेल.

स्पष्टटीकरण -

(१) "मंहुाराष्ट्र मंादिहुताी तांत्राज्ञानां/मंादिहुताी तांत्राज्ञानां सक्षमं सेवा धोरर्ण, २०२३" याचा अर्थीग, शासनां दिनांर्णगय उद्योग, ऊजाग, कामंगार व खदिनांकामंग दिवभाग, क्रमंांका. आयटीपी-२०२१/प्र.क्र.-१७०/उद्योग-२, दिदानांांका २७ जूनां, २०२३ द्वारे शासनांानांे जाहुीर काेलेले मंहुाराष्ट्र मंादिहुताी तांत्राज्ञानां/मंादिहुताी तांत्राज्ञानां सक्षमं सेवा धोरर्ण, २०२३, असा आहुे.

(२) "मंहुाराष्ट्र जागदिताका क्षमंता कांद्रां धोरर्ण, २०२५" याचा अर्थीग, शासनां दिनांर्णगय, उद्योग, ऊजाग, कामंगार व खदिनांकामंग दिवभाग क्रमंांका जासकां-२०२५/प्र.क्र.११४/ उद्योग-२, दिदानांांका ०३ नांोव्हुंबर २०२५ द्वारे, शासनांानांे जाहुीर काेलेले मंहुाराष्ट्र जागदिताका क्षमंता कांद्रां धोरर्ण, २०२५, असा आहुे.

(३) "जागदिताका क्षमंता कांद्रां युदिनांटी" याचा अर्थीग, खाजगी, सहुकारी, सावगजदिनांका, दिवश्वस्ता, मंयागदिदाता दादियत्व भागीदारी दिकांवा संयुक्ता उपीक्रमं यांसहु, कांपीनांी म्हुर्णूनां घोदिटीता काेलेला काोर्णताहुी औद्योदिगका उपीक्रमं/व्यवसाय असूनां जो जागदिताका क्षमंता कांद्रां (जीसीसी), ग्लोबल ईनां-हुाउस संटीर, दिकांवा बहुराष्ट्रीय युदिनांटी उभारता आहुे. या युदिनांटीांचाे कायागन्वयनां मंहुाराष्ट्राता असले पीादिहुजे आदिर्ण ताे, त्याच्या पीालका संस्र्थीा व जागदिताका संलग्नां संस्र्थीांनांा सेवा दाेण्याचाे कामं कारीता असायला पीादिहुजे.

(४) या आदाेशान्वये तारताूदा काेलेला मंुद्रांांका शाुल्काताील कापीाताीचा दिकांवा मंाफीचा लाभा, उक्ता जागदिताका क्षमंता कांद्रां धोरर्ण, २०२५ अन्वये पीात्रा जागदिताका क्षमंता कांद्रां युदिनांटी व त्यानांतारचाे युदिनांटी यांच्यामंध्ये दिनांष्पीादिदाता काेलेल्या भाडेपीट्ट्याच्या अर्थीवा भाडेपीट्टा हुक्कांच्या अदिभाहुस्तांतारर्णाच्या दिकांवा अदिभाहुस्तांकानांाच्या अर्थीवा दिवक्री प्रमंार्णपीत्राच्या मंागागनांे संपीादिदाता काेलेल्या जदिमंनांीच्या दिकांवा काोर्णत्याहुी प्रकारच्या जंगमं दिकांवा स्र्थीावर मंालमंत्तेच्या हुस्तांतारर्णाच्या संलेखास दिकांवा दास्ताऐवजांस लागू असर्णार नांाहुी.

(५) उक्ता जागदिताका क्षमंता कांद्रां धोरर्ण, २०२५ अन्वये पीात्रा जागदिताका क्षमंता कांद्रां युदिनांटी आदिर्ण त्यानांतारचाे दिकांवा त्यापीुढेील युदिनांटी यांच्यामंधोील पीुढेील संव्यवहुार, या आदाेशान्वये मंुद्रांांका शाुल्काच्या मंाफीसाठी दिकांवा कापीाताीसाठी पीात्रा असर्णार नांाहुी. असा युदिनांटी ताे युदिनांटी संव्यवहुार, या आदाेशान्वये मंुद्रांांका शाुल्काताील मंाफीसाठी दिकांवा कापीाताीसाठी पीात्रा असर्णार नांाहुी.

(६) यासोबता जोडलेल्या अनांुसूचाीच्या स्तांभा (२) मंध्ये वापीरलेले शाब्दा व शाब्दाप्रयोग यांनांा, "जागदिताका क्षमंता कांद्रां धोरर्ण - २०२५" यामंध्ये जो अर्थीग नांेमंूनां दिदालेला असेल ताोचा अर्थीग असेल.

ORDER

Maharashtra staMp act.

No.Mudrank-2025/URO-31/Mudrank-2.— Whereas, the Government of Maharashtra has vide the Government Resolution, Industries, Energy and Labour Department No. ITP-2021/CR-170/IND- 2, dated the 27th June 2023 declared the New Information Technology and Information Technology Enabled Services Policy of Maharashtra State-2023 (hereinafter referred to as "the said IT/ITES Policy-2023");

And Whereas, the Government of Maharashtra has vide the Government Resolution, Industries, Energy, Labour and Mining Department No. GCC-2025/CR-114/IND-2, dated the 03rd November 2025 declared the New Maharashtra Global Capability Centers (GCC) Policy-2025 (hereinafter referred to as "the said GCC Policy-2025");

And Whereas, the Government of Maharashtra has declared to provide inter alia fiscal incentives for the New Maharashtra Global Capability Centers units (hereinafter referred to as "the GCC Unit") in the form of exemption of the stamp duty as per the Maharashtra IT/ITES Policy-2023, Para. 7.1; Now, therefore, under the said GCC Policy-2025 in exercise of the powers conferred by clause (a) of section 9 of the Maharashtra Stamp Act (LX of 1958) (hereinafter referred to as "the said Act") the Government of Maharashtra, being satisfied that it is necessary to do so in the public interest, hereby reduces or remits the stamp duty to the extent specified in column (3) of the Schedule appended hereto, chargeable under various Articles of the Schedule-I appended to the said Act, on the instruments specified in column (4) of the Schedule, in respect of the elgibile category of units or projects as per the said GCC Policy-2025 specified in column (2) of the Schedule, for the period commencing on the 3rd November 2025 - 3rd November 2030 (inclusive of both days) or till the said GCC Policy-2025 is in force, subject to the following conditions, namely :-

Conditions .—

(1) Any GCC Unit failing to start the activities for which the reduction or remission is granted or commits breach of any of the conditions of the Maharashtra State GCC Policy 2025 shall be liable to pay the stamp duty and penalty, as if, there was no reduction or remission from the beginning.

(2) For the GCC unit seeking stamp duty exemption under the GCC policy, it will be essential to verify whether the unit under consideration has availed or not availed any stamp duty exemption, under any other Policies of Government of Maharashtra issued in this behalf.

It will be compulsory to submit 'No Objection Certificate' from the Competent Authority of Industries Department in this regard.

(3) No refund shall be granted where full or proper stamp duty has already been paid by any of the GCC Units, prior to the date of publication of this Order in the Maharashtra Government Gazette.

(4) The benefit of stamp duty remission or reduction under this Order is applicable in the zones specified in the Schedule appended hereto.

(5) The GCC Unit which has availed for the remission reduction of stamp duty under this Order shall not be entitled for remission or reduction of stamp duty for the same transaction as per any other Order or Policy.

(6) Any GCC Unit who is party to the document specified in column (4) of the Schedule appended hereto for which the remission or reduction in the stamp duty is granted under this Order and who fails to fulfill the purpose or objectives of the said GCC Policy-2025 or commits breach of any of the conditions as specified in this Order, shall be liable to pay the whole stamp duty and penalty, if any, as if there was no remission or reduction in stamp duty from the beginning.

(7) The Competent Authority as specified in the said GCC Policy-2025 must convey to the Inspector General of Registration and Controller Stamps, Maharashtra State, Pune on regular basis the names and details of the units which have availed of remission or reduction of the stamp duty under this Order but has failed to fulfill the purpose or objectives of the said GCC Policy-2025 or committed breach of any of the conditions specified in this Order.

(8) Any GCC Unit will be eligible to avail stamp duty exemption under this Order only for the premises which has valid Commencement Certificate or RERA Approval from the concerned Planning Authority or Competent Authority.

(9) Any GCC Unit in production or operation, shifting from one location to another and this unit had already availed of stamp duty exemption earlier, will not be eligible for stamp duty exemption under this Order.

(10) If any existing GCC Unit makes minimum 25% additional fixed capital investment on or after commencement of this policy will be considered as expansion or diversification unit and it will be eligible for stamp duty exemption under this Order.

Explanation.—

(1) "The Maharashtra IT/ITES Policy, 2023" means the Maharashtra IT/ITES Policy, 2023 declared by the Government, vide the Government Resolution, Industries, Energy and Labour Department, No. ITP-2021/CR-170/Ind-2, dated the 27th June 2023.

(2) "The Maharashtra Global Capabality Centres Policy, 2025" means the Maharashtra GCC Policy, 2025 declared by the Government vide the Government Resolution, Industries, Energy, Labour and Mining Department No. GCC-2025/CR-114/IND-2, dated the 03rd November 2025.

(3) "GCC unit" means any industrial enterprise/business, constituted as a company—including private, co-operation, public, trust, LLP, or joint undertaking—setting up a Global Capability Centre (GCC), Global In-house Centre, or Offshoring Unit. This unit must operate in Maharashtra and engaged in servicing its parent organisation or global affiliates. These units shall commonly be referred to as 'GCC' unit'.

(4) The benefit of stamp duty reduction or remission provided by this Order shall not apply to the instrument or documents of transfer of acquired land or any type of movable or immovable property by way of lease or conveyance or assignment of lease rights or sale certificate executed between the eligible GCC unit and the subsequent unit under the said GCC Policy-2025.

(5) Further transactions between the eligible GCC unit and the subsequent or the next unit under the said GCC Policy-2025 shall not be eligible for the remission or reduction in the stamp duty under this Order. Thus unit to unit transaction shall not be eligible for stamp duty remission or reduction under this Order.
