आवणे ज्याअर्थी, उक्ती अववनांयमंाच्या कलमं ३७ च्या पो-कलमं (१कक) अन्िये प्राप्ती अवकारा आवणे त्या संभातील सि शाक्तींा िापरा करुनां, शासनांानांे व.०८ मंे २०२३ राोजी सूनांा त्यासोबतीे परिरावशाष्ामंध्ये नांमंू प्रस्तीाविती फेराबलािरा (यापुढे ज्यांा उल्लेख "प्रस्तीाविती फेराबल" असा कराण्याती आला आहाे.) जनांतीेकडूनां हाराकती / सूनांा मंागविण्यासाठी प्रवसद्ध केली आहाे आवणे ज्याद्वाराे प्रस्तीाविती फेराबलाबाबती प्राप्ती हाोणेाऱ्या हाराकती / सूनांांिरा संबंवतीांनांा सुनांािणेी ेण्याकराीतीा तीसे उक्ती अववनांयमंाच्या कलमं ३७(१कक) अन्िये विवहाती केलेली कायिाहाी पूणे करूनां प्रस्तीाि शासनांास सारा कराणेसाठी सहा संालक नांगरारानांा, कोकणे विभाग यांी अवकाराी (यापुढे ज्यांा उल्लेख "उक्ती अवकाराी" असा कराण्याती आला आहाे.) म्हाणेूनां वनांयुक्ती कराण्याती आली आहाे;

आवणे ज्याअर्थी, प्रस्तीाविती फेराबलाी सरा शासनां सूनांा व.०८ मंे २०२३ हाी महाराष्ट्र शासन राजपत्र (असाराणे भाग-१ कोकणे विभागीय पुरािणेी) मंध्ये व.१६ मंे २०२३ राोजी प्रवसद्ध कराण्याती आली हाोती आवणे उक्ती अवकाराी यांनांी अववनांयमंाे कलमं ३७(१कक) अन्िये िैावनांक कायिाहाी पूणे करूनां व.०८/०४/२०२४ राोजीच्या पत्रान्िये त्यांा अहािाल नांगरारानांा संालनांालयामंाफेफती शासनांाे अंवतीमं मंजूराीसाठी सारा केला आहाे;

आवणे ज्याअर्थी उक्ती मंहानांगरापावलकेी विनांती विाराती घेऊनां ि संालक, नांगरारानांा, मंहाराष्ट्र राज्य, पूणे यांेशाी सल्लामंसलती केल्यानांतीरा प्रस्तीाविती फेराबल मंजूरा कराणे आिश्यक असल्याे शासनांाे मंती झालेले आहाे.

आतीा त्याअर्थी, उक्ती अववनांयमंाच्या कलमं ३७(१कक)(ग) अन्िये प्राप्ती अवकाराती आवणे त्या संभातील सि शाक्तींा िापरा करूनां शासनां याद्वाराे :

अ) उक्ती प्रस्तीाविती फेराबलाे प्रस्तीािास सोबतीे परिरावशाष्ामंध्ये नांमंू केलेप्रमंाणे मंजूराी ेती आहाे.

ब) सराी अवसूनांा शासकीय राजपत्रामध्ये प्रवसद्ध झालेा वनांांक हा उक्ती फेराबल अंमंलाती आलेा वनांांक असेल.

क) उक्ती वनांयमंािली मंजूराी सोबतीच्या फेराबलाे परिरावशाष्ामंध्ये शाेिच्या नांोंीनांतीरा खालील परिरावशाष् समंाविष् कराणे वनांदेशा ेती आहाे.

NOTIFICATION

Maharashtra regional and town Planning act, 1966.

No. TPB-4322/508/CR-119/2022/UD-11.—Whereas, the Government of Maharashtra has sanctioned the Unified Development Control and Promotion Regulations (UDCPR) (hereinafter referred to as "the said Regulations") for the state except Municipal Corporation of Greater Mumbai, other Planning Authorities / Special Planning Authorities / Development Authorities within the limits of Municipal Corporation of Greater Mumbai, MIDC, NAINA, Jawaharlal Nehru Port Trust, Hill Station Municipal Councils, Eco-Sensitive/ Eco-Fragile region notified by MoEF & CC and Lonavala Municipal Council and Area under CIDCO's jurisdiction as Planning Authority, PCNTDA, MIHAN, MADC, MSRDC, in Maharashtra under the provisions of the Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as "the said Act") vide Notification No.TPS-1818/CR.238/18/DP. & RP./Sec.37 (1AA) (c) & sec.20(4)/UD-13, dated 02/12/2020;

And whereas, to make applicable the Regulations for the area of CIDCO as Planning Authority, for the area of Pimpri-Chinchwad New Town Development Authority, for the area of Multi-Model International Hub Airport Notified area (MIHAN), for Shirdi Airport Notified area of Maharashtra Airport Development Company Ltd. (MADC) as Special Planning Authority and for notified area of Maharashtra State Road Development Corporation as Special Planning Authority, the Government has published Notices under section 37(1AA) & section 20(3) of the said Act, bearing No.TPS-1818/ CR-236/18/Sec.37(1AA) & Sec.20(3)/UD-13, dated 02/12/2020 and No.TPS-1818/CR-236/18/Sec.20(3)/ UD-13, dated 02/12/2020 respectively along with directives under section 154 of the said Act, 1966 vide resolutions No.TPS-1818/ CR-236/18/Sec.37(1AA) & Sec.20(3)/UD-13, dated 02/12/2020 and No.TPS-1818/CR-236/18/Sec.20(3)/UD-13, dated 02/12/2020 respectively;

And whereas, Government has issued Corrigendum / Addendums to the said Regulations vide various resolutions;

And whereas, the said regulations have come into force from 03/12/2020 and are applicable to Navi Mumbai Municipal Corporation (hereinafter referred to as "the said Corporation") and whereas, before the said regulations, the then Development Control Regulations were in operation from 27/12/2007 for the the said Corporation; and whereas, there was a provision regarding 'permissible FSI for Public Utility Plots' in Regulation 38.1(g) of the then Development Control Regulations of the said Corporation; and whereas, Government in Urban Development Department vide notification dated 07/12/2013 had modified the Regulation 38.1(g) along with Appendix-VIII (hereinafter referred to as "the said modification") and as per said modification, the Bus Depot, Bus Terminal and for the land belonging to Maharashtra State Road Transport Corporation (hereinafter referred to as "MSRTC") and Navi Mumbai Municipal Transport (hereinafter referred as "NMMT") were allowed to be developed with additional 0.5 FSI, over and above the permissible FSI and out of total FSI maximum 1.00 FSI was allowed to be developed for commercial use;

And whereas, Clause 7.0 of the said Regulations (UDCPR) stipulates about "Higher F.S.I. for certain uses" and table 7-A, Sr. No.E provides for the higher FSI for the Buildings of Government and Semi-Government Offices, Local Authorities and Public Sector Undertakings/the land in possession of MSRTC, City Transport/Metro Stations and Depot etc. and whereas, as per provision given in Column No.5(ii) of Sr. No.E, for the land in possession of MSRTC, maximum 2/3 FSI out of Maximum building potential can be utilized for Commercial use (hereinafter referred as "the said provision");

And whereas, a letter dated 13/10/2022 is received from the said Corporation wherein it is stated that, as there is no provision in the said regulations just like the provision inserted as per said modification in the then Development Control Regulations of the said Corporation, the said Corporation is facing problems in developing the land under possession of NMMT and further requested the Government to modify the said provision of the said regulations to make it applicable also in respect of the lands in the possession of NMMT just like in case of lands in possession of MSRTC;

And whereas, in exercise of the powers conferred under Sub-Section (1AA) of Section 37 of the said Act, Government had issued Notice dated 08 May, 2023 for inviting suggestions/objections from the general public with regard to the proposed modification as mentioned in the Schedule appended to the said Notice(hereinafter referred to as "the proposed modification") and appointed the Deputy Director of Town Planning, Greater Mumbai as the Officer (hereinafter referred to as "the said Officer") to complete the procedure as stipulated under Section 37(1AA) of the said Act and to submit a report on the objections/suggestions received in respect of the proposed modification to the Government after giving hearing to the concerned persons;

And whereas, the said Notice dated 08 May, 2023 was published in the Maharashtra Government Gazette (Part 1- Kokan Division supplement) (hereinafter referred to as "the Maharashtra Government Gazette") dated 16 May, 2023 and the said officer has submitted his report to the Government vide letter dated 08/04/2024 through the Director of Town Planning, Maharashtra State, Pune after completing the legal procedure as stipulated under Section 37(1AA) of the said Act;

And whereas, after considering the Report of the said Officer and after consulting the Director of Town Planning, Maharashtra State, the Government is of the opinion that the proposed modification is required to be sanctioned.

Now, therefore, in exercise of the powers conferred upon it under section 37(1AA) (c) of the said Act, the Government hereby:-

(A) Sanctions the proposed modification as described more specifically in the Schedule herewith.

(B) Fixes the date of publication of this Notification in the Official Gazette as the date of coming into force of this modification.

(C) Directs that in the Schedule of Modifications sanctioning the said Regulation, after the last entry, the Schedule referred to at (A) above shall be added.
