आवि ज्याअर्थी, आतीा, उक्ती विमनांीच्या मालकांनांी चीविलती बारामूल्य रा तीक्त्यानांुसारा येाऱ्या उक्ती विमनांीपुैकी ४.३ हेक्रा क्षेत्राच्या एकू राकमेच्या ५% रानांे येाऱ्या अविधामूल्य राक्कमेपुैकी शासनांास ेय असलेली अविधामूल्याची ५०% राक्कम रु.२,५५,४२०/- सहायक संचीालक, नांगरा राचीनांा, अमराती शाखा, अमराती यांच्या लेखाविशाषीारमध्ये विनांांक २ एविल, २०२६ राोी मा केलेली आहे, आवि विनांयोनां ाविधाकरास ेय असलेली ५०% अविधामूल्याची राक्कम रु.२,५५, ४२०/-, विनांांक २३ माचीर, २०२६, विनांांक २४ माचीर, २०२६ राोी मुख्याविधाकाराी, रूड नांगरापुरिराषी, वि. अमराती यांच्याकडे मा केलेली आहे ;
आतीा, त्याअर्थी, उक्ती अविधाविनांयमाचीे कलम ३७ चीे उपुकलम (२) अन्ये त्या अनांुषींगानांे असलेल्या इतीरा अविधाकाराचीा ापुरा करुनां, उक्ती विकास योनांेतील उक्ती फेराबल स्तीाखालील मौे रुड येर्थील सर्व्हेहे क्र. ४८६/१, ४८६/१/क, ४८६/२, ४८६/३ मधाील ४.३ हेक्रा ागेसाठीच्या फेराबलास, सरा क्षेत्रा कृषी विभागातीूनां गळूनां राविहास विभागाती समाविष् कराेस काही अंसह मंुराी ेती आहे, आवि त्यासाठी उपुराोक्ती विनांांक १५ ुलै, २००५ ची अविधासूचीनांा सुधारिराती कराण्याती येती आहे;

उक्ती मंूरा फेराबल शारविाऱ्या भाग नांकाशाची ती मुख्याविधाकाराी, रुड नांगरापुरिराषी, वि. अमराती यांच्या कायारलयाती, कायारलयीनां ेळूेमध्ये नांागरिराकांच्या अलोकनांार्थीर एक मविहन्याच्या कालाधाीसाठी ठेण्याती आली आहे.

NOTIFICATION
No.TPS-2824-1014-CR-199-2024-UD-30.—
Whereas, the Development Plan of Warud City, Dist. Amravati (Revised Original Limit + Extended Limit) has been sanctioned by the Government under section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") vide Urban Development Department's Notification No.TPS-2803-1896-CR-8(B)-04-UD-30, dated the 15th July, 2005 and has come into force with effect from the 01st September, 2005 and Republished Development Plan of Substantial nature modifications, has been sanctioned vide Urban Development Department's Notification No.TPS-2806-379-CR-243-2006-UD-30, dated the 06th June, 2007 and has come into force with effect from the 16th July, 2007 (hereinafter referred to as "the said Development Plan");
And whereas, in the said Development Plan, the land admeasuring 4.3 Hect. bearing Survey Nos. 486/1, 486/1/C, 486/2, 486/3 of Mauje Warud (hereinafter referred to as "the said Land") is included in "Agriculture Zone";
And whereas, as per the provisions of Section 37(1) of the said Act, the Chief Officer, Warud Municipal Council, Dist.Amravati videAdministrative Resolution No.217, dated the 1st January, 2024, has resolved to make modification in the said Development Plan, so as to delete the said Land from Agriculture Zone and to include the same in Residential Zone (hereinafter referred to as "the said Proposed Modification") and accordingly submitted the proposal to the Government for sanction;
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that, the said Proposed Modification should be sanctioned with certain conditions;
And whereas, the land owner of owner of the land admeasuring 4.3 Hect. out of the said Land, has deposited 50% the Government share of 5% premium amount of Rs. 2,55,420/-, as per the rate of said Land as prescribed in the Annual Statement of Rates (ASR) for the prevailing year, in the Government Treasury videchallan, dated the 02nd April, 2026, through the Assistant Director of Town Planning, Amravati Branch, Amravati and the remaining 50% of the 5% premium amount of Rs. 2,55,420/- has been deposited with the Chief Officer, Warud Municipal Council, Dist. Amravati, dated the 23rd March, 2026, 24th March, 2026;
Now, therefore, in exercise of the powers conferred on it under sub-section(2) of Section 37 of the said Act, the Government of Maharashtra hereby sanctions the said Proposed Modification, as shown on plan and for that purpose amends the above said Notification dated the 15th July, 2005 as follows:-
"In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry."-
ENTRY
"The land admeasuring 4.3 Hect. bearing Survey Nos. 486/1, 486/1/C, 486/2, 468/3 of Mauje Warud excluding land affected by 54m wide DP road, is deleted from Agriculture Zone and the land so released is included in Residential Zone as shown on plan, subject to following conditions-
Condition No.1 - While developing the land under modification, in addition to 10% open space, it is mandatory to provide additional 10% amenity space.
ConditionNo.2 - It is compulsory for the Land Owner/Developer to compound the land.
४ महाराष्ट्र शासन राजपत्र भाग एक-अ अमरावती विवभागीय पुरावणी, मे २८-जून ३, २०२६/ज्येष्ठ ७-१३, शाके १९४८Condition No.3 - It is compulsory for the Land Owner/Developer to provide basic amenities at their own cost. Basic amenities shall include roads, water supply, drainage,etc.
Condition No.4- If the above said infrastructure amenities are proposed to be developed by stages, then sale of plots shall be monitored by the Chief Officer, Warud Municipal Council, Dist. Amravati, in relation to expected development of civic facilities as per the stages given below.—
A. After final approval of layout - sale of 25% of total plots shall be permissible B. After completion of 40% of civic Amenities. - sale of 50% of total plots shall be permissible C. After completion of 60% of civic Amenities. - sale of 75% of total plots shall be permissible D. After completion of 80% of civic Amenities. - sale of 90% of total plots shall be permissible E. After completion of 100% of civic Amenities. - sale of 100% of total plots shall be permissible In case of violation of the above, the layout and non- agriculture permission will be eligible for revocation.
If group housing is to be developed in the layout, occupation certificate should not be issued unless all the infrastructure facilities are developed".
A copy of the part plan showing the aforesaid sanctioned modification shall be available in the office of the Chief Officer, Warud Municipal Council, Dist. Amravati, during office hours on all working days for inspection of public for a period of one month.
This Notification shall also be published on the Govt. website www.maharashtra.gov.in /Acts & Rules.

And whereas, it is observed that, the said Land had neither been acquired, within prescribed time period from the date of service of Notice, nor Notification of land acquisition required under section 126(4) of the said Act, read with section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, been published within prescribed time period by the said Appropriate Authority. And, in consequence thereof, the Government of Maharashtra is of opinion that, the said Reservations on the said Land stands lapsed as per the provisions of Section 127(1) of the said Act;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra, as mentioned in the Annexure below, hereby notifies that, the said Reservation on the said Land as specified in the Sanctioned Revised Development Plan of Akola City (Original Limit), stands lapsed and the area so released will be available to the owners for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan;

Whereas, the Revised Development Plan of Akola City (Original Limits) has been sanctioned by the Government under section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") vide Notification No. TPS-2502-680-CR-129(B)-2002-UD-30, date 26th October, 2004 and has come into force with effect from dated 15th December, 2004 (hereinafter referred to as "the said Development Plan") ;
And whereas, in the said Development Plan, the land bearing Survey No. 24/2, Sheet No. 82, Plot No. 7/1/1A of Mauje Malkapur, Dist. Akola (hereinafter referred to as "the said Reserved Land") is reserved for 'Site No. 184- Shopping Center & Vegetable Market' (hereinafter referred to as "the said Reservation");
And whereas, the Akola Municipal Corporation is "Appropriate Authority" for the said Reservations.

And whereas, the said Reserved Land has not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force ;
And whereas, the Owners of the land bearing Survey No. 24/2, Sheet No. 82, Plot No. 7/1/1A of Mauje Malkapur, Dist. Akola admeasuring area approximately 1951.43 Sq. Mtr. (hereinafter referred to as "the said Land") out of the said Reserved Land, in reference to the Said Reservation, had served a notice dated 26th June, 2015 under section 127(1) of the said Act to the said Appropriate Authority, being the Planning Authority (hereinafter referred to as "the said Notice");
