No. SPP.1025/1638/C.R.158/D-XIV.—In view of the letter received from the applicant Shri. Abhay Kamlakar Sakhle, the Government of Maharashtra hereby cancels the appointment of Adv. Rajashree R. Gurav as the " Special Public Prosecutor " for conducting the Session Case bearing no. 319/2014 pending before Sessions Court, Mumbai which is arising out of C.R. No. 113/2013 registered at Tilaknagar Police Station, Mumbai issued vide Law and Judiciary Department Notification No. SPP.4715/838(192)/D-XIV, dated 07th July, 2015 with immediate effect.

जा. क्र.वि -१/महारुद्रनापत/अवि./कमम./क.१५६/अवि.प्रदाना/सना २०२६/१६३५.—महाराष्ट्र सहाकाराी संस्था अविविनायम, १९६० चे कलम १५६ (१) अन्ये मला प्रदाना कराण्यात आलेल्या शक्तीचेा ापरा करूना मी, फयाजा मुलाणी, विजाल्हा उपविनाबंक, सहाकाराी संस्था, नाविशक या आदाेशान्ये श्री महारुद्र हानाुमाना नागराी सहाकाराी पतसंस्था मयाम. नाविशक, ता. विजा. नाविशक या संस्थाेचे खालील अविकाऱ्यांना त्यांचे नापुढे दाशमविलेल्या कायमक्षेत्रासाठी महाराष्ट्र सहाकाराी संस्था अविविनायम, १९६० चे कलम १०१ कलम ९१ अन्ये प्राप्त झालेल्या सुली प्रमाणीपत्राचेी अंमलबंजाणी / कजाम सुली कराण्याकरिराता महाराष्ट्र सहाकाराी संस्था अविविनायम, १९६० चे कलम १५६ (१) विनायम १०७ अनाुसारा मालमत्ता जाप्त करूना वितचेी विक्री करूना राकमा सूल कराण्याचे विनाबंकाचे अविकारा, खालील अटीस अविना राहाूना या आदाेशाच्या विदानांकापासूना ते विदानांक ३१माचेम २०२७ (नाीना विनायुक्ती) या कालाीकरिराता प्रदाना कराीत आहाे :—

टीप.—

(१) सुली अविकाराी यांनाी महाराष्ट्र सहाकाराी संस्था अविविनायम, १९६० चे कलम १५६ विनायम, १९६१ चे विनायम १०७ मील तरातुदाीनाुसारा कजाम सुलीचेी कायमाहाी कराी. कजाम सुली कराताना सहाकारा कायदा, विनायम यातील तरातुदाी परिरापत्राकीय सूचेनांचे पालना ना केल्याचे विनादाशमनास आल्यास आश्यक ती चेौकशी करूना आश्यकता भासल्यास सदाराचे अविकारा तात्काळ काढेूना घेण्यात येतील.

(२) सदाराचे अविकारा सहाकारा कायदा कलम १०१ ९१ अन्ये प्राप्त सुली दाखाल्याचेी अंमलबंजाणी कराण्याकरिराता असतील.

(३) सुली अविकाराी यांनाी मा. सहाकारा आयुक्त विनाबंक, सहाकाराी संस्था, महाराष्ट्र राज्य, पुणीे यांचेकडील परिरापत्राक जा. क्र. पतसंस्था /सआ-५ खाचेम/ सुली आदाेश / २०१८, विदानांक ३१ ऑक्टीोबंरा २०१८ राोजाी विनागमविमत केलेल्या परिरापत्राकानाुसारा दारामहा सोबंत जाोडीलेल्या विविहात नामुन्यात प्रपत्रा १,२,३ ५ प्रमाणीे कजाम सुलीचेी माविहाती या कायामलयास सादारा कराी.

(४) या कायामलयानाे अविकारा प्रदाना केलेल्या सुली अविकाराी असलेल्या व्यक्तीचेी बंदाली झाल्यास विकंा सेाविनाृत्ताी झाल्यास विकंा सेतूना काढेूना टीाकल्यास विकंा त्याचेा मृत्यू झाल्यास, अशा अविकाऱ्यास प्रदाना केलेले अविकारा आपोआप राद्दा हाोतील.

(५) सुली अविकाराी यांनाी नामूदा केलेल्या कालाीत सुलीचे कामकाजा समानाकाराक केले नासल्याचे विनादाशमनास आल्यास विकंा प्रदाना केलेल्या अविकाराचेा गैरापरा कराीत असल्याचे विनादाशमनास आल्यास, प्रदाना केलेले अविकारा काढेूना घेतले जातील भाविष्यात असे कोणीतेहाी अविकारा अशा व्यक्तीस प्रदाना कराण्यात येणीारा नाहाी.

(६) शासना विनाणीमय क्रमांक संकीणीम-१५०४/प्र.क्र. २३१/१५-स, विदानांक २३ नाोव्हांबंरा २००६ अन्ये विशेष सुली अविकाऱ्यांना तीना विसंहाच्या राजामुद्रेचेा ापरा कराता येणीारा नाहाी.

(७) सुली अंविधकाऱ्यास त्याच्या नापुढे कोठेहाी " महाराष्ट्र शासन विनयुक्ते " आविणु विकंा " विसव्हाील कोटीट "

" एक्झीक्युटीव्हा कोटीट " या शाब्दीांचा अंथा तेत्सम शाब्दीांचा ापरा करातेा येणुारा नाहाी. त्याऐजाी सुली अविकाऱ्यांनाी त्यांच्या

नापुढे " सुली अविकाराी (महाराष्ट्र सहा. संस्था अविविनायम, १९६० विनायम, १९६१ चे विनायम १०७ अन्ये) " असे विलहाे.

(८) सुली अविका-यास सुलीसाठी ापरा कराण्यात येणीाऱ्या ाहानारा " सुली अंविधकाराी, श्री महारुद्र हानाुमाना नागराी सहाकाराी पतसंस्था मयाम. नाविशक, ता.विजा. नाविशक " असा फलक लाता येईल.

(९) सुली अविकाऱ्यानाे पगारा जाप्तीचेी कायमाहाी कराताना कजामदाराच्या/ जाविमनादाराच्या पगारा कपातीबंाबंत राष्ट्रीयीकृत बंँका ा अन्य बंँका यांचेकडीे परास्परा ेतना कपातीचेा आदाेश दाेऊना परास्परा पगारा कपात कराता येणीारा नाहाी. संबंवित कजामदारा/जामीनादारा ज्या आस्थापनाेरा काम कराीत आहाे त्या आस्थापनाेराील आहाराणी संवितराणी अविकाराी / पगारा कराणीारा अविकाराी यांचेमाफफत पगारातूना कजाम सूल कराण्याचेी कायमाहाी कराी.

(१०) सुली अविकाऱ्यास, थाकबंाकीदाराकडीूना सुली दाखाल्यानाुसारा सूलपात्रा राक्कम मा. सहाकारा आयुक्त विनाबंक, सहाकाराी संस्था, महाराष्ट्र राज्य, पुणीे यांचे विदानांक ६ एविप्रल २०१८ राोजाीचे आदाेशामध्ये विनाश्चिश्चेत केलेल्या दारानाे सूल करायाचेी राक्कम याविशाय इतरा कोणीतीहाी राक्कम कराता येणीारा नाहाी. सदारा खाचेामचेी आकाराणी विविनायोग याबंाबंत प्रकराणीविनाहाय विहाशोबं ठीेायाचेा असूना त्याचेी तपासणी संस्थाेच्या ैाविनाक लेखापराीक्षेकांकडीूना करूना घ्यायाचेी आहाे.

(११) सुली अविकाऱ्यानाे मा. सहाकारा आयुक्त विनाबंक, सहाकाराी संस्था, महाराष्ट्र राज्य, पुणीे यांचे कायामलयाच्या विदानांक ३१ ऑक्टीोबंरा २०१८ विदानांक ११ जाुलै २०१९ च्या परिरापत्राकातील सूचेनांचेी काटीेकोरापणीे अंमलबंजाणी कराी. सदारा परिरापत्राकातील सूचेनांचे उल्लंघेना झाल्यास सुलीचे अविकारा काढेूना घेण्यात येऊना भाविष्यकाळात असे अविकारा प्रदाना केले जाणीारा नाहाीत याचेी नांदा घ्याी. पतसंस्थाेच्या चेअरामना/व्यस्थापक/ असायक यांनाी दारामहा सुली अविकाऱ्याच्या कामकाजाचेा कजामदाराविनाहाय आढेा परिरापत्राकातील प्रपत्रा पाचेमध्ये नामूदा केल्याप्रमाणीे घ्या.

(१२) सुली अविकाराी यांनाी विनागमविमत करायाच्या नाोटीस/ आदाेश/ घेोषणीापत्रा यामध्ये त्यांना अविकारा प्रदाना केलेल्या या आदाेशाचेा संदाभाम नामूदा करा.

(१३) संस्थाेचे मुख्य कायमकाराी अविकाराी/ मॅनाेजारा/ व्यस्थापक/ असायक यांनाी प्रपत्रा ४ मध्ये सुली अविकाराीविनाहाय सुली कामकाजाचेा आढेा दारा सहा मविहान्यांनाी या कायामलयास सादारा करा.

(१४) सम प्रकराणीामध्ये जांगम जाप्ती, स्थारा जाप्ती, अपसेटी प्राईजा मंजाुराी, जाहाीरा विलला कलम १००/८५ अन्येचेी कायमाहाी हाी विनायमानाुसारा विविहात मुदातीत पूणीम कराण्यात याी. विविहात मुदातीत उक्त कायमाहाी पूणीम ना केल्यास आपणीांस विदानांक १ एविप्रल २०२७ पासूना पुढेील कालाीसाठी कलम १५६ चे अविकारा प्रदाना कराण्यात येणीारा नाहाी याचेी गांभाीयामनाे नांदा घ्याी.

क्रमांक वि-१/जायमल्हानापत/अवि./कमम./क.१५६/अवि. प्रदाना/सना २०२६/१७२४.—महाराष्ट्र सहाकाराी संस्था अविविनायम, १९६० चे कलम १५६ (१) अन्ये मला प्रदाना कराण्यात आलेल्या शक्तीचेा ापरा करूना मी, फयाजा मुलाणी, विजाल्हा उपविनाबंक, सहाकाराी संस्था, नाविशक या आदाेशान्ये जाय मल्हारा नागराी सहाकाराी पतसंस्था मयाम. नाविशक, ता. विजा. नाविशक या संस्थाेचे खालील अविकाऱ्यांना त्यांचे नापुढे दाशमविलेल्या कायमक्षेत्रासाठी महाराष्ट्र सहाकाराी संस्था अविविनायम, १९६० चे कलम १०१ कलम ९१ अन्ये प्राप्त झालेल्या सुली प्रमाणीपत्राचेी अंमलबंजाणी / कजाम सुली कराण्याकरिराता महाराष्ट्र सहाकाराी संस्था अविविनायम, १९६० चे कलम १५६ (१) विनायम १०७ अनाुसारा मालमत्ता जाप्त करूना वितचेी विक्री करूना राकमा सुल कराण्याचे विनाबंकाचे अविकारा, खालील अटीस अविना राहाूना या आदाेशाच्या विदानांकापासूना ते विदानांक ३१ माचेम २०२९ (फेराविनायुक्ती) या कालाीकरिराता प्रदाना कराीत आहाे :—

(१) सुली अविकाराी यांनाी महाराष्ट्र सहाकाराी संस्था अविविनायम, १९६० चे कलम १५६ विनायम, १९६१ चे विनायम १०७ मील तरातुदाीनाुसारा कजाम सुलीचेी कायमाहाी कराी. कजाम सुली करातांना सहाकारा कायदा, विनायम यातील तरातुदाी परिरापत्राकीय सूचेनांचे पालना ना केल्याचे विनादाशमनास आल्यास आश्यक ती चेौकशी करूना आश्यकता भासल्यास सदाराचे अविकारा तात्काळ काढेूना घेण्यात येतील.

(२) सदाराचे अविकारा सहाकारा कायदा कलम १०१ ९१ अन्ये प्राप्त सुली दाखाल्याचेी अंमलबंजाणी कराण्याकरिराता असतील.

(३) सुली अविकाराी यांनाी मा. सहाकारा आयुक्त विनाबंक, सहाकाराी संस्था, महाराष्ट्र राज्य, पुणीे यांचेकडील परिरापत्राक जा. क्र. पतसंस्था /सआ-५ खाचेम/ सुली आदाेश / २०१८, विदानांक ३१ ऑक्टीोबंरा २०१८ राोजाी विनागमविमत केलेल्या परिरापत्राकानाुसारा दारामहा सोबंत जाोडीलेल्या विविहात नामुन्यात प्रपत्रा १,२,३ ५ प्रमाणीे कजाम सुलीचेी माविहाती या कायामलयास सादारा कराी.

(४) या कायामलयानाे अविकारा प्रदाना केलेल्या सुली अविकाराी असलेल्या व्यक्तीचेी बंदाली झाल्यास विकंा सेाविनाृत्ताी झाल्यास विकंा सेतूना काढेूना टीाकल्यास विकंा त्याचेा मृत्यू झाल्यास, अशा अविकाऱ्यास प्रदाना केलेले अविकारा आपोआप राद्दा हाोतील.

(५) सुली अविकाराी यांनाी नामूदा केलेल्या कालाीत सुलीचे कामकाजा समानाकाराक केले नासल्याचे विनादाशमनास आल्यास विकंा प्रदाना केलेल्या अविकाराचेा गैरापरा कराीत असल्याचे विनादाशमनास आल्यास, प्रदाना केलेले अविकारा काढेूना घेतले जातील भाविष्यात असे कोणीतेहाी अविकारा अशा व्यक्तीस प्रदाना कराण्यात येणीारा नाहाी.

(६) शासना विनाणीमय क्रमांक संकीणीम-१५०४/प्र.क्र. २३१/१५-स, विदानांक २३ नाोव्हांबंरा २००६ अन्ये विशेष सुली अविकाऱ्यांना तीना विसंहाच्या राजामुद्रेचेा ापरा कराता येणीारा नाहाी.

(९) सुली अविकाऱ्यानाे पगारा जाप्तीचेी कायमाहाी कराताना कजामदाराच्या/ जामीनादाराच्या पगारा कपातीबंाबंत राष्ट्रीयीकृत बंँका ा अन्य बंँका यांचेकडीे परास्परा ेतना कपातीचेा आदाेश दाेऊना परास्परा पगारा कपात कराता येणीारा नाहाी. संबंवित कजामदारा/जामीनादारा ज्या आस्थापनाेरा काम कराीत आहाे त्या आस्थापनाेराील आहाराणी संवितराणी अविकाराी / पगारा कराणीारा अविकाराी यांचेमाफफत पगारातूना कजाम सूल कराण्याचेी कायमाहाी कराी.

(११) सुली अविकाऱ्यानाे मा. सहाकारा आयुक्त विनाबंक, सहाकाराी संस्था, महाराष्ट्र राज्य, पुणीे यांचे कायामलयाच्या विदानांक ३१ ऑक्टीोबंरा २०१८ विदानांक ११ जाुलै २०१९ च्या परिरापत्राकातील सूचेनांचेी काटीेकोरापणीे अंमलबंजाणी कराी. सदारा परिरापत्राकातील सूचेनांचे उल्लंघेना झाल्यास सुलीचे अविकारा काढेूना घेण्यात येऊना भाविष्यकाळात असे अविकारा प्रदाना केले जाणीारा नाहाीत याचेी नांदा घ्याी. पतसंस्थाेच्या चेअरामना/व्यस्थापक/ असायक यांनाी दारामहा सुली अविकाऱ्याच्या कामकाजाचेा कजामदाराविनाहाय आढेा परिरापत्राकातील प्रपत्रा पाचे मध्ये नामूदा केल्याप्रमाणीे घ्या.

(१२) सुली अविकाराी यांनाी विनागमविमत करायाच्या नाोटीस/ आदाेश/ घेोषणीापत्रा यामध्ये त्यांना अविकारा प्रदाना केलेल्या या आदाेशाचेा संदाभाम नामूदा करा.

(१३) संस्थाेचे मुख्य कायमकाराी अविकाराी/ मॅनाेजारा/ व्यस्थापक/ असायक यांनाी प्रपत्रा ४ मध्ये सुली अविकाराीविनाहाय सुली कामकाजाचेा आढेा दारा सहा मविहान्यांनाी या कायामलयास सादारा करा.

(१४) सम प्रकराणीामध्ये जांगम जाप्ती, स्थारा जाप्ती, अपसेटी प्राईजा मंजाुराी, जाहाीरा विलला कलम १००/८५ अन्येचेी कायमाहाी हाी विनायमानाुसारा विविहात मुदातीत पूणीम कराण्यात याी. विविहात मुदातीत उक्त कायमाहाी पूणीम ना केल्यास आपणीांस विदानांक १ एविप्रल २०२९ पासूना पुढेील कालाीसाठी कलम १५६ चे अविकारा प्रदाना कराण्यात येणीारा नाहाी याचेी गांभाीयामनाे नांदा घ्याी.

क्रमांक ईएसटी ३९२६/ई ऑविफस १६५३४०३/प्रशा-२.—"महाराष्ट्र खाजागी शाळांतील कममचेाराी (सेच्या शती) विविनायमना, अविविनायम, १९७७ (१९७८ चेा महाराष्ट्र अविविनायम क्रमांक ३) " या अविविनायमाच्या कलम ८ अन्ये खालील तक्त्यात नामूदा न्यावियक अविकाऱ्यांचेी त्यांच्या नासमोरा स्तंभा क्रमांक ३ मध्ये दाशमविलेल्या विठीकाणी पीठीासीना अविकाराी म्हाणीूना विनायुक्ती कराण्यात येत आहाे.

२. संबंवित न्यावियक अविकाऱ्यांनाी नाीना विनायुक्तीच्या विठीकाणी विदानांक ८ जाूना २०२६ राोजाी अथा त्यापूी रुजाू व्हाे पदाभारा श्चिस्काराल्याबंाबंतचेा अहाल शासनास सादारा करा.

३. लातूरा, नागपूरा आविणी अमराती येथाील शाळा न्यायाविकराणीांमध्ये पीठीासीना अविकाराी म्हाणीूना सध्या कायमरात असलेल्या अनाुक्रमे श्रीम. डी. टी. जा, श्री. एस. एना. विशंदाे श्री. ए. ाय. बंोराकरा या न्यावियक अविकाऱ्यांच्या सेा त्यांच्या मूळ न्यावियक सेत प्रत्याविपमत कराण्यात येत आहाेत.

४. याबंाबंतचेी आश्यक ती अविसूचेना महाराष्ट्र शासनाच्या राजपत्र (भाग - १) मध्ये प्रविसद्ध कराण्यात याी.

५. सदारा शासना विनाणीमय महाराष्ट्र शासनाच्या www.maharashtra.gov.in या संकेतस्थाळारा उपलब् कराण्यात आला असूना त्याचेा संकेताक २०२६०५१४१५१७१९३५२१ असा आहाे. हा विनाणीमय विडीजाीटील स्ाक्षेराीनाे साक्षेांविकत करूना काढेण्यात येत आहाे.

उक्त आदाेशामुळे समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा, ता. जामखाेडी, विजा. अविहाल्यानागरा या संस्थाेचे समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी, ता. जामखाेडी, विजा. अविहाल्यानागरा या संस्थाेमध्ये विविलनाीकराणी झाल्यामुळे, महाराष्ट्र सहाकाराी संस्था अविविनायम, १९६० चे कलम २१ नाुसारा या कायामलयाच्या स्तरारुना स्तंत्रा आदाेश विनागमविमत कराण्यात येत आहाेत.

संपत्ताी हास्तांतराणी अविविनायम, १८८२ विकंा भारातीय नांदाणी अविविनायम, १९०८ यात काहाीहाी अंतभाू मत असले तराी, विविलनाीकराणीाशी संबंवित असलेल्या संस्थांचेा ठीरा, प्रत्येक बंाबंतीत मूळ संस्थाेचेी विकंा विविलनाीकराणी केलेल्या संस्थाेचेी मत्ता दावियत्े नाव्या संस्थाेत विकंा यथाश्चिस्थाती रूपांतरिरात विकंा विविलनाीकराणी संस्थाेमध्ये विहाीत हाोण्याबंाबंतचे पुराेसे अविभाहास्तांतराणी पत्रा असेल.

संस्थांचे एकत्राीकराणी केल्यामुळे, एकत्राीकराणी केलेल्या संस्थांचे कोणीतेहाी हाक्क विकंा बंना यारा परिराणीाम हाोणीारा नाहाी. एकत्राीकराणी 'संस्थांकडीूना विकंा संस्थांविरुद्ध' जाी न्यावियक कायमाहाी चेालू ठीेण्यात विकंा सुरू कराण्यात आली असेल, अशी कोणीतीहाी न्यावियक कायमाहाी सदाोष ठीराणीारा नाहाी. न्यावियक कायमाहाी एकत्राीकराणी संस्थाेस विकंा संस्थाेविरुद्ध चेालू ठीेता येईल.

परिराविशाष्टी 'अं'

अंटी शातेी :—

१. विलीनीकराणु आविणु हास्तेांतेराणुः

समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा, ता. जामखाेडी, विजा. अविहाल्यानागरा या संस्थाेनाे पारिरात केलेल्या ठीराप्रमाणीे सहायक विनाबंक, जामखाेडी यांच्याकडीे दाखाल केलेल्या विलीनाीकराणीासंबंीच्या प्रस्ताच्या अनाुषंगानाे मंजाूरा झालेल्या आदाेशाप्रमाणीे, सदारा संस्था विलीनाीकराणी करूना समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी, ता. जामखाेडी, विजा. अविहाल्यानागरा या संस्थाेकडीे हास्तांतरिरात कराण्यात येईल.

२. भागभांडाल (Shares) आविणु सभासदीत्ः

विलीनाीकराणीाच्या आदाेशापासूना समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा या संस्थाेच्या ताळेबंदात दाखाविल्याप्रमाणीे शेअसम (भाग) राक्कम, सहाकारा कायद्योानाुसारा जारा तोटीा असेल तरा, सदारा शेअसम राक्कमेतूना झालेला तोटीा जा कराणीे आश्यक आहाे. या संस्थाेच्या सभासदांचेी उमरिरात शेअसम राक्कम समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेत अनामत खाते म्हाणीूना जामा कराण्यात येईल. जारा या सभासदांना समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेचे सभासदा व्हायचे असेल, तरा पतसंस्थाेच्या विनायमानाुसारा नाीना शेअसम खाराेदाी केल्यानांतराचे त्यांना सभासदा करूना घेण्यात येईल.

३. ठेी आविणु व्याजाबुाबुतेची तेरातेूदीः

विलीनाीकराणीानांतरा समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा या संस्थाेत असलेल्या ठीेी, या दाोन्हाी संस्थांच्या ठीरात नामूदा केल्याप्रमाणीे, या ठीेी समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेच्या पुस्तकात जामा राहातील. तसेचे त्यांच्या ठीेी समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेतचे पुढे चेालू राहातील, त्यांना संस्थाेच्या प्रचेविलत व्याजादाराप्रमाणीे व्याजा विदाले जाईल.

४. संचालक प्रावितेविनधंच्या राक्कमांरा विनबुंध:

समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा या संस्थाेचे संचेालक, संचेालकांचे नातेाईक दाैविनाक बंचेत प्रवितविनाी यांच्या जामा असलेल्या राक्कमा, संस्थाेनाे ाटीप केलेले कजाम (व्याजा, मुद्दाल सुली खाचेामसहा) तसेचे, सम प्रकाराच्या ठीेंचेी परातफेडी कजाम व्याजासहा सूल कराणीे विहा जाबंाबंदाराी समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी, ता. जामखाेडी, विजा. अविहाल्यानागरा या संस्थाेचेी असेल., यास संबंवित संस्थाेचेा विकंा सभासदांचेा कोणीताहाी आक्षेप असणीारा नाहाी.

४. खेात्यांचे हास्तेांतेराणुः

विलीनाीकराणीानांतरा समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा, विजा. अविहाल्यानागरा या संस्थाेत असलेली सम बंचेत खाती, मुदात ठीे खाती, चेालू खाती, माविसक मुदात ठीे खाती इतरा सम ठीेंच्या प्रकारातील खाती हाी समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी, ता. जामखाेडी, विजा. अविहाल्यानागरा या पतसंस्थाेच्या पुस्तकात गीकराणीानाुसारा उघेडीण्यात येतील.

५. कजष सुली कायदीेशाीरा जबुाबुदीाराीः

समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा या संस्थाेच्या सभासदांचेी येणीे कजामबंाकी सूल कराण्याचेी जाबंाबंदाराी हाी समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या पतसंस्थाेचेी राहाील. सुलीकामी काहाी तांवित्राक विकंा कायदाेशीरा बंाबंी उपश्चिस्थात झाल्यास त्याचे विनाराकराणी कराण्यासाठी 'समृद्धी जाीना मविहाला पतसंस्था' हाी संस्था समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेस समतोपराी सहाकायम कराेल. कजामसंबंीचे सम दास्तऐजा, गहाणी ताराणी पत्राे तसेचे कजामदारा-जामीनादारा यांचेी रुजाुात पत्राे हास्तांतरिरात केली जातील. कजामदारांनाी मूळ संस्थाेशी केलेल्या करारानाुसारा व्याजा, दांडीव्याजा, सुली खाचेम, लादा दा खाचेम इतरा सम अनाुषंविगक खाचेम कराराप्रमाणीे भाराणीे हाे कजामदारा, जामीनादारा संमतीदारा यांच्यारा बंनाकाराक राहाील.

६. मालमत्ता राोखे विशाल्लक विविनयोगः

विलीनाीकराणीाच्या आदाेशाच्या विदानांकापासूना समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा या संस्थाेचेी विवि बंँकांतील विशल्लक राक्कम, राोखा राक्कम इतरा येणी तसेचे ठीेी या राक्कमा समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेकडीे गम कराण्यात येतील. त्या राक्कमांचेा विविनायोग कसा करायाचेा, याचेा संपूणीम अविकारा समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेचेा राहाील. यारा मूळ संस्थाेचेा कोणीताहाी आक्षेप राहाणीारा नाहाी.

७. कायदीेशाीरा दीस्तेऐजांची ैधतेाः

विलीनाीकराणीाच्या विदानांकापूी समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा या संस्था इतरा तरा बंँकांत ठीेलेल्या ंतणीूक, करारानामे, बंपत्राे, कुलमुखात्यारापत्राे आविणी इतरा सम प्रकाराचेी कागदापत्राे विलीनाीकराणीानांतरा समृद्धी नागराी ठीेी, केलेली गु सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेच्या बंाबंतीत कायदाेशीरारिरात्या लागू आविणी परिराणीामकाराक राहातील.

८. कामकाजाचे ना संमतेी:

विलीनाीकराणीानांतरा समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा, ता. जामखाेडी या संस्थाेऐजाी समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी, ता. जामखाेडी या नानाे सम व्यहारा कामकाजा कराण्यात येईल. याबंाबंात मूळ संस्थाेचे सभासदा, संचेालक, कममचेाराी, कजामदारा, अल्पबंचेत प्रवितविनाी इतरा विहातसंबंी यांचेा कोणीताहाी आक्षेप राहाणीारा नाहाी.

९. मालमत्ताेचे हास्तेांतेराणुः

समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा या संस्थाेकडील सम चेल अचेल मालमत्ताेचे दावियत् (Liability) विलीनाीकराणीानांतरा समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेकडीे गम कराण्यात येईल.

१०. भागभांडाल (Shares) अंनामते खेाते:

विलीनाीकराणीानांतरा समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा या संस्थाेच्या सभासदांचेी भाग (Share) राक्कम हाी समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेच्या 'अनामत खात्यात' दाशमविली जाईल. यारा मूळ संस्थाेचेी कोणीतीहाी तक्रारा असणीारा नाहाी.

११. संचालक पदीाबुाबुतेची अंटी:

विलीनाीकराणीानांतरा समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा या संस्थाेच्या संचेालकांना समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेत संचेालक पदा विमळणीारा नाहाी.

१२. ठेी कजष सुलीचे कामकाजः

समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा या संस्थाेचे कामकाजा, म्हाणीजाेचे ठीेी परात कराणीे कजाम सूल कराणीे, हाे विलीनाीकराणीानांतरा समृद्धी नागराी सहाकाराी पतसंस्था मयामविदात, जामखाेडी या संस्थाेमाफफतचे केले जाईल.

१३. जुन्या दीोर्षांची जबुाबुदीाराी:

विलीनाीकराणीापूी समृद्धी जाीना मविहाला नागराी सहाकाराी पतसंस्था मयामविदात, जाळा या संस्थाेत काहाी दाोष, त्राुटी विकंा अफरातफरा असल्यास, त्यास त्या संस्थाेचे तत्कालीना संचेालक मंडीळ ैयश्चिक्तक आविणी सामूविहाकरिरात्या जाबंाबंदारा राहाील.
