प्राकराण : एक

प्रास्तावना

१. संकिंप्त नाव व प्रारांभा.— (१) ह्या दिनांयमंांसं, मंहुाराष्ट्र कमंगचौाराी भारापोाई दिनांयमं, २०२६ असंे म्हुर्णावे.

(२) हुे दिनांयमं, ते शासकीये राजपत्रात प्रदिसंद्ध झाल्याच्या ताराखंेपोासंूनां अंमंलाता येताील.

२. व्येाख्येा.— (१) या दिनांयमंांता, दिवषय दिकंवा संदाभाग यानांुसंारा अन्यर्था दाुसंरा अर्थग आवश्यक नांसंेल तारा,-

(क) " कमंगचौाराी भारापोाईसंाठी प्रादिकृता केलेला अदिकाराी " याचौा अर्थग, राज्य शासंनां, ज्याला, संवगसंारार्णपोर्णे दिकंवा कोर्णत्याहुी क्षाेत्राच्या दिकंवा क्षाेत्रांच्या वगागच्या बाबताीता, या दिनांयमंांद्वाराे प्रादिकृता केलेल्या अदिकाऱ्यांकडे संोपोदिवलेली काये पोारा पोाडण्याच्या प्रयोजनांासंाठी पोदादिनांदाेदिशाता कराील असंा कोर्णताहुी अदिकाराी, असंा आहुे ;

(खं) " संदिहुता " याचौा अर्थग, संामंादिजक संुराक्षा संदिहुता, २०२० (२०२० चौा ३६), असंा आहुे ;

(ग) " नांमंुनांा " याचौा अर्थग, या दिनांयमंासं जोडलेले नांमंुनांे, असंा आहुे ;

(घ) " हुस्तांतारार्ण प्रादिकाराी " याचौा अर्थग, कोर्णत्याहुी दाेशाताील असंे कोर्णताेहुी प्रादिकरार्ण की, जे त्या दाेशाताील कमंगचौाराी भारापोाईशाी संबंदिता असंलेल्या कायद्यानांुसंारा दिनांवाडा दिदालेली आदिर्ण भाराताता राहुता असंलेल्या दिकंवा राहुर्णारा असंलेल्या कोर्णत्याहुी व्यक्ताीच्या लाभासंाठी लागू असंलेली कोर्णताीहुी एकराकमंी राक्कमं हुस्तांतारिराता कराताे दिकंवा हुस्तांतारिराता कराण्याचौी व्यवस्र्था कराताे.

(२) या दिनांयमंांमंध्ये वापोरालेले, मंात्रा, त्याता व्याख्या नां केलेले, पोरांताु संदिहुताेमंध्ये व्याख्या दिदालेले शाब्दा व संज्ञा यांनांा, संदिहुताेमंध्ये अनांुक्रमंे, जे अर्थग नांेमंूनां दिदालेले असंताील ताेचौ त्यांचौे अर्थग असंताील.

प्राकराण : दोन

कमषचाराी भारापाई

३. प्राणघातक अपघातांचा अहावाल.— दिनांयोक्ता दिकंवा कलमं ७३(१) अन्वये संक्षामं प्रादिकाऱ्याला प्रार्णघाताक अपोघातांचौा व गंभाीरा शाराीरिराक इजांचौा अहुवाल दाेण्यासंाठी दिनांयोक्त्यानांे दिनांयुक्ता केलेली व्यक्ताी, नांमंुनांा एकमंध्ये अहुवाल पोाठवील.

४. जमा करावयेाचाी राक्कम.— जरा कमंगचौाऱ्याच्या इजेमंुळे त्याचौा मंृत्यू झाला असंेल तारा, दिनांयोक्ता, संदिहुताेच्या कलमं ७६ च्या पोट-कलमं (७) अन्वये दिमंळेर्णाऱ्या भारापोाईव्यदितारिराक्ता, अशा कमंगचौाऱ्याच्या अंत्यसंस्काराच्या खंचौागपोटी त्याच्या हुयाता असंलेल्या वयानांे मंोठे असंलेल्या अवलंदिबता व्यक्ताीला दिकंवा, जेव्हुा कमंगचौाऱ्याचौी कोर्णीहुी अवलंदिबता व्यक्ताी नांसंेल दिकंवा त्याच्या मंृत्यूच्या वेळेी ताो त्याच्या अवलंदिबता व्यक्ताीसंोबता राहुता नांसंेल, तारा, ज्या व्यक्ताीनांे प्रत्यक्षाता असंा खंचौग केला असंेल त्या व्यक्ताीला प्रदानां कराण्यासंाठी संक्षामं प्रादिकाऱ्याकडे दिकमंानां वीसं हुजारा रुपोयांपोेक्षा कमंी नांसंेल इताकी राक्कमं जमंा कराील.

५. कलम ७९ च्येा पोट-कलम (१) खालील पंनकिंवषलोकन अजष.— दिनांयोक्ता दिकंवा कमंगचौाराी, कलमं ७९ च्या पोट-कलमं (१) अन्वये अगमंादिसंक प्रदानांाचौे पोुनांदिवगलोकनां कराण्यासंाठी वैद्याकीय प्रमंार्णपोत्रादिशावाय संक्षामं प्रादिकाऱ्याकडे संबळे कारार्णांसंहु अजग करू शाकेल.

(क) दिनांयोक्त्याद्वाराे, या कारार्णास्ताव की, भारापोाईचौा हुक्क दिनांागरिराता केल्यापोासंूनां कामंगारांचौी मंजुराी वाढीलेली आहुे;

(खं) कामंगाराद्वाराे, या कारार्णास्ताव की, भारापोाईचौा हुक्क दिनांागरिराता केल्यापोासंूनां त्याचौी मंजुराी कमंी झालेली आहुे;

(ग) कामंगाराद्वाराे, या कारार्णास्ताव की, दिनांयोक्त्यानांे भारापोाई प्रदानां कराण्यासं संुरुवाता केल्यानांतारा, ज्यामंुळे भारापोाई बंदा करार्णे आवश्यक ठराेल असंा कामंगारांच्या पोरिरास्थिस्र्थताीता कोर्णताहुी बदाल झालेला नांसंतानांा, ताी दाेण्याचौे बंदा केले आहुे;

(घ) एकतारा, दिनांयोक्त्याद्वाराे दिकंवा कामंगाराद्वाराे, या कारार्णास्ताव की, त्या त्या वेळेी लागू असंलेल्या भारापोाईच्या दाराचौे दिनांागरार्ण, फसंवर्णूक दिकंवा गैरावाजवी प्रभाव दिकंवा इतारा अनांुदिचौता मंागानांी कराण्याता आले हुोताे;

(ङ) एकतारा, दिनांयोक्त्याद्वाराे दिकंवा कामंगाराद्वाराे, या कारार्णास्ताव की, भारापोाईचौे दिनांागरार्ण करातानांा, अदिभालेखंावरा स्पोष्ट दिदासंर्णाराी चौूक दिकंवा त्राुटी झाली आहुे.

६. कलम ८२ च्येा पोट-कलम (४) अन्वये सूचाना पंस्तक ठेवणाऱ्येा किंनयेोक्त्येांचा वगष.—

(१) ज्या काराखंान्यांमंध्ये, खंार्णंमंध्ये व आस्र्थापोनांांमंध्ये ोकादायक कामंे केली जाताता, त्या संवग आस्र्थापोनांांचौे दिनांयोक्त्ये दिकंवा राज्य शासंनांानांे वेळेोवेळेी अदिसंूदिचौता केलेल्या दिनांयोक्त्ये, नांमंुनांा-दाोनांमंध्ये संूचौनांा पोुस्ताक ठेवताील.

(२) संूचौनांा पोुस्ताक, आस्र्थापोनांेमंध्ये ठळेक दिठकार्णी ठेवण्याता येईल आदिर्ण ताे इजा झालेल्या कोर्णत्याहुी कमंगचौाऱ्याला दिकंवा त्यांच्या वताीनांे कामं करार्णाऱ्या कोर्णत्याहुी व्यक्ताीला संवग वाजवी वेळेी संहुज उपोलब् असंेल.

७. कलम ८४ च्येा पोट-कलम (१) खालील वैद्योकीये तपासणीचाी वारांवाराता.— ज्या कमंगचौाऱ्याला पोंरावड्याचौे वेतानां दिमंळेताे त्या कमंगचौाऱ्यानांे, अपोघातानांताराच्या पोदिहुल्या मंदिहुन्याता दाोनांपोेक्षा अदिक वेळेा दिकंवा त्यानांताराच्या कोर्णत्याहुी मंदिहुन्याता एकदापोेक्षा अदिक वेळेा, ताो त्या त्यावेळेी जेर्थे राहुता असंेल त्या दिठकार्णाव्यदितारिराक्ता इतारात्रा वैद्याकीय तापोासंर्णीसंाठी हुजरा राहुण्याचौी आवश्यकता असंर्णारा नांाहुी.

८. कलम ८८ च्येा पोट-कलम (१) अन्वये किंनयेोक्त्येाने सादरा करावयेाचाे किंनवेदन.—

(१) जेव्हुा संक्षामं प्रादिकाराी, प्रार्णघाताक अपोघाताचौी मंादिहुताी दिमंळेताे, ताेव्हुा, ताे कमंगचौाऱ्याच्या मंृत्यूसं कारार्णीभाूता ठरालेल्या पोरिरास्थिस्र्थताीचौे दिनांवेदानां संादारा कराण्यासंाठी कमंगचौाऱ्याच्या दिनांयोक्त्याला नांमंुनांा-ताीनांमंध्ये नांोटीसं जाराी करू शाकेल.

(२) दिनांयोक्ता, कलमं ८८ च्या पोट-कलमं (१) नांुसंारा नांमंुनांा-चौारामंध्ये दिनांवेदानां संादारा कराील.

(३) कलमं ८८ च्या पोट-कलमं (१) खंालील अपोघाताच्या बाबताीताील अहुवाल, ज्या प्रादिकाऱ्यासं अशा अपोघाताचौी नांोटीसं दाेर्णे आवश्यक आहुे, त्या प्रादिकाऱ्याला पोाठवता येईल, त्यामंध्ये, अपोघाताचौी ताराीखं, वेळे, कमंगचौाऱ्याला दिदालेली वैद्याकीय मंदाता यांचौा संमंावेशा असंेल.

९. कलम ८९ च्येा पोट-कलम (१) अन्वये सम प्राकिंधाकाऱ्येाने सामंजस्ये कराराचाी नंद वहाीत नंद कराण्येाचाी राीत.—

(१) कलमं ८९ च्या पोट-कलमं (१) अन्वये संक्षामं अदिकाऱ्याकडे पोाठवलेला संामंजस्य करारा, संक्षामं प्रादिकाऱ्यानांे अन्यर्था दिनांदाेशा दिदालेला नांसंेल तारा, दाुबारा प्रताीमंध्ये असंेल आदिर्ण प्रकरार्णाच्या पोरिरास्थिस्र्थताीनांुसंारा शाक्य त्याप्रमंार्णे, यर्थास्थिस्र्थदिता, नांमंुनांा-पोाचौ दिकंवा नांमंुनांा-संहुा दिकंवा नांमंुनांा-संाताशाी दिनांकट संुसंगता असंेल.

(२) जेव्हुा संक्षामं प्रादिकाऱ्याकडे, त्यानांे संामंजस्य करारा नांदादिवण्यासं नांकारा द्यावा असंे वाटता नांसंेल ताेव्हुाचौी कायगपोद्धताी :-

(क) संामंजस्य करारा प्राप्ता झाल्यावरा, संक्षामं प्रादिकाराी, संामंजस्य करारा नांदावण्यासं नांकारा दाेण्यासं कारार्णे आहुेता असंे त्याला वाटता नांसंेल तारा, ताो नांदावण्यासंाठी एक ताराीखं दिनांस्थिश्चौता कराील, आदिर्ण संबंदिता पोक्षाकारांनांा नांमंुनांा-आठमंध्ये लेखंी स्वरूपोाता अशाी नांोटीसं दाेईल की, आक्षाेपो नां आल्यासं, ताो, अशा प्रकाराे दिनांस्थिश्चौता केलेल्या ताराखंेला संामंजस्य करारा नांदावण्याचौा प्रस्ताव कराील :

पोरांताु, ताेव्हुा लेखंी नांोटीसं काढीली जार्णारा हुोताी, त्या वेळेी जे उपोस्थिस्र्थता हुोताे त्या पोक्षाकारांनांा हुी नांोटीसं तांडी कळेदिवता येऊ शाकेल.

(खं) अशा प्रकाराे दिनांस्थिश्चौता केलेल्या ताराखंेला, संक्षामं प्रादिकाराी, जरा उपोस्थिस्र्थता असंलेल्या व आपोले म्हुर्णर्णे मंांडू इस्थिच्छर्णाऱ्या कोर्णत्याहुी पोक्षाकारांचौे म्हुर्णर्णे ऐकल्यानांतारा, त्याचौी नांदा करू नांये असंे त्याला वाटले नांाहुी तारा, दिनांवेदानांाचौी नांदा कराील :

पोरांताु, खंड (क) अन्वये नांोटीसं बजावल्यामंुळे, संबंदिता कोर्णत्याहुी पोक्षाकारानांे कोर्णताहुी आक्षाेपो घेताला नांसंला ताराी, संक्षामं अदिकाऱ्यासं, अशा प्रकाराे दिनांस्थिश्चौता केलेल्या ताराखंेला दिनांवेदानांाचौी नांदा कराण्यासं नांकारा दाेण्यापोासंूनां प्रदिताबं हुोताो असंे मंानांले जार्णारा नांाहुी.

(ग) जरा अशा ताराखंेला, संक्षामं प्रादिकाऱ्यानांे, दिनांवेदानांाचौी नांदा करू नांये असंा दिनांर्णगय घेताला असंेल तारा, ताो, उपोस्थिस्र्थता असंलेल्या पोक्षाकारांनांा त्याच्या दिनांर्णगयाचौी आदिर्ण त्यामंागील कारार्णांचौी मंादिहुताी दाेईल, आदिर्ण जरा दिनांवेदानांाचौी नांदा करावी अशाी इच्छा असंलेला कोर्णताहुी पोक्षाकारा हुजरा नांसंेल तारा, ताो त्या पोक्षाकाराला नांमंुनांा- नांऊमंध्ये मंादिहुताी पोाठवील.

(३) जेव्हुा संक्षामं प्रादिकाऱ्याला, त्यानांे संामंजस्य करारा नांदादिवण्यासं नांकारा द्यावा असंे वाटता असंेल ताेव्हुाचौी कायगपोद्धताी :-

(खं) जरा मंादिहुताी दिदालेले पोक्षाकारा उपोस्थिस्र्थता नांसंताील तारा, त्यांनांा, नांमंुनांा दाहुामंध्ये दिकंवा यर्थास्थिस्र्थदिता, नांमंुनांा अकरामंध्ये एक लेखंी नांोटीसं पोाठदिवण्याता येईल, आदिर्ण अशा नांोटीसंीमंध्ये दिनांस्थिश्चौता केलेली ताराीखं, ताी जाराी केल्याच्या ताराखंेनांतारा संाता दिदावसंांपोेक्षा कमंी नांसंेल.

(ग) जरा, खंड (क) अन्वये दिनांस्थिश्चौता केलेल्या ताराखंेला, संामंजस्य करारा नांदावण्याचौी इच्छा असंर्णाऱ्या पोक्षाकारानांे दिकंवा पोक्षाकारांनांी, त्याचौी नांदा कराण्यासंाठी कायगवाहुी कराण्याकरिराता पोुराेसंे कारार्ण दाखंवले असंेल तारा, संक्षामं प्रादिकाराी, जरा संवग संबंदिता पोक्षाकारांनांा आीचौ मंादिहुताी दाेण्याता आलेली असंेल तारा, कराराचौी नांदा करू शाकेल. जरा, अशा संवग पोक्षाकारांनांा मंादिहुताी दाेण्याता आलेली नांसंेल तारा, ताो पोट-दिनांयमं (१) नांुसंारा कायगवाहुी कराील.

(घ) जरा, अशा प्रकाराे दिनांस्थिश्चौता केलेल्या ताराखंेला, संक्षामं प्रादिकाराी, संामंजस्य करारा नांदावण्यासं नांकारा दाेईल तारा, ताो, खंड (क) अन्वये मंादिहुताी नां दिमंळेालेल्या कोर्णत्याहुी पोक्षाकाराला नांमंुनांा-नांऊमंध्ये नांोटीसं पोाठवील.

(४) संामंजस्य करारा नांदावण्यासं नांकारा दिदाल्यावरा करावयाचौी कायगपोद्धताी :—

(क) जरा, कोर्णत्याहुी प्रकरार्णी, संक्षामं प्रादिकाराी, संामंजस्य करारा नांदावण्यासं नांकारा दाेईल तारा, ताो, अशा नांकाराचौी कारार्णे र्थोडक्याता नांदावील.

(खं) जरा, संक्षामं प्रादिकाराी, संामंजस्य कराराचौी नांदा कराण्यासं नांकारा दाेईल तारा, ताो, अशाी राक्कमं दाेण्यासं पोात्रा असंलेल्या पोक्षाकाराला, ताी का दिदाली जाऊ नांये याचौे कारार्ण दाखंवण्याचौी संी दिदाली दिदाल्यादिशावाय, करारामंध्ये दिवदिनांदिदागष्ट केलेल्या राकमंेपोेक्षा अदिक असंलेल्या कोर्णत्याहुी राकमंेचौे दिकंवा राकमंांचौे प्रदानां कराण्याचौा दिनांदाेशा दाेर्णारा कोर्णताहुी आदाेशा पोारिराता करार्णारा नांाहुी.

११. कलम ९३(४) नंसारा अजष किंनकालात काढण्येासाठीचाी कालमयेाषदा आकिंण कायेषवाहाीचा अनंर्षंकिंगक खाचाष.—

(१) कलमं ९३ अन्वये दाव्याच्या ताडजोड कराण्यासंाठी केलेला अजग, शाक्यताोवरा, ताो प्राप्ता झाल्यापोासंूनां ६ मंदिहुन्यांच्या आता दिनांकालाता काढीण्याता येईल.

(२) आनांुषंदिगक खंचौग :— (एक) दिववादाताील कोर्णताहुी पोक्षाकारा, ज्याला दिनांर्णगयाच्या, हुकूमंनांाम्याच्या दिकंवा इतारा दास्ताऐवजांच्या प्रमंादिर्णता प्रताी हुव्या असंताील, ताो पोक्षाकारा पोुढील दारानांे खंचौग प्रदानां केल्यावरा त्या दिमंळेवू शाकेल :—

(क) अदिभालेखंाच्या दिकंवा दिनांवेदानांाच्या दिकंवा आदाेशाच्या दिकंवा हुकूमंनांाम्याच्या कोर्णत्याहुी दास्ताऐवजाच्या प्रताीचौा खंचौग, उक्ता दास्ताऐवजाच्या प्रत्येक पोृष्ठासंाठी दाोनां रुपोये इताका असंेल.

(खं) संमंन्सं दिकंवा नांोटीसं बजावण्याचौा खंचौग दिकंवा संाक्षाीदारांचौा खंचौग दिकंवा वरा दिनांदिदागष्ट नां केलेल्या कोर्णत्याहुी बाबंच्या बाबताीता प्रदाेय असंलेला खंचौग, संक्षामं प्रादिकाऱ्यानांे प्रत्येक प्रकरार्णाता आदाेशा दिदाल्याप्रमंार्णे असंेल.

(ग) संक्षामं प्रादिकाऱ्यासं, एकतारा अजगदाराच्या अजागवरूनां दिकंवा अन्य प्रकाराे, अजगदारा खंचौग दाेण्यासं असंमंर्थग असंल्याचौे आढीळेूनां येईल ताेव्हुा, ताो, त्याला खंचौग प्रदानां कराण्यापोासंूनां संूट दाेऊ शाकेल.

(दाोनां) दिववादाताील पोक्षाकारा नांसंलेली कोर्णताीहुी व्यक्ताी, गोपोनांीय दास्ताऐवज वगळेता, दिनांर्णगय, हुकूमंनांामंा दिकंवा इतारा दास्ताऐवजांचौी प्रमंादिर्णता प्रता, मंागील खंडाता दिवदिनांदिदागष्ट केलेले शाुल्क प्रदानां केल्यावरा दिमंळेवू शाकेल.

१२. कलम ९७ अन्वये सामंजस्ये कराराचाे अकिंधाप्रामाणन कराण्येाचाी राीत (अजषदाराचाी तपासणी).—

(१) कलमं ९३ मंध्ये दिनांदिदागष्ट केलेल्या स्वरूपोाचौा अजग प्राप्ता झाल्यावरा, संक्षामं प्रादिकाराी, अजगदाराचौी शापोर्थेवरा तापोासंर्णी करू शाकेल दिकंवा ताो, या बाबताीता राज्य शासंनांानांे प्रादिकृता केलेल्या कोर्णत्याहुी अदिकाऱ्याकडे अजगदारासं पोाठवू शाकेल आदिर्ण अशा अदिकाऱ्याला अजगदाराचौी व त्याच्या संाक्षाीदाराचौी तापोासंर्णी कराण्याचौे आदिर्ण त्याचौा अदिभालेखं, संक्षामं प्रादिकाऱ्याकडे पोाठवण्याचौे दिनांदाेशा दाेऊ शाकेल.

(२) नांदार्णीकृता वैद्याकीय व्यावसंादियकाचौा पोुरावा, शाक्य असंेल दितातापोता शाब्दाशाः दिलहुूनां घेण्याता येईल ; ताो स्थिव्हुदिडओ कॉन्फरान्संवरा ध्वदिनांमंुदिद्राता केला जाऊ शाकेल. खंड (एऊ) अन्वये केलेल्या कोर्णत्याहुी तापोासंर्णीचौा संारांशा, कलमं ९७ मंध्ये पोुरावा नांदावण्यासंाठी ताराताूदा केलेल्या राीताीनांुसंारा ध्वदिनांमंुदिद्राता कराण्याता येईल.

No. Miscellaneous-1026/C.R.03/LABOUR-7a.—The following draft of rules which the Government of Maharashtra proposes to make in exercise of the powers conferred by clauses (j), (k) and (l) of sub-section (2) of sections 154 and clauses (d), (e), (f), (g), (i) and (j) of sub-section (2) of section 156 of the Code on Social Security, 2020 (36 of 2020) and of all other power enabling it in that behalf and in supersession of the Maharashtra Workmen's Compensation Rules, 1924 made under the Employees' Compensation Act, 1923 (8 of 1923), is hereby published as required by sub-section (1) of section 154 and sub-section (1) of section 156, for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra, after the expiry of thirty days from the date of publication of this notification in the Maharashtra Government Gazette.

2. Any objection or suggestion may be received by the Commissioner of Labour, Maharashtra State, Kamgar Bhawan, C 20, E Block, Bandra Kurla Complex, Bandra (East), Mumbai 400 051 or on [email protected]. The objections and suggestions should be sent in a pro forma containing column (i) specifying the name and address of the person or organisation and column (ii) specifying the rule or sub-rule which is proposed to be modified and column (iii) specifying the revised rule or sub-rule proposed to be substituted and reasons thereof. The objections and suggestions, which may be received from any person or organisation with respect to the said draft before the expiry of the above mentioned period, will be considered by the State Government.

CHAPTER I

PRELIMINARY

1. Short title and commencement.— (1) These rules may be called the Maharashtra Employees' Compensation Rules, 2026.

(2) They shall come into force on the date of its publication in the Official Gazette.

2. Definitions.— (1) In these rules, unless the subject or context otherwise requires, - (a) "Authorised Officer for Employees' Compensation" means any officer whom the State Government may designate either generally or in respect of any area or class of areas, for the purpose of performing the functions assigned by these rules to the Authorised Officers ;

(b) "Code" means the Code on Social Security, 2020 (36 of 2020) ;

(c) "Form" means forms appended to these rules ;

(d) "transferring authority" means any authority in any country which transfers or causes to be transferred any lump sum awarded under the law relating to employees compensation in such country and applicable for the benefit of any person residing or about to reside in India.

(2) The words and expressions used in these rules which are not defined therein, but are defined in the Code shall have their respective meanings as are assigned to them in the Code.

CHAPTER II

Employees' Compensation

3. Report of fatal accidents— The employer or the person appointed by employer to give report of fatal accidents and serious bodily injury to the competent authority under section 73(1) shall sent the report in Form I.

4. The amount to be deposited— If the injury of the employee results in his death, the employer shall, in addition to the compensation under sub-section (7) of section 76 of the Code, shall deposit with the competent authority a sum of not less than twenty thousand rupees, for payment of the same to the eldest surviving dependent of the employee towards the expenditure of the funeral of such employee or where the employee did not have a dependent or was not living with his dependent at the time of his death, to the person who actually incurred such expenditure.

5. Application for review under sub-section (1) of section 79— The employer or employee may make an application with substantial grounds to the competent authority without a medical certificate for review of half monthly payment under sub-section (1) of section 79.

(a) by the employer on the ground that since the right to compensation was determined the workmen's wages have increased ;

(b) by the workman, on the ground that since the right to compensation was determined his wages have diminished ;

(c) by the workman, on the ground that the employer, having commenced to pay compensation, has ceased to pay the same, notwithstanding the fact that there has been no change in the workmen conditions such as to warrant such cessation ;

(d) either by the employer or by the workman, on the ground that the determination of the rate of compensation for the time being in force was obtained by fraud or undue influence or other improper means ;

(e) either by the employer or by the workman on the ground that in the determination of compensation there is mistake or error apparent on the face of the record.

6. Class of employers to maintain notice book under sub-section (4) of section 82—

(1) All the employers of factories, mines, and establishments where hazardous activities are carried out, or the employers notified by the State Government from time to time, shall maintain the notice book in Form-II.

(2) The notice-book shall be kept at a prominent place in the establishment and shall be readily accessible at all reasonable times to any injured employee or any person acting on their behalf.

7. The frequency of medical examination under sub-section (1) of section 84-A Employee who is in receipt of a half-monthly payment shall not be required to submit himself for medical examination elsewhere than at the place where he is residing for the time being more than twice in the first month following the accident or more than once in any subsequent month.

8. The statement to be submitted by the employer under sub-section (1) of section 88—

(1) When competent authority receives information of fatal accident, he may issue notice in Form-III to the employee's employer to submit the statement giving the circumstances attaining the death of employee.

(2) The employer shall submit a statement as per sub-section (1) of section 88 in Form-IV (3) The report in respect of an accident under sub-section (1) of section 88 may be sent to the authority to whom the notice of such accident is required to be given which includes; date of accident, time, medical aid provided to employee.

9. The manner of recording the memorandum in a register by the competent authority under

sub-section (1) of section 89—

(1) Memorandum of agreement sent to the Competent Authority under sub-section (1) of section 89 shall, unless the Competent Authority otherwise directs to be in duplicate and shall be in as close conformity as the circumstances of the case admit with Form-V or Form-VI or Form-VII, as the case may be.

(2) Procedure where Competent Authority does not consider that he should refuse to record memorandum :—

(a) On receiving a memorandum of agreement, the Competent Authority shall, unless he considers that there are grounds for refusing to record the memorandum, fix a date for recording the same, and shall issue a notice in writing in Form-VIII to the parties concerned that in default of objections he proposes to record the memorandum on the date so fixed :

Provided that, the notice may be communicated orally to the parties who are present at the time when notice in writing would otherwise be issued.

(b) On the date so fixed, the Competent Authority shall record the memorandum unless, after hearing any of the parties who appear and desire to be heard, he considers that it ought not to be recorded :

Provided that the issue of a notice under clause (a) shall not be deemed to prevent the Competent Authority from refusing to record the memorandum on the date so fixed even if no objection be made by any party concerned.

(c) If on such date, the Competent Authority decides that, the memorandum ought not to be recorded, he shall inform the parties present of his decision and of the reasons therefore, and if any party desiring the memorandum to be recorded is not present, he shall send information to that party in Form IX.

(3) Procedure where Competent Authority considers he should refuse to record memorandum:-

(a) If, on receiving a memorandum of agreement, the Competent Authority considers that there are grounds for refusing to record the same, he shall fix a date for hearing the party or parties desiring the memorandum to be recorded, and shall inform such party or parties and, if he thinks fit, any other party concerned, of the date so fixed and of the Grounds on which he considers that the memorandum should not be recorded.

(b) If the parties informed are not present, a written notice shall be sent to them in Form X or Form XI, as the case may be, and the date fixed in such notice shall be not less than seven days after the date of the issue of the same.

(c) If, on the date fixed under clause (a), the party or parties desiring the memorandum to be recorded show adequate cause for proceeding to the record of the same, the Competent Authority may, if information has already been given to all the parties concerned, recorded the agreement. If, information has not been given 'to all such parties, he shall proceed in accordance with sub-rule (1).

(d) If, on the date so fixed, the Competent Authority refuses to record the memorandum, he shall send notice in Form IX to any party who did not receive information under clause (a).

(4) Procedure on refusal to record memorandum :—

(a) If, in any case, the Competent Authority refuses to record a memorandum of agreement, he shall briefly record his reasons for such refusal.

(b) If, the Competent Authority refuses to record a memorandum of agreement, he shall not pass any order directing the payment of any sum or amount over and above the२६ महाराष्ट्रट शासन राजपत्र असाधाराण भाग एक-ल, जून १६, २०२६/ज्येष्ठ २६, शाके १९४८ sum specified in the agreement, unless opportunity has been given to the party liable to pay such sum to show- cause why it should not be paid.

(c) Where the agreement is for the redemption of half monthly payments by the payment of lump-sum, and the Competent Authority considers that the memorandum of agreement should not be recorded by reason of the inadequacy of the amount of such sum as fixed in the agreement, he shall record his estimate of the probable duration of the disablement of the workman.

(5) Registration of memorandum accepted for record:- In recording a memorandum of agreement, the Competent Authority shall cause the same to be entered in a register in Form XII and shall cause an endorsement to be entered under his signature on a copy of the memorandum to be retained by him in the following terms, namely,-

10. Transfer of records or money— (1) If any matter under the Code is required to be processed before or by a competent authority other than the competent authority having jurisdiction over the area in which the accident took place the former may for the proper disposal of the matter call for in Form XIII, a detailed report including transfer of any records or money remaining with the latter in Form XIII and on receipt of such a request the competent authority having the record shall comply with the same:

Provided that, if any further enquiry is necessary in the area in which the accident took place for framing of issues or for determining the amount of compensation, the competent authority, before whom the application has been files, require the competent authority for the area in which the accident took place to conduct such enquiries and to serve such notices or orders as may be necessary for the purpose of such enquiries.

(2) Money deposited with one competent authority under section 81 shall be transmitted to another competent authority either by remittance transfer receipt or by e-transfer or by net banking or by demand draft.

11. Time limit for the disposal of applications and cost incidental to the proceedings as per

Section 93 (4). —

(1) The application for settlement of claim made under section 93 shall, as far as possible, be disposed within 6 months from its receipt.

Incidental Costs- (i) Any party to the dispute who desires to get certified copies of decision, decree or other document, may get the same on payment of cost at the following rate, namely:-

(a) The cost for the copies of any document of record or statement or order or decree shall be rupees two per page of the said documents.

(b) The cost of service or summons or notices or expenses of witnesses or the cost payable in respect of any of the matter not referred above shall be such amount as may be ordered in each case by the competent authority

(c) The competent authority may, whenever it finds either on application of applicant or otherwise that the applicant is unable to pay the costs, it may exempt the applicant from the payment of cost.

(ii) Any person who is not a party to dispute, may get the certified copy of decision, decree or other documents except the confidential documents, on payment of such fees as specified in the preceding clause.

12. The manner of authentication of memorandum under section 97: (Examination of

Applicant).—

(1) On receiving the application of the nature referred to in section 93, the Competent Authority may examine the applicant on oath or may send the application to any officer authorised by the State Government in this behalf and direct such officer to examine the applicant and his witness and forward the record thereof to the Competent Authority.

(2) The evidence of the Registered Medical Practitioner shall be taken down as nearly as may be word for word ; may be recorded on Video Conference. The substance of any examination made under clause (i) shall be recorded in the manner provided for the recording of evidence in section 97.

In the event of your admitting liability to pay compensation the necessary deposit must under section 88 of the said Code, be made within thirty days of the receipt of this notice.

Memorandum of Agreement
