क्रमाका दिजुपदिन. २०२६/प्र.क्र.१०/ई-१७२६९०४/प.रा.२.— महाराष्ट्र दिजुल्हा परिरष व पचायत सदिमती अदिधदिनयम, १९६१ (महा. १९६२ चा ५) च्या कालैम २७४ च्या पोर्ट-कालैम (२) मधीलै खंड (xiv) अन्वये तसेचा याबाबत सक्षम कारणाऱ्या इतर सवझ अदिधकाराचा वापर कारून महाराष्ट्र शासनास "महाराष्ट्र पचायत सदिमत्या (नामदिनेदिशात सस्याचाी पात्रता व दिनयंक्ती) दिनयम, २०२६" या मसंा दिनयमाचा पंढीलै मजुकाूर, उक्त अदिधदिनयमाच्या कालैम २७४ च्या पोर्ट-कालैम (३) नंसार, याद्वारे प्रभादिवत हाोण्याचाी शाक्यता असलैेल्या सवझ व्यक्तंच्या मादिहातीसाठी यान्वये प्रदिसद्ध कारण्यात येत आहाे.

तसेचा, या अदिधसूचानेच्या दिनाकापासून ३० दिवसाच्या आत प्राप्त हाोणाऱ्या सर मसूा दिनयमावरीलै हारकाती दिकांवा सूचाना याचाचा महाराष्ट्र शासनाकाडून दिवचार कारण्यात येईलै, अशाी यान्वये सूचाना ेण्यात येत आहाे.

२. सर मसंा दिनयमाबाबत त्यामंळे बादिधत हाोण्याचाी शाक्यता असलैेल्या काोणात्याहाी व्यक्तीकाडून सदिचाव, ग्राम दिवकास दिवभाग, बई ४०० ००१ याच्याकाडे वरीलै नमू दिनाकापयंत दिकांवा त्यापूवी प्राप्त हाोणाऱ्या हारकाती दिकांवा बाधकाम भावन, २५, मर्झबान पथ, फोर्ट, मं सूचाना शासनाकाडून दिवचारात घेण्यात येतीलै.

किंनयेमांचा मसूदेा

१. संकिंप्त नाव.— हाे दिनयम " महाराष्ट्र पचायत सदिमत्या (नामदिनेदिशात सस्याचाी पात्रता व दिनयंक्ती) दिनयम, २०२६" म्हाणाून ओळेखंलैे जुातीलै.

२. व्येाख्येा.— (१) या दिनयमामध्ये, सभाझनंसार ंसरा अथझ अपेदिक्षत नसेलै तर,-

(अ) "अदिधदिनयम" याचा अथझ महाराष्ट्र दिजुल्हा परिरष व पचायत सदिमती अदिधदिनयम, १९६१ (महा. १९६२ चा ५) असा आहाे;

भाग चार-ब-३८८–१२ महाराष्ट्रट शासन राजपत्र असाधाराण भाग चारा-ब, जुलै ३, २०२६/आर्षाढ १२, शाके १९४८ (ब) " दिजुल्हादिधकारी" याचा अथझ सबदिधत दिजुल्ह्याचा दिजुल्हादिधकारी असा आहाे.

(२) या दिनयमामध्ये वापरलैेलैे परतं परिरभादिषत न काेलैेलैे शाब् व पप्रयोग याना अदिधदिनयमामध्ये त्याना नेमून दिलैेलैे अथझ अनंक्रमे लैागू हाोतीलै.

३. नामकिंनदेकिंशात सदेस्येांचाी संख्येा किंनश्चिचात कराणे.— दिनयम ४ मधीलै तरतंच्या अधीन राहाून, दिजुल्हादिधकारी पचायत सदिमतीमध्ये नामदिनेदिशात कारावयाच्या सस्याचाी सख्या पचायत सदिमतीच्या एकाूणा दिनवाझदिचात सस्य सख्येच्या वीस र्टक्काे दिकांवा दिकामान एका व्यक्ती, यापैकाी जुी सख्या जुास्त असेलै त्याप्रमाणाे दिनश्चिचात कारून नामदिनेशान कारतीलै.

४. नामकिंनदेशानासाठेी पात्रता.— एखंाी व्यक्ती नामदिनेदिशात सस्य पासाठी उमेवार म्हाणाून नामदिनेदिशात हाोण्यास पात्र असेलै, जुर दितलैा दिजुल्हा परिरष दिकांवा पचायत सदिमतीच्या प्रशासनासबधी दिवशाेष ज्ञान दिकांवा कायाझनंभाव असेलै आदिणा ती,—

(अ) सबदिधत पचायत सदिमती क्षेत्राचाी रदिहावासी असेलै; आदिणा

(ब) राज्यातीलै मान्यताप्राप्त व नंणाीकाृत वैद्यकाीय व्यवसादियका (Medical Practitioner) म्हाणाून दिकामान पाचा वषे कायझरत असेलै; दिकांवा

(का) मान्यताप्राप्त शाळेा दिकांवा महादिवद्यालैयामधीलै सेवादिनवृत्त प्राध्यापका, व्याख्याते दिकांवा प्राचायझ याच्यासहा दिशाक्षणातज्ज्ञा म्हाणाून दिकामान पाचा वषांचा अनंभाव असलैेलैी; दिकांवा

(ड) काृषी, जुलैसधारणा, सहाकार, ग्रामीणा दिवकास, मदिहालैा व बालै दिवकास, कालैा, सादिहात्य, समाजुकायझ या क्षेत्रामध्ये दिवशाेष ज्ञान असलैेलैी आदिणा वरीलैपैकाी काोणात्याहाी क्षेत्रात दिकामान पाचा वषांचा अनंभाव असलैेलैी; दिकांवा

(ई) मान्यताप्राप्त दिवद्यापीठीाचाी अदिभायादित्रकाी पवी धारणा काेलैेलैी आदिणा अदिभायादित्रकाी क्षेत्रात दिकामान पाचा वषांचा व्यावसादियका अनंभाव असलैेलैी; दिकांवा

(फो) दिकामान पाचा वषे वकाीलै (Advocate) म्हाणाून कायझरत दिकांवा मान्यताप्राप्त दिवद्यापीठीाचाी दिवधी पवी (Law Degree) धारणा काेलैेलैी आदिणा राज्यातीलै दिवधी क्षेत्रात दिकामान पाचा वषांचा अनंभाव असलैेलैी; दिकांवा

(ग) कांद्र शासन दिकांवा राज्य शासनाच्या सेवेत दिकामान वीस वषांचाी सेवा पूणाझ काेलैेलैा सेवादिनवृत्त अदिधकारी असलैेलैी; दिकांवा (घे) महाराष्ट्र सावझजुदिनका दिववस्त अदिधदिनयमातगझत नंणाीकाृत अशासकाीय सस्थेचा (Non-Government Organization) पादिधकारी म्हाणाून, दिजुल्हा परिरष दिकांवा पचायत सदिमतीच्या कायझक्षेत्रात सामादिजुका काल्याणादिवषयका उपक्रमामध्ये कायझरत राहाून दिकामान पाचा वषांचा अनंभाव असलैेलैी व्यक्ती असेलै.

५. सदेस्येांचाे नामकिंनदेशान:-

(१) दिजुल्हादिधकारी, दिजुल्हा परिरषेमधीलै मान्यताप्राप्त दिकांवा नंणाीकाृत पक्ष, गर्ट, आघेाडी दिकांवा फ्रंर्ट याच्या नेत्याशाी सल्लैामसलैत कारून आदिणा अशा पक्षाचाे दिकांवा गर्टाचाे तौलैदिनका सख्याबळे (Relative Strength) दिवचारात घेऊन, सस्य म्हाणाून नामदिनेदिशात कारण्यासाठी योग्य व्यक्तंचाी नावे पचायत सदिमतीकाडे दिशाफोारस कारतीलै. अशा प्रकारे दिशाफोारस कारण्यात आलैेल्या व्यक्तंचाी सख्या दिनयम ३ नंसार नामदिनेदिशात कारावयाच्या सस्यसख्येपेक्षा अदिधका असणार नाहाी :

परतं असे काी, अदिधदिनयमाच्या कालैम ५९अ च्या पोर्ट-कालैम (४) मधीलै तरतंनंसार स्थापन र्झालैेल्या मान्यताप्राप्त पक्ष, नंणाीकाृत पक्ष, गर्ट, आघेाडी दिकांवा फ्रंर्ट याचाे तौलैदिनका सख्याबळे दिनश्चिचात कारताना प्रथम पचायत सदिमतीच्या एकाूणा सस्यसख्येलैा नामदिनेदिशात सस्याच्या सख्येने भाग दिलैा जुाईलै. त्यानतर या भागाकाराच्या सख्येने सबदिधत मान्यताप्राप्त पक्ष, नंणाीकाृत पक्ष, गर्ट, आघेाडी दिकांवा फ्रंर्ट याच्या पचायत सदिमतीतीलै सस्यसख्येलैा भाग दिलैा जुाईलै. अशा प्रकारे प्राप्त र्झालैेलैी सख्या हा त्या पक्ष, गर्ट, आघेाडी दिकांवा फ्रंर्ट याचाे तौलैदिनका सख्याबळे मानण्यात येईलै. जुागाचाे वार्टप प्रथम सबदिधत तौलैदिनका सख्याबळेातीलै पूणांका दिवचारात घेऊन कारण्यात येईलै आदिणा त्यानतर एका दिकांवा अदिधका जुागा वार्टपासाठी दिशाल्लैका रादिहाल्यास, त्या जुागाचाे वार्टप सबदिधत मान्यताप्राप्त पक्ष, नंणाीकाृत पक्ष, गर्ट, आघेाडी दिकांवा फ्रंर्ट याच्या तौलैदिनका सख्याबळेातीलै सवाझत मोठ्या अपूणांकापासून संरुवात कारून अपूणांकाच्या उतरत्या क्रमाने वार्टून दिल्या जुातीलै.

परतं आणाखंी असे काी, दिशाल्लैका जुागाचाे वार्टप तौलैदिनका सख्याबळेातीलै अपूणांकाच्या उतरत्या क्रमाने कारताना, जुर अपूणांका अध्याझपेक्षा कामी असेलै तर तो दिवचारात घेतलैा जुाणार नाहाी आदिणा त्यासाठी काोणातीहाी जुागा वार्टप काेलैी जुाणार नाहाी. अशा प्रकारे जुागाचाे वार्टप काेल्यानतरहाी एका दिकांवा अदिधका जुागा वार्टपादिवना रादिहाल्यास, त्या जुागा व्यपगत (Lapsed) र्झाल्याचाे मानल्या जुाईलै:

परतं असेहाी काी, वरीलै तरतंीनंसार अपूणांकाच्या उतरत्या क्रमाने नामदिनेदिशात जुागाचाे वार्टप कारताना ोन दिकांवा अदिधका मान्यताप्राप्त पक्ष, नंणाीकाृत पक्ष, गर्ट, आघेाडी दिकांवा फ्रंर्ट याचाे अपूणांका समान असल्यास, अशा पक्ष, गर्ट, आघेाडी दिकांवा फ्रंर्ट याच्या प्रदितदिनधंच्या उपश्चिस्थतीत सोडत (Lots) काढीून सबदिधत व्यक्तीचाे दिजुल्हादिधकारी नामदिनेशान कारतीलै.

(२) पचायत सदिमती, दिजुल्हादिधकाऱ्यानी काेलैेल्या दिशाफोारशांचा दिवचार कारून सस्याचाे नामदिनेशान कारीलै :—

परतं असे काी, पचायत सदिमतीने दिजुल्हादिधकाऱ्यानी दिशाफोारस काेलैेल्या एखंाद्या व्यक्तीबाबतचाी दिशाफोारस स्वीकारू नये असा दिनणाझय घेतल्यास, त्याचाी कारणाे लैेखंी स्वरूपात नंदिवण्यात येतीलै:

परतं आणाखंी असे काी, दिनयम ४ मधीलै खंड (अ) ते (घे) मधीलै अहाझता असणाऱ्या प्रत्येकाी एका व्यक्तीचाे पचायत सदिमती सस्य म्हाणाून नामदिनेशा संदिनश्चिचात कारण्याचा प्रयत्न कारण्यात यावा.

६. पंचायेत सकिंमतीच्येा नामकिंनदेकिंशात सदेस्येांचाी नावे प्राकिंसद्ध कराणे.— दिजुल्हादिधकारी, शाक्य दिततक्या लैवकार, अशाप्रकारे नामदिनेदिशात कारण्यात आलैेल्या व्यक्तंचाी नावे महाराष्ट्र शासन राजपत्रात प्रदिसद्ध कारण्यासाठी पाठीवतीलै.

७. प्रासंकिंगक रिराक्त पदे .— नामदिनेदिशात सस्याचाी जुागा रिरक्त र्झाल्यास, ती जुागा भारण्यासाठी या दिनयमातीलै तरतंी यथाश्चिस्थत (Mutatis Mutandis) लैागू हाोतीलै.

८. नामकिंनदेकिंशात सदेस्येांना प्रामाणपत्र.— नामदिनेदिशात सस्याचाी नावे महाराष्ट्र शासन राजपत्रात प्रकादिशात र्झाल्यानतर, दिजुल्हादिधकारी नामदिनेदिशात सस्यास सलैग्न नमंन्यात (Form) प्रमाणापत्र ेतीलै.

NOTIFICATION

Zilla Parishads and Panchayat samitis act, 1961.

No.ZPN-2026/C.R.10/E-1726904/P.R.2.— The following draft of the Maharashtra Panchayat Samitis (Qualification and Appointment of Nominated Members) Rules, 2026, which the Government of Maharashtra proposes to make in exercise of the powers conferred by clause (xiv) of sub-section (2) of section 274 of the Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961 (Mah. V of 1962) and of all other powers enabling it in this behalf, is hereby published as required by sub-section (3) of section 274 of the said Act, for the information of all persons likely to be affected thereby; and notice is hereby given that objections or suggestions on the said draft sent within 30 days form the date of the notification will only be taken into consideration by the Government of Maharashtra.

2. Any objection or suggestion, may be sent to the Secretary, Rural Development Department, Bandhkam Bhavan, 25, Marzban Path, Fort, Mumbai-400 001 with respect to the said draft Rules from any person likely to be affected thereby; on or before the aforesaid date, will be considered by the Government.

DRAFT RULES

1. Short title.— These rules may be called the Maharashtra Panchayat Samitis (Qualifications and Appointment of Nominated Members) Rules, 2026.

2. Definitions.— (1) In these rules, unless the context otherwise requires,—

(a) "Act" means the Maharashtra Zilla Parishads and Panchayat Samities Act, 1961 (Mah. V of 1962);

(b) "Collector" means the collector of the concerned District,

(2) Words and expressions used but not defined in these rules shall have the meanings respectively assigned to them in the Act.

3. Determination of Number of Nominated Member.— Subject to the provisions of rule 4, the Collector shall nominate Members to the Panchayat Samiti equal to twenty per cent of the total number of elected Members of Panchayat Samiti, or a minimum one person, whichever is higher.

4. Eligibility for Nomination.— A person shall be eligible for being nominated as a candidate for the office of the nominated member if he has special knowledge or work experience in respect of the administration of Zilla Parishad or Panchayat Samiti, and he,—

(a) is a resident of the concerned Panchayat Samiti area; and

(b) has been a recognized and registered medical practitioner in the State for a minimum period of five years; or

(c) has been an educationist including retired professors, lecturers or principals of recognized schools or colleges for a minimum period of five years; or

(d) is possessing specialized knowledge in the fields of Agriculture, Water Conservation, Co-operation, Rural Development, Women and Child Development, Art, Literature, Social Work and has experience in any of the above fields for a period of five years; or

(e) possesses a degree in an engineering from a recognized university and has professional experience for a minimum period of five years; or

(f) has been an advocate for a minimum period of five years or is a person possessing degree in Law from a recognized University with a experience in the legal field in the State for a minimum period of five years, orमहाराष्ट्रट शासन राजपत्र असाधाराण भाग चारा-ब, जुलै ३, २०२६/आर्षाढ १२, शाके १९४८ ५ (g) is a retired officer who has completed at least twenty years of Central or State Government service; or

(h) has experience of not less than five years as an office-bearer of a Non-Government Organization registered under the Maharashtra Public Trusts Act, engaged in Social Welfare activities, working within the area of the Zilla Parishad or Panchayat Samiti.

5. Nomination of Member.—

(1) The Collector shall, after consultation with the leaders of recognized or registered parties, groups or aghadis or front in the Zilla Parishad, and taking into account the relative strength of such parties or groups, recommended the names of suitable persons to the Panchayat Samiti for being nominated as Members. The names of such persons recommended shall not exceed the number of Members to be nominated in accordance with rule 3:

Provided that, the relative strengths of recognized parties or registered parties or group or aghadi or front formed as per the provisions of the sub-section (4) of section 59A of the Act shall be calculated by first dividing the total number of Members of Panchayat Samiti by the strength of number of nominated Member. The number of Member of Panchayat Samiti of the recognized parties or registered parties, group or aghadi or front shall be further divided by the quotient of this division. The figure so arrived at shall be the relative strength of the respective recognized parties or registered parties or group or aghadi or front. The seat shall be allotted to the recognized parties or registered parties or groups or aghadis or front by first considering the whole number of their respective relative strength so ascertained and thereafter if one or more seats remained to be allotted, the same shall be allotted to such recognized parties or registered parties or groups, aghadis or fronts in the descending order beginning with the largest fractioning value of the proportionate strength of the respective recognized parties or registered parties, groups, aghadis or fronts:

Provided further that, while allocating the remaining seats by considering the fractional values in proportionate strength in descending order, if the fraction is less than half, it shall not be taken into account and no seat shall be allocated for it. After allocating seats in this manner, if one or more seats remain unallocated, they shall be treated as lapsed:

Provided also that, while nominating the person as nominated Member on the basis of the descending order of the fraction number as mentioned in above proviso, if two or more recognized parties, registered parties or groups, aghadis or fronts have the same fraction number, then the Collector shall, nominate the person belonging to such recognized parties, registered parties or groups, aghadis or fronts selected on the basis of lots drawn in the presence of representatives of all such parties, groups, aghadis, or fronts.

(2) The Panchayat Samiti after considering the recommendations made by the Collector, nominate the Members :

Provided that, if the Panchayat Samiti decides not to accept the recommendation of the Collector with respect to a person so recommended, it shall record the reasons therefor:

Provided further that, every endeavor shall be made to ensure that one Member each possessing any of the qualifications referred to in clauses (a) to (h) of rule 4 has been nominated.

6. Publications of names of nominated Members of the Panchayat Samiti.— The Collector shall as soon may be, send the names of the persons so nominated, for publication in the Maharashtra Government Gazette.

7. Casual vacancies.— When a seat of a nominated member becomes vacant, the provisions of these rules shall Mutatis Mutandis apply, for filling the vacancy.

8. Certificate to nominated Members.— After publication of the names of the nominated members in the Maharashtra Government Gazette, the Collector shall issue a Certificate in Form appended herewith to each of the nominated member.
