क्रमंांका वक्फ २०२०/प्र.क्र.६९/कायागसनां-४.— ज्याअर्थी, वक्फ अदिदिनांयमं, १९९५ (१९९५ चा ४३ वा) च्या कालमं ८३ च्या पोट-कालमं (१) व (४) अन्वये प्रदानां कारण्याता आलेल्या अदिकारांचा व यासंबंी प्राप्ता असलेल्या इतार सवग शक्तांचा वापोर कारूनां, मंहुाराष्ट्र शासनांानांे, शासनां अदिसूचानांा, अल्पोसंख्याका दिवकास दिवभाग, क्र. वक्फ २०१५/प्र.क्र.१४२/कायागसनां-४, दिदानांांका १ ऑगस्ट २०१७ (यापोुढे "उक्ता अदिसूचानांा" असे संबोण्याता येईल), अन्वये, एखाद्या वक्फ दिकांवा वक्फ मंालमंत्तेशी संबंदिता दिववादा, प्रश्नां व इतार संबंदिता बाबंचाे दिनांागरण कारण्यासाठी, एखाद्या भाडेकारूचाे दिनांष्कासनां दिकांवा अशा मंालमंत्तेा संदाभागताील भाडेपोट्टाकार व भाडेपोट्टादार यांच्या अदिकारांचाे व बंनांांचाे (Obligation) दिनांागरण उक्ता अदिदिनांयमंांतागगता कारण्यासाठी, संपोूणग मंहुाराष्ट्र राज्यावर अदिकारिरता असलेले, मंहुाराष्ट्र राज्य वक्फ न्यायादिकारण, औरंगाबादा (यापोुढे "उक्ता न्यायादिकारण" असे संबोण्याता येईल) चाी स्र्थीापोनांा काेली आहुे;

आदिण ज्याअर्थी मंहुाराष्ट्र शासनांानांे, शासनां अदिसूचानांा, अल्पोसंख्याका दिवकास दिवभाग, क्र. वक्फ/२०२०/ प्र.क्र.६९/ कायागसनां-४, दिदानांांका ४ जूनां, २०२४ अन्वये श्री.आदिदाल मंुश्ताका अहुमंदा खानां, दिजल्हुा न्यायादिश-१ आदिण अदितारिरक्ता सत्रा न्यायादिश, गंदिदाया यांचाी उक्ता न्यायादिकारणावर अध्यक्ष म्हुणूनां दिनांयुक्ताी कारण्याता आलेली हुोताी;

आदिण ज्याअर्थी, श्री.आदिदाल मंुश्ताका अहुमंदा खानां यांचाी बदाली हुोता असल्यानांे मंा. मंु ंबई उच्चा न्यायालयानांे त् यांच्या जागी ंबई यांच्या नांावाचाी उक्ता न्यायादिकारणावर अध्यक्ष म्हुणूनां श्री. वाय. एमं. एचा. खाराडेी, न्यायादिश, शहुर दिदावाणी न्यायादिश, दिदाडेंशी, मंु दिनांयुक्ताी कारण्यासाठी दिशफारस काेली आहुे.

भाग चार-अ-३०४–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, जुलै १४, २०२६/आर्षाढ २३, शके १९४८ त्याअर्थी, एकात्मित्मंका वक्फ व्यवस्र्थीापोनां, सक्षमंीकारण आदिण दिवकास अदिदिनांयमं, १९९५ (१९९५ चा ४३ वा) च्या कालमं ८३ च्या उपो-कालमं (४) मंील खांडे (अ) अन्वये प्रदानां कारण्याता आलेल्या अदिकारांचा व यासंबंी प्राप्ता असलेल्या इतार सवग शक्तांचा वापोर कारूनां मंहुाराष्ट्र शासनां याद्वारे श्री. वाय. एमं. एचा. खाराडेी यांचाी उक्ता न्यायादिकारणावर अध्यक्ष म्हुणूनां दिनांयुक्ताी कारता आहुे, आदिण त्या उदिष्टाकारिरता उक्ता अदिसूचानांेमंध्ये पोुढेीलप्रमंाणे सुारणा कारीता आहुे :—

उक्ता अदिसूचानांेसोबताच्या ताक्त्यामंध्ये अनांुक्रमंांका १ मंध्ये रकानांा क्रमंांका २ "नांाव" या दिशर्षगकाखाली "श्री. आदिदाल मंुश्ताका अहुमंदा खानां" या शब्दांऐवजी "श्री. वाय. एमं. एचा. खाराडेी" या शब्दांचा समंावेश कारण्याता यावा.

NOTIFICATION

Unified Waqf ManageMent, eMpoWerMent, efficiency and developMent act, 1995.

No.Waqf 2020/C.R.69/Desk-4.— Whereas, in exercise of the powers conferred by sub-sections (1) and (4) of section 83 of the Waqf Act, 1995 (43 of 1995) and of all other powers enabling it in that behalf; the Government of Maharashtra vide Government Notification, Minorities Development Department, No.Waqf-2015/C.R.142/Desk-4, dated the 1st August 2017 (hereinafter referred to as "the said Notification"), has constituted the Maharashtra State Waqf Tribunal at Aurangabad, (hearinafter referred to as "the said Tribunal") for the determination of any dispute, question or other matter relating to a waqf or waqf property, eviction of a tenant or determination of rights and obligations of the lessor and the lessee of such property, under the said Act, having jurisdiction over whole of the State of Maharashtra ;

And whereas, the State of Maharashtra has, vide Government Notification, Minorities Development Department, No. Waqf/ 2020/C.R.69/Desk-4, dated the 4th June 2024, appointed Shri Adil Mushtaque Ahmad Khan, District Judge-I and Additional Sessions Judge, Gondia, as a Chairman of the said Tribunal ;

And whereas the Hon'ble High Court of Judicature at Bombay has now recommended the name of Shri Y. M. H. Kharadi, Judge City Civil and Additional Sessions Judge, Dindoshi, Mumbai for appointment as a Chairman of the said Tribunal, in place of Shri Adil Mushtaque Ahmad Khan who is under order of transfer.

Now therefore, in exercise of the powers conferred by clause (a) of sub-section (4) of section 83 of the Unified Waqf Management, Empowerment, and Development Act, 1995 (43 of 1995) and of all other powers enabling it in that behalf, the Government of Maharashtra hereby appoints Shri Y. M. H. Kharadi, Judge City Civil and Additional Sessions Judge, Dindoshi, Mumbai, as a Chairman of the said Tribunal, and for that purpose amends the said Notification as follows :—

In Table appended to the said Notification, in Serial No.1, in column (2), under the heading "Name", for the words "Shri Adil Mushtaque Ahmad Khan" the words "Shri Y. M. H. Kharadi" shall be substituted.
