क्रमांका काौदिउ-२०२६/प्र.क्र. १५४/प्रशा-२.—भारताीय संदिधानांाच्या अनांुच्छेदा ३०९ खालील परंताुकान्ये प्रदानां कारण्याता आलेल्या शाक्तांचा ापर कारूनां आदि या संदाभागता संध्या अस्तितात्ाता असंलेले दिनांयमा, आदाेशा आदि अनांुदाेशा अदिधाक्रदिमाता कारूनां, माहुाराष्ट्राचाे राज्यपाल, याद्वारे, काौशाल्य, रोजगार, उद्योजकाता नांादिन्यता दिभागाच्या प्रशासंकाीय दिनांयंत्राखालील काौशाल्य दिकासं, रोजगार उद्योजकाता आयुक्तालयाताील कादिनांष्ठ काौशाल्य दिकासं, रोजगार उद्योजकाता मागगदाशागनां अदिधाकारी, गट "का" आदि रिरष्ठ दिलदिपका, गट "का" या पदांच्या संेाप्रेशाचाे दिदिनांयमानां कारारे पुढील दिनांयमा कारीता आहुेता :-

१. (१) या दिनांयमांसं काौशाल्य दिकासं, रोजगार उद्योजकाता आयुक्तालयाताील कादिनांष्ठ काौशाल्य दिकासं, रोजगार उद्योजकाता मागगदाशागनां अदिधाकारी, गट "का" आदि रिरष्ठ दिलदिपका, गट "का" (संेाप्रेशा) दिनांयमा, २०२६ असंे म्हुाे.

(२) हुे दिनांयमा, माहुाराष्ट्रा शासंनांाच्या राजपत्रात प्रदिसंद्ध काेल्याच्या दिदानांांकापासंूनां अंमालाता येताील.

२. या दिनांयमांता संदाभागनांुसंार दाुसंरा अर्थग अपेदिता नांसंेल तार,

(का) "दिनांयुक्ताी प्रादिधाकारी" याचा अर्थग, आयुक्तालयाताील कादिनांष्ठ काौशाल्य दिकासं, रोजगार उद्योजकाता मागगदाशागनां अदिधाकारी, गट "का" आदि रिरष्ठ दिलदिपका, गट "का" या पदांर दिनांयुक्ताी कारण्यासंाठी काौशाल्य दिकासं, रोजगार उद्योजकाता आयुक्तालयाचाे आयुक्ता, असंा आहुे ;

(खा) "आयोग" याचा अर्थग, माहुाराष्ट्रा लोकासंेा आयोग असंा आहुे ;

(१)

भाग चार-अ-३१६–१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, जुलै २२, २०२६/आर्षाढ ३१, शके १९४८ (ग) "आयुक्तालय" याचा अर्थग, माहुाराष्ट्रा शासंनांाच्या काौशाल्य, रोजगार, उद्योजकाता नांादिन्यता दिभागाच्या प्रशासंकाीय दिनांयंत्राखालील, काौशाल्य दिकासं, रोजगार उद्योजकाता आयुक्तालय असंा आहुे ;

(घ) "पदाी" याचा अर्थग, संांदिदिधाका दिद्योापीठाचाी काोत्याहुी शाखाेताील पदाी दिकांा शासंनांानांे घोदिता काेलेली संमाताुल्य अशाी इतार काोताीहुी अहुगता, असंा आहुे ;

(ङ) "दिभाग" याचा अर्थग, भारताीय संदिधानांाच्या अनांुच्छेदा १६६ अन्ये तायार कारण्याता आलेल्या माहुाराष्ट्रा शासंनां कायगदिनांयमालीसं जोडलेल्या पदिहुल्या अनांुसंूचाीता दिदिनांदिदागष्ट काेलेला काौशाल्य, रोजगार, उद्योजकाता नांादिन्यता दिभाग असंा आहुे ;

(चा) "पदाोन्नांताीसंाठी पात्राता" याचा अर्थग, संामान्य प्रशासंनां दिभागानांे ेळोेळोी दिनांगगदिमाता काेलेले दिनांयमा, शासंनां दिनांगय दिकांा आदाेशा यांमाध्ये पदाोन्नांताीसंाठी दिदिनांदिदागष्ट काेलेल्या अटी शाताीनांुसंार असंलेली पदाोन्नांताीचाी पात्राता असंा आहुे ;

(छे) "शासंनां" याचा अर्थग, माहुाराष्ट्रा शासंनां असंा आहुे.

३. कादिनांष्ठ काौशाल्य दिकासं, रोजगार उद्योजकाता मागगदाशागनां अदिधाकारी, गट "का" या पदारील दिनांयुक्ताी एकातार ,- (का) पदाोन्नांताीसंाठी पात्रा असंाऱ्या आदि आयुक्तालयाताील, रिरष्ठ दिलदिपका, गट "का", या पदारील ताीनां ापेा कामाी नांसंेल इताकाी दिनांयदिमाता अखांड संेा असंाऱ्या, उक्ता पदा धार काराऱ्या व्यक्तांमाधाूनां संामादियका ज्येष्ठता यादाीच्या अधाीनां राहुूनां, ज्येष्ठताेच्या आधारे, योग्य व्यक्ताीच्या पदाोन्नांताीनांे कारण्याता येईल ; दिकांा

(खा) जे उमाेदार, पुढील दिनांकांचाी पूतागता कारताता अशा, त्यासंाठी घेतालेल्या पधागत्माका परीेच्या दिनांकालाच्या आधारे आयोगानांे दिशाफारसं काेलेल्या उमाेदारांमाधाूनां, नांामादिनांदाेशानांाद्वारे कारण्याता येईल :-

(एक) वयेोमयेाषदा :-

(एका) दिकामानां योमायागदा-उक्ता पदाच्या भारताीच्या जादिहुराताीनांुसंार, अजग ीकाृताीच्या अंदितामा दिदानांांकासं अठरा ापेा कामाी नांसंेल.

(दाोनां) कामाल योमायागदा- त्या पदाच्या भारताीच्या जादिहुराताीनांुसंार, अजग ीकाृताीच्या अंदितामा दिदानांांकासं राखाी प्रगागताील नांसंलेल्या व्यक्तांसंाठी अडताीसं ापेा अदिधाका नांसंेल राखाी प्रगागताील असंलेल्या व्यक्तांसंाठी त्राेचाळोीसं ापेा अदिधाका नांसंेल.

(दोन) किंकमान शैक्षकिंणक अहषता :-

४. आयुक्तालयाताील, रिरष्ठ दिलदिपका, गट "का" या पदारील दिनांयुक्ताी एकातार ;

(का) पदाोन्नांताीसंाठी पात्रा असंाऱ्या आदि आयुक्तालयाताील, दिलदिपका टंकालेखाका, गट "का", या पदारील ताीनां ापेा कामाी नांसंेल इताकाी दिनांयदिमाता अखांड संेा असंाऱ्या, उक्ता पदा धार काराऱ्या व्यक्तांमाधाूनां संामादियका ज्येष्ठता यादाीच्या अधाीनां राहुूनां, ज्येष्ठताेच्या आधारे, योग्य व्यक्ताीच्या पदाोन्नांताीनांे कारण्याता येईल ; दिकांा

(एक) वयेोमयेाषदा :-

(एका) दिकामानां योमायागदा- उक्ता पदाच्या भारताीच्या जादिहुराताीनांुसंार, अजग ीकाृताीच्या अंदितामा दिदानांांकासं अठरा ापेा कामाी नांसंेल.

५. दिनांयमा ३ ४ माध्ये नांमाूदा काेलेल्या पदांर दिनांयुक्ताी, दिनांयुक्ताी प्रादिधाकाऱ्याच्या मान्यताेनांे कारण्याता येईल.

६. दिनांयमा ३ ४ खालील एकाू मांजूर पदांकारिरता, दिनांयमा ३ ४ माध्ये नांमाूदा काेलेल्या पदारील दिनांयुक्ताी, पदाोन्नांताीनांे नांामादिनांदाेशानांानांे अनांुक्रमाे, ७५:२५ या प्रमाता कारण्याता येईल.

७. (का) दिनांयमा ३ ४ माध्ये नांमाूदा काेलेल्या पदांर पदाोन्नांताीनांे दिनांयुक्ता कारायाचाी व्यक्ताी, उक्ता पदार पदाोन्नांताी दाेण्यापूी अगोदारचा माराठी भा दिहुंदाी भा परीा उत्तीग नांसंेल दिकांा त्या परीा उत्तीग हुोण्यापासंूनां दिताला संूट दाेण्याता आलेली नांसंेल तार, ताी, त्याबाबताीता शासंनांानांे ेळोेळोी काेलेल्या दिनांयमांनांुसंार, माराठी भा दिहुंदाी भा परीा उत्तीग कारील.

(खा) दिनांयमा ३ ४ माध्ये नांमाूदा काेलेल्या पदांर नांामादिनांदाेशानांाद्वारे दिनांयुक्ता काेलेली व्यक्ताी, अगोदारचा दिहुंदाी भा माराठी भा परीा उत्तीग नांसंेल दिकांा त्या परीा उत्तीग हुोण्यापासंूनां दिताला संूट दाेण्याता आलेली नांसंेल तार, ताी, त्याबाबताीता शासंनांानांे ेळोेळोी काेलेल्या दिनांयमांनांुसंार, दिनांयुक्ताीनांतार दिदिहुता कालमायागदाेता दिहुंदाी माराठी भा परीा उत्तीग कारील. ताी व्यक्ताी, या परीा उत्तीग हुोईपयता, ादिगका ेतानां ाढीसंाठी दिकांा पुढील पदाोन्नांताीच्या पदांरील पदाोन्नांताीसंाठी पात्रा असंार नांाहुी.

८. (का) दिनांयमा ३ ४ माध्ये नांमाूदा काेलेल्या पदांर पदाोन्नांताीद्वारे दिनांयुक्ता कारायाचाी व्यक्ताी, उक्ता पदार पदाोन्नांताी दाेण्यापूी दिताला संगका हुाताळोी प्रमापत्रा धार कारण्यापासंूनां संूट दाेण्याता आली नांसंेल तार, ताी, त्याबाबताीता शासंनांानांे ेळोेळोी काेलेल्या दिनांयमांनांुसंार दिकांा आदाेशांनांुसंार दिदिहुता काेलेले संगका हुाताळोी प्रमापत्रा धार कारील.

(खा) दिनांयमा ३ ४ माध्ये नांमाूदा पदांर नांामादिनांदाेशानांाद्वारे दिनांयुक्ता काेलेल्या व्यक्ताीनांे, दिताला संगका हुाताळोी प्रमापत्रा धार कारण्यापासंूनां संूट दाेण्याता आली नांसंेल तार, ताी, याबाबताीता शासंनांानांे ेळोेळोी दिदिहुता काेलेले असंे संगका हुाताळोी प्रमापत्रा, दिनांयुक्ताीनांतार दिदिहुता कालमायागदाेता धार कारील, अन्यर्था, ताी व्यक्ताी, ताे प्रमापत्रा धार कारीपयता, ादिगका ेतानां ाढीसंाठी दिकांा पुढील पदाोन्नांताीच्या पदारील पदाोन्नांताीसंाठी पात्रा असंार नांाहुी.

९. (१) दिनांयमा ३ ४ माध्ये नांमाूदा काेलेल्या पदार नांामादिनांदाेशानांाद्वारे दिनांयुक्ताीसंाठी दिशाफारसं काेलेली व्यक्ताी, माहुाराष्ट्रा नांागरी ंबाचाे प्रदिताज्ञापनां) दिनांयमा, २००५ च्या तारताुदांनांुसंार आदि याबाबता शासंनांानांे ेळोेळोी काेलेले अन्य संेा (लहुानां काुटं काोताेहुी दिनांयमा, आदाेशा दिकांा काोताेहुी संलेखा यांनांुसंार लहुानां काुटं ंबाचाे प्रदिताज्ञापनां संादार कारील.

(२) लहुानां काुटं ंबाचाे प्रदिताज्ञापनां संादार कारण्याच्या दिदानांांकाला दाोनांपेा अदिधाका अपत्ये असंारी व्यक्ताी, शासंकाीय संेताील दिनांयुक्ताीसंाठी अपात्रा असंेल.

(३) एखाद्योा व्यक्ताीचाी शासंकाीय संेता दिनांयुक्ताी झाल्यानांतार, जर दिताला दिनांयुक्ताीच्या ेळोी दिकांा त्यानांतार दाोनांपेा अदिधाका अपत्ये असंल्याचाे दिसंद्ध झाले तार, ताी व्यक्ताी, शासंकाीय संेताील उक्ता पदार कायमा राहुण्यासंाठी अपात्रा असंेल.

१०. दिनांयमा ३ ४ माध्ये नांमाूदा काेलेल्या पदार दिनांयुक्ता काेलेली व्यक्ताी, माहुाराष्ट्राता काोत्याहुी दिठकाी बदालीसंाठी पात्रा असंेल.

११. काोत्याहुी शासंकाीय कामागचाऱ्याच्या दिनांयुक्ताीनांतार, शासंनांानांे ेळोेळोी काेलेले काोताेहुी दिनांयमा, आदाेशा दिकांा दिनांगय यांमाध्ये शासंनांानांे दिदिनांदिदागष्ट काेलेल्या अटी शाताी दाेखाील अशा शासंकाीय कामागचाऱ्यासं लागू असंताील.

No. SDE-2026/CR-154/Adm-2.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all the existing rules, orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of the Junior Skill Development, Employment and Entrepreneurship Guidance Officer, Group 'C' and Senior Clerk, Group 'C' in the Commissionerate of Skill Development, Employment and Entrepreneurship under the administrative control of the Skills, Employment, Entrepreneurship and Innovation Department of the Government of Maharashtra, namely :—

1. (1) These rules may be called the Junior Skill Development, Employment and Entrepreneurship Guidance Officer, Group 'C' and Senior Clerk, Group 'C' in the Commissionerate of Skill Development, Employment and Entrepreneurship (Recruitment) Rules, 2026.

(2) These rules shall come into force on the date of publication of these rules in the Maharashtra Government Gazette.

2. In these rules, unless the context requires otherwise, —

(a) "Appointing Authority" means the Commissioner, Commissionerate of Skill Development, Employment and Entrepreneurship for appointing a candidate to the post of Junior Skill Development, Employment and Entrepreneurship Guidance Officer, Group 'C' and Senior Clerk, Group 'C' in the Commissionerate ;

(b) "Commission" means the Maharashtra Public Service Commission ;

(c) "Commissionerate" means the Commissionerate of Skill Development, Employment and Entrepreneurship under the administrative control of the Skills, Employment, Entrepreneurship and Innovation Department of the Government of Maharashtra ;

(d) "Degree" means a degree of any discipline of a statutory university or any other qualification declared by the Government to be equivalent thereto;

(e) "Department" means the Skills, Employment, Entrepreneurship and Innovation Department specified in the First Schedule appended to the Maharashtra Government Rules of Business made under article 166 of the Constitution of India ;

(f) "Eligibility for promotion" means the eligibility for promotion in accordance with the terms and conditions specified for promotion in rules, resolutions or orders issued by the General Administration Department, from time to time ;

(g) "Government" means the Government of Maharashtra ;

3. The appointment to the post of Junior Skill Development, Employment and Entrepreneurship Guidance Officer, Group 'C' in the Commissionerate shall be made,—

(a) by promotion of a suitable person having eligibility for promotion on the basis of seniority, as per seniority list subject to fitness from amongst the persons holding the post of Senior Clerk, Group 'C' in the Commissionerate, having not less than three years regular and continuous service on that post ; or

(b) by nomination from amongst the candidates recommended by the Commission on the basis of result of Competitive Examination conducted therefor, who fulfills the following criteria, namely :—

(A) Lower Age Limit– Not less than eighteen years as on the last date of receipt of applications as per the advertisement for recruitment to the said post.

(B) Upper Age Limit– Not more than thirty-eight years of age for the persons not belonging to reserved categories and forty-three years of age for the persons belonging to reserved categories as on the last date of receipt of applications as per the advertisement for recruitment to the post ;

(ii) Educational Qualification :—Possess a degree.

4. The appointment to the post of Senior Clerk, Group 'C' in the Commissionerate shall be made,–

(a) by promotion of a suitable person having eligibility for promotion on the basis of seniority, as per seniority list subject to fitness from amongst the persons holding the post of Clerk-Typist, Group 'C' in the Commissionerate having not less than three years regular and continuous service on that post ; or

(b) by nomination from amongst the candidates recommended by the Commission on the basis of result of Competitive Examination conducted therefor, who fulfills the following criteria, namely :—

(i) Age limit :—

(A) Lower Age Limit — Not less than eighteen years as on the last date of receipt of applications as per the advertisement for recruitment to the said post.

(B) Upper Age Limit — Not more than thirty-eight years of age for the persons not belonging to reserved categories and forty-three years of age for the persons belonging to reserved categories as on the last date of receipt of applications as per the advertisement for recruitment to the post ;

(ii) Educational Qualification :– Possess a degree.

5. Appointment to the posts mentioned in rules 3 and 4 shall be made with the approval of Appointing Authority.

6. Appointment to the posts mentioned in rules 3 and 4 by promotion and nomination shall be made in the ratio of 75:25, respectively, for the total number of sanctioned posts to be filled under rules 3 and 4.

7. (a) A person appointed to the posts mentioned in rules 3 and 4 by promotion shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, unless he has already passed or has been exempted from passing those examinations before getting promoted to the said post.

(b) A person appointed to the posts mentioned in rules 3 and 4 by nomination, shall pass the Marathi and Hindi languages examinations as per the rules made in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes those examinations.

8. (a) A person to be appointed to the posts mentioned in rules 3 and 4 by promotion shall possess a Certificate of Computer Operations prescribed by the Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from possessing such Certificate of Computer Operations before getting promoted to the said post.

(b) A person to be appointed to the posts mentioned in rules 3 and 4 by nomination, shall possess a Certificate of Computer Operations prescribed by the Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from possessing such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possess the same.

9. (1) A person appointed to the posts mentioned in rules 3 and 4 by nomination, shall submit a declaration of Small Family as per the provisions of the Maharashtra Civil Services (Small Family Declaration) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time.

(2) A person having more than two children on the date of submission of Declaration of Small Family shall be disqualified for the appointment in the Government service.

(3) After appointment of a person in the Government service, if it is proved that he has more than two children at the time of appointment or thereafter, then he shall be disqualified for continuing on the said post in the Government service.

10. A person appointed to the post mentioned in rules 3 and 4 shall be liable for transfer anywhere in Maharashtra.

11. The terms and conditions specified by the Government, subsequent to the appointment of any Government servant in any rules, orders or resolutions issued by the Government, from time to time, shall also be applicable to the Government servant.
