ज्याअर्थी, महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियम, १९६६ (यापुढे ज्यास " उक्त अधिनियम " असे संबोधले आहे) मधील तरतुदीनुसार अमरावती जिल्ह्यची प्रादेशिक योजना (यापुढे ज्यास " उक्त प्रादेशिक योजना " असे संबोधले आहे) शासनाने दिनांक २९ मे, १९९३ अन्वये मंजूर केली असून ती दिनांक १५ ऑगस्ट, १९९३ पासून अंमलात आलेली आहे;
आणि ज्याअर्थी, उक्त प्रादेशिक योजनेतील, मौजे गोपाळपूर, ता. जि. अमरावती येथील शेत गट नं. ४०/१, क्षेत्र ३.०५ हे. आर, गट नं. ४१/१, क्षेत्र १.८२ हे. आर, गट नं. ४१/१/अ, क्षेत्र २.०१ हे. आर, गट नं. ४०/१/अ, क्षेत्र ०.६० हे. आर, गट नं. ४१/२, क्षेत्र २.२० हे. आर, गट नं. ४२/५/अ, क्षेत्र १.२५ हे. आर असे एकूण १०.९३ हे. आर क्षेत्र (यापुढे ज्यास " उक्त जमीन " असे संबोधले आहे) शेती विभागात समाविष्ट होते;
आणि ज्याअर्थी, प्रस्ताव छाननी समितीचे (यापुढे " उक्त समिती " असे संबोधले आहे.) बैठक क्र. २१, दिनांक ०७ जून, २०२३ रोजी झालेल्या सभेमध्ये समितीचे सदस्यांचा सल्ला घेतल्यानंतर, शासनाचे दिनांक ०६ मे, २०१५ रोजीच्या शासन निर्णयान्वये प्रदान केलेल्या अधिकाराचा वापर करुन उक्त अधिनियमाचे कलम २० मधील तरतुदीनुसार उक्त जमीन शेती विभागातून वगळून काही अटींच्या अधिन राहून रहिवास विभागात समाविष्ट करणे आवश्यक असल्याचे उक्त समितीचे मत झाल्याने उक्त अधिनियमाचे कलम २० चे पोट-कलम (४) व त्यानुषंगाने प्राप्त अधिकारांचा वापर करुन सहसंचालक, नगर रचना, अमरावती विभाग, अमरावती यांनी उक्त जमिनी शेती विभागातून वगळून रहिवास विभागात समाविष्ट करणेबाबतच्या फेरबदलास अधिसूचना (यापुढे " उक्त अधिसूचना " असे संबोधले आहे.) क्र. प्रा.यो. अम.-कलम-२० (४)-मौ. गोपाळपूर, गट क्र. ४०-१ व इतर-सभा- २१-२०२३-सहसंचाअम-५९, दिनांक २५ फेब्रुवारी, २०२६ अन्वये मंजुरी प्रदान केली आहे;
आणि ज्याअर्थी, उक्त अधिसूचनेतील अट क्र. १ मध्ये नमूद ०.४० हे. आर अतिरिक्त सुविधा क्षेत्र सोडण्याबाबतची तरतूद (यापुढे " उक्त तरतूद " असे संबोधले आहे) रद्द करणेबाबत जमिनधारकांनी दिनांक २६ फेब्रुवारी, २०२६ रोजी परिसरातील सुविधा दर्शविणाया गुगल प्रतिमेसह उक्त समितीच्या सदस्य सचिवांकडे अर्ज केला आहे;

(१)२ महाराष्ट्र शासन राजपत्र भाग एक-अ अमरावती विभागीय पुरवणी, जुलै ३०-ऑगस्ट ५, २०२६/श्रावण ८-१४, शके १९४८ आणि ज्याअर्थी, संचालक, नगर रचना, महाराष्ट्र राज्य, पुणे यांनी दिनांक ०९ मार्च, २०२६ रोजीच्या पत्रान्वये उक्त तरतूद रद्द करणे बाबत सहसंचालक, नगर रचना, अमरावती विभाग, अमरावती यांनी स्थळपाहणी करुन खातरजमा केल्यानंतर फेरबदल (यापुढे " उक्त फेरबदल " असे संबोधले आहे) प्रस्ताव कार्यान्वित करण्यास हरकत नसल्याचे कळविले आहे;
आणि ज्याअर्थी, सहसंचालक, नगर रचना, अमरावती विभाग, अमरावती यांनी दिनांक १२ मार्च, २०२६ रोजी प्रत्यक्ष स्थळ निरिक्षण करुन उक्त जमिनीच्या परिसरातील विद्यमान सुविधांची पडताळणी केली आहे;
आणि ज्याअर्थी, सोबतचे परिशिष्ट " अ " मध्ये नमूद केले नुसार उक्त अधिसूचनेतील अट क्र. १ मधील उक्त तरतूद रद्द करुन सदरची अट सुधारित करणे आवश्यक असल्याचे समितीचे मत झाले होते;
आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम २० पोट-कलम (३) च्या तरतुदीनुसार सूचना क्र. प्रा.यो. अम.-कलम-२० (३)-मौ. गोपाळपूर, गट क्र. ४०-१ व इतर-सभा क्र.-३२-२०२६-सहसंचाअम-११८ अन्वये सदस्य सचिव, प्रस्ताव छाननी समिती यांनी प्रसिध्द केली होती व प्रस्तावित फेरबदलाबाबत नागरिकांकडून हरकती व सूचना दाखल करणायांना सुनावणी देण्याकरीता व सदस्य सचिव, प्रस्ताव छाननी समिती, अमरावती यांना अहवाल सादर करण्याकरीता " अधिकारी " (यापुढे " उक्त अधिकारी " असे संबोधले आहे) म्हणून सहायक संचालक, नगर रचना, शाखा कार्यालय, अमरावती यांना प्राधिकृत करण्यात आले होते;
आणि ज्याअर्थी, प्राधिकृत अधिकायाने त्यांच्या पत्र क्र. ६४७, दिनांक २१ मे, २०२६ अन्वये त्यांचा अहवाल सदस्य सचिव, प्रस्ताव छाननी समिती यांना सादर केलेला आहे;
आणि ज्याअर्थी, उक्त समितीचे दिनांक ०३ जून, २०२६ रोजी झालेल्या सभेमध्ये प्राधिकृत अधिकायाच्या प्राप्त अहवालानुसार सोबतचे परिशिष्ट " अ " मध्ये नमूद केले नुसार उक्त अधिसूचनेतील अट क्र. १ मधील उक्त तरतूद रद्द करुन सदरची अट सुधारित करणे आवश्यक असल्याचे समितीचे मत झाले आहे;
आणि ज्याअर्थी, शासनाच्या वापर विभाग बदलाच्या धोरणानुसार मौ. गोपाळपूर, ता. जि. अमरावती येथील भूमापन क्र.-उपविभाग-गट नं. ४०/१ व इतर एकूण क्षेत्र १०.९३ हे. आर या जमिनी शेती विभागातून वगळून रहिवास विभागात समाविष्ट करणेबाबत उक्त अधिसूचनेमधील अट क्र. १ सुधारित करणेबाबत (उक्त अटीत नमूद ०.४० हे. आर अतिरिक्त सुविधा क्षेत्र सोडणेची अट रद्द करणेबाबत) जमीन मालक यांनी जाहिरात प्रसिद्धी शुल्क शासकीय लेखाशिषार्ंत दिनांक ०३ जुलै, २०२६ रोजी जमा केले आहे;
आणि ज्याअर्थी, शासनाचे निर्णय क्र. टिपीएस-१८१५-प्र.क्र.४९-१५नवि-१३, दिनांक ११ जून, २०१५ अन्वये संबंधित विभागीय सहसंचालक, यांना उक्त अधिनियमाचे कलम २० (४) अन्वये अधिसूचना निर्गमित करण्याचे अधिकार प्रत्यायोजित करण्यात आले आहेत;
त्याअर्थी, आता, उक्त अधिनियमाचे कलम २० चे पोट-कलम (४) व त्यानुषंगाने प्राप्त अधिकारांचा वापर करुन सहसंचालक, नगर रचना, अमरावती विभाग, अमरावती उक्त जमिनीबाबत प्रस्तावित फेरबदलास पुढील प्रमाणे मंजुरी देत आहेत व त्यासाठी सोबतचे परिशिष्ट " अ " मध्ये नमूद केले नुसार उक्त अधिसूचनेमधील अट क्र. १ (उक्त अटीत नमूद ०.४० हे. आर अतिरिक्त सुविधा क्षेत्र सोडणेची अट रद्द करणेबाबत) पुढील प्रमाणे सुधारित करण्यात येत आहे;

BY MEMBER SECRETARY, PROPOSAL SCRUTINY COMMITTEE AND JOINT DIRECTOR OF TOWN PLANNING THE MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
NOTIFICATION
No. R.P. Amr.-Sect 20(4)-Mau. Gopalpur- Gut No.40-1 & others-Meeting No. 33-2026-JDTPAMT-478.---
Whereas, the Government has Sanctioned the Regional Plan for Amravati, District on 29th May,1993 (hereinafter referred to as "the said Regional Plan") under the provisions of Maharashtra Regional & Town Planning Act, 1966 (hereinafter referred to as "the said Act") and has came into force with effect from 15 th August, 1993;
And whereas, in the said Regional Plan, the land admeasuring total area about 10.93 H.R. bearing Gut No. 40/1, area 3.05 H.R., Gut No. 41/1, area 1.82 H.R., Gut No. 41/1/A, area 2.01 H.R., Gut No. 40/1/A, area 0.60 H.R., Gut No. 41/2, area 2.20 H.R. & Gut No. 42/5/A, area 1.25 H.R. of mouje Gopalpur, Tal. Dist. Amravati, (hereinafter referred to as "the said Land") was included in Agricultural Zone;
And whereas, in the Meeting No. 21, dated 7th June, 2023 of the Proposal Scrutiny Committee (hereinafter referred to as "the said Committee") after consulting the members of the Committee, it was opined that by exercising the powers conferred under the Government Resolution dated 6th May, 2015 and in accordance with the provisions of Section 20 of the said Act, it is necessary to exclude the said Land from the Agricultural Zone and to include it in the Residential Zone subject to certain conditions. Therefore, by exercising the powers conferred under Section 20, sub-section (4) of the said Act, the Joint Director, Town Planning, Amravati Division, Amravati, has approved the modification to exclude the said Land from the Agricultural Zone and include it in the Residential Zone, vide Notification (hereinafter referred to as "the said Notification") No. R.P.Amr.-Mau.-Gopalpur, Gut No. 40-1& others-Sect 20 (4)- Meeting No. 21-2023-JDTPAMT-59, dated 25th February, 2026;
And whereas, under Condition No. 1 in the said Notification, the provision (hereinafter referred to as "the said Provision") of 0.40 hectares as an additional amenity area has been requested to be deleted by the land holders vide an application dated 26th February, 2026 along with Google images showing the surrounding amenities to the Member-Secretary of the said Committee;
And whereas, the Director of Town Planning, Maharashtra State, Pune, vide Letter dated 9th March, 2026, has informed that, there is no objection to carry out the modification proposal (hereinafter referred to as "the said Modification") for deletion of the said Provision after site inspection and verification by the Joint Director, Town Planning, Amravati Division, Amravati;
And whereas, the Joint Director, Town Planning, Amravati Division, Amravati, has personally inspected the site on date12th March, 2026 and verified existing amenities in the vicinity of the said land;
And whereas, as mentioned in Scheduled 'A' appended herewith, the said Committee was of the opinion that, it was necessary to delete the said Provision under Condition No. 1 in the said Notification and accordingly amend this condition;
And whereas, the notice in respect of the Proposed Modification, under sub-section (3) of section 20 of the said Act, was published by the Member Secretary, Proposal Scrutiny Committee, Amravati, vide Notice No. R.P.Amr.- Sect 20 (3)-Mau. Gopalpur-Gut No. 40-1 & others -Meeting No. 32-2026-JDTPAMT-118, dated 27th March, 2026 inviting४ महाराष्ट्र शासन राजपत्र भाग एक-अ अमरावती विभागीय पुरवणी, जुलै ३०-ऑगस्ट ५, २०२६/श्रावण ८-१४, शके १९४८ objections and suggestions from the general public and the Assistant Director of Town Planning, Amravati Branch was appointed as an "Officer" (hereinafter referred to as "the said Officer") to hear the suggestions/objections received within the stipulated period only and to submit his report thereupon to the Member Secretary, Proposal Scrutiny Committee, Amravati;
And whereas, the said Officer submitted his report to the Member Secretary, Proposal Scrutiny Committee, Amravati vide his letter No. 647, dated 21st May, 2026;
And whereas, herewith in the meeting of the said Committee held on 3rd June, 2026 upon the report of the said Officer, the said Committee is of the opinion, as mentioned in Schedule 'A', it is necessary to delete the said Provision under Condition No. 1 in the said Notification and accordingly amend this condition;
And whereas, as per zone change policy of the Government, the owners of the said Land have deposited the Advertisement Publication Charges in the Government Treasury on 3rd July, 2026.
And whereas, the Government by order No. TPS-1815-C.R.49-15-UD-13, Dt. 11th June, 2015 has delegated power to the Joint Director of Town Planning of respective Division to issue notification under section 20 (4) of the said Act; Now, therefore, in exercise of the power conferred under sub section (4) of section 20 of the said Act, the Joint Director of Town Planning, Amravati Division, Amravati hereby sanctions the proposed Modification in respect of the said Land that Condition No. 1 of the said Notification (Regarding deletion of the condition of keeping 0.40 hectare additional amenity area mentioned in the said condition) as mentioned in Annexure 'A' is hereby amended;

While preparing the layout in respect of the said land under modification, apart from the compulsory 10% open space, 10% space shall be kept for public amenities.
