आता, त्याअर्थी, उक्त अविधविनायमाचंे कलम १२७ (२) नाुसारा प्राप्‍त अविधकारात राज्य शासना, उक्त विकास योजुनाेतील, मौजुे कोसारा, ता. विजु. चंद्रपुूरा मधील सर्व्हेहे क्र.१२ मधील, खालील पुरिराविशाष्ात नामू केल्यानाुसारा ०.७१ हेक्रा क्षेत्राराील "सामाविजुक नाीकराण" हे आराक्षेण र्व्हेयपुगत झाल्याचंे अविधसूविचंत कराीत आहे अशाप्रकाराे उक्त आराक्षेणातूना मुक्त झालेली जुमीना, संबंविधत जुमीनामालकास उक्त विकास योजुनाेतील लगतच्या अनाुज्ञेय भाूापुराप्रमाणे अन्यर्थीा अनाुज्ञेय असलेल्या विकासाकराीता उपुलब्ध हेोईल;

The MaharashTra regional and Town Planning acT, 1966

ORDER

No.TPS-2226-527-C.R.101-2026-UD-9.–

Whereas, the Government of Maharashtra vide Urban Development Department's Notification No.TPS-2284-1823-C.R.105-UD-9, dated 20th December, 1988, has appointed Maharashtra Housing and Area Development Authority (MHADA) to be "Special Planning Authority" under the provision of section 40(1)(b) of the Maharashtra Regional and Town Planning Act, 1966 (Maha. Act No. XXXVII of 1966) (hereinafter referred to as "the said Act") to undertake planned and orderly development of the notified area of New Chandrapur, as proposed in the sanctioned Regional Plan of Chandrapur-Ballarpur Region and the Government vide Urban Development Department's Notification No. TPS-2294-471-CR-159-UD-9, dated 30th June, 1998, has sanctioned the Development Plan for the aforesaid Notified Area which has come into force with effect from 1st September, 1998 (hereinafter referred to as "the said Development Plan");

And whereas, in the said Development Plan, the land area admeasuring 0.71 Hectare bearing Survey No.12, of Mouja Kosara (hereinafter referred to as "the said Land") is reserved as "Social Forestry" (hereinafter referred to as "the said Reservation") and the Appropriate Authority for the said Reservation is Maharashtra Housing & Area Development Authority (hereinafter referred to as "the said Special Planning Authority");

And whereas, the said Land under the said Reservation has not been acquired by the said Special Planning Authority within ten years from the date on which the said Development Plan has come into force;

And whereas, the Owners of the said Land, had served a notice dated 27th July, 2022 under Section 127(1) of the said Act, to the said Special Planning Authority, also being the Appropriate Authority (hereinafter referred to as "the said Notice");

And whereas, even after service of the said Notice as aforesaid, the said Land had neither been acquired, within prescribed time period nor the Notification of land acquisition required under section 126(4) of the said Act, read with Section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, has been published by the said Special Planning Authority within prescribed time period from the date of the service of said Notice;

And whereas, the owners of the said Land, have filed Writ Petition No. 2084/2025 before the Hon'ble Bombay High Court, Nagpur Bench, Nagpur and the final order dated 30th March, 2026 is passed by the Hon'ble High Court;

And whereas, it is observed that, the said Land had neither been acquired, within prescribed time period from the date of service of Notices, nor Notification of land acquisition required under section 126(4) of the said Act, read with section 19 of the Right to Fair Compensation of Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013, been published within prescribed time period by the said Special Planning Authority and in consequence thereof, the Government४ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, जुलै ३०-ऑगस्ट ५, २०२६/श्रावण ८-१४, शके १९४८ of Maharashtra is of opinion that, the said Reservation on the said Land, stands lapsed as per the provisions of section 127(1) of the said Act;

Now, therefore, in exercise of the powers conferred by sub-section (2) of section 127 of the said Act and of all other powers enabling it in that behalf, the Government of Maharashtra, as mentioned in the Annexure below, hereby notifies that, the said Reservation i.e. "Social Forestry" as specified in the said Development Plan stands lapsed to the extent of area admeasuring 0.71 Hectare bearing Survey No.12 of Mauja Kosara, Tal. Dist. Chandrapur and the area so released will be available to the owners for the purpose of development as otherwise permissible in the case of adjacent land under the said Development Plan.

In exercise of the powers conferred by sub-section (8) of Section 53 of the Maharashtra Regional and Town Planning Act. 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act"), and all other powers enabling it in this behalf, the Ramtek Municipal Council, being the Planning Authority for the urban area of Ramtek, hereby designates the officers specified in column (2) of the Schedule appended hereto to be the " Designated Officers " for the purposes of exercising the powers of the Planning Authority under Section 53, Section 54, Section 55, and Section 56 of the said६ महाराष्ट्र शासन राजपत्र भाग एक-अ नागपूर विभागीय पुरवणी, जुलै ३०-ऑगस्ट ५, २०२६/श्रावण ८-१४, शके १९४८ Act, within the local area of jurisdiction specified against them in column (3) of the said Schedule.

However, all ongoing legal matters, court cases, hearings, and enforcement actions initiated prior to this date shall henceforth be processed, conducted, and executed by the newly appointed Designated Officers. The designated officers shall assume full jurisdiction and authority to pursue all such pending and ongoing matters to their legal conclusion.
