क्रमंांका मंुद्रांांका-२०२५/प्र.क्र.२०३/मंुद्रांांका-२.— मंहुाराष्ट्र मंुद्रांांका अदिदिनांयमं, (१९५८ चा ६०) याच्या कालमं ९ च्या खंड (अ) द्वारे प्रदानां काेलेल्या अदिकारांचा वापर कारूनां, मंहुाराष्ट्र शासनां, जनांदिहुतार्थग तासे कारणे आवाश्यका असल्याचाी खंात्राी पटल्यानांे, याद्वारे, मंहुाराष्ट्र राज्याताील रदिहुवाशाी असलेला भारताीय सशास्त्रा दालांचा सैदिनांका दिकांवा अदिकारी जो, युद्ध, युद्ध-सदाृश्य परिरस्थिस्र्थताी, सैदिनांकाी हुालचाली, दाहुशातावादादिवारोी कारवाई दिकांवा दिवाद्रांोहुरोी कारवाईमंध्ये मंृता झाला आहुे याचाी दिवावा दिकांवा कायदाेशाीर वारसाच्या नांावानांे भाोगवाटा मंूल्य व्यदितारिरक्ता वा दिललावाव्यदितारिरक्ता शासनांाद्वारे वाटप काेलेल्या शाेताजदिमंनांीच्या बाबताीता दिनांष्पादिदाता कारावायाच्या अदिभाहुस्तांतारणेाच्या दिकांवा भाडेपट्ट्याच्या पदिहुल्या संलेखंावारील उक्ता अदिदिनांयमंासोबता जोडलेल्या अनांुसूचाी-एकाच्या अनांुच्छेदा २५च्या खंड (ब) वा अनांुच्छेदा ३६ अन्वाये अन्यर्था आकारण्यायोग्य असलेले संपूणेग मंुद्रांांका शाुल्का, पुढील शाताीस अीनां राहुूनां, मंाफ कारीता आहुे :—

शाती.—

(१) शासनांाद्वारे, मंहुसूल वा वानां दिवाभागाचाी अदिसूचानांा, दिदानांांका २८ जूनां, २०१८ दिकांवा त्या अनांुषंगानांे काढीलेला शासनां दिनांणेगय दिकांवा आदाेशान्वाये शाेताजमंीनां वाटप काेली जाईल.

(२) लाभार्थी हुा मंयता सैदिनांका दिकांवा अदिकाऱ्याचाी दिवावा दिकांवा कायदाेशाीर वारस असेल वा असा दाजाग सक्षमं प्रादिकारणेाद्वारे प्रमंादिणेता काेलेला असेल.

(३) सक्षमं प्रादिकारणे असे प्रमंादिणेता कारील काी, मंयता सैदिनांका दिकांवा अदिकारी,—

(अ) मंहुाराष्ट्र राज्याताील रदिहुवाशाी हुोता; आदिणे

(ब) युद्ध, युद्ध-सदाृश्य परिरस्थिस्र्थताी, सैदिनांकाी हुालचाली, दाहुशातावादादिवारोी कारवाई दिकांवा दिवाद्रांोहुरोी कारवाईमंध्ये मंृता झालेला आहुे.

भाग चार-ब-४२५-१२ महाराष्ट्रट शासन राजपत्र असाधाराण भाग चारा-ब, ऑगस्ट ४, २०२६/श्रावण १३, शाके १९४८ (४) सूट हुी अशा शाेताजदिमंनांीच्या वाटपाकारिरता दिनांष्पादिदाता कारावायाच्या काेवाळ पदिहुल्या संलेखंाच्या बाबताीता उपलब् असेल.

(५) जदिमंनांीचाे ज्या प्रयोजनांासाठी वाटप काेले आहुे त्याकारिरता दिताचा काटेकाोरपणे वापर काेला जाईल.

(६) जर या अदिसूचानांेन्वाये, काोणेत्याहुी लाभार्थ्यायागनांे, तार्थ्याये दाडपणे, दिवापयागस कारणे, दिकांवा वाटपाच्या काोणेत्याहुी शाताीचा भांग कारणे याद्वारे, मंुद्रांांका शाुल्काताील सूट दिमंळदिवाली असेल तार ताी सूट सुरुवाताीपासूनांचा काढीूनां घेताली जाईल आदिणे अशा लाभार्थ्यायागस, मंहुाराष्ट्र मंुद्रांांका अदिदिनांयमं, (१९५८ चा ६०) अन्वाये आकारण्यायोग्य असलेल्या शास्ताीसहु मंुद्रांांका शाुल्का काोणेताेहुी असल्यास, प्रदाेय असेल.

स्पष्टीकराण.—

(१) "कायदाेशाीर वारस" याचा अर्थग, लागू असलेल्या कायद्यानांुसार वा शासनांाच्या ोरणेानांुसार सक्षमं प्रादिकारणेानांे मंयता सैदिनांकाचा दिकांवा अदिकाऱ्याचा कायदाेशाीर वारस म्हुणेूनां मंान्यता दिदालेली व्यक्ताी, असा आहुे.

(२) "सैदिनांका वा अदिकारी" याचा अर्थग, भारताीय सशास्त्रा दालांता कायगरता असलेली व्यक्ताी, असा आहुे.

(३) युद्ध, युद्ध-सदाृश्य परिरस्थिस्र्थताी, सैदिनांकाी हुालचाली, दाहुशातावादादिवारोी कारवाई दिकांवा दिवाद्रांोहुरोी कारवाईमंध्ये मंृत्यूचाी घेटनांा, शासनांाद्वारे, दिवादिनांदिदागष्ट काेल्याप्रमंाणे सशास्त्रा दालांच्या सक्षमं प्रादिकारणेाद्वारे दिकांवा अशा प्रादिकारणेाद्वारे प्रमंादिणेता काेली जाईल.

Maharashtra staMp act.

No.Mudrank-2025/C.R.203/Mudrank-2.— In exercise of the powers conferred by clause (a) of section 9 of the Maharashtra Stamp Act (LX of 1958), the Government of Maharashtra, being satisfied that it is necessary to do so in the public interest, hereby remits the stamp duty in whole, as otherwise chargeable under clause (b) of article 25 and article 36 of Schedule-I appended to the said Act on the first instrument of Conveyance or Lease executed in respect of agricultural land allotted by the Government, without occupancy price and without auction, in favour of the widow or legal heir of a soldier or officer of the Indian Armed Forces who was domiciled in the State of Maharashtra and who died in war, war-like situation, military operation, anti-terrorist operation or anti-insurgency operation, subject to the following conditions, namely :—

Conditions.—

(1) The agricultural land shall be allotted by the Government under the Revenue and Forest Department Notification dated the 28th June 2018 or any Government Resolution or Order issued in continuation thereof.

(2) The beneficiary shall be the widow or legal heir of the deceased soldier or officer and such status shall be certified by the Competent Authority.

(3) The Competent Authority shall certify that the deceased soldier or officer

(a) was domiciled in the State of Maharashtra; and

(b) died in war, war-like situation, military operation, anti-terrorist operation or anti- insurgency operation.

(4) The remission shall be available only in respect of the first instrument executed for allotment of such agricultural land.

(5) The land shall be used strictly for the purpose for which it is allotted.

(6) If any beneficiary has obtained remission under this notification by suppression of facts, misrepresentation, or commits breach of any condition of allotment, the remission shall stand withdrawn ab-initio and the stamp duty together with penalty, if any, recoverable under the Maharashtra Stamp Act (LX of 1958), shall become payable.

Explanation.—

(1) "Legal heir" means the person recognised as the legal heir of the deceased soldier or officer by the Competent Authority in accordance with the applicable law and Government policy.

(2) "Soldier or Officer" means a person serving in the Indian Armed Forces.

(3) The fact of death in war, war-like situation, military operation, anti-terrorist operation or anti-insurgency operation shall be certified by the Competent Authority of the Armed Forces or by such authority as may be specified by the Government.
