क्रमांका एफएलआर-१२२५/प्र.क्र.२६५ (१)/राउशु-२.— ज्याअर्थी, माहुाराष्ट्र शुासनांास वाटताे काी, माु ंबई दिवादाेशुी माद्य दिनांयमा, १९५३ माध्ये आणखी सुधारणा कारूनां खीालील दिनांयमा तात्काळ अंमालाता आणले जावाेता आदिण म्हुणूनां माहुाराष्ट्र दारुबंदाी अदिधादिनांयमा (१९४९ चा २५) च्या कालमा १४३ च्या पोट-कालमा (३) च्या पोरंताुकाद्वारे तारताूदा काेल्याप्रमाणे पोूवाग प्रदिसद्धीदिशुवाय हुे दिनांयमा कारण्याता यावाेता.

त्याअर्थी, आता, माहुाराष्ट्र दारुबंदाी अदिधादिनांयमाचाे कालमा १४३ च्या पोट-कालमा (३) च्या पोरंताुकासहु पोट-कालमा (२) च्या खींड ंबई दिवादाेशुी माद्य दिनांयमा, (जी) आदिण (एचा-१) वा त्याबाबताीता प्रदानां काेलेल्या सवाग अदिधाकारांचा वापोर कारूनां, माहुाराष्ट्र शुासनां, याद्वारे, माु १९५३ माध्ये आणखी सुधारणा कारण्यासाठी खीालील दिनांयमा कारीता आहुे, जसे काी खीालीलप्रमाणे :—

१. या दिनांयमांनांा माु ंबई दिवादाेशुी माद्य (सुधारणा) दिनांयमा, २०२६ संबोधाण्याता यावाे,

२. माु ंबई दिवादाेशुी माद्य दिनांयमा, १९५३ च्या दिनांयमा २५ माधाील उपो दिनांयमा (४) माधाील खींड (d) च्या उपो-खींड (v) नांतार खीालील उपो-खींड समादिवाष्ट कारण्याता यावाे, जसे काी,—

"(vi) (अ) एफएल-२ अनांुज्ञप्ताीचाे प्रस्तादिवाता स्र्थीलांतार दिनांवासी वा दिनांवासी-वा-वादिणज्य संकाुलामाध्ये हुोता असल्यास वा सदार संकाुल माहुाराष्ट्र सहुकारी संस्र्थीा कायदा, १९६३ (१९६१ चा २४) माधाील कालमा ९ अंतागगता नांदाणीकाृता असल्यास एफएल-२ स्र्थीलांतारणासाठी अशुा सोसायटीचाे नांा-हुरकाता प्रमाणपोत्रा घेणे बंधानांकारका राहुील,

(ब) एखीाद्या दिनांवासी तासेचा दिनांवासी-वा-वादिणज्य संकाुलास अंशुता: भाोगवाटा प्रमाणपोत्रा प्राप्ता दिठीकाणी स्र्थीलांतारासाठी सोसायटीचाे नांा-हुरकाता प्रमाणपोत्रा बंधानांकारका राहुील,

(का) अशुा सोसायटीचाे नांा-हुरकाता प्रमाणपोत्रा घेऊनां स्र्थीलांतारीता झालेल्या एफएल-२ अनांुज्ञप्ताीसाठी दारवार्षी सदार सोसायटीचाे नांा-हुरकाता प्रमाणपोत्रा घेण्याचाी आवाश्यकाता नांाहुी."

NOTIFICATION

Maharashtra Prohibition act.

No.FLR-1225/C.R.265(1)/Exc-2.— Whereas, the Government of Maharashtra considers that the following rules further to amend the Bombay Foreign Liquor Rules, 1953, should be brought into force at once and therefore the rules should be made without previous publication as provided by the proviso to sub-section (3) of section 143 of the Maharashtra Prohibition Act (XXV of 1949).

Now, therefore, in exercise of the powers conferred by clauses (g) and (h-1) of sub-section (2) read with proviso to sub-section (3) of section 143 of the Maharashtra Prohibition Act and of all other powers enabling it in that behalf, the Government of Maharashtra hereby makes the following rules further to amend the Bombay Foreign Liquor Rules, 1953, as follows, namely :—

1. These rules may be called the Bombay Foreign Liquor (Amendment) Rules, 2026.

2. In rule 25 of the Bombay Foreign Liquor Rules, 1953 in sub-rule (4), in clause (d), after sub-clause (v), the following sub-clause shall be added, namely :—

"(vi) (A) If the proposed shifting of FL-2 licence is to be done in a residential or residential-and-commercial complex and if the said complex is registered as a society under section 9 of Maharashtra Co-operative Societies Act, 1963 (XXIV of 1961), it shall be mandatory to obtain the no-objection certificate from such society for shifting of FL-2 licence;

(B) No-objection certificate from the society shall be mandatory for shifting of FL-2 licence to a residential or residential-and-commercial complex with partial occupancy certificate;

(C) For FL-2 license holder who has shifted to a registered society with a no-objection certificate from such society, there shall be no need to obtain a no-objection certificate from the said society every year."
