In pursuance of clause (3) of article 348 of the Constitution of India, the following translation in English of the Maharashtra Private Universities (Establisment and Regulation) (Amendment) Ordinance, 2026 (Mah. Ord. XII of 2026), is hereby published under the authority of the Governor.

AN ORDINANCE
further to amend the Maharashtra Private Universities
(Establishment and Regulation) Act, 2023.
WHEREAS both Houses of the State Legislature are not in session ;
Mah. VIII of 2024.
AND WHEREAS the Governor of Maharashtra is satisfied that circumstances exist which render it necessary for him to take immediate action further to amend the Maharashtra Private Universities (Establishment and Regulation) Act, 2023 for the purposes hereinafter appearing;
NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article 213 of the Constitution of India, the Governor of Maharashtra is hereby pleased to promulgate the following Ordinance, namely :––

भाग आठ-१२५–१ २ महाराष्ट्रट शासन राजपत्र असाधाराण भाग आठ, ऑगस्ट २७, २०२६/भाद्रपद ५, शाके १९४८ 1. (1) This Ordinance may be called the Maharashtra Private Universities Short title and commencement.
(Establishment and Regulation) (Amendment) Ordinance, 2026.
(2) It shall come into force at once.
Mah. VIII of 2024.
2. In the SCHEDULE appended to the Maharashtra Private Universities (Establishment and Regulation) Act, 2023, in Part II, after entry 13, the following entries shall be added, namely :—
Amendment of Schedule to Mah. VIII of 2024.
"14. Lata Mangeshkar
VSPM Academy of Higher Education, 5, Y.M.C.A. Complex, Sitabuldi, Nagpur- 440 001.
University, Headquarters at – Digdoh Hills, Hingna Road, Nagpur-440 019. (For Health Science Courses)
15. Dr. Balasaheb Vikhe Patil
Dr. Vithalrao Vikhe Patil Foundation, Vadgaon Gupta (Vilad Ghat), Post: M.I.D.C., Ahilyanagar- 414 111. (Maharashtra) .".

STATEMENT
The Maharashtra Private Universities (Establishment and Regulation)
Act, 2023 (Mah. VIII of 2024) is enacted for establishment, incorporation and
regulation of private universities in the State of Maharashtra. The said Act is
amended by Maharashtra Act No. XXX of 2026 to include Health Science courses
therein and to provide for establishment of private university for Health Science
Courses.
2. Section 4A of the said Act provides that the sponsoring body who has
a recognized medical college having not less than twenty years' experience in
the field of health science education with National Assessment and Accreditation
Council (NAAC) Accreditation Grade 'A' and above (Cumulative Grade Point
Average (CGPA) 3.01 and above) with Post Graduate Courses in at least fifty
per cent. of it's disciplines and operational for at least ten years shall be eligible
for making application for establishment of University conducting Health
Science Courses under this Act.
3. The colleges of the VSPM Academy of Higher Education, Nagpur
having Health Science Courses are functioning since more than 35 years and
have Grade A+ NAAC Accreditation with CGPA 3.39. The Medical College and
Hospital, Ahilyanagar of Dr. Vitthalrao Vikhe Patil Foundation is functioning
since more than 22 years and have Grade A+ NAAC Accreditation with CGPA
3.26. The said sponsoring bodies have applied to the Government under the
said Act for establishment of private universities for Health Science Courses.
4. The Government, after considering the report submitted by the
Verification Committee under sub-section (4) of section 5 of the said Act, is
satisfied that the said sponsoring bodies of proposed Lata Mangeshkar
University, Nagpur and Dr. Balasaheb Vikhe Patil University, Ahilyanagar
have complied with the provisions of sections 4A, 5 and other Sections of the
said Act and may be permitted to establish the private universities for Health
Science Courses, by amending the Schedule appended thereto.
It is, therefore, considered expedient that the Lata Mangeshkar University,
Nagpur, Headquarters at- Kh. No. 127/1, 127/5, Digdoh Hills, Hingna Road,
Nagpur-440 019 and Dr. Balasaheb Vikhe Patil University, Ahilyanagar,
Headquarters at- Vilad Ghat, near Gov. Milk Dairy, MIDC, Ahilyanagar-414 111,
be established as the private universities for Health Science Courses, by
amending Part II of the Schedule appended to the said Act, suitably.
5. The said sponsoring bodies have proposed to establish private
universities for Health Science Courses from the 2026-27 academic year.
Admissions for Health Science Courses for the 2026-27 academic year are
currently ongoing.
