DECLARATION
The 30th July, 2019
S.R.O. No.269/2019―WHEREAS, it was alleged that Shri Pradipta Kumar Behera, OFS, S/o. Late Khetra Mohan Behera of Village‒ Praharajpur, P.S.‒ Kishorenagar, Dist.‒Cuttack, present address Flat No.201/P, Samantarapur, P.S.‒Lingaraj, Bhubaneswar, Dist.‒Khurda, State-Odisha, while holding high public office in the State of Odisha as Joint Director (Accounts), Gopabandhu Academy of Administration, Bhubaneswar committed an offence under clause (e) of sub-section (1) of Section 13 of the Prevention of Corruption Act, 1988 and that the matter was investigated in Bhubaneswar Vigilance P.S. Case No. 67, dated the 31st December, 2012;
AND, WHEREAS, on scrutiny of relevant materials available on record, the State Government is of the opinion that there is a prima facie case of commission of the offence by Shri Pradipta Kumar Behera, who has accumulated properties disproportionate to his known source of income by resorting to corrupt means;
AND, WHEREAS, it is felt necessary and expedient by the Government that the said offender should be tried by the Special Court established under sub-section (1) of Section 3 of Special Courts Act, 2006;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 5 of Special Courts Act, 2006 (Odisha Act 9 of 2007), the State Government do hereby declare that the said offence shall be dealt with under the Special Courts Act, 2006.
