30 of the Odisha Development Authority Rules, 1983)

NOTIFICATION

File No. 1840(cid:568)BDA-Planning (General Branch)-TPS 08/2023-45(cid:568)Whereas in exercise of the powers conferred on it under Sub-Section 1 of Section 23 of the ODA Act, 1982 and Rules framed there under the Bhubaneswar Development Authority declared its intention for making Town Planning Scheme No: 08/2024 in Bhubaneswar Development Authority Area vide BDA Notification No. 1460/BDA dt10.01.2024in part mouzas Andharua and Daspur covering an area of 560.86 Acres. The same was published in the Extraordinary issue of Odisha Gazette No. 211 dt. 30.01.2024 and two local Odia dailies i.e. The Prameya and The Sambad and one English daily i.e The New Indian Express on 09.02.2024as required under sub-section 2 of section 23 of the Orissa Development Authorities Act, 1982. The same was also approved in the 148th Authority meeting vide agenda item no.06/148 dt.12.03.2024.
And whereas the above scheme has been prepared with the following boundaries:
a) North : Starting from West to East side TPS-08 boundary is being bounded by adjoining plots 1424, 658, 659, 750, 751, 752, 754, 1504, 755, 756, 757, 771, 772, 773, 774, 816, 817, 818, 820, 821, 823, 824, 825, 828 and 829 of Jagannath Prasad mouza.
b) South : Starting from West to East side TPS-08 boundary is being bounded by adjoining plots 981, 103, 104, 106, 1121, 105, 107, 108, 109, 110 and 983 of Malipada mouza and 1184, 313, 202 and 201 of Shampur mouza.
2c) East : Starting from North to South side TPS-08 boundary is being bounded by adjoining plots 2170, 2839, 2833, 2834, 2836, 2835, 2832, 2831, 2830, 2393, 2396, 2397, 2399, 8196, 8195, 8194, 2398, 2774 (part), 2773, 2770, 2769, 2767, 2749, 2733, 2732, 2731, 2726, 2725, 2714, 8707, 2712, 2708 (part), 3507, 3512, 3513, 3522, 3523, 3531 (part), 4001, 4016, 4181, 4180, 4179, 4178, 4160, 4159, 4158, 4136, 4135, 4116, 4120, 4121, 4122, 4123, 4124, 4279, 4280, 4281, 4282, 4283, 4284, 4274, 4273,4272, 4271, 4270, 4291, 4292, 4293, 4294, 4296, 4297, 4298, 4309, 4316, 4319, 4318, 4317, 4421, 4423, 4437, 4438, 4439, 4441 and 4443 of Andharua mouza.
d) West : Starting from North to South side TPS-08 boundary is being bounded by adjoining plots 583, 1259, 1256, 1254, 891, 890, 897, 8806, 8805, 898, 910, 924, 923, 1148, 1149, 1150, 8970, 8969, 8968, 1159, 1160, 1449, 1454, 1457, 1458, 1459, 1460, 1461, 1432, 1431, 1430, 1420, 8951, 1974, 1981, 8555, 1980, 1983, 1986, 1966, 8719, 1926, 1928, 1938, 1937, 1936 and 1934 of Andharua mauza and 279, 280, 281, 282, 283, 413, 414, 415, 713, 711, 709, 708, 707, 417, 422, 426, 427, 431, 430, 446, 444, 719, 792, 451, 450, 454, 737, 456, 464, 463, 462, 466, 333, 336, 491, 562, 564, 565, 594, 593, 592, 595, 607, 608, 609, 611, 612, 614, 615, 617 and 700 of Daspur mouza.
And whereas, as provided under sub section 3 of section 23 of the said Act read with Sub- Rule 1 of Rule 28 of the ODA Rules, 1983 Notice in Form No.III was issued vide No.4634/BDA dated 03.02.2024 inviting information in respect of title or interest that any person may be having in the lands or buildings covered by the above intended scheme was published in the Odisha Gazette bearing No.294 Dt 09.02.2024 and in two Odia dailies i.e. The Sambad and The Samaj on 20.02.2024 and one English daily i.e The Times of India on 21.02.2024 for wider publicity.
And whereas, as required under Rule 29 of the ODA Rules 1983 the Authority had called a meeting of the land owners, persons having interest in land and stake holders in the land included in Town Planning Scheme No:08/2024 at village-Andharua on 21-01-2025 by issuing individuals notices to land owners whose addresses were available and also published a notice in two Odia local newspapers namely " The Pragativadi" and "The Orissa Bhaskar" and one English daily viz. "The New Indian Express" on 17/01/2025 inviting them to attend the land owner's meeting. The tentative proposal of the Draft Town Planning Scheme No:
08/2024 was explained to them and solicited their objections/suggestions, if any for consideration basing on merits of the submitted documents, so as to make suitable changes in the proposals of Scheme so that it can be processed for the publication of Draft Town Planning Schemes in Gazette and newspapers under section 24(3) of ODA Act-1982.
3Now therefore, In exercise of powers conferred under sub section 2 and sub section 3 of section 24 of the said Act, notice is hereby issued to landowners and persons having interest in the area for which intention to prepare Town Planning Scheme No.08/2024 was declared under sub section 1 of section 23 of the said Act that a Draft Town Planning Scheme has been prepared after observing all formalities and requirement of law. Secondly, this Draft Town Planning Scheme with all the relevant documents, plans etc. will be published in the Branch office of TP Scheme at 2nd floor of K-7, Market Complex, Kalinga Nagar, Bhubaneswar-751003 under sub section 2 of section 24 of ODA Act-1982 inviting objections/suggestions. Thirdly, the Draft Town Planning Scheme would be made available for inspection at the Branch office of TP Scheme at 2nd floor of K-7, Market Complex, Kalinga Nagar, Bhubaneswar-751003 with effect from date of its publication in the Gazette, during working hours on all working days to the land owners or person having interest in land or building of the scheme area. Further, on application a copy of the part(plot) plan of Draft Town Planning Scheme or any extracts there from certified to be correct will be made available for sale @ Rs. 100/- (Rupees Hundred only) per copy of each plot.
