In exercise of the powers conferred by sub-section (5) of section 1 of the Employees' State Insurance Act, 1948 (Central Act 34 of 1948), the Lieutenant-Governor, Puducherry in consultation with the Employees' State Insurance Corporation and with the approval of the Central Government, having already given one month notice as required thereunder vide Notification No. 7237/Lab./K/2010, dated 20-1-2011 of the Labour Department, Puducherry, published in the official gazette No. 5, dated 1-2-2011, and no objections and suggestions have been received thereto, hereby appoints the date of publication of this notification in the official gazette as the date on which all the provisions of the said Act shall extend to the establishments specified under column (1) of the schedule hereunder and within the area specified under column (2) of the said schedule namely:—

NOTE

1. Dearness allowance:— In addition to the above minimum wages, the employees shall be paid dearness allowance as follows :—

(i) The dearness allowance shall be linked to the Puducherry City Consumer Price Index for the month of December 2010, i.e. 182 points (with base year 2001=100) and for every raise of 1 point over and above 475 points an increase of ` 6.50( Rupees six and paise fifty only) per month shall be paid.

(ii) The revision of dearness allowance shall be effective from the 1st April of every year on the basis of the average of the indices of the proceeding twelve months i.e. from January to December.

(iii) The first calculation shall thus be effective from the date of publication of this notification in the official gazette, Puducherry Government, based on the average Puducherry City Consumer Price Index of the previous year as explained in item (ii).

2. Where the nature of work is the same, no distinction in the payment of wages shall be made in the case of men and women workers.

3. Where piece rate workers are employed in any Public Motor Transport, the remuneration paid to each of them for a normal working day shall not be less than the minimum wages fixed for approximate category.

4. To arrive at the daily wages, the monthly wages shall be divided by 26.
