Approval of the Lieutenant-Governor, Puducherry is hereby conveyed for the guidelines to be followed by the Puducherry Fishermen Welfare and Distress Relief Society, which is a society registered under Societies Registration Act, 1860 for payment of compensation to the affected fishermen of Yanam region, received from M/s. Gujarat State Petroleum Corporation Limited, in connection with laying of pipelines for the gas project in Yanam region towards loss of livelihood of the affected fishermen of Yanam region as prescribed in the Annexure.

ANNEXURE

GUIDELINES FOR MAKING PAYMENT OF COMPENSATION TO AFFECTED FISHERMEN OF

YANAM REGION BY M/S. GUJARAT STATE PETROLEUM CORPORATION LIMITED

I. Objective of the compensation.— To compensate the loss of livelihood to affected fishermen of Yanam region due to execution of Gas Project KG-OSF/2001/3 block implemented by M/s. Gujarat State Petroleum Corporation Limited, under product sharing contract with Government of India for laying 20" dia. submarine pipeline and to 10" dia. treated effluent disposal pipeline in Yanam region.

II. Eligibility criteria.— The following are the eligibility criteria for receiving compensation:

(i) Affected fishermen should be a resident of Yanam and they shall also be those who rely on fishing for all or part of their income or livelihood viz., fish catching and other business related to the fishing.

(ii) Should be above 18 years old and non-recipient of old age pension or any other pension issued by the Government of Puducherry.

(iii) Should be a member of Fishermen Co-operative Societies, with membership taken before 16th February, 2012.

(iv) Should be head/member of the ration card for which fishing ban relief was issued during 2011-12.

(v) Should possess a registered fishing craft and operate with base as Yanam region or should be a crew member of registered fishing craft in Yanam region (certificate to this effect to be issued by Assistant Director of Fisheries and Fishermen Welfare, Yanam). Person as a part of crew of the fishing vessel who would normally sustain his livelihood and depend on the owners of the vessel for fishing.

(vi) The following crafts will be covered under the scheme:

(a) Registered mechanised fishing crafts operating with base at Yanam during period of compensation.

(b) Registered motorised fishing crafts operating with base at Yanam during period of compensation.

(c) Registered non-motorised fishing crafts operating with base at Yanam during period of compensation.

(vii) Should not be employed in Government/Government undertakings/Corporations/Co-operatives in regular/temporary/part-time/hourly basis.

III. Period of compensation.— (i) Payment of relief assistance to be given on monthly basis and only from the date on which the fishing operations of Yanam fishermen were affected by the activities of the Corporation and till the time, the pipes are laid by the M/s. Gujarat State Petroleum Corporation Limited, Yanam.

(ii) Exclusions of uniform fishing ban period implemented on the East Coast from 15th April 2012 to 31st May 2012 (both days inclusive).

(iii) The fishermen of Yanam region are directly/indirectly affected by ongoing pipe laying works by the Gujarat State Petroleum Corporation Limited, in the Godavari basin will be eligible to get assistance under these scheme to offset loss of livelihood, and the compensation will be payable to the identified fishermen @ ` 270 each per day for a maximum of 25 days or a minimum of 10 days in a month depending on fishing operations.

IV. Deposit of amount of compensation.— M/s. Gujarat State Petroleum Corporation Limited shall deposit the amount of compensation with Puducherry Fishermen Welfare and Distress Relief Society on direction from the Government of Puducherry.

V. Procedures for claiming compensation by affected fishermen.— (i) An application for the grant of compensation shall be submitted by the affected fishermen in the prescribed form under the scheme.

(ii) The individual seeking compensation should fill in the application form with the particulars like name of the craft (whether owned or employed), number of days of loss of livelihood by affixing a recent passport size photograph along with the applicant's signature over it and in undertaking.

(iii) The Beneficiary Selection Committee comprising of the Regional Administrator, Yanam, Assistant Director of Fisheries and Fishermen Welfare, Yanam and Co-operative Officer, Yanam will scrutinise the applications and recommend the names of eligible fishermen for the purpose of the scheme, details of beneficiaries and amount of compensation.

(iv) All claims that are reasonable and justified shall be evaluated and approved by Beneficiary Selection Committee specified in the guidelines.

(v) Payment of compensation to the selected beneficiaries shall be the responsibility of the Assistant Director of Fisheries, Yanam.

(vi) Compensation shall be paid only to the persons who are eligible to get compensation under this scheme and who are carrying on their fishing activities within provision of applicable laws in force.

(vii) Claimant shall produce proof of documents for involvement in fishing or associated business related to fishing such as fishing licence, boat registration certificates, boat diesel pass book for being actively involved in fishing/fish trade and allied activities.

(viii) Publish the draft list of selected beneficiaries in a widespread manner at all Government Offices, such as Office of the Assistant Director of Fisheries and Fishermen Welfare, Yanam; Office of the Regional Administrator, Yanam; Taluk Office, Revenue Inspector Office, VAO Office, Yanam; Municipality, Yanam and prominent places in the villages concerned.

(ix) Hosting of draft list in the official websites.

(x) Call for objections, if any, for the draft list so published within a time-limit of 14 days.

(xi) People submitting objections to the concerned authority shall be provided with proper acknowledgment.

(xii) Objections to be examined by the Beneficiary Selection Committee and it shall be either accepted or rejected based on merits within the minimum required reasonable time-limit.

(xiii) Details of objections received, whether those objections were accepted or rejected shall be published in the Office of the Assistant Director of Fisheries and Fishermen Welfare, Yanam; Office of the Regional Administrator, Yanam; Taluk Offices, Revenue Inspector Office, VAO Office, Yanam; Municipality, Yanam and prominent places in the villages concerned.

(xiv) Final select list of beneficiaries shall have to be published widely including official websites.

(xv) The Regional Administrator, Yanam will furnish consolidated proposal to the Director of Fisheries and Fishermen Welfare, Union territory of Puducherry after obtaining the approval of the District Collector, Puducherry. On receipt of the proposal, the Director of Fisheries and Fishermen Welfare will scrutinise and submit to the Government for approval. After getting approval, the same will be sent to the Puducherry Fishermen Welfare and Distress Relief Society for disbursement of compensation amount to the selected beneficiaries through the Assistant Director of Fisheries, Yanam.

(xvi) Amount of compensation shall have to be disbursed by the Assistant Director of Fisheries, Yanam after getting countersignature of Regional Administrator, Yanam as per the final select list of beneficiaries.

(xvii) All beneficiaries shall be provided with relief assistance by way of Electronic Clearing System (ECS) payment only. No cash disbursement shall be made to the beneficiary.

(xviii) Details of payment to the beneficiaries, name of beneficiary, Aadhaar number, address, amount, date, etc., also shall have to be published/hosted in the website finally.

(xix) The compensation amount will be received from M/s. Gujarat Petroleum Corporation Limited, by the Member-Secretary, Puducherry Fishermen Welfare and Distress Relief Society and forwarded to Assistant Director of Fisheries and Fishermen Welfare, Yanam through Real Time Gross Settlement (RTGS) for disbursement to beneficiaries by way of Electronic Clearing System (ECS) payment only.

(xx) The Assistant Director of Fisheries, Yanam will utilise the amount within one month from the date of transfer of amount, as per Government terms and conditions and furnish a weekly physical and financial progress report on the utilisation of the compensation amount to the Director of Fisheries and Fishermen Welfare, Puducherry.

(xxi) Any disputes and discrepancies, complaints related to the above compensation shall be referred to the Beneficiaries Selection Committee who will scrutinise and recommend an appropriate action to the department, through Regional Administrator, Yanam/The District Collector, Puducherry.
