NOTIFICATION
Wh e r e a s , t h e a c c u m u l a t e d l o s s e s e r o d i n g t h e n e t w o r t h o f t h e G o v e r n m e n t o w n e d t e x t i l e u n d e r t a k i n g s e n g a g e t h e a t t e n t i o n o f t h e Government;
2. And whereas, the continuous loss suffered by the Government owned textile undertakings may endanger their continued existence, which may ultimately result in large scale unemployment of workers;
3. And whereas, it becomes necessary and expedient to take suitable measures to keep such textile undertakings as running industrial establishments for preventing unemployment;

4. Now, therefore, in exercise of the powers conferred by section 9B of the Industrial Disputes Act, 1947 (Central Act 14 of 1947) (hereinafter referred as the said Act), the Lieutenant-Governor, Puducherry hereby directs in public interest that section 9A of the said Act shall not apply in relation to the Anglo- French Textiles Limited of Pondicherry Textile Corporation Limited and Swadeshi Cotton Mills and Sri Bharathi Mills of Swadeshee-Bharathee Textile Mills Limited, Puducherry with immediate effect.
5. This notification shall be valid up to 31-12-2014.

NOTIFICATION
Whereas, the Government had implemented new pay scales for all the employees including workers with Industrial Dearness Allowance pattern in lieu of Central Dearness Allowance pattern for Staff, Supervisors and Officers and in lieu of variable Dearness Allowance for workers with effect from 1-9-2009 and 1-10-2010 to the employees of Anglo-French Textiles Limited of Pondicherry Textile Corporation Limited and Swadeshee-Bharathee Textile Mills Limited respectively and thereby the quantum of payment under the head wages/salary increased manifold;
2. And whereas, the Anglo-French Textile Limited and Swadeshee- Bharathee Textile Mills Limited are dependent on the Government assistance even to meet out their day-to-day expenses and in the result M/s. Anglo French Textile Limited is incurring continuous loss from the year 1993-94 and the accumulated loss as on 31-3-2012 is ` 480.04 crores and the operational loss in respect of Swadeshee-Bharathee Textile Mills Limited as on 31-12-2012 was ` 61.03 crores and the net worth of the Anglo-French Textile as on 30-3-2012 was (–) ` 101.37 crores;
3. And whereas, in the High Level Meeting held on 13-8-2012 under the Chairmanship of the Hon'ble Chief Minister to review the functioning of the Anglo-French Textiles, it was resolved to take measures for freezing the increase if any, in dearness allowance to the employees of Anglo-French Textiles for two years by taking into account the precarious financial condition of the textile undertakings;

291 4. And whereas, the Board of Directors of the Anglo-French Textiles in its meeting held on 28-12-2012 resolved to approach the Government to issue necessary Government sanction to freeze the increase if any, in dearness allowance to its employees for two years;
5 . A n d w h e r e a s , i n t h e A n n u a l G e n e r a l B o d y M e e t i n g o f t h e Pondicherry Textile Corporation Limited held on 31-12-2012 under the Chairmanship of the Chief Secretary to Government, it was decided to freeze future increase in the dearness allowance for two years to all the textile undertakings of the Government of Puducherry due to the continuous loss incurred by all the textile undertakings;
6. Now, therefore, the Lieutenant-Governor, Puducherry has been pleased to order that the increase if any, in the dearness allowance points under the Industrial Dearness Allowance pattern is freezed in the case of the employees of both Anglo-French Textiles Limited of Pondicherry Textile Corporation Limited and Swadeshi Cotton Mills and Sri Bharathi Mills of Swadeshee-Bharathee Textile Mills Limited, Puducherry by taking into account their poor financial condition and also the continuous loss registered by them.
7. This notification shall come into force with immediate effect and it will be valid up to 31-12-2014.
