Whereas, the Lieutenant-Governor, Puducherry has by notification vide G.O. Ms. No. 9/95/Lab., dated 7-4-1995 under sub-section (1) of section 52 of the Puducherry Shops and Establishments Act, 1964 authorised the Secretary to Government, Labour Department, Puducherry to exercise the powers of the Government under section 6 of the said Act relating to exemption;

ORDER

Approval of the Lieutenant-Governor is hereby conveyed for constitution of Screening Committee to scrutinize the applications and recommend nominees for Tagore International Award for Cultural Harmony conferred by Ministry of Culture, New Delhi. The tenure of the committee comes into effect from the date of issue of this order. The composition of the committee shall be as follows:

And whereas, the Karaikal Stationery Merchants Association, Karaikal West Side Viyabarigal Sangam, Karaikal Jewellers Association and Karaikal Jawli Viyabarigal Sangam have applied for grant of exemption to shops and establishments in Karaikal region to keep them open beyond the working hours and on weekly holidays from certain provisions of the said Act on account of important festivals viz., Tamil New Year, Atchayathridhiyai, Re-opening of schools/colleges, Mangani Festival, Ramalan, Adi Month Festival, Vinayagar Chaturthi, Bakrid, Ayuthapooja, Deepavali, Christmas and Pongal, etc.;

Now, therefore, in exercise of the powers conferred by section 6 of the said Act, the Secretary to Government, Labour Department hereby exempt all shops and establishments in Karaikal region from the application of the provisions of the sections 10(1), 12(1), 12(2), 13, 14(1), 14(2), 16(1), 17(1), 17(2), 18 and 19 of the said Act, to keep them open beyond the working hours and on weekly holidays during the under - mentioned festivals period, subject to the following conditions:—

Total 114 1. Every person shall be paid overtime wages at twice the ordinary rate of wages for the period of work done by him in excess of 8 hours in a day or 48 hours in a week.

2. The total hours of work of each worker including overtime shall not exceed 10 hours including one hour of rest in any day or 54 hours in a week.

3. Each shop/establishment should file a return at the end of each of spell exemption specifying the number of workmen engaged beyond normal working hours and on their weekly holiday and enclosing proof for payment of extra wages for the hours/days so employed.

NOTIFICATION

Whereas, the Government is of the opinion that an industrial dispute raised by Regma Ceramics Limited Pattali Thozhilalargal Sangam and Regma Ceramics Limited Pattali Staff Welfare Association, Karaikal against the management of M/s. Regma Ceramics Limited, Karaikal, over stoppage of work, non-payment of salary, etc., in respect of the matter mentioned in the annexure to this order;

And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;

Now, therefore, by virtue of the authority delegated vide G. O. Ms. No. 20/91/Lab., dated 23-5-1991 of the Labour Department, Puducherry to exercise the powers c o n f e r r e d b y c l a u s e ( c ) o f s u b - s e c t i o n ( 1 ) of section 10 of the Industrial Disputes Act, 1947 (Central Act XIV of 1947), it is hereby directed by the Secretary to Government (Labour) that the said dispute be referred to the Labour Court, Puducherry for adjudication. The Labour Court, Puducherry shall submit the award within 3 months from the date of issue of reference as stipulated under sub-section (2-A) of section 10 of the Industrial Disputes Act, 1947 and in accordance with rule 10-B of the Industrial Disputes (Central) Rules, 1957. The party raising the dispute shall file a statement of claim complete with relevant documents, list of reliance and witnesses to the Labour Court, Puducherry within 15 days of the receipt of the order of reference and also forward a copy of such statement to each one of the opposite parties involved in the dispute.

Whereas, the Lieutenant-Governor, Puducherry has by notification vide G.O. Ms. No. 9/95/Lab., dated 7-4-1995 under sub-section (1) of section 52 of the Puducherry Shops and Establishments Act, 1964 authorised the Secretary to Government, Labour Department, Puducherry to exercise the powers of the Government under section 6 of the said Act relating to exemption;

And whereas, M/s. Green Field Supermarket (Nilgris), No. 23, Rangapillai Street, Puducherry has applied for grant of exemption from section 14(1) of the said Act to run the shop on weekly holidays, since the shop is dealing with highly perishable items in addition to the other products catering to the daily needs of the public;

Now, therefore, considering the reasons stated, the Secretary to Government, Labour Department in exercise of the powers conferred by section 6 of the said Act, hereby exempts M/s. Green Field Supermarket (Nilgris), No. 23, Rangapillai Street, Puducherry from the provisions of section 14(1) of the Puducherry Shops and Establishments Act, 1964 for a period of one year from the date of issue of this notification subject to the following conditions:-

(1) Every employee employed should be allowed a weekly holiday with wages without fail on a staggered weekly off basis.

(2) No employee should be allowed to work continuously for 7 days in a week.

(3) The employer, on any account, should not seek the service of an employee on his weekly off day.

NOTIFICATION

Whereas, regulation 2.3.4 of the Food Safety and Standards (Prohibition and Restriction on Sales) Regulations 2011, made by the Food Safety and Standards Authority of India, in exercise of the powers conferred by clause (1) of sub-section (2) of section 92 read with section 26 of the Food Safety and Standards Act, 2006 (Central Act 34 of 2006) provide that tobacco and nicotine shall not be used as ingredients in any food products, as they are injurious to health;

And whereas, gutkha and panmasala are food products in which tobacco and nicotine are widely used as ingredients now-a-days;

And whereas, it is expedient to prohibit gutkha and panmasala in the Union territory of Puducherry, being food products in which tobacco and nicotine are widely used as ingredients;

7. No claim about the quantity and quality of the condemned books will be admitted once the tender is finalised. Sales tax will be charged as per rates as applicable under rules in force.

Sealed tenders quoting the rate per kilogram (excluding sales tax) are invited for the sale of old/condemned library books, old newspapers (Tamil and English) and old 9. The undersigned reserves the right to accept or reject any tender in part or whole without assigning any reason thereof.
