NOTIFICATION
Whereas pursuant to the Special Economic Zone Policy announced by the Government of India and keeping in view of the potential for economic development i t o f f e r s , t h e G o v e r n m e n t o f P u d u c h e r r y h a s d e s i r e d o f s e t t i n g u p a Special Economic Zone at Sedarapet and Karasur Revenue Villages near the port city of Puducherry and made several agreements with the strategic partners;
And whereas, the Ministry of Home Affairs, Government of India in consultation with Planning Commission and Department of Economic Affairs informed in their letter, dated 6-8-2009, that in view of the several infirmities in the selection process of the strategic partner and as no transparent bidding process was followed, the Ministry could not approve the selection of strategic partner LA GAZETTE DE L'ETAT [ PART-I 650 650 and could not approve the transfer of any land to PIPDIC or SPV in which the strategic partner is a member. And therefore, the Ministry of Home Affairs advised the Government of Puducherry to cancel the entire agreement with the strategic partner and not to part with the land in favour of PIPDIC or SPV (Special Purpose Vehicle). And also the Ministry of Home Affairs advised the Government of Puducherry to resume the land in case any part of land has already been transferred to PIPDIC or the SPV;
And whereas, the Ministry of Home Affairs, Government of India vide letter, dated 18-11-2009 have requested to intimate the action taken by Government of Puducherry for resumption of land that has already been transferred to PIPDIC or SPV;
And whereas, the Ministry of Home Affairs, Government of India, reiterated the views stated in their letter, dated 6-8-2009 and advised the Government of Puducherry to cancel the entire agreement with the strategic partner and not to part with the land in favour the PIPDIC or SPV and to resume the land in case any part of land has already been transferred to PIPDIC or the SPV;
And whereas, the Government has therefore decided to terminate the agreements mentioned hereunder and accordingly accorded approval for termination/ cancellation;
Now, therefore, the Lieutenant-Governor, Puducherry is pleased to cancel t h e f o l l o w i n g a g r e e m e n t s m a d e i n c o n n e c t i o n w i t h t h e s e t t i n g u p o f Special Economic Zone, Sedarapet-Karasur Villages, Puducherry.
(1) Development and State Support Agreement executed between Government of Pondicherry and the Pondicherry Special Economic Zone Company Limited, dated 28-8-2006 and Supplemental Agreement, dated 13-2-2008.
(2) Share Subscription and Share Holders Agreement executed between PIPDIC and Subhash Projects and Marketing Limited (SPML) and Om Metals Infraprojects Limited [formerly known as Om Metals Limited (OML)] and Pondicherry Special Economic Zone Company Limited, dated 28-8-2006 and Supplemental Agreement, dated 12-2-2008.
(3) Lease and Possession Agreement executed between PIPDIC and the Pondicherry Special Economic Zone Company Limited, dated 13-2-2008.
