NOTIFICATION
The Union Territory Administration was extending relief to fishermen in the operating cost of their mechanised fishing boats by reimbursement of sales tax on High Speed Diesel by issuing G.O. Ms. No. 10/Fy., dated 26-5-2009 of the Chief Secretariat (Fisheries), Puducherry. The scheme was in vogue and the Union Territory Administration allocated sufficient funds under Annual State Plan. Schemes for meeting out the expenditure towards reimbursement of sales tax on High Speed Diesel for the boat owners of the Union Territory.

Later on, the Union Territory Administration decided to exempt fishing boat operators of the Union Territory from levy of sales tax on High Speed Diesel and a notification vide No. 4-3/2009-10/Mech. (BR), dated 1-12-2009 of the Director of Fisheries and Fishermen Welfare, Puducherry was issued, for the designated diesel outlets whereby, fishing boat owners had to purchase their admissible quantity of diesel without paying sales tax on the quantity procured by them.
[ 905 ]LA GAZETTE DE L'ETAT [ PART-I 906 906 3. Subsequently, the Union Territory Administration, in public interest, withdrew the exemption vide G.O. Ms. No. 68/F2/2011, dated 31-12-2011 of the Joint Secretary to Government (Finance), Puducherry and now the fishermen, being deprived of their benefits are subjected to serve livelihood hardships, coupled with escalation, the price of High Speed Diesel.
4. In view of the above, His Excellency the Lieutenant - Governor is pleased to order restoration of reimbursement of sales tax on High Speed Diesel to registered fishing craft owners in the Union territory of Puducherry with effect from 1-1-2012 to 13-10-2013 for outlying regions of Karaikal, Mahe and Yanam and from 1-6-2012 to 13-10-2013 for Puducherry region subject to the following terms and conditions:-
I. Eligibility criteria:- The fishing crafts must be compliant on (a) Colour Coding, (b) Registration under Realcraft Programme with Port of Registry in the Union territory of Puducherry, (c) Fitted with mandatory life saving appliances, navigational and communication equipments, (d) Should not have indulged in destructive fishing, especially in using purse-seine and twin travel nets, (e) The owner of the fishing craft should be resident of the Union territory of Puducherry having no dues with the village Primary/Central/ Apex Fisheries Co-operative Society. He should be non-recipient of Old Age Pension and not be employed in/under Government/Government Undertakings/Co-operatives even on part-time basis.
II. Other terms and conditions:- (i) The scheme implementing officers will obtain details of High Speed Diesel availed by the registered boat owners from designated diesel outlets in the Union Territory along with their Savings Bank Account Number as well as particulars of fishing conducted by them. Form-VII as prescribed under Puducherry Marine Fishing Regulation Rules, 2009.
(ii) After scrutiny of the bills the department will submit admissible bills every quarter to the Directorate of Accounts and Treasuries, who in turn will make payment to the beneficiaries account by Electronic Clearance System mode.
(iii) The department will also maintain a register showing admissible quantity of diesel claimed by the boat owners, actual claimed by the department with Directorate of Accounts and Treasures and disallowed quantity if any with reasons. The register will be maintained and countersigned by the authorised officer each time the bills are presented to Directorate of Accounts and Treasuries i.e. in every quarter.
(iv) For this purpose the following diesel bunks in Union territory of Puducherry are designated :
(a) Puducherry The Pondicherry State Fishermen Co-operative Federation's diesel bunk at Fishing Harbour Complex, Thengaithittu, Puducherry.
(b) Karaikal The Karaikal Fishermen Co-operative Marketing Union's diesel bunk of Fishing Harbour, Karaikalmedu, Arasalaru.
(c) Yanam The Pondicherry State Fishermen Co-operative Federation's
diesel bunk at Savithri Nagar, Yanam.
(d) Mahe The Mavoor Trade-Links, Mahe.
5. It is further ordered that the Director of Fisheries and Fishermen Welfare,PART-I ] LA GAZETTE DE L'ETAT 907 Puducherry is empowered and authorised to designate or re-designate additional diesel outlets for this purpose as and when exigencies arise.
* Eligible maximum litres of diesel permitted per day/per trip/per annum by a registered fishing craft is as follows:-

* Reimbursement of sales tax on High Speed Diesel will not be eligible during the ban period enforced on conservation of fishing wealth and any other closed fishing season as and when notified by Government from time to time.
* An authorised officer not below the rank of Sub-Inspector of Fisheries may be authorised to verify the records and register of the designated diesel bunks on any working day.
6. The registration and fishing licence permits of the fishing boats are liable for cancellation/revocation if it is determined that the High Speed Diesel drawn is utilised for purpose other than those for which issued.
7. This issues with the concurrence of the Finance Department, vide their U.O. No. 3000/2013-14/F4, dated 12-11-2013.
