Withdrawal of proclamation issued under section 8 (2) (a) of the Puducherry

Prevention of Anti-Social Activities Act, 2008 and under section 82 of

Cr.P.C. requiring the appearance of absconding person

NOTIFICATION

Whereas, a detention order was issued against Thiru Nithi @ Nithiyanantham, S/o. Krishnaraj, No. 32, Main Road, Thirukanji, Mangalam, Puducherry vide Order No. 30/DM/RO/D2/PPASAA/2013, dated 7-11-2013 under the provisions of Puducherry Prevention of Anti-Social Activities Act, 2008 (Act No.10 of 2010) and the said detention order was also approved by the Government of Puducherry within the stipulated period of 12 days as prescribed in the said Act vide G.O. Ms. No. 77, dated 18-11-2013 of Home Department, Puducherry;

2. And whereas, the Station House Officer, Mangalam Police Station, Puducherry on 19-11-2013 has reported that from the date of issue of detention order, the abovesaid detenu has absconded and is evading the execution of the said detention order and his whereabouts are not known;

3. And whereas, based on the report of Station House Officer, Mangalam Police Station, Puducherry, a proclamation under section 8 (2) (a) of Puducherry Prevention of Anti-Social Activities Act, 2008 and under section 82 of Cr.P.C. 1973 was issued vide No. 30/DM/RO/D2/PPASAA/2013, dated 5-12-2013, by the undersigned with instruction that the absconding person Thiru Nithi @ Nithiyanantham, S/o. Krishnaraj shall appear before the undersigned on 7-1-2014;

4. And whereas, the absconding Thiru Nithi @ Nithiyanantham, S/o. Krishnaraj, did not appeared before the undersigned on the prescribed date and kept himself concealed and hence necessary action was initiated under the provisions of section 83 of Cr.P.C. to attach the moveable and immoveable properties of the absconding person Thiru Nithi @ Nithiyanantham;

5. And whereas, in the meanwhile, the Station House Officer, Mangalam Police Station, Puducherry submitted a special report on 24-3-2014 stating that after taking strenuous effort, he secured the absconded person Thiru Nithi @ Nithiyanantham, S/o. Krishnaraj and produced him before me on 24-3-2014 at around 11.00 a.m.;

6. And whereas, the undersigned has directed the Chief Superintendent of Jail, Central Prison, Kalapet, Puducherry vide Order No. 30/DM/RO/D2/PPASAA/2013, dated 24-3-2014 to detain Thiru Nithi @ Nithiyanantham, in the Central Prison, Kalapet, Puducherry, in connection with the detention order, dated 7-11-2013;

7. Now, therefore, I, Dr. S.B. Deepak Kumar, I.A.S., District Magistrate, Puducherry, in view of the arrest and detention of Thiru Nithi @ Nithiyanantham, S/o. Krishnaraj, No. 32, Main Road, Thirukanji, Mangalam, Puducherry on 24-3-2014 by the Mettupalayam Police Station, hereby order that the proclamation issued by t h e u n d e r s i g n e d v i d e N o t i f i c a t i o n N o . 3 0 / D M / R O / D 2 / P PA S A A / 2 0 1 3 , dated 5th December 2013, became infructuous and stands cancelled.
