NOTIFICATION
The Lieutenant-Governor, Puducherry has been pleased to order that the G.O. Ms. No. 10/2012-Ind.B, dated 18-9-2012 applicable to Anglo-French Textiles Limited, Puducherry ceases its operation with effect from 5-11-2013 i.e. from the date of declaration of lay off by the management after adopting the due process of law provided that the payment made by virtue of the said G.O Ms. No. 10/2012-Ind.B, dated 18-9-2013 shall not be deemed to be wages for the purpose of the Payment of Wages Act, 1936.
LA GAZETTE DE L'ETAT [ PART-I 546 546Therefore, only ex gratia shall be entitled to all the employees of the Anglo-French Textiles during the period from 1-1-2012 to 22-11-2012 and from 25-2-2013 to 4-11-2013 which was declared as holiday without performance of any actual work due to the following reasons.
(i) Incurring continuous loss and poor financial status;
(ii) The bank accounts with the consortium banks are classified as Non-Performing Assets (NPA) due to non-settlement of LC dues overdrafts, etc., which resulted in denial of any financial assistance by the banks like temporary overdraft (OD);
(iii) Inadequate working capital for the purchase of raw materials like cotton, yarn, furnace oil, chemicals, stores and spares to resume the production activities in "A", "B" and "C" units.
(iv) EPF authorities had frequently freezed the accounts of Anglo-French Textiles under 8F of Employees Provident Funds and Miscellaneous Provisions Act, 1952 for the non-payment of EPF dues to the tune of ` 7.66 crores;
(v) Non-payment of ESI dues to the Employees State Insurance Corporation for the past three years.
(vi) The net worth has been totally eroded and the net worth is (-) 107.84 crores.
(vii) The dues to the Electricity Department has not been paid for a long time.
And, ex post facto approval of Lieutenant-Governor, Puducherry is also hereby accorded for the payment of ex gratia not exceeding to 50% of the basic pay, dearness pay, dearness allowance, house rent allowance and other applicable allowances to all the employees of the Anglo-French Textiles during the period from 1-1-2012 to 22-11-2012 and from 25-2-2013 to 4-11-2013 which was declared as holiday without performance of any actual work since the payment for this period shall not be deemed to be wages for the purpose of Payment of Wages Act, 1936.
