NOTIFICATION
In exercise of the powers conferred by sub-section (2) of
section 49 of the Factories Act, 1948 (Central Act No. 63 of 1948),
the Lieutenant-Governor, Puducherry is pleased to amend the
Puducherry Factories (Welfare Officers) Rules, 1965 vide Notification
No. 39-7/66-Lab., dated 24th February 1966, the draft of the same
which were issued in the Labour Department's Notification vide G.O. Ms.
No. 18/AIL/Lab./G/2014, dated 30th July 2014 were pre-published in the

Extraordinary Part-II, No. 18 of the Gazette of Puducherry, dated 30-7-2014
as required under sub-section (1) of section 115 of the Factories
Act, 1948. As no objection/suggestion having been received in response
thereto, the Government have decided to confirm the amendment to the
said rules, namely:—
1. Short title and commencement.— (1) These rules may be called
the Puducherry Factories (Welfare Officers) (Amendment) Rules, 2015.
(2) They shall extend to the whole of the Union territory of
Puducherry.
(3) They shall come into force with effect from the date of
publication in the official gazette.
2. Amendment of rule 4.— For the existing rule 4 of the Puducherry
Factories (Welfare Officers) Rules, 1965, the following shall be
substituted, namely:-
"4. Qualifications.- No person shall be eligible for appointment as
Welfare Officer unless he possess the following qualifications,
namely:—
(a) (i) A postgraduate degree of Master of Labour Management
or Bachelor Degree in Labour Management or B.A. (Labour
Management) or M.A. (Labour Management) awarded by the
Tamil Nadu Institute of Labour Studies, Chennai or by any
University; or
(ii) Any postgraduate degree in Social Work or Social
Welfare or Social Dynamics with Industrial Management or Commerce (Personnel Management and Industrial Relations) or 145

(iii) A degree in Bachelor of Law awarded by any University recognised by the University Grants Commission for the purpose of its grant; or
(b) (i) A degree awarded by any University other than the degree or postgraduate degree specified in clauses a (i), (ii) and (iii) above; and
(ii) A diploma in Labour Administration or Labour Laws and Administrative Laws or Personnel Management, Industrial Relation and Labour Welfare or Social Work or Social Science or Personnel Management and Labour Relations or Social Welfare with Labour Laws on Industrial Relations or Labour Laws or Social Service Administration or Labour Welfare or Social Work or Labour Training Course or Social Sciences or Industrial Psychology and Industrial Relations or Labour Welfare and Personnel Management or Industrial Sociology, Labour Welfare and Personnel Management or Social Welfare or Social Science or Social Technique or Personnel Management and Industrial Relations or Human Resources Development in Industry of Business Administration as a main subject of any University or Institutions recognised by the State Governments or the Institutions recognised by the University Grants Commission for the purpose of its grant.
(c) Has adequate knowledge of the language spoken by the
majority of the workers to which is to be attached:
Provided further that in the case of a person who is already acting as a Welfare Officer, the State Government may, subject to such condition as it may specify, relax all or any of the aforesaid qualifications."
