NOTIFICATION
In supersession of the "Incentive for Widow's Re-marriage Rules, 1981" notified vid e G.O. Ms. No. 55/81-HEW( SW), dated 18th March 1981 and published in the Extraordinary Gazette No. 36, dated 1st April 1981, save in respect of things done or omitted to be done before such supersession, the Lieutenant-Governor, Puducherry has been pleased to make the "Incentive for Widow's Remarriage Rules, 2015 to provide for the grant of financial assistance to widow's remarriage in the Union territory of Puducherry as appended in the Annexure.

ANNEXURE
INCENTIVE FOR WIDOW REMARRIAGE RULES, 2015
1. Short title, extent and commencement.— (i) These rules may be
called the "Incentive for Widow Remarriage Rules, 2015."
(ii) They shall extend to the whole of the Union territory of
Puducherry.
(iii) They shall come into force with effect from the 1st day of April 2014.
2. Object.— The object of these rules are to encourage the widows
to get married and lead a good life confidently.
3. Definitions.— In these rules, unless context otherwise requires,-
(a) "Appellate Authority" means the Secretary to Government
in-charge of the Department;
(b) "Attesting Authority" means any Gazetted Officer of Central Government/Government of Puducherry/Manager of a recognized poor house or similar recognized charitable institution/Special Officer or Commissioner of a Municipality or a Commune Panchayat/ Chairman of a Municipal Council or a Commune Panchayat/Member of the Lok Sabha/Rajya Sabha/Legislative Assembly.
(c) "Department" means the Department of Women and Child
Development.
(d) "Widow" means a woman of above 18 years and whose
husband is dead.
(e) "Director" means the Director in-charge of the Department.
(f) "Government" means the Administrator of the Union territory of Puducherry appointed by the President under Article 239 of the Constitution of India.
(g) "Union Territory" means the Union territory of Puducherry.
(h) "Form" means form appended to these rules.

4. Eligibility conditions.— A widow woman is eligible for incentive
for widow remarriage under these rules, subject to the following
conditions namely:-
(i) The applicant shall be a widow as defined in rule 3 above and
shall marry a bachelor or widower.
(ii) The applicant shall be in the age group of 18-40 years.
(iii) The applicant should not have children who are earning
members.
(iv) The bachelor or widower who marries the applicant shall
be in the age group of 21-45 years.
(v) The marriage shall be performed in accordance with law in
force on the date of marriage and the marriage shall be registered
either in the Registration Department or in the Municipality/
Commune Panchayat concerned.
(vi) The applicant shall be resident of the Union territory of
Puducherry for a period not less than five years preceding the date
of application.
(vii) The applicant's annual income shall not exceed ` 75,000 of
her own or of anyone else who is legally bound to maintain the said
person.
(viii) A sworn affidavit by the individual that she is a widow and
shall be signed by a Notary/Gazetted Officer of the Central
Government/Government of Puducherry/Manager of a recognized
poor house or similar recognized charitable institution/ Special
Officer or Commissioner of a Municipality or a Commune Panchayat/
Chairman of a Municipal Council or a Commune Panchayat/Member
of the Lok Sabha/Rajya Sabha/Legislative Assembly.
5. Quantum of assistance.— The incentive shall be in the form of
National Savings Certificate in the name of both the applicant (widow)
and the spouse of the applicant to the value of ` 50,000 to be held for
the period prescribed in the National Savings Scheme.

6. Procedure for grant of incentive.— (1) The forms shall be made
available by the department to intending applicants free of cost and also
be downloaded from the department's official website.
(2) Application for grant of incentive to widow remarriage shall
be made in Form-I, appended to these rules by the intending applicant.
(3) The application shall be submitted to the Director in Puducherry
region, the Child Development Project Officer in Karaikal region and the
Welfare Officer in Mahe and Yanam regions within 60 days from the date
of marriage.
(4) The application shall be accompanied by the following
certificates/documents namely :-
(i) Certificate of residence from an officer of the Revenue
Department not below the rank of Deputy Tahsildar.
(ii) Certificate of income from an officer of the Revenue
Department not below the rank of Deputy Tahsildar.
(iii) Certificate from the Anganwadi worker in the prescribed
Form-III.
(iv) Declaration given by the applicant and her spouse.
(v) Self-attested copy of Death Certificate of the husband of the
applicant.
(vi) Self-attested copy, of Birth Certificate of the bridegroom who
marries the applicant.
(vii) Self-attested copy of the Marriage Registration Certificate.
(viii) Self-attested copy of the Ration Card (Smart card), Elector's
Photo Identity Card and Aadhaar Card.
7. Receipt, verification and selection.— (1) The application
received from the applicants shall be acknowledged and entered in the
receipt register and allot receipt number in seriatum.
(2) The Director shall thereafter cause an enquiry to be conducted
through the field level functionaries of the department and satisfy himself
that the particulars furnished in the application are genuine and correct.

8. Competent authority for selection of beneficiaries.— (i) The Director,
Department of Women and Child Development, Puducherry/Child
Development Project Officer, Karaikal/Welfare Officer, Mahe and Yanam,
shall be the competent authority for selection of beneficiaries who fulfil
the criteria prescribed in the rules. On being satisfied that the applicant
has fulfilled all the conditions prescribed under these rules, the
Department of Women and Child Development, Puducherry shall issue
release order for extending the assistance based on the block sanction
obtained from the Government for granting such assistance as per the
seniority of the receipt of the application (region-wise).
(ii) Payment shall be made by the Deputy Director (WD), Puducherry/
Child Development Project Officer, Karaikal/Welfare Officer, Mahe/Yanam
regions.
(iii) Separate registers shall be maintained by the concerned officers
and necessary entries and other details shall be recorded in the register
regarding the receipt of application, receipt of assistance from the
Government and payment made thereof. Payment shall be made on
obtaining proper acknowledgements.
(iv) The officers in the outlying regions who are authorized to make
the payments under these rules shall forward to the Director of Women
and Child Development, Puducherry an extract of the entries made during
the month in the register maintained as required under sub-rule (ii) to
enable to furnish quarterly and annual reports.
(v) If the Director, Department of Women and Child Development,
Puducherry and the officers in the outlying regions find that the applicant
is not eligible for the incentive under these rules, he/she shall inform the
applicant furnishing the reason thereof.
(vi) In case the grantee has obtained the assistance by fraud or by
misrepresentation or by suppression of material facts, the applicant shall,
on demand by the Director, forthwith refund the amount granted to her
within 30 days from the date of issue of the notice together with interest
at the rates applicable to Government loans. The applicant has to furnish
a declaration to this effect in Form-VII.
