ORDER UNDER SECTION 144 of Cr. P.C.
Whereas, it has been brought to me by the Inspector of Police (Coastal) and Deputy Tahsildar (Revenue)-cum-Excise Inspector, Yanam that people belong to various areas of Yanam region are found manufacturing illicit arrack in the Islands No. 2 and 4 of my jurisdiction and selling the same in the nearby villages;
Whereas, Yanam region is consisting of 4 Islands out of which Island No. 1 has been assigned LGR Pattas and Island No. 3, some extent of the land has been given to Schedule Caste Agricultural Field Labour Co-operative Society Limited, Dariyalatippa by the Government of Puducherry for cultivation and the rest of the Islands No. 2 and 4 have been found using for manufacturing illicit arrack;
LA GAZETTE DE L'ETAT [ PART-I 330 330Whereas, the Model Code of Conduct has been came into force with effect from 04-03-2016 following the announcement of General Elections to the Puducherry Legislative Assembly, 2016 according to the Press Note released by the Election Commission of India;
Whereas, to prevent manufacturing, sale and transport of illegal liquor/ arrack during election campaign period and to curtail the movement of spurious liquors for bribing of electors is prohibited by the Election Commission of India;
Whereas, I am convinced that such illegal activities will endanger public health and it is also a threat to public tranquility in the region under the control of my jurisdiction and surrounding areas. Therefore, immediate action is required for curtailing such illegal activities;
Whereas, in my opinion that there is sufficient ground for proceedings under section 144 of the Code of Criminal Procedure, 1973 and immediate prevention is desirable;
Now, therefore, I, P. Parthiban, I.A.S., Additional District Magistrate,Yanam, in exercise of the powers conferred under section 144 of Cr.P.C. do hereby prohibit using of Islands No. 2 and 4 in the region under the control of my jurisdiction for any work and have entry to these Islands is prohibited for a period of two months from the date of this order or till any further orders are passed by the Competent Authority revoking this prohibition as per law, whichever is earlier.
This order shall valid for 2 months from the date of issue.
