appointed Lt. Cdr M. Ramesh as the inquiring authority No. 225/Dis/Civ/P&C/2016.

and Tmt. R. Saraswathi, Superintendent, NCC Group

Puducherry, the 23rd June 2016.

ORDER

Whereas, Thiru V. Radja while functioning as Upper Division Clerk in the 1(P) Naval Unit NCC, Puducherry was on unauthorized absence from 18th March 2011. A memo was issued to the individual on 31st March 2011 to rejoin duty immediately. On receipt of the said memo the individual submitted an explanation letter, dated 4th April 2011 along with xerox copy of Medical Certificate obtained from the Private Doctor. Again he was issued a memoranda on 18th April 2011 stating that the Pay for the month of April 2011 is being withheld until unauthorized absence is regularized and the entire period will be treated as EOL without MC. The individual on receipt of the memo, dated 18th April 2011 reported to the office on 4th May 2011 and submitted a joining report, dated 4th May 2011 and thereafter, worked for 3 days only. Again he proceeded on unauthorized absence with effect from 7th May 2011 till date. After that he has been served memoranda for 5 times (dated 31st May 2011, 16 th J une 20 11, 3rd August 2011, 3rd December 2011 and 6th June 2012) for his unauthorized absence;

And whereas, Thiru V. Radja, Upper Division Clerk was granted Extraordinary Leave without pay up to 14th June 2012 on the condition that he shall report for duty on 15th June 2012 failing which the EOL granted will be treated as break-in-service;

Headquarters, Puducherry as the Presenting Officer vide order of even No., dated 3rd March 2016;

And whereas, the inquiry authority has stated that he has served memoranda to the charged official on 16th March 2016, 31st March 2016 and 13th April 2016 instructing him to appear for enquiry and all these memoranda were returned undelivered by the postal authority with the remarks "Not known", "Unclaimed" and "Unclaimed" respectively. The inquiring authority thereafter conducted ex parte enquiry and with the available documentary evidence, he has furnished his inquiry report on 2nd May 2016 stating that the charges framed against him are proved. A copy of the report of the inquiring authority has been served on the charged official on 9th May 2016 which was also returned with the remarks "Unclaimed";

And whereas, on careful consideration of the inquiry report and other documentary evidence placed before me, I am of the considered view that Thiru V. Radja, Upper Division Clerk, does not show any inclination to rejoin service and he is not a person fit to be returned in service and the gravity of the charge is such as to warrant the imposition of a major penalty of removal from service;

Now, therefore, the Disciplinary Authority concludes that the charges framed against Government servant Thriu V. Radja, Upper Division Clerk, 1(P) Naval Unit NCC, Puducherry have been proved and he is hereby awarded the major penalty of "Removal From Service", which shall not be a disqualification for future employment under the Government with immediate effect.

ANIL NAUTIYAL,

And whereas, Thiru V. Radja, Upper Division Clerk had not reported to duty on 15th June 2012, consequent to which the EOL granted to him has been treated as break-in-service. All the memoranda have been returned from the postal authorities stating that the individual was not availab le at the said ad dr ess. A memo was also published in the local newspapers through Directorate of Information and Publicity, Puducherry on 12th January 2012. However, the individual has neither reported for duty nor submitted his explanation for his unauthorized absence;

And whereas, charge-sheet was issued listing out the articles of charges against the said Thiru V. Radja, Upper Division Clerk vide memorandum of even No. dated 3rd March 2016. The said memorandum was returned undelivered by the postal authorities stating "Left";

Group Commander.
