In the above circumstances, this Court does not find any reasonable cause to grant full back wages to the petitioner and consequently, considering the other circumstances in this case, this Court is inclined to grant partial back wages of 30% to the petitioner till his reinstatement. Accordingly, this point is answered.

11. In the result, the petition is partly allowed and the petitioner is entitled for the reinstatement with continuity of service and 30% of back wages till his reinstatement.

Whereas, the Government is of the opinion that an industrial dispute has arisen between the management of M/s. Jeevan Diesels and Electricals Limited, Puducherry and Jeevan Diesel and Electricals Limited Thozhilalar Viduthalai Munnani, Puducherry over non-payment of wages and illegal lock-out in respect of the matter mentioned in the Annexure to this order;

And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;

shall file a statement of claim complete with relevant documents, list of reliance and witnesses to the Labour Court, Puducherry within 15 days of the receipt of the order of reference and also forward a copy of such statement to each one of the opposite parties involved in the dispute.
