Whereas, the Lieutenant-Governor, Puducherry has by notification, in G.O. Ms. No. 9/95/Lab., dated 7-4-95 under sub-section (1) of section 52 of the Puducherry Shops and Establishments Act, 1964, authorized the Secretary to Government, Labour Department, Puducherry to exercise the powers of the Government under section 6 of the said Act, relating to grant of exemption;

And whereas, the Management of (1) M/s. Ashok Theatre A/C, Villianur, Puducherry-605 110 have applied for grant of exemption from certain provisions of the said Act to conduct special morning shows at 9.00 a.m. from 14-4-2017 to 20-4-2017 on account of screening a new Tamil film "Shivalinga".

Now, therefore, in exercise of the powers conferred by section 6 of the said Act, the Secretary to Government, Labour Department, Puducherry hereby exempts (1) M/s. Ashok Theatre A/C, Villianur, Puducherry-605 110 from the provisions of the sections 16(1), 17(1), 17(2) and 18 of the Puducherry Shops and Establishments Act, 1964 for conducting special morning shows from 14-4-2017 to 20-4-2017 on account of screening a new Tamil film "Shivalinga" subject to the following conditions;

Whereas, the Government is of the opinion that an industrial dispute has arisen between the management of M/s. Eureka Forbes Limited, Thattanchavady, Puducherry and Thiru N. Ramesh over non-employment in respect of the matter mentioned in the Annexure to this order;

And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;

Now, therefore, by virtue of the authority delegated vide G.O. Ms. No. 20/91/Lab./1, dated 23-5-1991 of the Labour Department, Puducherry to exercise the powers conferred by clause (c) of sub-section (1) of section 10 of the Industrial Disputes Act, 1947 (Central Act XIV of 1947), it is hereby directed by Secretary to Government (Labour) that the said dispute be referred to the Labour Court, Puducherry for adjudication. And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;

GOVERNMENT OF PUDUCHERRY In excercise of the powers conferred by clause (b) of sub-section (1) of section 3, read with sub-section (1) of section 13 of the Minimum Wages Act, 1948 (Central Act 11 of 1948), the Lieutenant-Governor of Puducherry is pleased to revise the minimum rates of wages payable to the categories of employees employed in Taxies and Autorickshaws in the Union territory of Puducherry, as specified in the Schedule hereunder:-

Classes of Minimum rates of employees wages per month (1)

(8 hours work per day) (2) 1 Drivers in Autorickshaws ` 443 per day (or) (fitted with meters). ` 11,520 per mensem 2 Drivers in Taxies ` 482 per day (or) (fitted with meters). ` 12,524 per mensem.

Note: (1) In addition to the minimum rates of basic wages fixed herein, the employees shall be paid dearness allowance as indicated below:

NOTIFICATION

The following draft of the proposal for revision of minimum rates of wages payable to the employees employed in Taxies and Autorickshaws in the Union territory of Puducherry, which the Lieutenant-Governor of Puducherry hereby proposes to make in exercise of the powers conferred by clause (b) of sub-section (1) of section 3, read with sub-section (1) of section 13 of the Minimum Wages Act, 1948 (Central Act 11 of 1948), is hereby published as required under clause (b) of sub-section (1) of section 5 of the said Act, for information of all the persons likely to be affected thereby and notice is hereby given that the said draft proposal will be taken into consideration by the Government of Puducherry, after the expiry of sixty days from the date of publication of the said proposal in the Official Gazette of Government of Puducherry.

2. Any objections or suggestions, which may be received from any person with respect to the proposal before the expiry of the period specified above, will be considered by the Government of Puducherry.

3. Objections or suggestions should be addressed to the Secretary to Government, Labour Department, Puducherry.

(i) The dearness allowance is linked to the Average Puducherry City Consumer Price Index for the year 2016 i.e., 286 points with base year 2001=100 and every raise of 1 point over and above 286 points an increase of ` 46.45 (Rupees forty-six and forty-five paise only) per month shall be paid as dearness allowance.

(ii) The revision of dearness allowance shall be calculated every year on the 1st April, on the basis of the average of the indices of the preceding twelve months that is from January to December.

(iii) The first calculation shall be effective from the date of publication of this notification in the Gazette of Government of Puducherry, based on the average of the Puducherry City Consumer Price Index for the previous year.

2. To arrive at the daily rates of wages, the monthly rate of wages shall be divided by 26.

3. Where, the nature of work is the same, no distinction in the payment of wages shall be made in the case of male and female employees.

4. Wherever the existing wages are higher than the minimum wages fixed herein, the existing wages shall be continued to be paid.

The Government of Puducherry has notified the revised rates for the supply of water to various categories of consumers in Puducherry, Karaikal, Mahe and Yanam regions and for collection of non-refundable one-time security deposit as detailed in the Annexure (both in English and Tamil) vide notification issued in the G.O. Ms. No. 5, dated 13-2-2017 of the Chief Secretariat (Works), Government of Puducherry with effect from 1-4-2017 to adopt the same in the Muncipalities and Commune Panchayats, the Local Administration Secretariat, Puducherry has also issued order vide G. O. Ms. No. 37/LAS/2017, dated 22-3-2017 and the proceedings of the Collector-cum- Authorized Officer of Kottucherry Commune Panchayat vide No. 34, dated 12-4-2017. The same notification is applicable to Kottucherry Commune Panchayat.
