He has neither responded to the communication sent to him by the Department on 28-3-2012, 25-6-2012, 8-8-2012, 29-8-2016 and 9-9-2016 nor has he reported for duty till date.
2. As per rule 12(2) of the CCS (Leave) Rules, 1972, a Government Servant who remains absent from duty for a continuous period exceeding five years other than on foreign service, with or without leave, shall be deemed to have resigned from the Government service, provided that a reasonable opportunity shall be given to the Government Servant to explain the reasons before invoking provision of sub-rule (2). this office memo of even No. dated 31-3-2017 which was published in Dinamalar and Daily Thanthi on 6 -4-2 0 17 and also in the Gazette o f P uducher r y on 18-4-2017. Despite that he has not responded to the Notice nor has he reported for duty till date.
4. Now, therefore, the undersigned invoking Rule 12(2) of CCS (Leave) Rules, 1972, hereby orders that Thiru M. Venkataramanan, Bal Bhavan Instructor, shall be deemed to have resigned from the Government Services with effect from 13-3-2017.

7,217 (i) The dearness allowance shall be linked to the Puducherry City Consumer Price Index for the month of April, 2016 i.e., 279 points (with base year 2001=100) and for every raise of 1 point over and above 279 points, an increase of ` 29.05 (Rupees twenty-nine and paise five only) per point per month shall be paid.
(ii) The revision of dearness allowance shall be effective from the 1st April of every year on the basis of the average of the indices for the preceding twelve months that is from January to December.
(iii) The first calculation shall thus be effective from the date of issue of this notification in the Gazette of Government of Puducherry, based on the average of the Puducherry City Consumer Price Index of the previous year.

In partial modification of the earlier orders, save as respects things done or omitted to be done before such modifications, the Hon'ble Lieutenant-Governor, Puducherry, is pleased to approve the proposal of the Department of Agriculture for enhancement of quantum of financial assistance under the scheme component 'Extension of back-ended investment subsidy to the farmers in the Union territory of Puducherry for raising paddy crops' under the Scheme 'Crop Production Technology' and for the said purpose, hereby makes further amendment to the guidelines of the said Scheme, notified vide G.O. Rt. No. 62/Ag., dated 22-10-2010 of the Chief Secretariat (Agriculture), Government of Puducherry and published in the Gazette of Puducherry, Ordinary, Page No. 964-968, dated 9th November, 2010 (hereinafter referred to as the said guidelines), as follows:
AMENDMENT
In the said guidelines (i) for clause (III), the following shall be substituted, namely:-
'III. Scale of Financial Assistance: "The farmers who have raised paddy crops in the Union territory of Puducherry are eligible for the back ended investment subsidy @ ` 5000/hectare from the cropping season Sornavari 2015 onwards".
(ii) for clause VII, the following shall be substituted, namely:-
"VII. Modification:(i) Any modification in the guidelines shall be made only with the approval of the Government.
(ii) If, any ambiguity arises in the implementation of scheme, the decision of Secretary (Agri.) shall be final."
2. This issues with the concurrence of the Finance Department vide I.D. No. 3424/FC/FD/A3/2017, dated 31-3-2017.

NOTIFICATION
Whereas, the Government is of the opinion that an industrial dispute has arisen between the management of M/s. Hindustan Unilever Limited, Tea Factory, Kirumampakkam, Puducherry and HLL Tea Workers Welfare Union, Puducherry over conferment of permanent status and payment of monthly salary inclusive of holidays for 126 workers in respect of the matter mentioned in the Annexure to this order;
And whereas, in the opinion of the Government, it is necessary to refer the said dispute for adjudication;
Now, therefore, by virtue of the authority delegated vide G.O. Ms. No. 20/91/Lab./L, dated 23-5-1991 of the Labour Department, Puducherry to exercise the powers conferred by clause (c) of sub-section (1) of section 10 of the Industrial Disputes Act, 1947 (Central Act XIV of 1947), it is hereby directed by Secretary to Government (Labour) that the said dispute be referred to the Labour Court, Puducherry for adjudication. The Labour Court, Puducherry shall submit the Award within 3 months from t he d a te o f i ss ue o f r ef er en ce a s s ti p u la t ed u nd er sub-section (2-A) of section 10 of the Industrial Disputes Act, 1947 and in accordance with r ule 1 0 -B o f t h e I n d u s tr ia l D is p u te s ( C en tr al ) Rules, 1957. The party raising the dispute shall file a statement of claim complete with relevant documents, list of reliance and witnesses to the Labour Court, Puducherry within 15 days of the receipt of the order of reference and also forward a copy of such statement to each one of the opposite parties involved in the dispute.
