establishment itself is started only in the year 1995 and therefore, the petitioner has failed to establish the fact that he was working as permanent employee in the respondent establishment as bus Conductor from the year 1996 as stated by him.

12. Further more, though the petitioner has filed the claim statement, he has not at all stated the particulars of the due which is to be recovered from the respondent management in the name of P.F., E.S.I., insurance and other benefits while he admits in his evidence that he has received bonus for every year from the respondent management but, the particulars of the amount how much he has been received the bonus for every year and how much is given to him arrear of bonus has not at all stated by the petitioner and that therefore, the petitioner has utterly failed to prove his case by filing all the documentary evidence like pay slip, E.S.I, or ID card or any other communication between the respondent and the petitioner workman or any other document to prove the fact that he is a p e r ma n e n t e m p l o y e e o f t h e r e s p o n d e n t establishment and that therefore, the dispute raised by the petitioner before the Conciliation Officer over non-settlement of dues is not justified and as such the petitioner is not entitled for any relief as claimed by him and hence, the claim petition is liable to be dismissed,

13. In the result, the petition is dismissed. No cost.

GOVERNMENT OF PUDUCHERRY (c) The certificate should invariably contain the details regarding the type of industry, whether a new industry or expansion of the existing industry, type of deed to be registered and the property details such as Revenue Village, Re-Survey number/Town Survey number, Extent with boundaries, etc., for clear identification of the property.

(d) Future transactions based on the deed registered by availing this exemption shall not be entertained unless a NOC is obtained from the Director, Industries and Commerce Department, Government of Puducherry. Further, if, the above transaction happens within 5 years, the entrepreneur shall have to repay the entire stamp duty amount granted as remission by the Government of Puducherry.

(e) This exemption of stamp duty for entrepreneurs to start industries in the Union territory of Puducherry shall be in force till the 31st day of March, 2020.

GOVERNMENT OF PUDUCHERRY LABOUR DEPARTM ENT

Puducherry, dated the 25th September 2017.

In exercise of the powers conferred under clause (a) of sub-section (1) of section 9 of the Indian Stamp Act, 1899 (Central Act II of 1899), the Lieutenant- Governor, Puducherry is pleased to grant remission of 100% stamp duty for purchase/lease/mortgage/ hypothecation of land/shed/buildings to the entrepreneurs who start new industrial establishments in the Union territory of Puducherry, subject to the following conditions, namely:

(a) The entrepreneur to start a new industrial establishment and for the expansion of the existing industries shall obtain a certificate from the Director, Industries and Commerce Department, Government of Puducherry to the effect that the entrepreneur identified in the certificate has obtained an industrial licence and is eligible for availing the stamp duty exemption under the Industrial Policy, 2016 notified by the Government of Puducherry.

(b) The deed shall be registered only in favour of the entrepreneur certified by the Industries and Commerce Department, Government of Puducherry and the certificate shall be a part of the deed to be registered.

ORDER

Whereas, the management of M/s. Puducherry Co-operative Sugar Mills Limited, Puducherry has submitted an application in Form O-3, read with rule 75(B) of the Industrial Disputes (Central) Rules, 1957, dated 21-7-2017, addressed to the Secretary to Government (Labour), Puducherry seeking permission to lay-off of 160 workmen employed in their establishment with effect from July, 2017 to September, 2017 under Section 25-M of the Industrial Disputes Act, 1947;

Whereas, the employer has to make an application in Form O-3 to the appropriate authority (Secretary to Government, Labour Department, Puducherry is the specified authority) in order to obtain permission for laying-off his workmen u/s 25 M.A. copy of such application shall also be served simultaneously on the17 October 2017] LA GAZETTE DE L'ETAT 1149 workmen concerned in the prescribed manner and a proof to that effect shall also be submitted by the employer along with application (sub-rule (2) of rule 75-B of the Industrial Disputes (Central) Rules, 1957;

Whereas, as per sub-section (4) of section 25-M of the Industrial Disputes Act, 1947, the Secretary to Government (Labour), Labour Department who is appointed as the specified authority has to make an enquiry after giving an opportunity to the employer and the workmen concerned within a period of 60 days and pass orders either to grant or refuse to grant such permission;

And Whereas, on scrutiny of the Lay-off application, it was found that the employer has not followed the procedures laid down under sub-section (1) (2) and (5) of section 25-M of the Industrial Disputes Act, 1947;

Now, therefore by virtue of the authority delegated vide G.O.Ms.No. 177/80-LAB, dated 1st September, 1980 of the Labour Department to exercise the powers conferred by the sub-section (1) of section 25-M of the Industrial Disputes Act, 1947 (Central Act 14 of 1947) the undersigned hereby refuse to grant permission sought for by the management of M/s. Puducherry Co-operative Sugar Mills Limited, Lingareddipalayam, Puducherry to Laff-off 160 workmen as defined under section 2(s) of the Industrial Disputes Act, 1947 (Central Act 14 of 1947).

The Labour Court, Puducherry shall submit the Award within 3 months from the date of issue of reference as stipulated under sub-section 2-A of section 10 of the Industrial Disputes Act, 1947 and in accordance with rule 10-B of the Industrial Disputes (Central) Rules, 1957. The party raising the dispute shall file a statement of claim complete with relevant documents, list of reliance and witnesses to the Labour Court, Puducherry within 15 days of the receipt of the order of reference and also forward a copy of such statement to each one of the opposite parties involved in the dispute.

NOTIFICATION

Applications are invited for the allotment of the following plots/sheds at Industrial Estate, Thattanchavady, Puducherry and at Rural Industrial Estate, Kattukuppam, Puducherry.

2. The quotations in plain paper should be sealed and addressed to the Deputy Director (Elementary Education), Directorate of School Education, Puducherry duly superscribing on the envelope as "Quotation for the disposal of Old/Outdated Text Books" sent to this office on or before 30-10-2017 at 3.00 p.m. The quotations will be opened on the same day at 4.00 p.m. in the presence of the tenderers who are present by the Committee constituted for this purpose. The rate should be quoted for per kilogram.

I. Industrial Estate, Thattanchavady, Puducherry

1. Plot measuring 17,878 sq. ft., - One number 2. Plot measuring 11,200 sq. ft. with constructed building of 3,500 sq. ft. - One number.

3. The intending tenderers should submit an amount of ` 10,000 (Rupees ten thousand only) as earnest money deposit in the form of Demand Draft in favour of the Drawing and Disbursing Officer, Directorate of School Education, Puducherry. The same will be returned immediately to the unsuccessful tenderers after the tender sale is over.

4. Quotations received after the due date and time will summarily be rejected.
