NOTIFICATION

Notice under rule 2 of the Pondicherry Commune Panchayats

(Procedure for Framing of Bye-laws) Rules, 1975

Whereas, bye-laws regarding, regulating the collection of Market

Adikasu Fees by Vegetable Shop Vendors, Market Stalls, etc., in

Ariyankuppam Commune Panchayat have been framed and published

vide Gazette No. 26, dated 26-6-1990.

2. And whereas, the Designated Officer/Council of Ariyankuppam

Commune Panchayat has resolved vide Proceedings No. 20/2016-2017/ACP,

dated 12th December 2016 to the said amendment to the bye-laws under

section 320 of the Pondicherry Village and Commune Panchayats Act,

1973 (No. 10 of 1973), read with the Pondicherry Commune Panchayat

(Procedure for Framing of Bye-laws) Rules, 1975, for regulating the

collection of Market Adikasu Fees in respect of Vegetable Shop Vendors,

Market Stalls, etc., in Ariyankuppam Commune Panchayat;

3. And whereas, the Draft Amendment of the bye-laws were

published as required under rule 2 of the Pondicherry Commune

Panchayats (Procedure for Framing of Bye-laws) Rules, 1975 in the Extra

Ordinary Gazette No. 55, dated 23rd August 2017 vide Notification

No. 20-13/2015-Rev./ACP, dated 21st August 2017, inviting objections

and suggestions, if any, from the public till the expiry of a period of

thirty days beginning from the date of publication;

4. And whereas, no objections/suggestions in respect of the said

Draft Amendment has been received within the stipulated period;

5. Now, therefore, in exercise of the powers conferred by

sub-section (1) of section 320, read with under section 208(2)(b) of the

Pondicherry Village and Commune Panchayats Act, 1973 the Designated

Officer hereby makes the following amendment of the bye-laws regulating

the collection of Market Adikasu Fees in respect of Vegetables Shop

Vendors, Market Stalls etc., in Ariyankuppam Commune Panchayat with 354 LA GAZETTE DE L'ETAT [PART–II

the approval and confirmation of the Director (Local Administration) as

required under rule 3 of the Pondicherry Commune Panchayats

(Procedure for Framing of Bye-laws) Rules, 1975, namely:-

Amendment

(i) Amendment for Bye-law No. 1, the following shall be

substituted, namely:-

"1. The Market adikasu lease auction will be conducted by

verbal proceedings or sealed tenders or e-Tender".

(ii) for Bye-law No. 4:- the following shall be substituted, namely:-

"4. The bidder shall pay of ` 25,000 (Rupees twenty-five

thousand only) as earnest money deposit in the form of Demand Draft

taken from a Nationalized Bank in the name of Commissioner,

Ariyankuppam Commune Panchayat. Otherwise, the bidder will not be

allowed to participate in the auction".

(iii) in Bye-law No. 9, Sl. No. (1) to (30), the following shall be

substituted, namely:-
