NOTIFICATION

Whereas, pre-publication notification for amendment of rule 34 of

Puducherry Right to Fair Compensation and Transparency in Land

Acquisition, Rehabilitation and Resettlement Rules, 2016 were published,

as per section 112 of the Right to Fair Compensation and Transparency

in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013)

vide Notification No. 2709/DRDM/Rev./Bl/2017, dated 13th April, 2018 of

the Department of Revenue and Disaster Management, Government of

Puducherry, and published in Part-II of the Extraordinary Gazette No. 16,

dated 13-04-2018, for inviting objections and suggestions from all personslikely to be affected thereby before the expiry of a period of fifteen days from the date on which copies of the Official Gazette containing the notification were made available to the general public. And whereas, the copies of the Official Gazette containing the said notification were made available to the general public on the 13th April, 2018. 512 LA GAZETTE DE L'ETAT [PART–II

And whereas, there is no objection/suggestion are received, from any persons within the stipulated time-limit with respect to the said notification.

Now, therefore, in exercise of the powers conferred by section 109 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, (30 of 2013), the Lieutenant-Governor, Puducherry, hereby makes the following amendment rules, as the same having been previously published in the Notification No. 2709/DRDM/Rev./B1/2017, dated 13th April, 2018 of the Department of Revenue and Disaster Management, Government of Puducherry, and published in Part-II of the Extraordinary Gazette No. 16, dated 13-04-2018 as required under section 112 of the said Act.

1. Short title, application and commencement.—

(1) These rules may be called as the "Puducherry Right to Fair Compensation Transparency in Land Acquisition, Rehabilitation and Resettlement Rules (Amendment) - 2017".

(2) It shall extend to the whole of the Union territory of

Puducherry.

(3) It shall come into force on and from the date of its publication in the Official Gazette of Government of Puducherry.

2. In the Puducherry Right to Fair Compensation and Transparency

in Land Acquisition, Rehabilitation and Resettlement Rules, 2016-

(i) for rule 34(i) substitute the following, namely,-

"(i) The cases covered under clause (a) of sub-section (1) of section 24 where the notification was issued on or before 31st December, 2013 under section 4 of the Land Acquisition Act, 1894 (1 of 1894), the date for determination of market value shall be the date on which such notification was issued."
